The nature of the relation between jurisprudential theories and first-order legal judgments is a strangely uncontroversial matter in contemporary legal philosophy. There is one dominant conception of the relation according to which jurisprudential theories are second-order or meta-legal theories that specify the ultimate grounds of first-order legal judgments. According to this conception, difficult first-order legal disputes are to be resolved by jurisprudential theorizing. According to an alternative conception that Ronald Dworkin has influentially advocated, jurisprudential theories are not second-order theories about (...) the nature of law, but instead covert first-order legal theories. These two conceptions of the relation between jurisprudential theories and first-order legal judgments dominate the contemporary legal philosophical scene and crowd out other possible conceptions. This article scrutinizes the two conceptions, and in the process raises the possibility of a different and arguably more credible conception. According to this new conception, our first-order legal views and a jurisprudential theory that we accept are supposed to form a mutually disciplining and supporting set of views that we accept in our pursuit of the epistemic ideal of wide reflective equilibrium. The two sets of views are supposed to constrain and discipline each other; but neither is meant to underwrite, certify, or ultimately determine the contents of the other. This new conception, which allows the relation between jurisprudential theories and first-order legal judgments to be much looser, untidier, and more complex than what the two dominant conceptions imply, should facilitate progress in legal philosophy and in first-order legal thinking. William James said that sometimes detailed philosophical argument is irrelevant. Once a current of thought is really under way, trying to oppose it with argument is like planting a stick in a river to try to alter its course: “round your obstacle flows the water and ‘gets there just the same’”. He thought pragmatism was such a river. There is a contemporary river that sometimes calls itself pragmatism, although other titles are probably better. At any rate it is the denial (...) of differences, the celebration of the seamless web of language, the soothing away of distinctions, whether of primary versus secondary, fact versus value, description versus expression, or of any other significant kind. What is left is a smooth, undifferentiated view of language, sometimes a nuanced kind of anthropomorphism or “internal” realism, sometimes the view that no view is possible: minimalism, deflationism, quietism. Wittgenstein is often admired as a high priest of the movement. Planting a stick in this water is probably futile, but having done it before I shall do it again, and—who knows?—enough sticks may make a dam, and the waters of error may subside. The general tendency or attitude that Dreier 2004 calls creeping minimalism is ramping up in contemporary analytic philosophy. Those who entertain this attitude will take for granted a framework of deflationary or minimal notions – principally semantical1 and ontological – by means of which to analyse problems in different philosophical fields – e.g. theory of truth, metaethics, philosophy of language, the debate on realism and antirealism, etc. Let us call sweeping minimalist the philosopher affected by creeping minimalism. The framework of (...) minimal notions that the sweeping minimalist takes for granted encompasses, for instance, the concept of truth, reference, proposition, fact, individual, and property. Minimal notions are characterized in terms of general platitudinous principles expressed by schemata like the following (cf.: 26): ‘S’ is true if and only if S; ‘S’ is true if and only if ‘S’ corresponds to the facts; a has the property of being P if and only if a is P. Where ‘S’ and ‘a is P’ stand for sentences satisfying superficial constraints of truth-aptitude (i.e. sentences in declarative form subject to communally acknowledged standards of proper use), and.. The moral belief problem is that of reconciling expressivism in ethics with both minimalism in the philosophy of language and the syntactic discipline of moral sentences. It is argued that the problem can be solved by distinguishing minimal and robust senses of belief, where a minimal belief is any state of mind expressed by sincere assertoric use of a syntactically disciplined sentence and a robust belief is a minimal belief with some additional property R. Two attempts to specify R are (...) discussed, both based on the thought that beliefs are states that aim at truth. According to the first, robust beliefs are criticisable to the extent that their content fails to match the state of the world. This sense fails to distinguish robust beliefs from minimal beliefs. According to the second, robust beliefs function to have their content match the state of the world. This sense succeeds in distinguishing robust beliefs from minimal beliefs. The conclusion is that the debate concerning the cognitive status of moral convictions needs to address the issue of the function of moral convictions. Evolutionary theorising may be relevant, but will not be decisive, in answering this question. (shrink)

In the opening line of his essay ‘On Truth’, Francis Bacon ticks off Pontius Pilate for not giving the subject its due time and gravity—‘“What is truth?”, said jesting Pilate, and would not stay for an answer.’ If Pilate had stayed for an answer, he would have been waiting a long time—four centuries after Bacon, and twenty after Christ, the jury is still out. But things do seem to have been moving along quite nicely, this past century or so; and (...) as Pilate might note with satisfaction, he himself has been getting a better press. Perhaps Nietzsche’s extravagant compliment was a mixed blessing: Nietzsche declared (‘as offensively as possible’, as Will Durant [1929: 25] put it) that.. (shrink)

At the very least, externalists about content will accept something like the following claim.

Carnap was one of the first to use the term 'non-cognitivism'. His linguistic pluralism and voluntarism, and his deflationary views of ontology and semantics, are highly congenial to those of us who want to take non-cognitivism in the direction of global expressivism. In his own case, however, this move is in tension with his continued endorsement of what he calls 'the general thesis of logical empiricism', that 'there is no third kind of knowledge besides empirical and logical knowledge.’ So while (...) In recent work Allan Gibbard claims to be both a local quasi-realist, in Blackburn’s sense, and a global expressivist. His local quasi-realism rests on an argument that for naturalistic discourse but not ethical discourse, the semantic relation of denotation and the causal relation of tracking can and should be identified; that denoting simply is tracking, for naturalistic vocabulary. I argue that Gibbard’s case for this conclusion is unconvincing, and poorly motivated by his own expressivist standards. I also argue that even (...) if it were successful, it is doubtful whether the resulting position would count as global expressivism, as Gibbard and I both use that term. (shrink)

This paper discusses the relation between Crispin Wright’s alethic pluralism and my global expressivism. I argue that on many topics Wright’s own view counts as expressivism in my sense, but that truth itself is a striking exception. Unlike me, Wright never seems to countenance an expressivist account of truth, though the materials needed are available to him in his approaches to other topics.

The problem of creeping minimalism concerns how to tell the difference between metaethical expressivism and its rivals given contemporary expressivists’ acceptance of minimalism about truth and related concepts. Explanationism finds the difference in what expressivists use to explain why ethical language and thought has the content it does. I argue that two recent versions of explanationism are unsatisfactory and offer a third version, subject matter explanationism. This view, I argue, captures the advantages of previous views without their disadvantages and gives (...) us a principled and general characterisation of non-representational views about all kinds of language and thought. This thesis engages with three topics and the relationships between them: (i) the phenomenon of disagreement (paradigmatically, where one person makes a claim and another denies it); (ii) the normative character of disagreements (the issue of whether, and in what sense, one of the parties is “at fault” for believing something that’s untrue); (iii) the issue of which theory of what truth is can best accommodate the norms relating belief and truth. People disagree about all sorts of things: about whether (...) climate is changing, death penalty is wrong, sushi is delicious, or Louis C.K. is funny. However, even focusing on disagreements in the evaluative domain (e.g., taste, moral and comedic), where people have the intuition that there is ‘no fact of the matter’ about who is right, there are significant differences that require explanation. For instance, disagreement about taste is generally perceived as shallow. People accept to disagree and live comfortably with that fact. By contrast, moral disagreement is perceived as deep and sometimes hard to tolerate. Comedic disagreement is similar to taste. However, it may involve an element of ‘intellectual snobbery’ that is absent in taste disagreement. The immediate questions are whether these contrasts allow of precise characterization and what is responsible for them. I argue that, once a case is made for the truth-aptness of judgments in these areas, the contrast can be explained in terms of variable normative function of truth – as exerting a lightweight normative constraint in the domain of taste and a stricter constraint in the moral domain. In particular I claim that while truth in the moral domain exerts a sui generis deontic control, this normative feature of truth is silent in both the taste and the comedic domains. This leads me to investigate how to conceive of truth in the light of normative variability. I argue that an amended version of deflationism – minimally inflated deflationism – can account for the normative variability of truth. (shrink)

It is often claimed that there is an explanatory divide between an expressivist account of normative discourse and a realist conception of normativity: more precisely, that expressivism and realism offer conflicting explanations of (i) the metaphysical structure of the normative realm, (ii) the connection between normative judgment and motivation, (iii) our normative beliefs and any convergence thereof, or (iv) the content of normative thoughts and claims. In this paper I argue that there need be no such explanatory conflict. Given a (...) minimalist approach to the relevant metaphysical and semantic notions, expressivism is compatible with any explanation that would be acceptable as a general criterion for realism. Moral Expressivists typically concede that, in some minimal sense, moral sentences are truth-apt but claim that in some more robust sense they are not. The Immodest Disciplined Syntacticist, a species of minimalist about truth, raises a doubt as to whether this contrast can be made out. I here address this challenge by motivating and describing a distinction between reducibly and irreducibly truth-apt sentences. In the light of this distinction the Disciplined Syntacticist must either adopt a more modest version of his (...) theory, friendlier to Expressivism, or substantially modify it, abandoning one of its central conditions on truth-aptness. One natural and promising such modification, the Pure Discipline View, is described and its implications for an understanding of Expressivism briefly discussed. (shrink)

This thesis comprises three main chapters—each comprising one relatively standalone paper. The unifying theme is fragmentalism about truth, which is the view that the predicate “true” either expresses distinct concepts or expresses distinct properties. -/- In Chapter 1, I provide a formal development of alethic pluralism. Pluralism is the view that there are distinct truth properties associated with distinct domains of subject matter, where a truth property satisfies certain truth-characterizing principles. On behalf of pluralists, I propose an account of logic (...) and semantics that shows how they can answer central conceptual and logical challenges for their view. -/- In Chapter 2, I motivate and develop a modal account of propositions on the basis of an iterative conception of propositions, where the modality is logico-mathematical. The modal account of propositions takes the conception to motivate an inherently potential hierarchy of propositions. I show that the account helps provide satisfying solutions to the intensional paradoxes of Russell-Myhill, Kaplan, and Prior. -/- In Chapter 3, I propose that “true” is polysemous. I suggest that “true” is initially polysemous between correspondence truth and disquotational truth, and further polysemous between the meanings corresponding to the subconcepts of the concept truth generated by the indefinite extensibility of that concept. I show that the proposal provides satisfying solutions to the semantic paradoxes. (shrink)

Quasi-realist expressivists have developed a growing liking for minimalism about truth. It has gone almost unnoticed, though, that minimalism also drives an anti-Archimedean movement which launches a direct attack on expressivists’ non-moral self-image by proclaiming that all metaethical positions are built on moral grounds. This interplay between expressivism, minimalism and anti-Archimedeanism makes for an intriguing metaethical encounter. As such, the first part of this dissertation examines expressivism’s marriage to minimalism and defends it against its critics. The second part then turns (...) to the anti-Archimedean challenge to expressivism and shows how to ward off this challenge by securing expressivism’s non-moral, metaethical status without having to abandon minimalism about truth. The aim of this paper is to trace the development of a particular current of thought known under the label ‘pragmatism’ in the last part of the Twentieth century and the beginning of the Twenty-first. I address three questions about this current of thought. First, what is its actual historical development? Second, does it constitute a single, coherent, philosophical outlook? Third, in what form, if any, does it constitute an attractive philosophical outlook. In the course of addressing these questions I (...) identify a potential tension between the two main proponents of this current of thought (Huw Price and Simon Blackburn), namely the attitude they take to what I refer to as their ‘naturalist master narrative’. While historically prominent theories of truth such as the correspondence theory, coherentism, pragmatism, verificationism, and instrumentalism diverge in many ways, they converge in at least one fundamental respect. They are all monist theories of truth. They incorporate the thesis that there is one property—and one property only—in virtue of which propositions can be true. The truth pluralist, on the other hand, rejects this idea. There are several properties in virtue of which propositions can be true. This article offers a survey (...) of recent work on alethic pluralism—presenting various incarnations of the view, objections leveled against them, and various lines of response available to pluralists. According to a widespread interpretation, in the Investigations Wittgenstein adopted a deflationary or redundancy theory of truth. On this view, Wittgenstein’s pronouncements about truth should be understood in the light of his invocation of the equivalences ‘p’ is true = p and ‘p’ is false = not p. This paper shows that this interpretation does not do justice to Wittgenstein’s thoughts. I will be claiming that, in fact, in his second book Wittgenstein is returning to the pre-Tractarian notion of bipolarity, (...) and that his new development of this notion in the Investigations excludes the redundancy-deflationary reading. Wittgenstein’s thoughts about truth are instead compatible with another interpretative option: Wittgenstein remains faithful to his methodological pronouncements, and he merely presents us with platitudes about the notions of “true” and “false”. Many philosophers believe that judgments about propositional attitudes, or about which mental states are expressed by which sentences, are normative judgments. If this is so, then metanormative expressivism must be given expressivist treatment. This might seem to make expressivism self-defeating or worrisomely circular, or to frustrate the explanatory ambitions central to the view. I argue that recent objections along these lines to giving an expressivist account of expressivism are not successful. I shall also suggest that in order to deal with (...) these worries, Dreier's influential response to the so-called ‘problem of creeping minimalism’ must be slightly revised. (shrink)

This paper explores how consideration of the notions of naturalness and eligibility, which have played an increasingly significant role in contemporary metaphysics, might impact on the study of truth. In particular, it aims to demonstrate how taking such notions seriously may be of benefit to ‘representational’ theories of truth by showing how the naturalness of truth on a representational account provides a response to the ‘Scope Problem’ presented by Lynch (2009).

Although it is obvious that much of language is representational, it is occasionally denied. I have attended conference papers attacking the representational view of language given by speakers who have in their pockets pieces of paper with writing on them that tell them where the conference dinner is and when the taxis leave for the airport.
