Animal welfare is a concept that plays a role within both our moral deliberations and the relevant areas of science. The study of animal welfare has impacts on decisions made by legislators, producers and consumers with regards to housing and treatment of animals. Our ethical deliberations in these domains need to consider our impact on animals, and the study of animal welfare provides the information that allows us to make informed decisions. This thesis focusses on taking a philosophical perspective to (...) answer the question of how we can measure the welfare of animals. Animal welfare science is an applied area of biology, aimed at measuring animal welfare. Although philosophy of animal ethics is common, philosophy focussing on animal welfare science is rare. Despite this lack, there are definitely many ways in which philosophical methods can be used to analyse the methodologies and concepts used in this science. One of the aims of the work in this thesis is to remedy this lack of attention in animal welfare. Animal welfare science is a strong emerging discipline, but there is the need for conceptual and methodological clarity and sophistication in this science if it is to play the relevant informative role for our practical and ethical decision-making. There is thus is a strong role here for philosophical analysis for this purpose. The central aim of this thesis is to provide an account of how we can measure subjective animal welfare, addressing some of the potential problems that may arise in this particular scientific endeavour. The two questions I will be answering are: what is animal welfare, and how do we measure it? Part One of the thesis looks at the subjective concept of animal welfare and its applications. In it, I argue for a subjective welfare view - that animal welfare should be understood as the subjective experience of individuals over their lifetimes - and look at how the subjective welfare concept informs our ethical decision-making in two different cases in applied animal ethics. Part Two of the thesis looks more closely at the scientific role of welfare. Understanding welfare subjectively creates unique measurement problems, due to the necessarily private nature of mental states and here I address a few of these problems, including whether subjective experience is measurable, how we might validate indicators of hidden target variables such as welfare, how we can make welfare comparisons between individual animals and how we might compare or integrate the different types of experience that make up welfare. I end with a discussion of the implications of all these problems and solutions for the practice of welfare science, and indicate useful future directions for research. (shrink)

It is commonly said that some standards, such as morality, are ‘normatively authoritative’ in a way that other standards, such as etiquette, are not; standards like etiquette are said to be ‘not really normative’. Skeptics deny the very possibility of normative authority, and take claims like ‘etiquette is not really normative’ to be either empty or confused. I offer a different route to defeat skeptics about authority: instead of focusing on what makes standards like morality special, we should focus on (...) what makes standards like etiquette ‘not really normative’. I defend a fictionalist theory on which etiquette is ‘not really normative’ in roughly the same way that Sherlock is ‘not really a detective’, and show that fictionalism about some normative standards helps us explain the possibility of normative authority. Discussions of aesthetic reasons and normativity are becoming increasingly popular. This piece outlines six basic questions about aesthetic reasons, normativity, and value and discusses the space of possible answers to these questions. I divide the terrain into two groups of three questions each. First are questions about the shape of aesthetic reasons: what they favour, how strong they are, and where they come from. Second are relational questions about how aesthetic reasons fit into the wider normative landscape: whether they are (...) distinctive, what their normative status is, and how they interact with each other and with non-aesthetic reasons. Effective Altruism is a social movement which encourages people to do as much good as they can when helping others, given limited money, time, effort, and other resources. This paper first identifies a minimal philosophical view that underpins this movement, and then argues that there is an analogous minimal philosophical view which might underpin Effective Justice, a possible social movement that would encourage promoting justice most effectively, given limited resources. The latter minimal view reflects an insight about justice, and our (...) non-diminishing moral reason to promote more of it, that surprisingly has gone largely unnoticed and undiscussed. The Effective Altruism movement has led many to reconsider how best to help others, but relatively little attention has been paid to the differences in degrees of cost-effectiveness of activities designed to decrease injustice. This paper therefore not only furthers philosophical understanding of justice, but has potentially major practical implications. (shrink)

Recent developments in theories for responsible innovation have focused on the importance of actively accounting for values in our technological designs. Leading among these theories is that of Value Sensitive Design which attempts to guide the design process on the basis of evaluative analysis. However, values often come into conflict and VSD has been criticized for not providing a proper method to resolve such inevitable conflicts. This paper examines three such methods and argues that although each has its merits, they (...) all fail to account for a common source of value conflicts known as value incommensurability. Drawing on literature from the field of axiology, this paper argues that by incorporating the evaluative relation of ‘parity’ each of these three methods, and the VSD framework in general, will be able to properly understand the relation which holds between conflicting design options stemming from the incommensurable of values and be able to guide designers in making rational decision in the face of such conflicts. This paper argues that accepting incommensurability can be a useful step for developing attractive hybrid theories to how to distribute scarce health-related resources. If one provides opportunity for distributive options to be incommensurable with respect to substantive criteria, one can hold on to substantive criteria while also providing room for decision processes to play a significant role. The paper also argues that the strategy of accepting incommensurability is preferable to the strategy of having substantive criteria establish sets of options that (...) are equally, explains why incommensurability gives us reason to go hybrid, and argues that reasons grounded in decision processes have properties that make them appropriate as “tiebreakers” in choice situations characterized by incommensurability. The endeavour to locate value in moral progress faces various substantive as well as more formal challenges. This paper focuses on challenges of the latter kind. After some preliminaries, Section 3 introduces two general kinds of “evaluative moral progress-claims”, and outlines a possible novel analysis of a descriptive notion of moral progress. While Section 4 discusses certain logical features of betterness in light of recent work in value theory which are pertinent to the notion of moral progress, Sections 5 and (...) 6 outline the ambiguous character of “making moral progress”. One of the main lines of research in algorithmic fairness involves individual fairness (IF) methods. Individual fairness is motivated by an intuitive principle, similar treatment, which requires that similar individuals be treated similarly. IF offers a precise account of this principle using distance metrics to evaluate the similarity of individuals. Proponents of individual fairness have argued that it gives the correct definition of algorithmic fairness, and that it should therefore be preferred to other methods for determining fairness. I argue that (...) individual fairness cannot serve as a definition of fairness. Moreover, IF methods should not be given priority over other fairness methods, nor used in isolation from them. To support these conclusions, I describe four in-principle problems for individual fairness as a definition and as a method for ensuring fairness: (1) counterexamples show that similar treatment (and therefore IF) are insufficient to guarantee fairness; (2) IF methods for learning similarity metrics are at risk of encoding human implicit bias; (3) IF requires prior moral judgments, limiting its usefulness as a guide for fairness and undermining its claim to define fairness; and (4) the incommensurability of relevant moral values makes similarity metrics impossible for many tasks. In light of these limitations, I suggest that individual fairness cannot be a definition of fairness, and instead should be seen as one tool among several for ameliorating algorithmic bias. (shrink)

This paper develops an account of existential choices and their role in practical reasoning. In contrast to other views that attempt to make sense of existential choices as a type of rational choice, the proposed account takes them to be choices among the normative outlooks that determine the reasons we have, and as such are nonrational. According to the argument in the paper, existential choices bring to light a feature of all choices, that they are made against the backdrop of (...) a normative outlook, which grounds the rationality of the choice but is not itself rationally determined. This paper proposes a sufficientarian theory with an interval of sufficiency levels. I assume that there are upper and lower bounds of sufficiency and that all well-being levels in between can be considered sufficiency levels. This interval reflects the vagueness of the concept of sufficiency. According to the proposed principle, a distribution is morally better than another if and only if, for each threshold within the interval, the headcount of those below the threshold under the former distribution is smaller than (...) that under the latter distribution. This necessarily leads to incommensurability in moral relations. I argue that such incommensurability makes sufficientarian principles invulnerable to some fundamental objections. (shrink)

Transformative experiences are epistemically and personally transformative: prior to having the experience, agents cannot predict the value of the experience and cannot anticipate how it will change their core values and preferences. Paul (2014, 2015) argues that these experiences pose a puzzle for standard decision-making procedures because values cannot be assigned to outcomes involving transformative experience. Responding philosophers are quick to point out that decision procedures are built to handle uncertainty, including the uncertainty generated by transformative experience. My paper enters (...) here and contributes two points. First, religious experiences are transformative experiences that are especially resistant to these responses. Second, a procedure that appeals to voluntarist reasons—reasons arising from an act of the will—can allow an agent to rationally decide to undergo or avoid an outcome involving transformative experience. Combining these two points results in some interesting implications with respect to practical aspects of religion. (shrink)

A phenomenon called perspectival disagreement is laid out and modelled on the basis of modifications to known consensus measures for qualitative representations of preferences and transitive values by binary relations. Cases of perspectival disagreement are of general philosophical interest, because they allow for the possibility that two or more agents judge the value positions of other agents differently even when their assessments are based on the same evidence. Various examples of perspectival disagreement are given, generalizations are discussed, and it is (...) argued that any representation by cardinal utilities also gives rise to some form of perspectivity. Although the examples strongly suggest that this phenomenon occurs in real life, it is concluded in the end that it does not pose any fundamental threat to representations of preferences and values as binary relations. Instead, position‐sensitive measures of disagreement ought to be taken as a modelling option for cases in which the relative importance of preference changes matters to an agent. (shrink)

This paper introduces incommensurability, its potential relevance to population-level bioethics, and thecontributions to the special issue. It provides an overview of recent research on incommensurability, outlines somereasons to believe in its possibility and relevance, and presents some problems and opportunities that arise onceone accepts that incommensurability is possible.

Ruth Chang and Joseph Raz have both drawn far-reaching consequences for agency from the phenomenon of incommensurability. After criticizing their arguments, I outline an alternative view: if incommensurability is vagueness, then there are no substantial implications for agency, except perhaps a limited form of naturalistic voluntarism if our reasons are provided by desires.

A standard approach to neutral value suggests that it can be understood in comparative terms by reference to value relations. I develop some objections to the standard approach based on assumptions about value facts being closely connected to fittingness facts. I then suggest that these objections give us reasons to amend the standard approach with a noncomparative understanding. The claim is that if an item has neutral value, then it is a fitting target of indifference, where this is understood not (...) as an absence of attitudes but a discrete type of reaction or evaluation. By leaning on some general insights from philosophical psychology about the evaluative role of indifference, I then attempt to give some hints as to how we might understand its nature. (shrink)

If preference-based freedom rankings are based on all-things-considered preferences, they risk judging phenomena of adaptive preferences as freedom enhancing. As a remedy, it has been suggested to base preference-based freedom rankings on reasonable preferences. But this approach is also problematic. This article argues that the quest for a remedy is unnecessary. All-things-considered preferences retain information on whether the availability of an option contributes to the value that freedom has for a person’s self-expression. If preference-based freedom rankings use all-things-considered preferences to (...) evaluate whether an option contributes to a person’s self-expression, they are immune to the problem posed by adaptive preferences. I aim to show that the common idea according to which we can assess how bad death is for the person who dies relies on numerous dubious premises. These premises are intuitive from the point of view of dominant views regarding the badness of death. However, unless these premises have been thoroughly justified, we cannot measure the badness of death for the person who dies. In this paper, I will make explicit assumptions that pertain to the alleged level of badness (...) of death. The most important assumption I will address is the assignment of a quantitative value of zero to death, which leads to the conclusion that there are lives not worth living for the affected person. Such a view interprets the idea of a live worth living in quantitative terms. It is in conflict with actual evaluations of relevant people of their lives. (shrink)

After putting forward a formal account of value disagreement via imprecise measures, I develop a logic of value attribution and of agreement based on truthmaker semantics.

This paper begins with the assumption that the concept of risk implies an entanglement between facts and values. This is not an arbitrary assumption since it can directly be deduced from the standard notion of risk. The value-ladenness of risk raises at least two further issues: the first one concerns the scales adopted to evaluate the severity of risks; the second concerns the commensurability/comparability of risks to human health and the environment. Some additional light is shed on those issues by (...) asking what would happen if the models used in risk analysis were understood as fictions limited by the values that they can include. From this point of view, controversies on the limited scope of standard risk assessments are not only descriptive but also evaluative. In this thesis, I discuss the aggregation problem for T. M. Scanlon’s “contractualism”. I argue that Scanlonian contractualists have the following two options when it comes to the aggregation problem. First, they can choose to limit aggregation directly via a specific version of the Relevance View, “Sequential Claims-Matching”. Second, Scanlonian contractualists can adopt a so-called “mixed solution” of which I propose a specific version. My mixed solution does not limit aggregation. Rather, it either avoids some of the counterintuitive results in (...) certain cases, or at least makes these same results look a lot less counterintuitive by putting them into perspective thanks to a plausible plurality of precisely specified values. The stakes between these two options are as follows. The first option justifies Scanlon’s intuition in one vs. many cases of which his “World Cup Case” is one example, but it comes at the cost of a seemingly quite limited range of application: any version of the Relevance View only works in cases in which we have no more than two groups of competing claimants. The second option has the exact opposite implications: my mixed solution cannot justify Scanlon’s intuition in one vs. many cases, but it could be applied to any case with any number of groups of competing claimants. In this choice between pre-theoretical intuition and feasibility, I would urge Scanlonian contractualists to choose feasibility. (shrink)
