  1. On the Limits of Political Emancipation and Legal Rights.Peter D. Burdon - 2019 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 34 (2):319-339.
In this paper I offer a new interpretation of Marx’s essay On the Jewish Question which re-states its key ideas but removes unnecessary debates that are not relevant to current political and legal problems. Because OJQ is a demonstration of critique it does not offer positive proscriptions or suggestions for change. Its utility, I argue, lies in the way it can help us think about the limits of resolving deeply entrenched power-relations without a thoroughgoing engaging of how those powers are (...)

  • Feminism Against Crime Control: On Sexual Subordination and State Apologism.Koshka Duff - 2018 - Historical Materialism 26 (2):123-148.
Its critics call it ‘feminism-as-crime-control’, or ‘Governance Feminism’, diagnosing it as a pernicious form of identity politics. Its advocates call it taking sexual violence seriously – by which they mean wielding the power of the state to ‘punish perpetrators’ and ‘protect vulnerable women’. Both sides agree that this approach follows from the radical feminist analysis of sexual violence most strikingly formulated by Catharine MacKinnon. The aim of this paper is to rethink the Governance Feminism debate by questioning this common presupposition. (...)

  • Lineages of Capital.Neeladri Bhattacharya - 2013 - Historical Materialism 21 (4):11-35.
Banaji’s essays offer a powerful plea for a renewal of Marxism, a passionate argument to emancipate Marxism from the dead weight of vulgar traditions – with their simplifications, forced abstractions, mechanical reductions, generalised a-historical theorising, and familiar teleologies. To reinvigorate Marxism, argues Banaji, it is essential to use theory creatively, and recognise the need for complexity in thinking about categories. We cannot generalise about modes of production simply by referring to the forms of labour exploitation in the abstract: associate serfdom (...)

  • Dialogue as a Governmental Technique: Managing Gendered Islam in Germany.Schirin Amir-Moazami - 2011 - Feminist Review 98 (1):9-27.
Throughout the last decades, state and civil society actors in Germany have undertaken a number of initiatives in order to enter into a structured conversation with Muslim communities, and to find spokespersons who serve as partners for political authorities. This process has commonly been analysed in terms of its empowering effects for Muslims via the emerging ‘institutionalisation’ of Islam. The modes and techniques of power at stake in this process have yet often been undermined. Through the lens of Foucault's concept (...)

  • Jurisdictions of Sexual Assault: Reforming the Texts and Testimony of Rape in Australia. [REVIEW]Peter D. Rush - 2011 - Feminist Legal Studies 19 (1):47-73.
The reform of rape law remains a vexed enterprise. The wager of this article is that the plural traditions and technologies of criminal law can provide the resources for a radical rethinking of rape law. Parts 1 and 2 return to the historical and structural forms of rape law reform in Australia. These forms of reform illustrate a variety of criminal jurisdictions, and a transformation in the way in which rape law reform is conducted now. Against this transformation, Part 3 (...)

  • Estranged Bodies: Shifting Paradigms and the Biomedical Imaginary.Deborah Lynn Steinberg & Margrit Shildrick - 2015 - Body and Society 21 (3):3-19.
This introductory article provides a contextual and theoretical overview to this special issue of Body & Society. The special issue presents five selected case studies – focusing on the contexts of transplantation, psychiatry, amputation and war, and a transvalued media ecology of cancer – to offer meditations on a number of interlinked questions. The first of these is the entanglement of biomedical governance – political/economic as well as self-disciplinary – with the nexus of estrangement, which can denote both the distancing (...)

  • Before Identity, Gender and Human Rights.Andreas Philippopoulos-Mihalopoulos - 2006 - Feminist Legal Studies 14 (3):271-291.
This is the beginning of an exploration of before as the thesis ‘before’ (temporally) and ‘be-fore’ (spatially) difference. Before denotes the origin and the desired destination. Before (in the double sense of ‘before’ and ‚be-in-the-fore’) opens up a space of pre-difference, of origin and of forgotten memory, as well as a space of desire, objective, illusion of teleology, unity, completion. Applied to the two domains of Human Rights and Sex/Gender, the space of ‘before’ yields two slightly different vistas: in human (...)
