In this discussion, the author asks the question if Oakeshott’s famous depiction of a practice might be understood in relation to contemporary cognitive science, in particular connectionism (the contemporary cognitive science approach concerned with the problem of skills and skilled knowing) and in terms of the now conventional view of "normativity" in Anglo-American philosophy. The author suggests that Oakeshott meant to contrast practices to an alternative "Kantian" model of a shared tacit mental frame or set of rules. If cognitive science, (...) in its connectionist forms, allows us to give a naturalistic though nonreductive sense to his words, Oakeshott, like other philosophers who have employed the concept of tradition, expanded his discussion into a broader reconsideration of the nature of theorizing, a metaphilosophy. And this extension can be understood in relation to such recent thinkers as McDowell and, in particular, to the problem of the acquisition of the normative. This paper makes the non-monotonicity of a wide range of moral reasoning the basis of a case for particularism. Non-monotonicity threatens practical decision with an overwhelming informational complexity to which a form of ethical generalism seems the best response. It is argued that this impression is wholly misleading: the fact of non-monotonicity is best accommodated by the defence of four related theses in any theory of justification. First, the explanation of and defence of a default/challenge model of justification. Secondly, the (...) development of a theory of epistemic status and an explanation of those unearned entitlements that accrue to such status. Thirdly, an explanation of the basis of epistemic virtues. Finally, an account must be given of the executive capacity of rational decision itself as a ‘contentless ability’. This overall set of views can accommodate a limited role for generalizations about categories of evidence, but not such as to rescue a principled generalism. In particular, the version of particularism defended here explains why one ought not to accept the principled holism that has proved to be a problem for Dancy’s form of particularism. Ethics certainly involves hedged principles. However, principles cannot be self-hedging: there cannot be a that’s it operator in a principle as Richard Holton has claimed that there can be. Practical reasoning is concluded by the categorical detachment of the action-as-conclusion itself. (shrink)

The challenges that normative redundancies and normative conflicts pose to legal theory have been traditionally addressed by either altering the rules that trigger them, or by including preference rules that deactivate them. As an alternative to these routes, this paper argues that the problems with both redundancies and conflicts only arise as a consequence of a mistaken understanding of legal reasoning that ignores the material relations between the rules at issue. The problem of establishing the best interpretation of a speech act is of fundamental importance in argumentation and communication in general. A party in a dialogue can interpret another’s or his own speech acts in the most convenient ways to achieve his dialogical goals. In defamation law this phenomenon becomes particularly important, as the dialogical effects of a communicative move may result in legal consequences. The purpose of this paper is to combine the instruments provided by argumentation theory with the (...) advances in pragmatics in order to propose an argumentative approach to meaning reconstruction. This theoretical proposal will be applied to and tested against defamation cases at common law. Interpretation is represented as based on a hierarchy of interpretative presumptions. On this view, the development of the logical form of an utterance is regarded as the result of an abductive pattern of reasoning in which various types of presumptions are confronted and the weakest ones are excluded. Conflicts of interpretations and equivocation become essentially interwoven with the dialectical problem of fulfilling the burden of defeating a presumption. The interpreter has a burden of explaining why a given presumption is subject to default, assuming that the speaker is reasonable and acting based on a set of shared expectations. (shrink)

“Morality is relative to culture” is a descriptive claim; many people in many different cultures have different moral beliefs. When one adopts moral relativism, however, the claim accrues a normative dimension, in that what follows from relativity is the flattening out of rightness, of one moral belief being better than another regardless of culture. But in practice, humans rarely, if ever, actually behave as if certain things or beliefs are not better than others, as evidenced in everything from foreign policy (...) to religion to consumption choices. A wave of recent philosophical work on practical rationality is organized by the following implicit argument: Practical reasoning is figuring out what to do; to do is to act; so the forms of practical inference can be derived from the structure or features of action. Now it is not as though earlier work, in analytic philosophy, had failed to register the connection between action and practical rationality; in fact, practical reasoning was usually picked out as, roughly, reasoning directed toward action. (...) But for much of the twentieth century, attention moved quickly away from this initial delineation of the subject area, to the interplay of beliefs and desires within the mind (Humean theories, including their Davidsonian and Williamsian variants), or to procedures for checking that a plan of action was supported by sufficient yet consistent reasons (Kantian theories), or to the ultrarefined sensibilities of the practically intelligent reasoner (Aristotelian theories). The hallmark of the emerging family of treatments to be surveyed here is, first, the sustained attention paid to answering the question, "What does it take to be an action (at all)?", and second, the use made of a distinction between full-fledged action and its lesser relatives. (Characterizations and terminology vary, but often the less robust alternative is called "mere activity" or "mere behavior".) Very schematically, these arguments for a theory of practical reasoning try to show that reasons brought to bear on choice must have some particular logical form, if action is not to lapse into something less than that. The entry is intended as an advanced introduction to the topic of knowledge-how. It starts with a list of overviews, monographs and collections, followed by selected 20th century discussions. The last two sections contain sources pertaining to Ryle's own work on the topic as well as work by other influential thinkers, and themes that are sometimes associated with knowledge-how. The remaining seven sections survey the contemporary literature on knowledge-how from three perspectives: (i) generic desiderata for accounts of knowledge-how, (ii) specific (...) topics that are already well-entrenched in the tradition of particular subdisciplines and (iii) second-order controversy regarding distinct assumptions and tools employed by the debaters. This thesis studies the role of conceptual content in inference and reasoning. The first two chapters offer a theoretical and historical overview of the relation between inference and meaning in philosophy and psychology. In particular, a critical analysis of the formality thesis, i.e., the idea that rational inference is a rule-based and topic-neutral mechanism, is advanced. The origins of this idea in logic and its influence in philosophy and cognitive psychology are discussed. Chapter 3 consists of an analysis of the (...) relationship between inference and representation. It is argued that inference has to be studied from a pluralistic per- spective due to its dependence on different formats of representing information. The following four chapters apply conceptual spaces, a formal theory of concepts within cognitive semantics, to three concept-based inference-types. First, an explication of Sellars notion of material inference is advanced. Later, the model is extended to account for nonmonotonic inference by studying the role expectations in reasoning. Finally, a conceptual space-model of category-based induction is presented. This model predicts most of the empirical properties of this psychological phenomenon and subsumes some of the previous theories in psychology. It is stated that the explanatory fruitfulness of this new approach is evidence for the failure of the formality thesis and calls for a unified model of rational inference that puts semantics at center stage. The last chapter of the thesis discusses how inference and concepts interact in scientific reasoning, which makes constant use of hybrid symbolic structures for representing conceptual information. Stephen Toulmin’s notions of method of representation and inferential technique are developed and applied in a case study about the emergence of the notion of instantaneous speed during the passage from geometrical physics to analytical mechanics. It is claimed that this analysis provides support to the pluralistic perspective for theorizing about reasoning. (shrink)

In the tradition stemming from Aristotle through Aquinas, rational decision making is seen as a complex structure of distinct phases in which reasoning and will are interconnected. Intention, deliberation, and decision are regarded as the fundamental steps of the decision-making process, in which an end is chosen, the means are specified, and a decision to act is made. Based on this Aristotelian theoretical background, we show how the decision-making process can be modeled as a net of several patterns of reasoning, (...) involving the classification of an action or state of affairs, its evaluation, the deliberation about the means to carry it out, and the decision. It is shown how argumentation theory can contribute to our understanding of the mechanisms involved by formalizing the steps of reasoning using argumentation schemes, and setting out the value-based criteria underlying the evaluation of an action. Representing each phase of the decision-making process as a separate scheme allows one to identify implicit premises and bring the roots of ethical dilemma to light along with the means to resolve them. In particular, we will show the role of framing and classification in triggering value-based reasoning, and how argumentation theory can be used to represent and uproot the grounds of possible manipulations. A través de un análisis de los requisitos normativos de la racionalidad que gobiernan los compromisos individuales, se muestra que los agentes poseen autoridad racional para revaluar sus razones, modificar sus juicios prácticos y cambiar sus intenciones. De esta autoridad depende su autonomía racional: uno y el mismo sujeto puede obligarse a hacer algo, y revocar esta orden. Mediante un compromiso social, el deudor renuncia a su (...) autoridad y autonomía racionales en favor del acreedor, generando así una obligación en el deudor, un derecho en el acreedor, y una razón normativa relativa al deudor.
