Levinas is often credited with introducing a strong notion of ethics into postmodern thought. But his commitment to Zionism, his views on the Palestinian people, and his underformulated theory of justice raise questions about the desirability of his thinking for politics. In this study, the well-known encounter between Levinas and the Palestinians is addressed in order to determine how his philosophy of ethics can be deployed for political ends. As the philosopher famously concerned with the connection between self and the (...) Other, the relation between Levinas, Israel and the Palestinians stands as the natural political test of his ethics. Based on this encounter, it is demonstrated that Levinasian justice is too unsafe as a prescription for a political order. Only when Levinas' ethics as first philosophy is supported by love as first politics is his Messianic polity acceptable. (shrink)

In this book, Gavin Rae analyses the foundations of political life by undertaking a critical comparative analysis of the political theologies of Carl Schmitt and Emmanuel Levinas. In so doing, Rae contributes to key debates in contemporary political philosophy, specifically those relating to the nature of, and the relationship between, the theological, the political, and the ethical, as well as those questioning the existence of ahistoric metaphysical, ontological, and epistemological foundations. While the theological is often associated with belief in a (...) fixed foundation such as God or the truth of a religion, Rae identifies another sense rooted in epistemology. On this understanding, the ontological limitations of human cognition mean that, ultimately, human truth is based in faith and so can never be certain. The argument developed suggests that Levinas’ conception of the political is grounded in theology in the sense of religion, particularly the revelations of Judaism. For this reason, Levinas claims that the political decision is based on how to implement a prior religiously-inspired norm: justice. Schmitt, in contrast, develops a conception of the political rooted in epistemic faith to claim that the political decision is normless. While sympathetic to Schmitt’s conception of theology and its relationship to the political, Rae concludes by arguing that the emphasis Levinas places on responsibility is crucial to understanding the implications of this. The continuing relevance of Schmitt’s and Levinas’ political theologies is that they teach us that, while the political decision is ultimately normless, we bear an infinite responsibility for the consequences of this normless decision. In this article I argue that Levinas can be read as a critic, not just of Heideggerian being, but also of being-with. After pointing out that the publication of the Black Notebooks only makes this criticism more interesting to revisit, I first of all discuss passages from both earlier and later writings in which Levinas explicitly takes issue with Heidegger’s claim that there is no self outside of a specific socio-historical community. I then explain how these criticisms are reflected in (...) Levinas’s own account, arguing that Levinasian subjectivity and alterity are precisely defined by their not belonging to a larger unity; to the extent that they partake in a multi-personal collectivity, this does not take the form of a traditional community. In the final section, I look into a different and seemingly opposing argument Levinas makes against Heidegger: on the basis of the latter’s reflections on death, he argues that Dasein is anti-social rather than overly immersed in the socio-historical. Arguing that this rests on a misreading of Being and Time, I use this opportunity to raise questions about Levinas’s interpretation of Heidegger and his “otherwise than being-with” more generally, for Levinas’s account runs into several problems as well. Yet as I will conclude, this in fact offers a valuable insight, not just for the present-day reception of Heidegger, but also for thinking community today. It indicates that a radical break with human situatedness does not automatically fare better than a firmly enrooted account of existence. (shrink)

In both popular and scholarly discussions, sexual consent is gaining traction as the central moral consideration in how people should treat one another in sexual encounters. However, while the concept of consent has been indispensable to oppose many forms of sexual violence, consent-based sexual ethics struggle to account for the phenomenological complexity of sexual intimacy and the social and structural pressures that often surround sexual communication and behavior. Feminist structural critique and social research on the prevalence of violation even within (...) consensual sex suggest that consent is insufficient to ground responsibility; a more fundamental orientation toward the value of sexual agency provides a better foundation for sexual ethics. Using feminist critical theory, phenomenology, and black feminist thought, this dissertation develops a socially situated and relational notion of sexual agency and diagnoses how such agency is neglected in prevailing discussions of consent in moral philosophy and legal theory. I argue that the ethical question of responsibility to another in a sexual encounter—apart from juridical considerations—should be reframed around the value of each person’s socially situated practices of agency. Preceding and extending beyond the obligation to gain valid consent for an action, responsibility demands adapting one’s intentions and behaviors in response to the wider range of another’s communicative expressions of agency. However, communicative expressions can be ambiguous or overdetermined by social context and cultural norms; they often offer only provisional traces of agency. To address this inherent uncertainty in intimacy, I propose drawing on insights from Emmanuel Levinas about the dynamic, open-ended nature of relationality, responsibility, and communication. Responsibility toward another does not depend on securing certainty about their “yes” or “no,” but requires responding continuously under conditions of uncertainty and ambiguity, adapting behaviors and intentions to make room for another’s agency despite its opacity. Adorno and Levinas argue from distinct yet intersecting perspectives that there are pathological forms of freedom, formed by systems of power and economic exchange, which legitimate the neglect, exploitation and domination of others. In this paper, I examine how the works of Adorno and Levinas assist in diagnosing the aporias of liberty in contemporary capitalist societies by providing critical models and strategies for confronting present discourses and systems of freedom that perpetuate unfreedom such as those ideologically expressed in possessive individualist (...) and libertarian conceptions of freedom. Most readers believe that it is difficult, verging on the impossible, to extract concrete prescriptions from the ethics of Emmanuel Levinas. Although this view is largely correct, Levinas’ philosophy can, with some assistance, generate specific duties on the part of legal actors. In this paper, I argue that the fundamental premises of Levinas’ theory of justice can be used to construct a prohibition against capital punishment. After analyzing Levinas’ concepts of justice, responsibility, and interruption, I turn toward his scattered remarks (...) on legal institutions, arguing that they enable a sense of interruption specific to the legal domain. It is here that we find the conceptual resources most important to my Levinasian abolition. I argue that the interruption of legal justice by responsibility implies what I call the principle of revisability. The principle of revisability states a necessary condition of just legal institutions: To be just, legal institutions must ensure the possibility of revising any and all of their rules, principles, and judgments. From this, the argument against capital punishment easily follows. Execution is a legal act, perhaps the only legal act, that cannot be undone. An application of the principle of revisability to this fact leads to the conclusion that legal institutions cannot justly impose capital punishment. After defending these points at length, I conclude with some observations on the consequences of the principle of revisability for law more generally. (shrink)

This article takes as its subject matter the juridico-political space of the prisoner of war (POW) camp. It sets out to determine the nature of this space by looking at the experience of war captivity by Jewish members of the Western forces in World War II, focusing on the experience of Emmanuel Levinas, who spent 5 years in German war captivity. On the basis of a historical analysis of the conditions in which Levinas spent his time in captivity, it argues (...) that the POW camp was a space of indifference that was determined by the legal exclusion of prisoners from both war and persecution. Held behind the stage of world events, prisoners were neither able to exercise their legal agency nor released from law into a realm of extra-legal violence. Through a close reading of Levinas’s early concept of the ‘there is’ [il y a], the article seeks to establish the impact on prisoners of prolonged confinement in such a space. It sets out how prisoners’ subjectivity dissolved in the absence of meaningful relations with others and identifies the POW camp as a space in which existence was reduced to indeterminate, impersonal being. I seek to draw out the unique character of Levinas’ theory of recognition by highlighting its transitional character in a double sense. It is transitional, firstly, in that it stands between two models of recognition: the earlier agonistic model of Kojeve and the later model of Honneth which takes as its point of departure a primordial relation of mutual affirmation between individuals. It is transitional secondly in the sense that, while Levinas initially employs the concept of recognition, he is later (...) explicit in his rejection of it. The interest of Levinas’ transitional model of recognition for the philosophy of religion is that Levinas negotiates both transitions by calling on archetypes borrowed from the Jewish tradition. An exploration of this model thus provides us with a fresh vantage point from which to address anew the question of the articulation of social philosophy and the philosophy of religion in his work. In this essay I return to the difficult relation between the ethics and politics of Emmanuel Levinas through his critique of "paganism" and "primitivism." I argue that Levinas' central philosophical claims are fundamentally constituted by his problematic conceptions of so-called primitive life. Thus unlike current scholarship which has tried to put a wedge between Levinas' ethics and his politics, I suggest that one way to make Levinas' contributions meaningful in a global world is to unhinge the philosophy from the beginning. Building on the dialogue between Levinas and Derrida, as well as contemporary anthropology, I argue that we can make an orginary agnostic moment prior to his work, which might allow us to think through a plurality of ethical subjectivities. This article examines the impact of messianic thought on political philosophy in the theory of philosopher Emmanuel Levinas. Levinas’s work enables us to consider the political not only in terms of contemplation of the tension between the political and the ethical and of the ethical limits of politics but as an attempt to create ethical political thought. Discussion of the tension between the political and the ethical intensifies in wartime and in the context of militaristic thinking. At the same time, (...) it lends itself to new meanings of peace. At the heart of this article lies an examination of the role of the political discourse articulated in Levinas’s influential work Totality and Infinity and of the possibility of understanding this discourse in light of the Levinasian reading of the Talmud. The general topic of my philosophical dissertation is phenomenological ontology of breathing. I do not investigate the phenomenon of breathing as a natural scientific problem, but as a philosophical question. Within our tradition, breathing has been normally understood as a mechanistic-materialistic physiological life-sustaining process of gas exchange and cellular respiration which does not really seem to have any essential connection to human being’s spiritual, mental or philosophical capacities. On the contrary to this natural scientific view, I argue that breathing can (...) be understood as a philosophical question that has phenomenological, experiential, ontological, spiritual, bodily, mental, poetic, elemental, ethical, voluntary and mystical dimensions. My investigation conceptualizes breathing in the first place as a question of phenomenological ontology. Maurice Merleau-Ponty’s phenomenologico-ontological method of interrogation of the lived body’s experiential openness to the world and Being provides the most fundamental point of departure in this dissertation. Merleau-Ponty emphasized in his investigations the lived body’s perceptual openness to the world and Being. He argued famously for the primacy of perception. His thesis of the primacy of perception means that perception as the perceptual openness to the world and Being is the foundation which is always presupposed by all the other levels of our existence and being-in-the-world. In this dissertation, I challenge this idea of the primacy of perception with Merleau-Ponty’s own remarks about breathing. I argue that in his own remarks about breathing, he implicitly points toward a level which is even more fundamental than the primacy of perception. In this dissertation, this level of our being-in-the-world I call the primacy of breathing. Breathing as the lived body’s respiratory openness to the world and Being is now understood as the foundation which is always presupposed by all the other dimensions of our being-in-the-world. These dimensions are, for example, our theoretical, practical, social and perceptual ways of relating with the world. If the idea of the primacy of breathing is taken seriously, it means that all the questions of philosophy could be rethought, reexamined and re-experienced within the fundamental atmosphere of respiratory openness to the world and Being. In this dissertation, I initially try to rethink philosophy as a new philosophy of breathing. This new philosophy of breathing would be phenomenological ontology of breathing. The bases of this new phenomenological ontology of breathing are Merleau-Ponty’s remarks about breathing. My task is to explicate and interpret them with the help of Merleau- Ponty’s own phenomenological ontology. In my task of beginning philosophy anew as philosophy of breathing or as respiratory philosophy, I will also use the ideas of Martin Heidegger, Gaston Bachelard, Paul Claudel, Luce Irigaray, Edmund Husserl and David Kleinberg-Levin. My dissertation is divided into two main sections. In Section One, I construct within the framework of phenomenological ontology a new notion of breathing as the primacy of breathing. In Section Two, I develop a phenomenological method that I call the method of ontologico-respiratory reduction. This method will lead us back to the primacy of breathing. (shrink)
