In this paper I criticize a growing movement within public policy circles that self-identifies as neoliberal. The issue I take up here is the sense in which the neoliberal label signals a turn away from libertarian political philosophy. The are many import ant figures in this movement, but my focus here will be on Will Wilkinson of the Niskanen Center, not least because he has most prolifically written against libertarian political philosophy. Neoliberals oppose the idea that the rights that libertarianism (...) claims people have are useful guides for making the world a freer place because they forestall too much governmental/democratic political action that they purport to be necessary for increasing freedom. Wilkinson mistakenly takes libertarianism to be a set of ideal public policies for achieving a perfectly free society. If it were, he would be right to turn away from it. But placing rights to freedom at the center of their theory of justice does not commit libertarians to an all-or-nothing approach to political change. Consequences and strategy matter – particularly in a non-ideal world – without abandoning the idea that each individual has a right to freedom. In mistaking libertarian moral claims as a set of policy prescriptions, Wilkinson complains that idealistic policy prescriptions not only fail to take account of how those who disagree will respond to such policies if implemented, but also thereby undermines the justice of those policies in the first instance. Wilkinson proposes that change in the direction of freedom must go through the proper channels of actually-existing democratic legitimacy. It as this stage that Wilkinson’s project comes into direct conflict with libertarianism. Whilst libertarianism is not committed to any particular method of creating a free society under non-ideal conditions, and therefore does not rule out democratic political activism as one among many means of doing that, it cannot be committed to the permanence of democratic political authority, and this is what Wilkinson’s neoliberalism demands above all else. It turns out that Foucault’s characterization of neoliberalism long ago is still accurate to Wilkinson’s own view: that neoliberalism is not about creating a society of free individuals, it is about designing the state apparatus in ways that are inspired by the workings of free society – it is about legitimizing the chains, not breaking them. Neoliberalism is not a pragmatic alternative to libertarianism, but rather a gross misapplication of it. (shrink)

How do we determine whether individuals accept the actual consistency of a political argument instead of just its rhetorical good looks? This article answers this question by proposing an interpretation of political argument within the constraints of political liberalism. It utilises modern developments in the philosophy of logic and language to reclaim ‘meaningless nonsense’ from use as a partisan war cry and to build up political argument as something more than a power struggle between competing conceptions of the good. Standard (...) solutions for ‘clarifying’ meaning through descriptive definition encounter difficulties with the biases of status quo idioms (long noted by theorists like William Connolly and Quentin Skinner), as well as partisan translations and circularity. Collectively called linguistic gerrymandering, these difficulties threaten political liberalism’s underlying coherency. The proposed interpretation of political argument overcomes this with a new brand of conceptual analysis that can falsifiably determine whether rhetoric has hijacked political argument. (shrink)

Robert Nozick is most prominently known as the hero of the anti-taxation movement and chief libertarian. However, in his later writings he introduced a rule that could justify estate taxation of up to 100 percent, the subtraction rule. This paper shows that this subtraction rule is not only compatible with the core pillars of his entitlement theory, but also necessary for self-ownership from a strictly libertarian-individualistic point of view. As such, it deals with the compatibility of such estate taxation with (...) the historical non-patternedness of the entitlement theory as well as with the notion of self-ownership as core elements of Nozickian libertarianism. In particular, it is argued that self-ownership requires an intimate bond or explicit consent between the initial creator of an object and the current inheritor because the initial creator has poured a part of herself into the object. Where that explicit or implicit consent is not given, the transgression of the initial creator’s right has to be compensated by the inheritor. That compensation is realized through estate taxation. The subtraction rule could, therefore, help combat the ever-increasing cascading of wealth through generations and provide a useful tool for a more equal distribution of wealth. (shrink)

Political realists complain that much contemporary political philosophy is insufficiently attentive to various facts about politics yet some political philosophers insist that any critique of normative claims on grounds of unrealism is misplaced. In this paper I focus on the methodological position G.A. Cohen champions in order assess the extent to which this retort succeeds in nullifying the realist critique of contemporary political philosophy. I argue that Cohen’s work does not succeed in doing so because the political principles that we (...) are prepared to endorse are hostage to various fact-sensitive judgements about how they apply to the political domain. I then argue that this discredits various philosophical approaches to political theorising which begin by utilising non-political thought-experiments, such as Cohen’s own Why Not Socialism? (shrink)

Robert Nozick's Anarchy, State, and Utopia made libertarianism a major theory in political philosophy. However, the book is often misread as making impractical, question‐begging arguments on the basis of a libertarian self‐ownership principle. This essay explains how academic philosophical libertarianism since Robert Nozick has returned to its humanistic, classical liberal roots. Contemporary libertarians largely work within the PPE (politics, philosophy, and economics) tradition and do what Michael Huemer calls “non‐ideal, non‐theory.” They more or less embrace rather than reject ideals of (...) social justice, and they accept that positive liberty is important. The difference between them and Left‐liberals is not so much a dispute over fundamental values, but empirical disagreements about the extent of market versus government failure. In contemporary political philosophy, libertarianism remains a significant but influential minority position.1 Nevertheless, many philosophers have little sense of how libertarian and classical liberal thought has developed and changed after Robert Nozick's seminal Anarchy, State, and Utopia, published in 1974. This essay provides a short guide. The terms “libertarianism” and “classical liberalism” refer to a body of related views about politics, philosophy, and economics. As a body of related ideas, classical liberalism has the unity of a neighborhood more than a house. That said, libertarians and classical liberals generally tend to argue for following two sets of claims: As a matter of justice, each individual has an extensive set of negative civil and economic rights, which cannot easily be overridden in the name of utility, stability, or desirable cultural goals. Granting everyone a wide scope of personal and economic liberty tends to generate good consequences, while restrictions on liberty tend to produce bad consequences. Classical liberals accept that markets and civil society can fail, but they argue government agents generally lack both the competence and the motivation to intervene in ways that fix rather than exacerbate the problems (Mueller, 2003). The first set of arguments is deontological; the second is consequentialist. Early classical liberal thinkers, such as Adam Smith, Adam Ferguson, and David Hume, did not quite recognize this distinction. They made both arguments without any apparent worry that these were different kinds of argument. But Robert Nozick, the most famous libertarian philosopher of the Twentieth Century, seemed to focus almost entirely on rebutting deontological arguments against libertarianism with providing deontological arguments of his own. This tendency, along with the radical contrarianism of certain other mid‐Twentieth Century libertarians, seems to cause the perception that libertarians are impractical and inhumane (Barry, 1975; Sachs, 2012). In contrast to Nozick, contemporary classical liberal thought is largely pre‐occupied with social justice issues and with assessing the expected consequences of adopting various institutions and policies. In a sense, this a return to Adam Smith and origins of classical liberal thought: Contemporary classical liberals are not so much synthesizing left‐liberalism and classical liberalism as they are instead clarifying the basic concerns that have driven mainline classical liberal thought all along.2. Lockean approaches to property take it that persons can unilaterally acquire private ownership over hitherto unowned resources. Such natural law accounts of property rights are often thought to be of limited use when dealing with the complexities of natural resource use outside of the paradigm of private ownership of land for agricultural or residential development. The tragedy of the commons has been shown to be anything but an inevitability, and yet Lockeanism seems to demand that even the most robust common (...) property arrangements be converted to privatized units. This often motivates a move away from natural law in the moral analysis of property rights. I argue however that it is not the deontological nature of Lockean principles that are at fault, but rather the manner of their application. Lockean theory often exhibits a bias in favour of private property: assuming that only private property can protect one’s interest in autonomy, and therefore asserting that each individual has a power of private acquisition. Starting with a claim against interference however enables us to mould the appropriate property rights to each individual’s particular interest in autonomy. This sometimes leads to private ownership, but often leads to various forms of commons. (shrink)
