Authority arguments generate support for claims by appealing to an agent’s authority status, rather than to reasons independent of it. With few exceptions, the current literature on argument schemes acknowledges two basic authority types. The _epistemic_ type grounds in knowledge, the_ deontic_ type grounds in power. We review how historically earlier scholarship acknowledged an_ attractiveness-based_ and a _majority-based_ authority type as equally basic type. Crossing these with basic speech act types thus yields authority argument sub-schemes. Focusing on the_ epistemic-assertive_ sub-scheme (...) (‘an epistemic authority _A_ _E_ asserts a proposition _P_’), we apply a meta-level approach to specifying critical questions. Results improve the evaluation of this sub-scheme and show how similar improvements are obtainable for other schemes. (shrink)

According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, then conclusion; (...) so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

Current practice in logic increasingly accords recognition to abductive, presumptive or plausible arguments, in addition to deductive and inductive arguments. But there is uncertainty about what these terms exactly mean, what the differences between them are (if any), and how they relate. By examining some analyses ofthese terms and some of the history of the subject (including the views of Peirce and Cameades), this paper sets out considerations leading to a set of definitions, discusses the relationship of these three forms (...) of argument to argumentation schemes and sets out a new argumentation scheme for abductive argument. Can argumentation schemes play a part in the critical processing of argumentation by lay people? In a qualitative study, participants were invited to come up with strong and weak arguments for a given claim and were subsequently interviewed for why they thought the strong argument was stronger than the weak one. Next, they were presented with a list of arguments and asked to rank these arguments from strongest to weakest, upon which they were asked to motivate their judgments in an (...) interview. In order to assess whether lay people apply argument scheme specific criteria when performing these tasks, five different argumentation schemes were included in this study: argumentation from authority, from example, from analogy, from cause to effect, and from consequences. Laypeople’s use of criteria for argument quality was inferred from interview protocols. The results revealed that participants combined general criteria from informal logic and scheme-specific criteria. The results supported the conventional validity of the pragma-dialectical argument scheme rule in a strong sense and provided a more fine-grained view of central processing in the Elaboration Likelihood Model. Douglas Walton, perhaps the most prolific author in Argumentation theory, has been of a great influence in the fields of Informal logic, Artificial intelligence, and Law. His contributions in the field of educational research, in particular in the field of argumentation and education, are less known. This review paper aims at shedding light on those aspects of Walton’s theory that have received educational researchers’ attention thus far, as well identifying existing lacks of consideration and open paths for future research.

This article seeks, first, to show that much of the existing normative work on argument from expert opinion (AEO) is problematic for failing to be properly informed by empirical findings on expert performance. Second, it seeks to show how, with the analytic tool of Bayesian reasoning, the problem diagnosed can be remedied to circumvent some of the problems facing the scheme-based treatment of AEOs. To establish the first contention, we will illustrate how empirical studies on factors conditioning expert reliability can (...) be drawn upon to re-construct. Walton’s critical questions matching the scheme of AEOs. To establish the second contention, we will illustrate how Walton’s re-constructed set of critical questions can be formalized within a Bayesian network. Finally, we will highlight how the specific ways in which the Bayesian framework we propose is both continuous with and distinct from the models of source reliability put forward by theorists like Bovens and Hartmann (2003). Abstract: The article presents and critically discusses Walton's (and Reed's and Macagno's) argument scheme approach to a theory of good argumentation. In particular, four characteristics of Walton's approach are presented: 1. It presents normative requirements for argumentation in the form of argument schemes, i.e. relatively concrete type descriptions. 2. These schemata are enthymematic, i.e. they omit some of the premises required by other approaches. 3. The actual argument schemes are usually supplemented by critical questions. 4. The method is inductive, bottom-up, (...) gaining the normative schemata by abstraction from empirically collected groups of similar arguments. These characteristics, among others, are then discussed on the basis of four adequacy conditions: AC1: effectiveness in achieving the epistemic goal of obtaining and communicating justified acceptable opinions; AC2: completeness in capturing the good argument types; AC3: efficiency in achieving the goals; AC4: justification of the argument schemes. The discussion then reveals a number of weaknesses in Walton's argument schemes; among other things, they are neither effective (in the defined sense) nor truly justified. Contributing factors to these problems include the schema approach, i.e. not looking at the form of arguments, and the lack of epistemological foundations in the development of good types of arguments. However, the critical analyses reveal a better alternative: an epistemological approach based on epistemological principles. The article concludes with a detailed analysis of the scheme Practical Inference, which confirms the general criticism in detail. (shrink)

Douglas Walton has done extensive and valuable work on the concepts of presumption and practical reasoning. However, Walton’s attempt to model practical reasoning as presumptive is misguided. The notions of “inference” and of the burden of proof shifting back and forth between proponent and respondent are misleading and lead to counterintuitive consequences. Because the issue in practical reasoning is a proposal, not a proposition, there are, in the standard case, several perfectly good reasons on both sides simultaneously, which implies that (...) argument appraisal necessarily contains a subjective element—a fact argumentation theory needs to conceptualize. Some solo verbal reasoning serves the function of arriving at a correct answer to a question from information at the reasoner’s disposal. Such reasoning is good if and only if its grounds are justified and adequate, its warrant is justified, and the reasoner is justified in assuming that no defeaters apply. I distinguish seven sources of justified grounds and state the conditions under which each source is trustworthy. Adequate grounds include all good relevant information practically obtainable by the reasoner. The (...) claim must follow from the grounds in accordance with a justified general warrant. If this warrant is not universal, the reasoner must be justified in assuming that no exception-making circumstances hold in the particular case to which it is applied. (shrink)

This article reviews David Hitchcock’s selected papers, On Reasoning and Argument.

This paper begins a working through of Blair’s (2001) theoretical agenda concerning argumentation schemes and their attendant critical questions, in which we propose a number of solutions to some outstanding theoretical issues. We consider the classification of schemes, their ultimate nature, their role in argument reconstruction, their foundation as normative categories of argument, and the evaluative role of critical questions.We demonstrate the role of schemes in argument reconstruction, and defend a normative account of their nature against specific criticisms due to (...) Pinto (2001). Concerning critical questions, we propose an account on which they are founded in the R.S.A. cogency standard, and develop an account of the relationship between critical questions and burden of proof. Our ultimate aim is to initiate a reconciliation between dialectical and informal logic approaches to the schemes. (shrink)

While there has been in depth discussion of many particular argumentation schemes, some lament that there is little to no theory underpinning the notion of an argumentation scheme. Here I shall argue against the utility of argument schemes, at least as a fundamental part of a complete theory of arguments. I shall also present and defend a minimalist theory of their nature—a scheme is just a set of proposition expressions and propositional functions. While simple, the theory contravenes several typical desiderata (...) of argumentation schemes such as aiding in the identification of enthymemes and keeping arguments constrained to a manageable taxonomy. So much the worse for the desiderata. Instead, I shall recommend focusing less on schemes and more on the component propositional functions. (shrink)

The Nature and Status of Critical Questions in Argumentation Schemes.

Knowledge plays an important role in argumentation. Yet, recent work shows that standard conceptions of knowledge in epistemology may not be entirely suitable for argumentation. This paper explores the role of knowledge in argumentation, and proposes a notion of knowledge that promises to be more suitable for argumentation by taking account of: its dynamic nature, the defeasibility of our commitments, and the non-monotonicity of many of the inferences we use in everyday reasoning and argumentation.

Douglas Walton’s multitudinous contributions to the study of argumentation seldom, if ever, directly engage with argumentation in mathematics. Nonetheless, several of the innovations with which he is most closely associated lend themselves to improving our understanding of mathematical arguments. I concentrate on two such innovations: dialogue types (§1) and argumentation schemes (§2). I argue that both devices are much more applicable to mathematical reasoning than may be commonly supposed.

The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. This paper presents a formalization of informal logic using the Carneades Argumentation System, a formal, computational model of argument that consists of a formal model of argument graphs and audiences. Conflicts between pro and con arguments are resolved using proof standards, such as preponderance of the evidence. Carneades also formalizes argumentation schemes. Schemes can be used to check whether a given argument instantiates the types of argument deemed normatively appropriate for the type of dialogue.

The contribution critically discusses Walton's argumentation scheme approach. On the one hand, its enormous richness and closeness to the empirical argumentation material is appreciated, but, on the other, fundamental conceptual weaknesses are revealed. Although the approach more recently has been declared to strive for “true beliefs and correct choices” it has not systematically developed the proposed schemes in a way that these goals are reached. Accordingly, many proposed schemes are fallacious from an epistemological standpoint.

In academic contexts the appeal to authority is a quite common but seldom tested argument, either because we accept the authority without questioning it, or because we look for alternative experts or reasons to support a different point of view. But, by putting ourselves side by side an already accepted authority, we often rhetorically manoeuvre to displace the burden of the proof to avoid the fear to present our opinions and to allow face saving.

As appeals to expert authority shift from “fallacies” to “argument schemes,” argumentation theorists are called on to provide critical questions for assessing them. I argue that current treatments focus too heavily on assessing expertise, and not enough on judging trustworthiness. I propose instead a norma-tive pragmatic account of the rational force of the appeal to expert authority, one that emphasizes the ex-pert's actions in constructing his/her own legitimate trustworthiness.

The deep operation of androcentrism in scientific argumentation demands recognition as a form of fallacy. On Walton’s account, fallacies are serious mistakes in argumentation that employ presumptions acceptable in other circumstances. There are only isolated cases in which androcentric pre-sumptions are acceptable, and I argue that androcentrism affects an overarching theme of generalization in science rather than an isolated scheme. Androcentrism is related to other ways of treating privileged people as exemplary humans, whose negative impact on processes of argumentation can (...) be described as the fallacy of “appeal to the standard.”. Arguments sometimes appeal to sex by invoking the sexuality of a model or a person or the promise of sexual gratification. When sexual gratification is not a relevant consideration, the appeal seems to be fallacious. We will address when this may be an appropriate line of reasoning -- there is such a thing as “sex appeal”--and when it may be biased to assume the relevance of sexuality. Advertising, which provides infinite examples of appeal to sex, may be questionable as a (...) case of argumentation, as opposed to some other sort of negotiation or communication, especially perhaps in its reliance on visual imagery. Yet, more classic textual cases of appeal to sex can be found, as well as what may be reasonable enough practical advice about making oneself sexually attractive. Its appropriate role sometimes as a practical consideration suggests that appeal to sex is analogous to appeal to force, or ad baculum, which can be relevant in a negotiation dialogue, Douglas Walton argues. So, it deserves at least the same attention from argumentation scholars, and perhaps even more from critical thinking educators in cultures more saturated with sexuality than with threats. (shrink)
