Anarchism and Political Modernity looks at the place of 'classical anarchism' in the postmodern political discourse, claiming that anarchism presents a vision of political postmodernity. The book seeks to foster a better understanding of why and how anarchism is growing in the present. To do so, it first looks at its origins and history, offering a different view from the two traditions that characterize modern political theory: socialism and liberalism. Such an examination leads to a better understanding of how anarchism (...) connects with newer political trends and why it is a powerful force in contemporary social and political movements. This new volume in the Contemporary Anarchist Studies series offers a novel philosophical engagement with anarchism and contests a number of positions established in postanarchist theory. Mario Bunge's project is part of the humanist and scientific tradition of the Enlightenment. At the end of his intellectual journey, he wrote more than 150 books and 540 articles or chapters, including translations into several languages. The work (...) covers almost all branches of philosophy, from ontology to ethics, semantics, episte mology, methodology, praxeology and axiology, as well as a large number of scientific disciplines, ranging from physics to sociology, chemistry, biology and psychology. Without a doubt, Bunge's mag num opus is the Treatise on Basic Philosophy in nine volumes (1974- 1989). The six contributions gathered here come from authors from differ ent backgrounds. Like Bunge's project, they are neither part of the an alytic or continental movement in philosophy. The reader will find studies on the Bungean system, applications of Bungean thought, re flections and testimonies, and metascientific contributions. From the point of view of metascience as theorized in these pages, Bunge is the last of the philosophers and the first metascientific. He kept from philosophy the idea of a complete system that would inte grate semantics, ontology, epistemology, ethics, axiology and praxe ology, but he refused to problematize scientific knowledge in a tradi tional way. The result is surprising: even by accepting science as it is, he finds room for questioning. May Mεtascience be a place of questioning and deployment of the approach designed by Mario Bunge. Gibt es überzeugende Überforderungseinwände gegen anspruchsvolle moralische Auffassungen? In diesem Buch werden Überforderungseinwände präzise charakterisiert, systematisch eingeordnet und argumentativ verteidigt. Unter Berücksichtigung der wichtigsten philosophischen Beiträge zum Thema wird gezeigt, weshalb gewisse Moraltheorien und -prinzipien dafür kritisiert werden können, dass sie zu viel von einzelnen Personen verlangen.

The main claim of this study is that, contrary to Latour’s view about the need to leave aside epistemology to deal with anything valuable about science, Mario Bunge has consistently built up a detailed and thorough epistemology. The argumentative strategy will be to show that (a) it is not true that we have never been modern (b) epistemology is here to stay, and (c) Mario Bunge endorses a strong scientific realism, a brand of materialism, systemism and emergentism, including a moral (...) dimension (there are objective values like, truth, peace and justice that deserve to be respected). Then, Bunge’s realism rejects axiological neutrality making scientists responsible for their actions. Bunge has always been modern and keeps enriching his own views. (shrink)

Cette étude défend l’idée que, contrairement à l’opinion de Latour sur la nécessité de laisser de côté l’épistémologie pour traiter de tout ce qui a de la valeur pour la science, Mario Bunge a systématiquement construit une épistémologie détaillée et approfondie. La stratégie argumentative consistera à montrer (a) qu’il est faux que nous n’avons jamais été modernes (b) que l’épistémologie est là pour de bon et (c) que Mario Bunge soutient un réalisme scientifique fort, une version du matérialisme, du systémisme (...) et de l’émergentisme, comportant une dimension morale (il existe des valeurs objectives comme la vérité, la paix et la justice qui méritent d’être étudiées). Ensuite, le réalisme de Bunge rejette la neutralité axiologique rendant les scientifiques responsables de leurs actions. Bunge a toujours été moderne et continue à enrichir ses propres positions. Can compensation repair the moral harm of a previous wrongful act? On the one hand, some define the very function of compensation as one of restoring the moral balance. On the other hand, the dominant view on compensation is that it is insufficient to fully repair moral harm unless accompanied by an act of punishment or apology. In this paper, I seek to investigate the maximal potential of compensation. Central to my argument is a distinction between apologetic compensation and non-apologetic (...) compensation. Apologetic compensation, I argue, is an act that expresses regret and apology by means of some offer of money, goods, or services. Non-apologetic compensation is an act that seeks to restore loss or harm without expressing regret or apology. In the paper, I defend the view that acts of compensation can be apologetic and argue that such apologetic compensation is sufficient for moral repair. (shrink)

Why did such highly abstract ideas as truth, knowledge, or justice become so important to us? What was the point of coming to think in these terms? This book presents a philosophical method designed to answer such questions: the method of pragmatic genealogy. Pragmatic genealogies are partly fictional, partly historical narratives exploring what might have driven us to develop certain ideas in order to discover what these do for us. The book uncovers an under-appreciated tradition of pragmatic genealogy which cuts (...) across the analytic-continental divide, running from the state-of-nature stories of David Hume and the early genealogies of Friedrich Nietzsche to recent work in analytic philosophy by Edward Craig, Bernard Williams, and Miranda Fricker. However, these genealogies combine fictionalizing and historicizing in ways that even philosophers sympathetic to the use of state-of-nature fictions or real history have found puzzling. To make sense of why both fictionalizing and historicizing are called for, the book offers a systematic account of pragmatic genealogies as dynamic models serving to reverse-engineer the points of ideas in relation not only to near-universal human needs, but also to socio-historically situated needs. This allows the method to offer us explanation without reduction and to help us understand what led our ideas to shed the traces of their practical origins. Far from being normatively inert, moreover, pragmatic genealogy can affect the space of reasons, guiding attempts to improve our conceptual repertoire by helping us determine whether and when our ideas are worth having. Certain difficulties pervade the course of moral education and in this essay a broad picture of these shall be sketched. Moral educators need to understand the problems they will face if they intend to enhance their performance; this includes knowing the limits of moral education, and not going beyond their capacities. These difficulties may be put in two groups, one internal, which is within the control of moral educators; the other external, which is beyond the control of moral educators. Internal (...) difficulties concern the gap between moral cognition and moral conduct. Since moral educators are not saints and suffer from vices themselves, students might learn the contrary of what educators mean to convey. External difficulties are more complicated. In this essay the author concentrates on proving how moral education provides an incentive to breach morality itself. The author shall also endeavor to show that a higher standard of morality might cause greater failure in moral education. Under this logic, we need to first deal with the external difficulties in order to tackle internal ones, for they are intertwined. (shrink)

The history of the political thought on pleasure is not a cloistered affair in which scholars only engage one another. In political thought, one commonly finds a critical engagement with the wider public and the ruling classes, which are both perceived to be dangerously hedonistic. The effort of many political thinkers is directed towards showing that other political ends are more worthy than pleasure: Plato battles vigorously against Calicles' pleasure seeking in the Gorgias, Augustine argues in The City of God (...) against the human tendency to hedonism in favor of a profound distrust of pleasure, and even Machiavelli claims in The Prince that it is in the prince's best interest to separate his pursuit of pleasure from his pursuit of political power. The thrust of the majority of political thought is to interrupt the popular equation that links pleasure with the good. Instead, political thought has largely followed Plato's lead and has worked to contain hedonism on two fronts. First, pleasure is rigorously separated from ethical and political good: what is good is not identical with what is pleasurable even if the two sometimes overlap. Second, even where the pursuit of pleasure is judged to be coincident with the good, pleasure should only be pursued to the degree it is rational to do so and pursued in the most rational way. Of course, it is not true that all thinkers hold to these two positions on pleasure. Epicureanism and utilitarianism are two major schools of thought that challenge the first precept equating pleasure with the good. Both Epicureanism and utilitarianism argue that the only good is pleasure. However, it is much less frequently that one finds a thinker challenging the second Platonic position that reason must master and guide our pursuit of pleasure—even the Epicureans and utilitarians believe that pleasure is best pursued rationally. However, Foucault has attracted recent attention by challenging the idea that reason should dominate the pursuit of pleasure. (shrink)

Jeremy Bentham provided a comprehensive list of the sources of pleasure and pain, rather in the manner of modern researchers into human well-being. He explicitly used the term well-being and made both qualitative and quantitative proposals for its measurement. Bentham insisted that the measurement of well-being should be firmly based on the concerns and subjective valuations of those directly concerned, in the context of a liberal society. Those who wished to superimpose other judgements were dismissed as "ipsedixitists." He also addressed, (...) though of course could not solve, some of the measurement problems more recently tackled by "neo-Benthamites." The paper concludes that many of Bentham’s observations about the measurement of well-being are still relevant to issues in current research. “Virtue jurisprudence” is a normative and explanatory theory of law that utilises the resources of virtue ethics to answer the central questions of legal theory. The main focus of this essay is the development of a virtue–centred theory of judging. The exposition of the theory begins with exploration of defects in judicial character, such as corruption and incompetence. Next, an account of judicial virtue is introduced. This includes judicial wisdom, a form of phronesis, or sound practical judgement. A virtue–centred account (...) of justice is defended against the argument that theories of fairness are prior to theories of justice. The centrality of virtue as a character trait can be drawn out by analysing the virtue of justice into constituent elements. These include judicial impartiality (even–handed sympathy for those affected by adjudication) and judicial integrity (respect for the law and concern for its coherence). The essay argues that a virtue–centred theory accounts for the role that virtuous practical judgement plays in the application of rules to particular fact situations. Moreover, it contends that a virtue–centred theory of judging can best account for the phenomenon of lawful judicial disagreement. Finally, a virtue–centred approach best accounts for the practice of equity, departure from the rules based on the judge’s appreciation of the particular characteristics of individual fact situations. In terms of the distinction between relationalist and substantialist philosophies of science opened up by American pragmatist thinkers like Dewey and Bentley, Bentham’s social ontology is relationalist and anti-substantialist. When the ontology is combined with his emphasis on ordinary language as the basis of social reality, it is seen to have thematic connections to later developments in social science such as social constructionism, social phenomenology, ethnomethodology and, due to its intent to critically question-received fictions, to neo-Marxian and other concerns about (...) objectivation and reification. Also, by re-reading Bentham’s theory of fictions as a theory of vernacular language habits, it can be shown to have empirical relevance for the sociology of language. (shrink)

Climate change is the first anthropogenic alteration of a global Earth system. It is globally catastrophic in terms of food production, sea level rise, fresh water availability, temperature elevation, ocean acidification, species disturbance and destruction to name just a few crisis concerns. In addition, while those changes are occurring now, they are amplifying over decadal periods and will last for centuries and possibly millennia. While there are a number of pollutants involved, carbon dioxide which results from the combustion of any (...) fossil fuel is the primary pollutant. It has not been considered a pollutant until recently because of its natural dissociation into oxygen and carbon compounds like wood. However, because of its molecular durability and ability to acidify water, it has become the primary pollutant as a result of the exponential increase in fossil fuel use for the production of energy by Earth’s population that has doubled over the last six decades. That increase has exceeded Earth’s ability to handle humanity’s waste CO2. Obviously, the involved changes detrimentally affect all life on Earth. Because of the evolving nature of the changes, climate change is presently denied primarily in the United States because of the costs of eliminating our carbon addiction. Because no similar global natural or anthropogenic situation has previously occurred during the lifetime of Homo sapiens, our extant ethical theories are incapable of confronting the crisis. Consequently, new ethical paradigms are necessary. This dissertation attempts to provide thoughts about the use of Aristotelian ethical theory, the aidōs feeling, Aquinian psychology and a possible new virtue of proper primility in an effort to further nurture the growth of the new climate change ethics. Despite the prevalence of the terms utilitarianism and utilitarian in the health care and health policy literature, anecdotal evidence suggests that authors are often not fully aware of the diversity of utilitarian theories, their principles, and implications. Further, it seems that authors often categorically reject utilitarianism under the assumption that it violates individual rights. The tendency of act utilitarianism to neglect individual rights is attenuated, however, by the diminishing marginal utility of wealth and the disutility of a protest by those (...) who are disadvantaged. In practice, act utilitarians tend to introduce moral rules and preserve traditional rules. At the same time, the tenability of rule utilitarianism is limited because it ultimately collapses into act utilitarianism or a deontological theory. Negative utilitarianism is a viable utilitarian variant only if we accept complete aversion to suffering, ie, if we disregard any forgone opportunities to increase pleasure. Finally, the adoption of preference utilitarianism requires us to accept the subjectivity of individual claims which may be perceived as unfair. (shrink)

Este artículo revisa los fundamentos del utilitarismo de Jeremy Bentham y las principales críticas a esta doctrina, profundizando en aquella que sostiene su incompatibilidad con el respeto irrestricto de los derechos humanos. Insertándose en esta problemática, analiza una paradigmática propuesta política del filósofo inglés: el panóptico, proyecto arquitectónico formulado por Bentham a finales del siglo XVIII con el fin de reformar el sistema penitenciario europeo. A partir del análisis del Panóptico –que se descubre como una aplicación coherente del utilitarismo benthamiano–, (...) se postula que: a) esta doctrina fomenta un trato humanitario; b) los derechos humanos no quedan garantizados, sino condicionados al grado de beneficio colectivo que generen; c) este utilitarismo supone un cuestionamiento por la universalidad e irrevocabilidad de dichos preceptos. How, then, did Bentham view the relationship between utility and truth? Did he think that utility and truth simply coincided, and hence that falsehood necessarily led to a diminution in happiness, and conversely truth (...) led to an increase in happiness? This article addresses this issue through two bodies of material: the first consists of Bentham's writings on religion under the heading of ‘Juggernaut’ and dating from 1811 to 1821; the second consists of the writings on judicial evidence dating from 1803 to 1812 and which appeared in Rationale of Judicial Evidence. O objetivo do presente artigo é discutir os vínculos existentes entre a teoria humeana e o Utilitarismo. Nesse contexto, mencionando a divergência existente entre os comentadores de Hume a respeito de seu lugar diante do Utilitarismo, conclui-se que, embora o caráter descritivo de fato predomine na teoria humeana, ela não é inteiramente desprovida de pretensão prescritiva. Será ainda necessário discutir em que consiste essa pretensão, isto é, o que ela busca prescrever.

Abstract Bentham favored a free press as an instrument of public control of the state, in the interest of the general happiness. Kant favored free public discussion as an instrument for the development and expression of autonomous rationality. But a free press embodied in the property rights of the owners of the press may well fail to achieve either Benthamite or Kantian goals. Such goals lead to a personal right to communicate rather than to a corporate right to press freedom.

SUMMARYThe essay argues that Jeremy Bentham played a major role in the transitional process between the eighteenth and the nineteenth centuries leading to the ‘discovery' or ‘invention of society' as an order, i.e., as an autonomous object of knowledge. By comparing Bentham's discourse with those developed by select protagonists of that transition, particularly Ferguson, Sieyès, and Mirabeau, it is shown how society emerges as the logical and historical space of a set of relationships that affects both the rationalisation and the (...) practice of government. In contrast with Michel Foucault's interpretation of Bentham's role in the genealogy of neoliberalism, recently developed by Pierre Dardot and Christian Laval, this paper suggests that ‘the new governmental reason’ rose from within the discourse of law. Consequently, the problem of ‘constitution’ was not left behind by the epistemological change of the eighteenth century, as they argue. Rather, the scientific and political understanding of society as a code became the base for an innovative conception of both law and politics. (shrink)

What motivates the benevolent or charitable agent is regard for another’s good or well-being, but talk about regard for others’ good or well- being is simply talk about benevolence or charity in different terms. Yet Hume clearly holds that the regard for another’s good is a motive to produce benevolent acts that is distinct from a sense of their benevolence. So what is the difference? ‘Well’, one might say, ‘intuitively, rights are very different from wellbeing.’ Yes indeed. And that, I (...) shall contend, is Hume’s point. My general contention is that Hume’s discussion of justice is in fact an attack on that concept of rights we think of as having motivated the American and French revolutions, a concept that is still (deplorably in my view) prevalent. I think the very fact that it is so prevalent and so sanctified by its position in the American Constitution has blinded most readers to the power and plausibility of Hume’s attack, which I shall try to defend. Las doctrinas que defienden el deber de obediencia al derecho consideran que este deber es universal, afecta a todos los individuos de un Estado. Quienes se oponen suelen considerar que en ningún caso tendríamos un deber de obediencia al derecho. En este trabajo se sostiene que hay un espacio intermedio entre ambas posiciones. Las posiciones voluntaristas sirven para justificar ese deber respecto a quienes dan su consentimiento expreso al Estado. El grueso de este trabajo, sin embargo, se centra en las (...) posibilidades que presentan algunas doctrinas no voluntaristas. Veremos que de todas ellas se pueden extraer buenos argumentos para considerar que, para algunos individuos o respecto a determinadas cuestiones, es posible fundar el deber de obediencia al derecho. ABSTRACTThis paper critically analyses current depictions of prevention and tries to offer a new theoretical reflection on the concept by reconstructing it on the basis of Jeremy Bentham’s writings on indirect legislation. It is my aim not only to explore Bentham’s concept of indirect legislation as an outstanding example of enlightened social/public policy, but also to show to what extent his thoughts might be a fruitful contribution to a necessary reconceptualization of current conceptions of prevention, which are heavily criticized by (...) many scholars. This article tries to study the evolution of the place and significance of the term “fiction” in Bentham’s critical strategy against English law. If, in an initial phase, Bentham uses fictions to bring to light mystification operating in English law, he then attacks the theories that sought to justify and ground political society and law. Bentham proposes a foundation justified with the help of the principle of utility, which he presents as a “fundamental axiom” that needs no proof. Paradoxically, his (...) argumentation, taken as a whole, becomes intrinsically problematical on recognizing the inevitable linguistic necessity of fictions and the fictitious character of utility: every legal discourse will, in consequence, invoke the fictions that it previously criticised. He must therefore refine his theory of fictions and construct its positivity with the aim of drawing up a legal discourse that satisfies the demands of his theory of law. (shrink)

Kita vertus, akademinėje ir ypač profesinėje teisininkų bendruomenėje teisininko buvimo etišku reikšmė ir poreikis vis labiau akcentuojami. Analitiškai ir kritiškai aptarus tokį status quo šiame straipsnyje pristatoma alternatyvi teisininkų etikos vertybių realaus egzistavimo perspektyva, taip pat formuluojant teisininkų etikos modeliavimo gaires. Ši perspektyva remiasi subjektyviąja ontologija ir pamatiniais moralinio proto principais: altruizmu (...) ir teisingumo kaip proporcinės lygybės nuostata. (shrink)

The Indiana Religious Freedom Restoration Act and its subsequent backlash serve as a case-study to raise ethical concerns both about the characterization of contemporary western liberal democracy as a political theory and a prevailing religious extremism acting as a legislative power within governments; Developing and reflecting on these issues this study will attempt to show a need to evaluate the moral principles attributed to modern political systems and the governmental delineation of power over individuals within a society. Applying Rawlsian concepts, (...) this study will show that laws such as the RFRA are representative of weak and superficial democracies that in most cases are actually centres of power, funded by corporations and organisations in direct conflict with liberal principles.
