  1. With or Without Religious Symbols? Why Political Liberalism is Inconclusive in the Case of Civil Servants.François Levrau & Patrick Loobuyck - 2020 - Res Publica 26 (3):319-335.
In this article, we scrutinize several arguments that are frequently used to legitimize a ban on religious symbols for civil servants. Most arguments, however, do not stand up to the test of Rawlsian political liberalism. One argument stands out as underpinning such a general ban: state neutrality. While this argument has the most potential, we argue why it is still not decisive for a ban on all religious symbols for all civil servants. We conclude that from a political liberal point (...)

  • Equality, Citizenship and Segregation: A defense of separation.Michael S. Merry - 2013 - New York: Palgrave Macmillan.
In this book I argue that school integration is not a proxy for educational justice. I demonstrate that the evidence consistently shows the opposite is more typically the case. I then articulate and defend the idea of voluntary separation, which describes the effort to redefine, reclaim and redirect what it means to educate under preexisting conditions of segregation. In doing so, I further demonstrate how voluntary separation is consistent with the liberal democratic requirements of equality and citizenship. The position I (...)

  • What Is Neutrality?Roland Pierik & Wibren Van der Burg - 2014 - Ratio Juris 27 (4):496-515.
This paper reinvestigates the question of liberal neutrality. We contend that current liberal discussions have been dominated—if not hijacked—by one particular interpretation of what neutrality could imply: namely, exclusive neutrality, aiming to exclude religious and cultural expressions from the public sphere. We will argue that this is merely one among several relevant interpretations. To substantiate our claim, we will first elaborate upon inclusive neutrality by formulating two supplementary interpretations: proportional neutrality and compensatory neutrality. Second, we will argue that inclusive proportional (...)

  • Postsecularism, piety and fanaticism: Reflections on Jürgen Habermas' and Saba Mahmood’s critiques of secularism.Yolande Jansen - 2011 - Philosophy and Social Criticism 37 (9):977-998.
This article analyses how recent critiques of secularism in political philosophy and cultural anthropology might productively be combined and contrasted with each other. I will show that Jürgen Habermas' postsecularism takes insufficient account of elementary criticisms of secularism on the part of anthropologists such as Talal Asad and Saba Mahmood. However, I shall also criticize Saba Mahmood’s reading of secularism by arguing that, in the end, she replaces the secular–religious divide with a secularity–piety divide; for example, in her reading of (...)

  • Religious Freedom, Free Speech and Equality: Conflict or Cohesion?Maleiha Malik - 2011 - Res Publica 17 (1):21-40.
There have recently been a number of high profile political incidents, and legal cases, that raise questions about hate speech. At the same time, the tensions, and perceived conflicts, between religion and sexuality have become controversial topics. This paper considers the relationship between religious freedom, free speech and equality through an analysis of recent case law in Great Britain, Canada and the United States. The paper starts with a discussion of how conflicts between these values arise in areas such as (...)

  • Beyond Establishment and Separation: Political Liberalism, Religion and Democracy.Matteo Bonotti - 2012 - Res Publica 18 (4):333-349.
Does John Rawls’s political liberalism require the institutional separation between state and religion or does it allow space for moderate forms of religious establishment? In this paper I address this question by presenting and critically evaluating Cécile Laborde’s recent claim that political liberalism is ‘inconclusive about the public place of religion’ and ‘indeterminate about the symbolic dimensions of the public place of religion’. In response to Cécile Laborde, I argue that neither moderate separation nor moderate establishment, intended as regimes of (...)
