This introductory article describes the phenomena of incommensurability and incomparability, how they are related, and why they are important. Since incomparability is the more significant phenomenon, the paper takes that as its focus. It gives a detailed account of what incomparability is, investigates the relation between the incomparability of values and the incomparability of alternatives for choice, distinguishes incomparability from the related phenomena of parity, indeterminacy, and noncomparability, and, finally, defends a view about practical justification that vindicates the importance of (...) incomparability — assuming it exists — for practical reason. This open access book provides the first explicit case study for an application of the method of reflective equilibrium (RE), using it to develop and defend a precautionary principle. It thereby makes an important and original contribution to questions of philosophical method and methodology. The book shows step-by-step how RE is applied, and develops a methodological framework which will be useful for everyone who wishes to use reflective equilibrium. With respect to precautionary principles, the book demonstrates how a rights-based precautionary (...) principle can be constructed and defended. The case study succeeds in demonstrating that RE can be successfully applied and puts real constraints on the justification process. This is all the more remarkable as the case study was designed as an open-ended process, without presupposing any specific results. This chapter lays out what we take to be the main types of justice and ethical challenges concerning those adverse effects of climate change leading to climate-related Loss and Damage (L&D). We argue that it is essential to clearly differentiate between the challenges concerning mitigation and adaptation and those ethical issues exclusively relevant for L&D in order to address the ethical aspects pertaining to L&D in international climate policy. First, we show that depending on how mitigation and adaptation are distinguished (...) from L&D, the primary focus of policy measures and their ethical implications will vary. Second, we distinguish between a distributive justice framework and a compensatory justice scheme for delivering L&D measures. Third, in order to understand the differentiated remedial responsibilities concerning L&D, we categorise the measures and policy approaches available. Peter Singer’s defense of the duty to aid the world’s poor by the pond analogy is self-defeating. It cannot be both true that you ought to save the drowning child from a pond at the expense of ruining your shoes and that you ought to aid the world’s poor if you thereby do not sacrifice anything of comparable moral importance. Taking the latter principle seriously would lead you to let the child in front of you drown whenever you could thereby (...) save more children in the developing world. Though Singer can defend the duty to aid the world’s poor starting from consequentialist principles requiring you to make things go best in the impartial sense, he cannot have it invoking the commonsense judgment about what you ought to do in the pond case. There is no sound path from commonsense morality to Singer’s principles of beneficence. (shrink)

The Precautionary Principle (PP) is an influential principle of risk management. It has been widely introduced into environmental legislation, and it plays an important role in most international environmental agreements. Yet, there is little consensus on precisely how to understand and formulate the principle. In this paper I prove some impossibility results for two plausible formulations of the PP as a decision-rule. These results illustrate the difficulty in making the PP consistent with the acceptance of any trade-offs between catastrophic risks (...) and more ordinary goods. (shrink)

One of the main lines of research in algorithmic fairness involves individual fairness (IF) methods. Individual fairness is motivated by an intuitive principle, similar treatment, which requires that similar individuals be treated similarly. IF offers a precise account of this principle using distance metrics to evaluate the similarity of individuals. Proponents of individual fairness have argued that it gives the correct definition of algorithmic fairness, and that it should therefore be preferred to other methods for determining fairness. I argue that (...) individual fairness cannot serve as a definition of fairness. Moreover, IF methods should not be given priority over other fairness methods, nor used in isolation from them. To support these conclusions, I describe four in-principle problems for individual fairness as a definition and as a method for ensuring fairness: (1) counterexamples show that similar treatment (and therefore IF) are insufficient to guarantee fairness; (2) IF methods for learning similarity metrics are at risk of encoding human implicit bias; (3) IF requires prior moral judgments, limiting its usefulness as a guide for fairness and undermining its claim to define fairness; and (4) the incommensurability of relevant moral values makes similarity metrics impossible for many tasks. In light of these limitations, I suggest that individual fairness cannot be a definition of fairness, and instead should be seen as one tool among several for ameliorating algorithmic bias. (shrink)

Metanormativists hold that moral uncertainty can affect how we ought, in some morally authoritative sense, to act. Many metanormativists aim to generalize expected utility theory for normative uncertainty. Such accounts face the “easy problem of intertheoretic comparisons”: the worry that distinct theories’ assessments of choiceworthiness are incomparable. The easy problem may well be resolvable, but another problem looms: while some moral theories assign cardinal degrees of choiceworthiness, other theories’ choiceworthiness assignments are merely ordinal. Expected choiceworthiness over such theories is undefined. (...) Call this the “hard problem of intertheoretic comparisons.” This paper argues that to solve the hard problem, we should model moral theories with imprecise choiceworthiness. Imprecise choiceworthiness assignments can model incomplete cardinal information about choiceworthiness, with precise cardinal choiceworthiness and merely ordinal choiceworthiness as limiting cases. Generalizing familiar decision theories for imprecise choiceworthiness to the case of moral uncertainty generates puzzles, however: natural generalizations seem to require reifying parts of the model that don’t correspond to anything in normative reality. I discuss three ways of addressing this problem: by demystifying the reified elements by using them as promiscuously as possible; by constructing alternative decision theories that don’t require the troublesome elements; and by employing an alternative model of metanormative decision problems, and of moral uncertainty generally. There is a concern about the effectiveness of petitionary prayer. If I pray for something good, wouldn’t God give it to me anyway? And if I pray for something bad, won’t God refrain from giving it to me even though I’ve asked? This problem has received significant attention. The typical solutions suggest that the prayer itself can alter whether something is good or bad. I will argue that this is insufficient to fully address the problem, but also that the problem (...) requires another assumption which can be doubted, thereby opening up a new way to solve the problem. Public-policy choices frequently have to be carried out in the presence of incommensurabilities. These incommensurabilities may manifest themselves in the form of incompleteness—that is, some of the options under consideration are not comparable by a decision maker. As a consequence, it may be impossible to select policies that are at least as good as all competing proposals. When faced with incommensurabilities of this nature, transitivity can be considered too demanding a requirement. An attractive weakening of transitivity consists of a property (...) that Kotaro Suzumura (Economica, 43:381–390, 1976) introduced under the label of consistency. Suzumura consistency postulates that goodness cycles with at least one instance of betterness are to be avoided thus strengthening the well-known acyclicity condition that precludes the existence of betterness cycles. The property is compared to alternative weakenings of transitivity, and it is shown that it has numerous advantages over other contenders. For instance, Suzumura consistency is precisely what is needed to avoid a money pump. The issue of rational choice in the context of public decision-making is discussed in order to provide an illustration of the usefulness of Suzumura consistency. (shrink)

This paper offers one formal reason why it may often be inappropriate to hold, of two conflicting desires, that the first must be weaker than, stronger than, or of the same strength as the second. The explanation of this fact does not rely on vagueness or epistemological problems in determining the strengths of desires. Nor does it make use of the problematic notion of incommensurability. Rather, the suggestion is that the motivational capacities of many desires might best be characterized by (...) two values, neither of which should be interpreted as strength. (shrink)

Most people believe that death is bad for the one who dies. Much attention has been paid to the Epicurean puzzle about death that the rests on a tension between that belief and another—that death is the end of one’s existence. But there is nearby puzzle about death that philosophers have largely left untouched. This puzzle rests on a tension between the belief that death is bad for the one who dies and the belief that that death is not the (...) end of one’s existence. Many philosophers have responded to the Epicurean puzzle with the deprivation account of the badness of death, which seeks to make sense of the badness of death given that there is no life after death. This paper focus on the other puzzle, and advances the argument that the deprivation account can also make sense of the badness of death given that there is life after death. (shrink)

According to normative pluralists there are no truths about what one ought simpliciter to do, only truths about what one ought to do according to some normative system or stand-point. In contrast with conceptual normative pluralists who argue for this conclusion on the basis that the concept of an ought simpliciter is somehow defective, non-conceptual normative pluralists defend this conclusion on first-order grounds. Non-conceptual normative pluralism has recently received a book-length defence by Mathea Slåttholm Sagdahl. In this article I critique (...) Sagdahl’s defence of non-conceptual normative pluralism. Firstly, I challenge Sagdahl’s attempt to motivate non-conceptual normative pluralism by appealing to Henry Sidgwick’s work on the dualism of practical reason. Secondly, I criticise her response to the most prominent argument against non-conceptual normative pluralism in the philosophical literature, the argument from nominal-notable comparisons. Thirdly, I explore the possibility of a view similar to Sagdahl’s position but which accepts the ought simpliciter. (shrink)

This paper defends the claim that if a person P exists, there can be true positive comparisons between P's existence and P's never having existed at all in terms of what is better or worse for P. If correct, this view will have significant implications for various fundamental issues in population ethics. I try to show how arguments to the contrary fail to take note of a general ambiguity in comparisons when compared alternatives contain their own different standards (or, in (...) the case of non-existence, a lack thereof) on which to base these comparisons. After having answered arguments against the possibility of making positive comparisons, the paper develops a positive account of how to make existence/non-existence comparisons in terms of personal value whilst accepting that a person's non-existence fails to make any contact with the relevant categories of personal value. The guiding idea is the following: When some item satisfies some relevant standard, we can, I argue, infer that it satisfies this standard better than something that fails to satisfy this standard (be this failure due to empirical or conceptual reasons). In the paper, I aim to reconstruct a charitable interpretation of Durkheimian utilitarianism, a normative theory of public morality proposed by well-recognised American moral psychologist – Jonathan Haidt, which might provide reasons to justify particular legal regulations and public policies. The reconstruction contains a coherent theory that includes elements of rule-utilitarianism, value pluralism, objective list theory and perfectionism, as well as references to Emile’s Durkheim views on human nature. I also compare Durkheimian utilitarianism with two similar theories – Brad Hooker’s (...) rule consequentialism and Krzysztof Saja’s institutional function consequentialism. (shrink)

Many contemporary accounts of normative reasons for action accord a single strength value to normative reasons. This paper first uses some examples to argue against such views by showing that they seem to commit us to intransitive or counterintuitive claims about the rough equivalence of the strengths of certain reasons. The paper then explains and defends an alternate account according to which normative reasons for action have two separable dimensions of strength: requiring strength, and justifying strength. Such an account explains (...) our intuitions in the cases that make trouble for single-value views. The justifying/requiring account is compared with two other solutions that have been offered to justify and explain our intuitions about these sorts of cases. These other solutions appeal to the notions of incommensurability of reasons, and to second-order normative entities called `exclusionary permissions'. It is argued that the justifying/requiring distinction provides a superior solution. (shrink)

ABSTRACTConfucianism tends to play only a marginal role in current theorizing about justice, which is a global pursuit dominated by Western theory and its strong tendency to assume that justice refers to some substantive conception of distributive, socioeconomic justice. This article examines and compares reconstructions of Confucian justice by Joseph Chan, May Sim, and Fan Ruiping. Each reconstruction makes reference to both classical and modern Western justice theory and thus each involves a comparative approach; indeed, each reconstruction seeks ultimately, in (...) its own distinctive fashion, to present a version of Confucian justice that is comparable with modern Western justice theory. In this article we assess, critically and comparatively, the tertium comparationis and the arguments in each reconstruction. Los principales objetivos son: 1) identificar la estructura formal de las situaciones de compromiso en las que alguna decisión de compromiso es inevitable, incluyendo CDs que ponen en riesgo la integridad del decisor; 2) mediante las nociones de juicio básico y compulsivo propuestas por Amartya Sen, establecer cuándo una CD en una situación de compromiso podría estar moralmente justificada.
