This article aims to refute the “incompatibility thesis” that nationalism is incompatible with transnational feminist solidarity, as it fosters exclusionary practices, xenophobia, and racism among feminists with conflicting nationalist aspirations. I examine the plausibility of the incompatibility thesis by focusing on the controversy regarding just reparation for Second World War “comfort women,” which is still unresolved. The Korean Council at the center of this controversy, which advocates for the rights of Korean former comfort women, has been criticized for its strident (...) nationalism and held responsible for the stalemate. Consequently, the case of comfort women has been thought to exemplify the incompatibility thesis. I argue against this common feminist perception in three ways: first, those who subscribe to the incompatibility thesis have misinterpreted facts surrounding the issue; second, the Korean Council's nationalism is a version of “polycentric nationalism,” which avoids the problems of essentialist nationalism at the center of feminist concerns; and, third, transnational feminist solidarity is predicated on the idea of oppressed/marginalized women's epistemic privilege and enjoins that feminists respect oppressed/marginalized women's epistemic privilege. To the extent that oppressed/marginalized women's voices are expressed in nationalist terms, I argue that feminists committed to transnational feminist solidarity must accommodate their nationalism. This paper focuses on demands for reparations for colonial slavery and their public reception in France. It argues that this bottom-up, context-sensitive approach to theorising reparations enables us to formulate a critical republican theory of international racial justice. It contrasts the critical republican perspective on reparations with a nation-state centred approach in which reparations activists are accused of threatening the French republic’s sense of homogeneity and unity, thus undermining the national narrative on the French identity. It also rejects the liberal (...) egalitarian perspective, which itself rejects reparations in favour of focusing on present disadvantages. In so doing, this paper illustrates how the notion of non-domination offers a superior way of conceptualising global racial injustices compared to more traditional distributive outlooks. (shrink)

ABSTRACTThe incorrect conceptualization and evaluation of reparations for colonial slave trade and slavery within the legal, as opposed to the political, domain, produces an interpretation of the demands in France that views them as morally absurd and politically deleterious. I’ll use Iris Marion Young’s distinction between a liability model and a social connection model of responsibility to suggest that the moral claim according to which we can be held responsible today for redressing the structural injustices inherited from slave trade and (...) slavery is not irrational, nor motivated by a political will to divide the body politic between blamed perpetrators and innocent victims. I’ll first analyze the difficulties posed by the liability model by focusing on a specific legal case, MIR and CMDP vs. French state. Then I’ll argue that using a political model of responsibility solves conceptual and normative issues and allows us to understand why, and to what extent, we are responsible for redressing the structural racial injustice that endures in French society. In this article, I critically reassess Iris Marion Young's late works, which centre on the distinction between liability and social connection responsibility. I concur with Young's diagnosis that structural injustices call for a new conception of responsibility, but I reject several core assumptions that underpin her distinction between two models and argue for a different way of conceptualising responsibility to address structural injustices. I show that Young's categorical separation of guilt and responsibility is not supported by the writings of Hannah (...) Arendt, which Young draws on, and that it is also untenable on independent systematic grounds. Furthermore, I argue that several of Young's other criteria fail to clearly demarcate two distinct phenomena. I therefore propose to transcend Young's distinction between two models in favour of a related, but conceptually different distinction between two forms of responsibility: interactional and structural. Embracing this terminology facilitates the conceptualisation of the general features of responsibility that are shared by both forms, including their retrospective and prospective time-direction and their applicability to individual, joint and group agency. The distinction between interactional and structural responsibility also yields a more compelling general account of the role of background structures, and of blame within ascriptions of political responsibility. This article argues that all-affected principle needs to be reconceptualized to account for the differences in the historical and current social position of those who are or who should be making legitimacy claims. Drawing on Butler’s theory of vulnerability, this article advances a new and more robust all-affected principle that affords a stronger claim to legitimacy to those most-deeply affected by both the current decision in question and the historical process and practices shaping the choices available. In particular, this article (...) identifies three sets of exclusions of groups and claims that drive this reformulation: first, cases of historical injustice such as indigenous peoples; second, cases of current processes of minoritization which silence or render some groups and opinions as marginal such as women, ethnic minorities or even people in lower economic classes; and third, cases of state establishment of boundaries and ‘worthy’ citizenship such as refugees making claims for relocation and asylum. This paper examines caregiving for sick older family members in the context of socio‐economic transformations in rural China, combining empirical investigation with normative inquiry. The empirical part of this paper is based on a case study, taken from fieldwork in a rural Chinese hospital, of a son who took care of his hospitalized mother. This empirical study highlighted family members’ weiqu (sense of unfairness)—a mental status from experiencing mistreatment and oppression in family care, yet with constrained power to explicitly protest (...) or make care‐related choices. Underpinning people’s weiqu and constrained choice, as informed by the conception of structural injustice, is the impact of unjust social structures, organized by unfavourable norms, discriminatory social policies and institutions targeting rural populations. By restraining individual choices and capacities in supporting health care for aging populations, these unjust structures create additional difficulties for and discriminations against rural families and their older members. Some policy recommendations are proposed to mitigate structural injustice so as to empower families and promote care for older people in rural settings. (shrink)

I argue that if we claim colonialism is per se wrong, then we face a dilemma that stems from the fact that many states today are a result of past colonialism. We believe that postcolonial states have a right to self-determination such that it is wrong to colonize them. But this entails that there is a process that can turn a colonial state into a rightful state, and so we admit that there is a way to carry out colonialism that (...) is not wrongful. To avoid this conclusion, we must accept that the wrongness of colonialism has been superseded or remedied. These options either entail instrumentalism, which admits that colonialism is not per se wrong, or they are implausible. (shrink)

ABSTRACT Stephen Gardiner’s A Perfect Moral Storm offers an in-depth analysis of the ethical facets of climate change. In this paper, I contend that he nonetheless overlooks an important structural layer to climate vulnerabilities and injustices because he analyzes them implicitly interactional. I argue that climate change should rather be understood as a form of structural injustice as outlined by Iris M. Young. In this reading, the unjust socio-economic structural processes that give rise to climate change, the production and consumption (...) of fossil fuel energy, are at their core marked by (i) oppressive and dominating power relations that position agents (ii) intersecting with other structural constraints. Crucially, (iii) these structural processes arose historically, persist over time, and entrench the burden on those suffering in the future. This viewpoint improves our understanding of how the climate crisis unfolds over time in a way that augments Gardiner’s analysis. The structural approach can advance the climate justice debate both theoretically and practically. (shrink)

If a state commits injustice, who is responsible for compensating its victims and safeguarding against future wrongdoing? Do the state’s citizens bear this responsibility? Do they all bear it equally? Avia Pasternak's and Holly Lawford-Smith's recent books address these pressing questions. Each book represents a thought-provoking attempt to derive an account of citizen responsibility for state wrongs from an account of state agency understood as group agency. Though the books demonstrate the promise of this approach to produce action-guiding advice for (...) real policymakers, they also demonstrate its limitations—in particular, its lack of attention to social structures. Here, I argue that Pasternak's and Lawford-Smith's views would be enriched by further engagement with the literature on structural injustice, which takes individuals’ perpetuation of social systems (not their implication in acts of group agency) as a central source of their remedial obligations. Through critical engagement with Pasternak and Lawford-Smith, I illustrate how a structural injustice framework could yield more attractive conclusions than a group agency framework in certain cases, better explain non-culpable forms of citizen responsibility, and allow us to theorize citizen responsibility for state action without making questionable claims about the metaphysics or social ontology of group agency. The concept of “structural injustice” has a long intellectual lineage, but Iris Marion Young popularised the term in her late work in the 2000s. Young’s theory tapped into the zeitgeist of the time, providing a credible way of thinking about transnational and domestic injustices, illuminating the importance of political, economic and social structures in generating injustice, theorising the role of individuals in perpetuating structural injustice, and the responsibility of everyone to try to correct it. Young’s theory has inspired secondary and (...) novel research. In this paper, I outline the main topics in this recent literature: what structural injustice is, responsibility for structural injustice, acting on responsibility, avoiding responsibility, and historical injustice. I conclude by noting how the influence of structural injustice theory is spreading beyond the confines of political theory. Any field that is concerned with structural inequalities, disadvantage, or oppression, can utilize structural injustice theory. (shrink)

This review essay discusses two recent attempts to reform the framework in which issues of international and global justice are discussed: Iris Marion Young's ?social connection' model and the practice-dependent approach, here exemplified by Ayelet Banai, Miriam Ronzoni and Christian Schemmel's edited collection. I argue that while Young's model may fit some issues of international or global justice, it misconceives the problems that many of them pose. Indeed, its difficulties point precisely in the direction of practice dependence as it is (...) presented by Banai et al. I go on to discuss what seem to be the strengths of that method, and particularly Banai et al.'s defence of it against the common claim that it is biased towards the status quo. Some believe that the mere beneficiaries of wrongdoing of others ought to disgorge their tainted benefits. Others deny that claim. Both sides of this debate concentrate on unavoidable beneficiaries of the wrongdoing of others, who are presumed themselves to be innocent by virtue of the fact they have neither contributed to the wrong nor could they have avoided receiving the benefit. But as we show, this presumption is mistaken for unavoidable beneficiaries who intend in certain ways to benefit from wrongdoing, (...) and who have therefore done something wrong in forming and acting on such an intention. Structural injustice is either wrong or not. A deontic view, on which there is no injustice except agents’ wrongdoing, may have trouble reaching such intuitive cases as structural sexism, and especially structural class inequality. An alternative telic approach, on which injustice is bad but not wrong, can reach those cases. But how could injustice in that telic sense warrant resentment or righteous anger, as it seems injustice must? I press the dilemma to scrutinize not only the current idea of structural (...) injustice but also a wider swath of views about justice, and I critically consider possible ways out of it. (shrink)

The traditional blackface character Black Pete has been at the center of an intense controversy in the Netherlands, with most black citizens denouncing the tradition as racist and most white citizens endorsing it as harmless fun. I analyze the controversy as an utter failure, on the part of white citizens, of what Alison Jaggar has called multicultural literacy. This article aims to identify both the causes of this failure of multicultural literacy and the conditions required for multicultural literacy to be (...) possible. I argue that this failure of multicultural literacy is due to hermeneutical injustice and to white ignorance. I close by considering possible avenues for fostering multicultural literacy. (shrink)

The current debate on why colonialism is wrong overlooks what is arguably the most discernible aspect of this particular historical injustice: its exreme violence. Through a critical analysis of the recent contributions by Lea Ypi, Margaret Moore and Laura Valentini, this article argues that the violence inflicted on the victims and survivors of colonialism reveals far more about the nature of this historical injustice than generally assumed. It is the arbitrary nature of the power relations between colonizers and the colonized (...) which is at the heart of the injustice of colonization, and violence was the way arbitrariness and domination was cemented. The example of colonialism in the Caribbean during the 16th and 17th centuries is used to expose the full extent of this historical injustice. (shrink)

It has often been argued that charitable donations are not a sufficient response to global poverty; individuals need to address structural injustice. Proponents of the Effective Altruism (EA) movement have raised two main problems with this focus on structural injustice. In this paper, we respond to these concerns. The first problem raised by EA proponents is that focusing on structural injustice absolves individuals of any responsibility other than political ones. In response, we argue that discharging this duty requires more commitment (...) than EA defenders think, and we do so by framing individual responsibility in global structural injustice through the lens of Robin Zheng’s Role-Ideal Model (RIM). The second response given by EA proponents is that a focus on structural injustice does not provide concrete ways for any given individual to discharge such duties. To address this worry, we argue that RIM can be complemented with the Rawlsian account of moral maturation. This new framework makes it clear how individuals can form the right concept of justice and become responsible citizens who act in accordance with RIM. (shrink)

In discussions about responsibility for climate change, it is often suggested that the historical use of natural resources is in some way relevant to our current attempts to address this problem fairly. In particular, both theorists and actors in the public realm have argued that historical high-emitters of greenhouse gases (GHGs) – or the beneficiaries of those emissions – are in possession of some form of debt, deriving from their overuse of a natural resource that should have been shared more (...) equitably. These accounts of what might be termed ‘natural debt’ generally focus on one particular natural resource (global GHG sink capacity); invoke a principle of justice by which rights to consume this resource should have been allocated (most commonly, equal per capita shares); and then argue that historical violations of this principle give rise to certain rectificatory duties in the present (generally, duties on the part of those who have historically consumed an excessive amount of the world’s GHG sink capacity, or who have benefitted from such excess consumption, to offer some form of compensation to those who have not – such compensation usually taking the form of emission credits or cash). Though many seem to find it intuitively plausible that historical high-emissions have incurred some form of debt, significant challenges arise in rendering the concept of natural debt both coherent and defensible. Such problems are not, however, my focus in this piece. Instead, I here suggest that discussions about historical responsibility for climate change commonly fail to recognise certain other past injustices concerning natural resources that appear to hold contemporary relevance. In particular, I argue that it is not just the unequal consumption of global GHG sink capacity that may be of moral significance here; but also the way in which the world’s resources have more generally been governed.
