There continues to be a debate on whether addiction is best understood as a brain disease or a moral condition. This debate, which may influence both the stigma attached to addiction and access to treatment, is often motivated by the question of whether and to what extent we can justly hold addicted individuals responsible for their actions. In fact, there is substantial evidence for a disease model, but the disease model per se does not resolve the question of voluntary control. (...) Recent research at the intersection of neuroscience and psychology suggests that addicted individuals have substantial impairments in cognitive control of behavior, but this "loss of control" is not complete or simple. With the waves of reform occurring in mental health legislation in England and other jurisdictions, mental capacity is set to become a key medico-legal concept. The concept is central to the law of informed consent and is closely aligned to the philosophical concept of autonomy. It is also closely related to mental disorder. This paper explores the interdisciplinary terrain where mental capacity is located. Our aim is to identify core dilemmas and to suggest pathways for future interdisciplinary research. The terrain (...) can be separated into three types of discussion: philosophical, legal and psychiatric. Each discussion approaches mental capacity and judgmental autonomy from a different perspective yet each discussion struggles over two key dilemmas: whether mental capacity and autonomy is/should be a moral or a psychological notion and whether rationality is the key constitutive factor. We suggest that further theoretical work will have to be interdisciplinary and that this work offers an opportunity for the law to enrich its interpretation of mental capacity, for psychiatry to clarify the normative elements latent in its concepts and for philosophy to advance understanding of autonomy through the study of decisional dysfunction. The new pressures on medical and legal practice to be more explicit about mental capacity make this work a priority. (shrink)

Neuroethics, in its modern form, investigates the impact of brain science in four basic dimensions: the self, social policy, practice and discourse. In this study, we analyzed a set of 461 peer-reviewed articles with neuroethics content, published by authors from 32 countries. We analyzed the data for: (1) trends in the development of international neuroethics over time, and (2) how challenges at the intersection of ethics and neuroscience are viewed in countries that are considered developed by International Monetary Fund (IMF) (...) standards, and in those that are developing. Our results demonstrate a steady increase in global participation in neuroethics from 1989 to 2005, characterized by an increase in numbers of articles published specifically on neuroethics, journals publishing these articles, and countries contributing to the literature. The focus from all countries was on the practice of brain science and the amelioration of neurological disease. Indicators of technology creation and diffusion in developing countries were specifically correlated with increases in publications concerning policy implications of brain science. Neuroethics is an international endeavor and, as such, should be sensitive to the impact that context has on acceptance and use of technological innovation. (shrink)

Scientific developments take place in a socio-political context but scientists often ignore the ways their innovations will be both interpreted by the media and used by policy makers. In the rush to neuroscientific discovery important questions are overlooked, such as the ways: (1) the brain, environment and behavior are related; (2) biological changes are mediated by social organization; (3) institutional bias in the application of technical procedures ignores race, class and gender dimensions of society; (4) knowledge is used to the (...) advantage of the powerful; and (5) its applications may reinforce existing structures of power that pose ethical questions about distributive justice. The case of crime, deception and functional Magnetic Resonance Imaging (fMRI) shows the complexity, and the political and ethical challenges that confront those who seek to use neuroscience to explain the etiology of crime, and who base policy on its findings. An ethically grounded neuroscience needs to take account of existing structures of power and difference, and to develop a public neuropolitical consciousness that ensures that those subject to risk by the application of science and technology are participants in the decision-making processes involving the implementation of policies that affect them. The portrayal of novel neurotechnologies in Steven Spielberg’s Minority Report serves to inoculate viewers from important moral considerations that are displaced by the film’s somewhat singular emphasis on the question of how to reintroduce freedom of choice into an otherwise technology driven world. This sets up a crisis mentality and presents a false dilemma regarding the appropriate use, and regulation, of neurotechnologies. On the one hand, it seems that centralized power is required to both control and effectively implement such technologies (...) and, on the other hand, individual heroic resistance is required to protect citizens from the invasions of personal privacy and state control made possible through neurotechnologies. While Minority Report, as a dystopic vision of emergent neurotechnologies, engages surface ethical issues it risks cheapening them through its rather simplistic, dichotomous analysis. Most conspicuously absent from this approach is a sense of the social matrices that work to circumscribe or augment expressions of human freedom, privacy, control and power that are all implicated in our engagement with novel neurotechnologies. Were Minority Report unique in this respect it would have little interest, but we think this type of cheapening of ethical discourse about novel technologies is common. Because science fiction film informs the social imaginary in which ethical considerations and ultimately policy decisions take place, such cheapening risks subverting pervasive and tangible ethical issues by focusing on the sensationalistic and simplistic. Is there anything special about the ethical problems of intracerebral stem-cell transplantation and other forms of cell or tissue transplantation in the brain that provides neuroethics with a distinctive normative profile, setting it apart from other branches of medical ethics? This is examined with reference to some of the ethical problems associated with interventions in the brain such as potential changes in personal identity and potential changes in personality. It is argued that these problems are not sufficiently specific to justify (...) the autonomy of neuroethics as a separate discipline and can be handled by the established principles of medical ethics. The paper concludes with a constructive proposal how to deal with interventions in the brain for which the patient is unable to give valid ex-ante consent. (shrink)

Z propozycją rekalibracji etyki i zastąpienia jej neuroetyką wystąpiła Patricia S. Churchland. Churchland twierdzi, że im bardziej rozumiemy szczegóły funkcjonowania naszego systemu nerwowego, tym bardziej jesteśmy przekonani co do tego, że przyjmowane przez nas standardy moralnego działania są uwarunkowane neurobiologicznie. Od roku 2002 termin „neuroetyka” funkcjonuje jako nazwa nowej subdyscypliny etyki. Wymienia się w niej dwa zasadnicze działy: etykę neuronauki i neuronaukę etyki. Pierwszy dotyczy zasadniczo moralnych problemów związanych z zastosowaniem osiągnięć neuronauk, przedmiotem drugiego: neuronauki etyki, jest wpływ, jaki wiedza (...) z zakresu neuronauk ma na nasze rozumienie etyki. Artykuł jest krytyczną prezentacją nowej subdyscypliny etycznej i próbą pokazania, że jakkolwiek neurobiologiczne procesy mają wpływ na nasze działanie, to nie decydują o jego moralnym wymiarze. O ile nie uznajemy moralności za zupełnie irracjonalną, każda jej teoria musi z konieczności zakładać jakąś teorię namysłu praktycznego. Tymczasem próbując opracować tę ostatnią napotykamy poważne problemy; wydaje się, że oceny wyników deliberacji nie możemy dokonywać wyłącznie na podstawie kryteriów stosowanych przy ocenie wyników myślenia teoretycznego, takich jak stopień pewności przyjmowanych przesłanek czy formalna poprawność wnioskowania. Jeśli namysł praktyczny istotnie przebiega zawsze na pozaracjonalnym podłożu żywionych przez jednostkę intuicji i pragnień, to wydaje się, że nie ma nadziei na stworzenie uniwersalnej (...) teorii etycznej. W artykule próbuję z jednej strony wykazać, że namysł praktyczny jest w rzeczy samej tylko częściowo racjonalny, a z drugiej zaproponować wyjście z wynikającego stąd teoretycznego impasu; w moim ujęciu umożliwia je pewna interpretacja Arystotelesowskiej teorii cnoty. This thesis philosophically examines, critically discusses, and proposes how a plausible philosophical framework of consciousness and free will should be formulated. This framework takes into account contemporary scientific research on human consciousness and free will and its possible challenges; also it is examined how this framework should be related to theistic beliefs – especially those connected to human and divine consciousness and free will. First, an overview of important research within the natural sciences about the conscious mind is presented together (...) with its challenges to a theistic worldview. Next, questions related to reductive physicalism and dualism as a thesis and an antithesis are discussed. This dialectical approach leads to two lines for possible alternatives: emergence theories and process panpsychism. The subsequent analysis suggests that a form of process panpsychism in combination with a weaker form of emergence is most plausible. After a discussion of some central ideas about determinism and indeterminism, together with a brief overview of standard arguments within the philosophical free will debate, the proposed emergent process panpsychism is related to these standard arguments in the free will debate and scientific research about decision-making. As a result it will be suggested how free will should be understood in relation to the emergent process panpsychism. The consequences of these results are then discussed in relation to a theistic worldview. Here panentheism will be suggested as the most reasonable conception of God. Also, the consequences for divine consciousness, divine action and interaction, the human soul, life before birth and after death, and more briefly a personal relationship with God, theological determinism, omniscience, and omnipotence will be discussed specifically in relation to panentheism in an emergent process panpsychist setting. The new dilemmas and responsibilities which arise in bioethics both because of the unprecedented pace of scientific development and of growing moral pluralism are more and more difficult to grapple with. At the ‘global’ level, the call for the universal nature at least of some fundamental moral values and principles is often being contended as a testament of arrogance, if not directly as a new kind of subtler imperialism. The human rights framework itself, which provided the basis for the most (...) relevant international declarations and documents, is not exempt from the charge. However, the refusal of a top-down conception of the universal as a sort of product for exportation should not be confused with a relativistic landscape, where all the cows can be indifferently black or white. This contribution aims at outlining an approach, which reconciles universalism as enshrined in founding human rights declarations with respect for cultural diversity. In order to do so, two conceptual frameworks are discussed: the ‘tool-kit’ model and the morals/ethics difference. The example of the right to quality health care confirms the argument that striking a balance between cherishing pluralism and defending some fundamental rights and obligations does not amount to an assertion of moral imperialism.
