  • Definition and the Question of “Woman”.Victoria Barker - 1997 - Hypatia 12 (2):185-215.
    Within recent feminist philosophy, controversy has developed over the desirability, and indeed, the possibility of defining the central terms of its analysis—“woman,” “femininity,” etc. The controversy results largely from the undertheorization of the notion of definition; feminists have uncritically adopted an Aristotelian treatment of definition as entailing metaphysical, rather than merely linguistic, commitments. A “discursive” approach to definition, by contrast, allows us to define our terms, while avoiding the dangers of essentialism and universalism.

    Argument mapping is a way of diagramming the logical structure of an argument to explicitly and concisely represent reasoning. This paper overviews the innovation and provides a procedural approach for new teaches wanting to use argument mapping in the classroom. A brief history of argument mapping is provided at the end of this paper.

    This article examines the role of normative hierarchies in constitutional argumentation. A threefold distinction between formal, material, and axiological hierarchy is employed. The correlative concepts of formal validity, material validity, and applicability are also briefly described.     Journalistic narrative prose is rich in suggestion. By voicing a single narrative ("X happened") statement in a supposedly non-fiction context, sender invites receiver to impute intelligibility, ascertainability, feasibility, topicality and speaker sincerity, as well as veracity, to the terms of an account. Conversely, when a narrative statement passes through a 'news-giving' medium, receivers are deterred from appraising those invited inferences.     Criticism may degenerate into quibbling or nitpicking. How can discussants keep quibblers under control? In the paper we investigate cases in which a battle about words replaces a discussion of the matters that are actually at issue as well as cases in which a battle about minor objections replaces a discussion of the major issues. We survey some lines of discussion dealing with these situations in profiles of dialogue.

    A generation before Beardsley, legal scholar John Henry Wigmore invented a scheme for representing arguments in a tree diagram, aimed to help advocates analyze the proof of facts at trial. In this essay, I describe Wigmore's "Chart Method" and trace its origin and influence. Wigmore, I argue, contributes to contemporary theory in two ways.
