How should policymakers respond to the risk of technological unemployment that automation brings? First, I develop a procedure for answering this question that consults, rather than usurps, individuals’ own attitudes and ambitions towards that risk. I call this the insurance argument. A distinctive virtue of this view is that it dispenses with the need to appeal to a class of controversial reasons about the value of employment, and so is consistent with the demands of liberal political morality. Second, I appeal (...) to the insurance argument to show that governments ought not simply to provide those who are displaced by machines with unemployment benefits. Instead, it must offer re-training programmes, as well as enact more general macroeconomic policies that create new opportunities for employment. My contribution is important not only because it helps us to resolve a series of urgent policy disputes—disputes that have been discussed extensively by labour market economists and policymakers, but less so by political philosophers—but also because my analysis sheds light on more general philosophical controversies relating to risk. Economic disparities often translate into disparities in political influence, rendering political liberties less worthy to poor citizens than to wealthier ones. Concerned with this, Rawls advocated that a guarantee of the fair value of political liberties be included in the first principle of justice as fairness, with significant regulatory and distributive implications. He nonetheless supplied little examination of the content and grounding of such guarantee, which we here offer. After examining three uncompelling arguments in its favor, we complete a more (...) promising yet less explored argument that builds on the value of self-respect. We first inspect the conditions and duties that securing self-respect entails. We then look into how uneven allocations of the value of political liberties bear, expressively and due to the power imbalances they yield, on such conditions and duties. (shrink)

We lack analyses of the judiciary from a systemic perspective. This article thus examines arguments offered by deliberativists who have reflected about this institution and argues that the current state of deliberative democracy requires us to rethink the ways they conceive of the judiciary within a deliberative framework. After an examination of these accounts, I define the deliberative system and describe the different phases deliberative democracy has gone through. I then single out elements common to all systemic approaches against which (...) I test whether the regard that the authors show for the judiciary in deliberative terms can be maintained and argue in the negative. I conclude by pointing at the necessity to think about the definition of deliberative systems, and to the value of these discussions for debates on the legitimacy of judicial review when it is exercised under the form of judicial supremacy. An emerging branch of political theory, ‘the politics of dissensus’, starts out from the premise that in order to understand the politics of constitutional democracies, one needs to focus on parliamentary politics, which compromises both institutional settings and debates. Politics takes place among adversaries, and dissensus and argumentation pro et contra is the rule. The focus on the conditions for consensus in contemporary democratic theory accordingly misses the essence of politics. The politics of dissensus tends to think that the political (...) philosophy inaugurated by John Rawls, political liberalism in particular, is too idealistic and utopian to capture real parliamentary politics. I argue that this basic objection against political liberalism is misconceived. To the contrary, the politics of dissensus and political liberalism supplement each other. The impact of my argument is that research in these disparate fields of political studies ought to enlighten each of them. (shrink)

On Conditions of Participation: The Deficits of Public Reason The paper analyzes the conditions of civic participation that are elucidated by criticism of the deficits of public reason. The interpretation proceeds in three steps. First, the idea of public reason and discourse is analyzed, followed by an explanation of democratic deficit and of the social deficit in the second and third steps, respectively. These deficits are analyzed as an essential limit to political and social conditions of the participation of citizens. (...) The analysis focuses thereby on the theory of public reason by one of the most influential political philosophers of the last decades, John Rawls. The paper identifies two main pitfalls in his theory: first, the deficit following from an inadequate integration of an individual into society, which, in this case, represents democratic deficit, second, the deficit linked with underrating the socio-distributive dimension of justice, which means a social deficit. Despite the vast literature on Rawls's work, few have discussed his arguments for the value of democracy. When his arguments have been discussed, they have received staunch criticism. Some critics have charged that Rawls's arguments are not deeply democratic. Others have gone further, claiming that Rawls's arguments denigrate democracy. These criticisms are unsurprising, since Rawls's arguments, as arguments that the principle of equal basic liberty needs to include democratic liberties, are incomplete. In contrast to his trenchant remarks about core civil (...) liberties, Rawls does not say much about the inclusion of political liberties of a democratic sort – such as the right to vote – among the basic liberties. -/- In this paper, I complete some of Rawls's arguments and show that he has grounds for including political liberties, particularly those of a democratic nature, in the principle of equal basic liberty. In doing so, I make some beginning steps toward illustrating the genuinely democratic nature of Rawls's arguments. Rawls believes that a few different arguments can be given for democratic institutions and that these arguments work together to support the value of democracy. In this paper, I focus on Rawls's arguments relating to self-respect. I focus on this set of arguments because they are among the strongest of Rawls's arguments for equal political liberty and its fair value. (shrink)

John Rawls is arguably the most important political philosopher of the past century. His theory of justice has set the agenda for debate in mainstream political philosophy for the past forty years, and has had an important influence in economics, law, sociology, and other disciplines. However, despite the importance and popularity of Rawls's work, there is no clear picture of what a society that met Rawls's principles of justice would actually look like. This article sets out to explore that question.

An interdisciplinary theoretical framework is proposed for analysing justice in global working conditions. In addition to gender and race as popular criteria to identify disadvantaged groups in organizations, in multinational corporations (MNCs) local employees (i.e. host country nationals (HCNs) working in foreign subsidiaries) deserve special attention. Their working conditions are often substantially worse than those of expatriates (i.e. parent country nationals temporarily assigned to a foreign subsidiary). Although a number of reasons have been put forward to justify such inequalities—usually with (...) efficiency goals in mind—recent studies have used equity theory to question the extent to which they are perceived as fair by HCNs. However, since perceptual equity theory has limitations, this study develops an alternative and non-perceptual framework for analysing such inequalities. Employment discrimination theory and elements of Rawls’s ‘Theory of Justice’ are the theoretical pillars of this framework. This article discusses the advantages of this approach for MNCs and identifies some expatriation practices that are fair according to our non-perceptual justice standards, whilst also reasonably (if not highly) efficient. With the publication of A Theory of Justice in 1971, John Rawls not only rejuvenated contemporary political philosophy but also defended a Kantian form of Enlightenment liberalism called “justice as fairness.” Enlightenment liberalism stresses the development and exercise of our capacity for autonomy, while Reformation liberalism emphasizes diversity and the toleration that encourages it. These two strands of liberalism are often mutually supporting, but they conflict in a surprising number of cases, whether over the accommodation of group difference, the design (...) of civic education, or the promotion of liberal values internationally. During the 1980’s, however, Rawls began to jettison key Kantian characteristics of his theory, a process culminating in the 1993 release of Political Liberalism and completing the transformation of justice as fairness into a Reformation liberalism. -/- Reconstructing Rawls argues that this transformation was a tragic mistake because it jeopardized the most important features of his theory, viz. the lexical priorities of right, liberty, and fair equality of opportunity as well as the difference principle. Controversially, this book contends that Rawls’s so-called “political turn,” motivated by a newfound interest in diversity and the accommodation of difference, has been unhealthy for autonomy-based liberalism and has pushed liberalism more broadly towards cultural relativism, be it in the guise of liberal multiculturalism or critiques of cosmopolitan distributive-justice theories. The book then demonstrates that the central elements of justice as fairness can only be defended within the context of a Kantian Enlightenment liberalism and that Rawls’s hope for a more pluralistic grounding for his theory, endorsed by a wide variety of belief systems present in modern democratic societies, is illusory. -/- Reconstructing Rawls is the first book to systematically compare Rawls’s and Kant’s theories and the first to offer an internal critique and reconstruction of justice as fairness, reconceiving it as a comprehensive, universalistic Kantian liberalism. By doing so, it gives us both the vision of a liberal world order—“a republicanism of all states, together and separately,” as Kant put it—and a mode of justification addressed to all men and women, not as members of particular nations, races, and faiths, but as human beings, as citizens of the world. I consider whether political deference by a citizen within a liberal democracy to moral experts is morally problematic. I compare and contrast deference in the political and personal domains. I set to one side consequentialist worries about political deference and evaluate its possible intrinsic wrongness, expressed as a worry that deference is inconsistent with the grant to individuals of the power exercised in a democratic vote, just as personal deference is inconsistent with the grant of a power of moral choice. I consider several possible versions of such inconsistency: that a vote to delegate decision-making to experts is self-defeating, that it is unfree, or is blind to the significance of exercising a political choice, or is a denial of democratic equality. I conclude that the worries are ill-founded and that political deference is not in itself morally troubling. (shrink)

En este artículo defiendo que la concepción rawlsiana de la justicia distributiva va más allá de los márgenes de la justicia asignativa y que esta presenta buenos argumentos para hacer frente a las demandas de reconocimiento. Para alcanzar este objetivo, en primer lugar muestro que algunos críticos del paradigma liberal distributivo malinterpretan la concepción de la justicia distributiva elaborada por Rawls y reducen su finalidad a un mero reparto de bienes. Al hacer lo anterior, ellos no logran comprender la dimensión (...) moral de la propuesta rawlsiana, propuesta firmemente asentada en la idea de reconocimiento. En segundo lugar, analizo la relevancia que tienen las nociones de reconocimiento recíproco y autorrespeto en la teoría de la justicia de Rawls, para finalmente mostrar cómo a partir de ellas se puede reinterpretar la finalidad de la justicia distributiva e incluir las demandas de reconocimiento. Este artículo mostrará que las versiones estrictas del Igualitarismo Democrático y del Igualitarismo de la Suerte son implausibles ya que defienden una visión monista del objeto de la justicia igualitaria. Por el contrario, sus versiones moderadas son aceptables ya que admiten la composición plural del objeto de justicia igualitaria. Esta comprensión plural exige, sin embargo, el establecimiento de prioridades normativas ya que las exigencias de cada valor entran típicamente en conflicto. Igualitarismo Democrático sobre el Igualitarismo de la Suerte: uno instrumental, otro relacionado con el significado expresivo de las políticas públicas estatales y un último que justifica la división del trabajo moral igualitarista. One of the central elements of John Rawls’ argument in support of his two principles of justice is the intuitive normative ideal of citizens as free and equal. But taken in isolation, the claim that citizens are to be treated as free and equal is extremely indeterminate, and has virtually no clear implications for policy. In order to remedy this, the two principles of justice, together with the stipulation that citizens have basic interests in developing their moral capacities and pursuing (...) their conceptions of the good life, are meant to provide a more precise interpretation of what is involved in treating citizens as free and equal. Rawls’ critics, however, have argued that satisfying the two principles of justice is not the most appropriate or plausible way to respect the status of citizens as free and equal. In relation to this debate, the present paper has two aims. The first is to examine Rawls’ account of the type of freedom that a just society must guarantee equally to its citizens. I will argue that those who think of Rawls as a theorist of freedom as non-interference are mistaken, because his notion of liberty resembles in important respects the republican notion of freedom as non-domination. Second, I will consider the extent to which Rawls’ principles of justice successfully protect the freedom as non-domination of all citizens so as to effectively treat them as free and equal. “Confucian democracy” is considered oxymoronic because Confucianism is viewed as lacking an idea of equality among persons necessary for democracy. Against this widespread opinion, this article argues that Confucianism presupposes a uniquely Confucian idea of equality and that therefore a Confucian conception of democracy distinct from liberal democracy is not only conceptually possible but also morally justifiable. This article engages philosophical traditions of East and West by, first, reconstructing the prevailing position based on Joshua Cohen’s political liberalism; second, articulating a (...) plausible conception of Confucian democracy predicated on Confucian conceptions of persons and political participation from the Mencian tradition; and third, exposing the implausibility of the prevailing position in light of the articulation. (2) This charge brings up the question of the deficiency dilemma: Do others disagree with us because of our failures or theirs? —where the two dilemmas appear to be independent of each other and lead to the questions of the logic of deficiency, moral epistemic deficiency, epistemic peers, and the hardness of (...) philosophy. (3) In reply, on an expanded principle of charity Rawls does not overlook the Euthyphro but rather offers ground-breaking solutions to it, (4) that nonetheless trip on the independent bootstrap (5)—as also do Dreben and Nussbaum. (6) Furthermore, Rawls's ' burdens of judgment' seek to bypass the necessity of moral epistemic deficiency and (7) suggest a wider framework for understanding disagreement that sees disagreement as arising from inquiry being in development, unpredictable and uncertain. Any liberal argument for incorporating meaningful work within a theory of justice inherits a burden of proof to show why it does not fall to the objection that privileging the work process valorizes particular ideas about the good and thereby unfairly privileges some persons over others. Existing liberal defences of meaningful work, which rely on the formative effects of work in contemporary economies, have a limited scope of appeal and do not provide a convincing reply to the objection. The paper (...) offers an alternative reply by arguing that meaningful work, understood as a person-engaging social contribution, is intimately connected through reciprocity to the fundamental political idea of society as a system of cooperation between free and equal participating members. This makes the opportunity to engage in meaningful work a social basis of self-respect. (shrink)

Una de las críticas más importantes a las democracias contemporáneas señala que si bien todos sus ciudadanos poseen derechos políticos iguales, la igualdad política es puramente formal. Dado que la objeción posee una fuerza normativa considerable, parecería claro que deberían aceptarse trueques entre la igualdad política formal y mejoras en la distribución económica. El objetivo del artículo es mostrar que tales trueques son irrazonables ya que la igualdad política puramente formal tiene un significado expresivo específico que no puede ser expresado (...) de otra forma. El argumento que se utiliza para defender este objetivo tiene un carácter contractualista y señala que el valor de esta dimensión formal de la igualdad política consiste en la expresión de la igualdad moral de las personas de una forma única y en mostrar el debido respeto a la capacidad para un sentido de la justicia de los ciudadanos. Artikkel käsitleb kriitiliselt üht viimaste kümnendite vastandust poliitilises filosoofias — ‘poliitilise liberalismi’ (Rawls) ja ‘radikaalse demokraatia’ (Laclau ja Mouffe) vahel. Artikkel püüab käivitada potentsiaalset dialoogi nende kahe näiliselt lahkneva lähenemise vahel. Kokkuvõttes näitab artikkel, et vastandus on möödarääkimine vähemalt ühes fundamentaalses mõttes: mõlemad lähenemised jagavad ühiskonnastmõtlemisel sama aluseetost. Artiklis nimetatakse seda ‘sattumuslikkuse eetoseks’ ning väidetakse, et see on kõige fundamentaalsem alusveendumus nii Laclau ja Mouffe’i ‘radikaalse demokraatia’ kui ka Rawlsi ‘õigluse kui ausameelsuse’ idee jaoks. Artikkel osutab ka ühele kesksele kitsaskohale (...) Laclau ja Mouffe’i lähenemises: nende suutmatusele kontseptualiseerida institutsioonilisi korraldusi tulenevalt nende ülemäärasest rõhuasetust demokraatia dekonstruktiivsele potentsiaalile. Selles suhtes osutatakse ka Rawlsi käsitluse ilmselgetele eelistele, kuna see pakub juhiseid organiseerimaks demokraatlikke institutsioone. The paper concentrates on a controversy in recent decades’ political thought between ‘political liberalism’ of Rawls and ‘radical democracy’ (represented in this paper by Laclau and Mouffe). The article tries to initiate a potential dialogue between these seemingly divisive approaches. In conclusion the paper maintains that the whole controversy is misguided in one fundamental respect: both approaches share the same underlying ethos in envisioning society—‘the ethos of contingency’. It is argued that it is the most fundamental tenet informing both Laclau and Mouffe’s theory of hegemony with its complementary idea of ‘radical democracy’, and justice as fairness conceived in terms of reciprocity with its accompanying idea of public justification and reflective equilibrium. _e article points to a central impasse in Laclau and Mouffe’s approach: its incapability to conceptualize institutional arrangements due to their overemphasis on the deconstructive potential of democracy. In this respect the obvious merits of Rawls’ conception are highlighted in view of his proposals for organizing democratic institutions. (shrink)

Although republican political theory has undergone something of a revival in recent years, some question its contemporary relevance on the grounds that republicanism has little to say about central questions of modern economic organization. In response, this paper offers an account of core republican values and then considers how capitalism stands in relation to these values. It identifies three areas of republican concern related to: the impact of unequal wealth distribution on personal liberty; the impact of the private control of (...) investment on popular sovereignty and pursuit of the common good; and the impact of capitalism on the level and quality of political participation. In view of these concerns, we can see some of the likely requirements of a distinctively republican, but contemporary political economy. (shrink)

L’analyse de la notion de procéduralisme montre qu’elle est utilisée dans la littérature en deux sens très différents. Nous mettons en évidence une condition suffisante à la mise en cohérence de ces deux idées, basée sur une compréhension pragmatique de la notion d’acceptabilité. Nous montrons alors que l’adoption de cette condition suffisante implique que tout dépassement procéduraliste du welfarisme passe par un travail de formation des préférences.

Democracy can be a means to independently valuable ends and/or it can be intrinsically (or non-instrumentally) valuable. One powerful non-instrumental defence of democracy is based on the idea that only it can publicly justify political authority. I contend that this is an argument about the reasonable acceptability of political authority and about the requirements of publicity and that satisfying these requirements has nothing to do with whether a society is democratic or not. Democracy, then, plays no role in publicly justifying (...) political authority. I also show that any non-instrumental defence of democracy must make claims about what justice requires and make several further claims that require substantial justification. (shrink)

The aim of this paper is to propose a model for understanding the relation between substance and procedure in discourse ethics and deliberative democracy capable of answering the common charge that they involve an ‘empty formalism’. The expressive-elaboration model introduced here answers this concern by arguing that the deliberative practical rationality presupposed by discourse ethics and deliberative democracy involves the creation of a practical medium in which certain general basic ideas of solidarity, equality and freedom are expressed and elaborated in (...) the context of widespread moral disagreement. In the course of this paper I propose an elucidation of these ideas and argue for the thesis that they are internally related to the endorsement of deliberative practical rationality. The three basic substantive ideas contribute to the determination of the existence, the form, the topics and intended outcomes, and the effects of the practice of public deliberation. This amounts to an elucidatory defense of deliberative practical rationality by explicating its substantive significance or point. En Liberalismo político, en cambio, Rawls discute varios de los muchos temas sobre los que el concepto de democracia nos invita a reflexionar. En este escrito concentro mi atención en una de esas discusiones: la tensión entre constitucionalismo y democracia. Más específicamente, procuro examinar de qué modo Rawls trata de afirmar el doble compromiso que toda constitución quiere honrar, esto es, el compromiso con (...) el ideal de la autonomía individual, y el compromiso con el ideal del auto-gobierno colectivo. One of the most distinctive and startling claims of Rawlsian political liberalism is that truth has no place in public political deliberation on matters of basic justice. Joshua Cohen thinks there is a tension between Rawls’s exclusion of truth in public political deliberation and the importance accorded to truth in the conception of morally serious political deliberation held by most citizens. Cohen claims that this apparent tension can be resolved by constructing and introducing a suitably political, non-divisive and neutral, conception (...) of truth which is capable of satisfying both the highly distinctive requirements of Rawlsian political liberalism and the importance accorded to truth by the conception of public deliberation held by most citizens. In this paper I argue that Cohen is unsuccessful in this attempt and that his political conception of truth cannot satisfy both political liberalism and a descriptively adequate specification of the importance accorded to truth by the familiar accounts of morally serious political deliberation upon which Cohen relies. In my reply to Pogge's critique of Rawls's international relations theory, I will try to show two things: (1) that Pogge's account of the public criterion of domestic social justice endorsed by Rawls is a partial one and (2) that this leads him to wrongly postulate a significant asymmetry between Rawls's domestic and international theories of justice. In the end, I hope to show that the domestic and international accounts are characterized by a significant degree of symmetry ? that both (...) accounts are motivated by Rawls's fundamental concern with self-respect. In other words, a more expansive, complete account of the domestic public criterion of social justice necessarily leads us (contra Pogge) to affirm a significant degree of continuity between the domestic and international accounts.
