This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

In this paper, we define a class of dialogue games for Johansson’s minimal logic and prove that it corresponds to the validity of minimal logic. Many authors have stated similar results for intuitionistic and classical logic either with or without actually proving the correspondence. Rahman, Clerbout and Keiff [17] have already specified dialogues for minimal logic; however, they transformed it into Fitch-style natural deduction only. We propose a different specification for minimal logic with the proof of correspondence between the existence (...) of winning strategies for the Proponent in this class of games and the sequent calculus for minimal logic. We now move to the demonstration of the left-to-right direction of the equivalence result. Let us assume that there is a winning $$\mathbf {P}$$ P -strategy in the dialogical game for $$\varphi $$ φ.

The logics of formal inconsistency are logics tolerant to some amount of contradiction, but in which some versions of explosion still hold. The main result of this paper is a reconstruction of two such logics in the dialogical framework. By doing so, we achieve two things. On the one hand, we provide a formal approach to argumentative situations where some contradictions may occur while keeping the idea that there may still be situations in which some propositions are ‘safe’ in the (...) sense of immunity to the contradictions. On the other hand, we open a new line of study on these logics, in the context of the game-theoretical approach to semantics born in the 1960s, with various interesting perspectives, some of which are discussed at the end of this article. This monograph proposes a new way of implementing interaction in logic. It also provides an elementary introduction to Constructive Type Theory. The authors equally emphasize basic ideas and finer technical details. In addition, many worked out exercises and examples will help readers to better understand the concepts under discussion. One of the chief ideas animating this study is that the dialogical understanding of definitional equality and its execution provide both a simple and a direct way of implementing the CTT approach (...) within a game-theoretical conception of meaning. In addition, the importance of the play level over the strategy level is stressed, binding together the matter of execution with that of equality and the finitary perspective on games constituting meaning. According to this perspective the emergence of concepts are not only games of giving and asking for reasons, they are also games that include moves establishing how it is that the reasons brought forward accomplish their explicative task. Even when inconsistencies are present in our premise set, we can sensibly distinguish between good and bad arguments relying on these premises. In making this distinction, the inconsistency-adaptive approach of Batens strikes a particularly nice balance between inconsistency-tolerance and inferential strength. In this paper, we use the machinery of Batens’ approach to extend the paraconsistent approach to dialogical logic as developed by Rahman and Carnielli. In bringing these frameworks closer together, we obtain a dynamic mechanism for the systematic study of (...) dialogues in which two parties exchange arguments over a central claim, in the possible presence of inconsistencies. Recent literature on dialogical logic discusses the case of tonk and the notion harmony in the context of a rule-based theory of meaning. Now, since the publications of those papers, a dialogical version of constructive type theory has been developed. The aim of the present paper is to show that, from the dialogical point of view, the harmony of the CTT-rules is the consequence of a more fundamental level of meaning characterized by the independence of players. En este artículo delineamos una propuesta para elaborar una lógica de las ficciones desde el enfoque lúdico del pragmatismo dialógico. En efecto, centrados en una de las críticas mayores al enfoque clásico de la lógica: la esquizofrenia estructural de su semántica, recorremos los compromisos ontológicos de las dos tradiciones mayores de la lógica para establecer sus posibilidades y límites en el análisis del discurso ficcional, y la superación desde una perspectiva lúdico pragmática.

Recent work on the development of a dialogical approach to the logic of fiction stresses the notion of existence as choice. Moreover, this approach to existence has been combined with the notion of ontolog-ical dependence as deployed by A. Thomasson’s artifactual theory of fiction. In order to implement such a combination within the dialogical frame several predicates of ontological dependence have been de-fined. However, the definition of such predicates seems to lean on a model-theoretic semantics for mod-al logic after all. (...) The main aim of the present paper is to set a dialogical frame for the study of fictions in the context of the dialogical approach of CTT recently developed by S. Rahman and N. Clerbout where a fully-interpreted language is unfolded. We will herewith develop the idea that in such a setting fiction-al entities are understood as hypothetical objects, that is, objects (functions) the existence of which is dependent upon one or more hypotheses that restrict the scope of choices available. We will finish the paper by suggesting that this provides both a natural and genuinely dialogical way to understand R. Frigg’s take on scientific models as fictions and a new perspective on Thomasson’s notion of generic ontological dependence. Ordinary dialogical logic offers processing memory as a history of dialogues. Find a reference in this history is an ambiguous process, which can transform in complex or impossible issues the questions that compose a dialogue. Thus, two researches of justifications overlap in a dual problem of justification. In addition, this consideration of the memory uses a lot of technical resources.We propose a dialogical formalism that solves these problems: double justification, composition, memory saving. To do this, we will develop "special" rules (...) that will reconfigure the formalism and consider the metaphysical and philosophical concepts in this logical system and its interpretations.This article is divided into three parts:A presentation of the dialogical framework oriented towards the presentation of the problem of double justification.A re-interpretation of this framework in terms of matrices: the logical formulas modeled on the linguistic and mathematical language reading are replaced by a concept borrowed from the game semantical approach.A brief summary of the new approaches presented by this method: reaffirmation of the clear separation between different levels of analysis and economy on the amount of memory required.
