With its express intention ‘to put an end to impunity’, the International Criminal Court (ICC) faces a substantial challenge in the shape of conditional amnesties granted in future national truth commissions (TCs)—a challenge that invokes fundamental considerations of criminal justice ethics. In this article, I give an account of the challenge, and I consider a possible solution to it presented by Declan Roche. According to this solution the ICC-prosecutor should respect national amnesties and prosecute and punish only those perpetrators who (...) have refused to cooperate with the TC. I argue, however, that this compromise is untenable. As a general rule, if we justify the ICC on grounds of deterrence we should not accept conditional amnesties granted in national TCs. (shrink)

In § 35 of Sein und Zeit Heidegger’s denunciation of Gerede, idle talk, is confident and scathing. It sounds so sinister and threatening. What could Heidegger be talking about? One could cite numerous fictional characters (e.g., Pecksniff, Mrs. Gamp, Skimpole, Podsnap – all in Dickens), characters whose speech is very nearly an idiolect of bad faith. And yet there is something so fascinating and creative in their speech, an exuberance in their dissimulation, that one wouldn’t want to miss them. Could (...) idle talk in Heidegger’s sense contribute to the theoretization of Bakhtin's idea of the dialogic and heteroglossia and to the notion of discours as it has been developed by Benveniste, Barthes, and Genette? In prose fiction language is valorized (often implicitly) in terms of meaning/nonsense, serious/non-serious, full/empty. When in fiction language that is deemed low, formulaic, or “empty”-- gossip, chatter, prattle, idiotismes – comes to the fore the narrative elements falters, “nothing much” is said. But a kind of speech as act and process is foregrounded. It is this kind of inadvertence in language, its “idling” state, that Gerede points to. (shrink)

This book concerns the foundations of epistemic modality and hyperintensionality and their applications to the philosophy of mathematics. David Elohim examines the nature of epistemic modality, when the modal operator is interpreted as concerning both apriority and conceivability, as well as states of knowledge and belief. The book demonstrates how epistemic modality and hyperintensionality relate to the computational theory of mind; metaphysical modality and hyperintensionality; the types of mathematical modality and hyperintensionality; to the epistemic status of large cardinal axioms, undecidable (...) propositions, and abstraction principles in the philosophy of mathematics; to the modal and hyperintensional profiles of the logic of rational intuition; and to the types of intention, when the latter is interpreted as a hyperintensional mental state. Chapter \textbf{2} argues for a novel type of expressivism based on the duality between the categories of coalgebras and algebras, and argues that the duality permits of the reconciliation between modal and hyperintensional cognitivism and modal and hyperintensional expressivism. Elohim develops a novel, topic-sensitive truthmaker semantics for dynamic epistemic logic, and develops a novel, dynamic two-dimensional semantics grounded in two-dimensional hyperintensional Turing machines. Chapter \textbf{3} provides an abstraction principle for two-dimensional (hyper-)intensions. Chapter \textbf{4} advances a topic-sensitive two-dimensional truthmaker semantics, and provides three novel interpretations of the framework along with the epistemic and metasemantic. Chapter \textbf{5} applies the fixed points of the modal $\mu$-calculus in order to account for the iteration of epistemic states in a single agent, by contrast to availing of modal axiom 4 (i.e. the KK principle). The fixed point operators in the modal $\mu$-calculus are rendered hyperintensional, which yields the first hyperintensional construal of the modal $\mu$-calculus in the literature and the first application of the calculus to the iteration of epistemic states in a single agent instead of the common knowledge of a group of agents. Chapter \textbf{6} advances a solution to the Julius Caesar problem based on Fine's `criterial' identity conditions which incorporate conditions on essentiality and grounding. Chapter \textbf{7} provides a ground-theoretic regimentation of the proposals in the metaphysics of consciousness and examines its bearing on the two-dimensional conceivability argument against physicalism. The topic-sensitive epistemic two-dimensional truthmaker semantics developed in chapters \textbf{2} and \textbf{4} is availed of in order for epistemic states to be a guide to metaphysical states in the hyperintensional setting. -/- Chapters \textbf{8-12} provide cases demonstrating how the two-dimensional hyperintensions of hyperintensional, i.e. topic-sensitive epistemic two-dimensional truthmaker, semantics, solve the access problem in the epistemology of mathematics. Chapter \textbf{8} examines the interaction between Elohim's hyperintensional semantics and the axioms of epistemic set theory, large cardinal axioms, the Epistemic Church-Turing Thesis, the modal axioms governing the modal profile of $\Omega$-logic, Orey sentences such as the Generalized Continuum Hypothesis, and absolute decidability. These results yield inter alia the first hyperintensional Epistemic Church-Turing Thesis and hyperintensional epistemic set theories in the literature. Chapter \textbf{9} examines the modal and hyperintensional commitments of abstractionism, in particular necessitism, and epistemic hyperintensionality, epistemic utility theory, and the epistemology of abstraction. Elohim countenances a hyperintensional semantics for novel epistemic abstractionist modalities. Elohim suggests, too, that higher observational type theory can be applied to first-order abstraction principles in order to make first-order abstraction principles recursively enumerable, i.e. Turing machine computable, and that the truth of the first-order abstraction principle for two-dimensional hyperintensions is grounded in its being possibly recursively enumerable and the machine being physically implementable. Chapter \textbf{10} examines the philosophical significance of hyperintensional $\Omega$-logic in set theory and discusses the hyperintensionality of metamathematics. Chapter \textbf{11} provides a modal logic for rational intuition and provides a hyperintensional semantics. Chapter \textbf{12} avails of modal coalgebras to interpret the defining properties of indefinite extensibility, and avails of hyperintensional epistemic two-dimensional semantics in order to account for the interaction between interpretational and objective modalities and the truthmakers thereof. This yields the first hyperintensional category theory in the literature. Elohim invents a new mathematical trick in which first-order structures are treated as categories, and Vopenka's principle can be satisfied because of the elementary embeddings between the categories and generate Vopenka cardinals in the category of Set in category theory. Chapter \textbf{13} examines modal responses to the alethic paradoxes. Elohim provides a counter-example to epistemic closure for logical deduction. In an epistemology of contextualism, how robust does consensus need to be for critique to be practically effective? In ‘Relativism and the Critical Potential of Philosophy of Education’ Frieda Heyting proposes a form of contextualism, but her argument raises a number of problems. The kinds of criteria that her version of contextualism will furnish provide, at best, the potential only for an immanent form of critique from within a particular practice, and the possibility that practitioners alone will adopt a general (...) stance of critique. By their nature, the criteria that Heyting endorses will be too transient and ephemeral to assist in any larger project that might be aimed at making effective criticism of the status quo. Further problems are exposed to do with the conditions needed to make critique effective when Heyting's normative argument is situated in the Realpolitik of contemporary education. Drawing on the work of Charles Sanders Peirce, and in a manner intended to be complementary to Heyting's normative argument, the paper offers some suggestions regarding the role that doubt might play in justifying criticisms of the status quo. This paper motivates an account of knowledge as a social kind, following a cue by Edward Craig, which captures two major insights behind social and feminist epistemologies, in particular our epistemic interdependence concerning knowledge and the role of social regulative practices in understanding knowledge.

If an object has a property essentially, it has that property in every possible world according to which it exists.2 If an object has a property accidentally, it does not have that property in every possible world according to which it exists. Claims about an object’s essential or accidental properties are de re modal claims, and essential and accidental properties are de re modal properties. Take an object’s modal profile to specify its essential properties and the range of its accidental (...) properties. Note that “world” as I am using it is a term of art: a modal realist believes that there are many concrete worlds, while the actualist believes in only one concrete world, the actual world. The ersatzist is an actualist who takes nonactual possible worlds and their contents to be abstracta. Essentialism is the view that objects have properties essentially, but one should distinguish deep essentialism from shallow essentialism. Deep essentialists take the (nontrivial) essential properties of an object to determine its nature— such properties give sense to the idea that an object has a unique and distinctive character, and make it the case that an object has to be a certain way in order for it to be at all.3 As Stephen Yablo (1987, 297) describes it, the essence of a thing is “an assortment of properties in virtue of which it is the entity in question,” as well as “a measure of what is required for it to be that thing.” Intuitively, on the deep essentialist picture, an ordinary object has essential properties, and it must have its essential properties in order for it to exist. On this view, objects’ essential properties are absolute, i.e., are not determined by contexts of describing (or thinking, etc.) about the object, and truths about such properties are absolute truths.4 Shallow essentialists oppose deep essentialists: they reject the view that objects can be said to have essential properties independently of contexts of description or evaluation, and so substitute context-dependent truths for the deep essentialist’s context-independent ones.. Malebranche is both an occasionalist and an advocate of the preformationist theory of generation. One might expect this given that he is a mechanist: passive matter cannot be the source of its own motion and so requires God to move it (occasionalism); and such matter, moving according to a few simple laws of motion, could never fashion something as complex as a living being, and so organisms must be fashioned by God at Creation (preformationism). This expectation finds a challenge in (...) Kant's depiction of the relation between causation and generation. According to Kant, preformation is the generation theory one would expect the advocate of the pre-established harmony to endorse, while the occasionalist would endorse a theory whereby God directly forms the organism upon every insemination. I make sense of Malebranche's position in light of Kant's suggestion by examining the relation Malebranche sees between science and metaphysics, the roles that he believes empirical investigations and final causes have in scientific practice and explanation, and the role of the supernatural in Malebranche's philosophy. Meinertsen’s unifier is discussed on the background of Aristotle’s distinction between four kinds of unity. It argued that Meinertsen combines two different kinds of unity that exclude each other. Only Aristotle’s first meaning of unity seems to be relevant for Meinertsen’s unifier. But this meaning applies literally only to spatial complexes. Its application to states of affairs is problematic because they are mostly not spatial. It is also problematic because unity in the first sense requires an agent. Meinertsen’s unifiers are (...) connectors between particulars and universals in states of affairs. It is objected that connectors in a state of affairs lead to a vicious infinite regress of further states of affairs. Meinertsen argues for his unifiers that states of affairs without them are non-mereological, that is, their existence is not entailed by the existence of their constituents. That does not seem a good argument if it is realised that a complex is not an additional entity and thus not existent if the existence of its parts is sufficient for its existence. It is also pointed out that the meaning of “mereological” involved is not related to the classical mereological calculus. (shrink)

This essay considers whether liberal political theory has tools with which to count gender, and so gender relations, as political. Can liberal political theory count sub-ordination among the harms of sex inequality that the state ought to correct? Watson defends a version of deliberative democracy—liberalism—as able to place issues of social inequality in the form of hierarchical social identities at the center of its normative commitments, and so at the center of securing justice.

ABSTRACT The use of intuitions as evidence is widespread in epistemology, but not uncontroversial. For over a decade and a half, some experimental epistemologists have called into question this appeal to epistemic intuitions. These philosophers bring the methods of experimental psychology, in particular survey methods, to bear on epistemological theorizing. Given their commitment to the relevance of empirical work to philosophical theory construction, they qualify as methodological naturalists. But some methodological naturalists who also recommend giving up appeals to intuition as (...) evidence do not base their case on experimental surveys. In this article I consider two main challenges to the standard practice of appealing to intuitions posed by these naturalist philosophers and argue that a Craig-style epistemological project can allow the methodological naturalist to address them. Anyway I conclude that, regardless of the truth of the Craigian approach, intuitions still have a role to play in epistemological theorizing in the adjudication between approaches. (shrink)
