We all have agent-relative permissions to give extra weight to our own well-being. If you and two strangers are drowning, and you can save either yourself or two strangers, you have an agent-relative permission to save yourself. But is it possible for you to ‘vest’ your agent-relative permissions in a third party – a ‘proxy’ – who can enact your agent-centered permissions on your behalf, thereby permitting her to do what would otherwise be impermissible? Some might think that the answer (...) is ‘no’; it is definitive of agent-centered permissions that they apply only to the individuals ineliminably referenced in the content of that reason, which means that they lack reason-giving force for any ostensible proxy. The purpose of this paper is to show that vesting agent-relative permissions is indeed possible, provide an account of how agent-relative permissions are vested by considering the structure of rights more generally, and show that we have a right to vest such permission in this way. In this paper I defend Judith Jarvis Thomson's 'Good Samaritan Argument' (otherwise known as the 'feminist argument') for the permissibility of abortion, first advanced in her important, ground-breaking article 'A Defense of Abortion' (1971), against objections from Joseph Mahon (1979, 1984). I also highlight two problems with Thomson's argument as presented, and offer remedies for both of these problems. The article begins with a short history of the importance of the article to the development of practical ethics. Not alone did (...) it put the topic of the abortion on the philosophical map, but it made 'practical ethics' in the late 1960s feminist, also. (shrink)

This thesis takes up a rights-based perspective to discuss a number of issues related to the problem of permissible harm. It appeals to a person’s capacity to shape her life in accordance with her own ideas of the good to explain why her death can be bad for her, and why each of us should have primary say over what may be done to her. The thesis begins with an investigation of the badness of death for the person who dies. (...) If death is bad for us, this helps explain the wrongness of killing. The thesis defends the deprivation account—i.e. the idea that death is bad for us when and because it deprives us of good life—against two Epicurean challenges. It adds that death is also bad when and because it thwarts our agency. Next, the thesis deals with the logic of our moral rights to non-interference. It proposes a conception of rights according to which the stringency of our rights derives from and is justified by the rational aspect of our human nature. It argues that this conception of moral rights solves the paradox of deontology. While our rights to non-interference are stringent, they are not absolute. The thesis considers two possible exceptions to the general rule that it is impermissible to harm an innocent person against her consent. First, using an actual case from WWII, it investigates the circumstances under which a government may expose some parts of its population to an increased risk of harm in order to decrease the risk to others. Second, it considers the permissibility of self-defence against an innocent threat. It argues that the potential victim of an innocent threat has a justice-based reason to treat her own interests as on a par with those of the threat. (shrink)

The debate concerning abortion abounds in miraculous narratives. Judith Jarvis Thomson has contrived the most celebrated set among related ones, to wit the “violinist analogy,” the “Good Samaritan” narrative, and the “Henry Fonda” allegory, by virtue of which, she intends, on the one hand, to argue that women’s right to autonomy outweighs the alleged fetus’s right to life, and on the other, to prove that no positive moral duties can be derived towards other persons alone from the fact that a (...) moral agent is ascribed certain rights. What this short paper endeavors to prove is that Thomson’s argumentation by analogy is a weak one, since neither the number nor the relevance of similarities invoked is adequate or satisfactory, while crucial parameters concerning the morality of abortion are being totally overlooked. Over the past 20 years, there has been a huge amount of work on which things you can kill in self‐defense and why. This paper surveys that work.

Anti-abortion violence (‘AAV’) is anathema to almost everyone, on all sides of the abortion debate. Yet, as this article aims to show, it is far more difficult than has previously been recognised to avoid the deeply unpalatable conclusion that it can sometimes be justified. Some of the most frequently-occupied positions on the morality of abortion will imply precisely that conclusion, I argue, unless conjoined with an especially stringent and unattractive form of pacifism. This is true not only of strict anti-abortion (...) views, but also, more surprisingly, of some of the most familiar and influential moderate defences of abortion rights. The latter conclusion raises the question, which further work will be required to fully resolve, of what our account of abortion ethics and prenatal moral status must be if it is to enable reconciliation of the common-sense rejections of both pacifism and AAV. I end with reasons to expect that the path to an account that satisfies this demand, without generating further significant intuitive problems, will be far from straightforward. (shrink)

Most opponents of abortion (OA) believe fetuses matter. Critics argue that OA act inconsistently with regards to fetal life, seeking to restrict access to induced abortion, but largely ignoring spontaneous abortion and the creation of surplus embryos by IVF. Nicholas Colgrove, Bruce Blackshaw, and Daniel Rodger call such arguments inconsistency arguments and contend they do not matter. They present three objections to these arguments — the other beliefs, other actions, and hypocrisy objection. Previously, I argued these objections fail and threaten (...) to undermine ethical inquiry. Colgrove et al. have recently replied, but here, I argue their reply fails as well and raises a new criticism of the other actions’ objection. This essay sets out to show, as well as any philosophical argument can, that inconsistency arguments are morally significant. (shrink)

This paper deals with the conditions of liability to self-defense. When I use the term liability, I mean moral liability. This is different from desert. If I am liable to be killed in self-defense, it does not follow that I deserve to be killed. In short, desert entails liability but liability does not entail desert. My use of the term in this paper may be stated succinctly as follows: if killing a person will neither wrong him nor violate his rights, (...) he is morally liable to be killed. A person poses an unjust threat when he threatens harms that are neither justified nor excused. A person is culpable for an unjust threat if he intends the threat he poses, is a morally responsible agent, and there are no mitigating circumstances, such as duress, that excuse his actions. A person is at fault, but not culpable, for an unjust threat if he is a morally responsible agent, has acted unreflectively, recklessly, though not maliciously, in a way that poses risks to others. Though culpability entails fault, fault does not entail culpability; as I will explain later, a person does not have to be culpable in order to be at fault for an unjust threat. (shrink)

Proportionality is widely accepted as a necessary condition of justified self-defense. What gives rise to this particular condition and what role it plays in the justification of self-defense seldom receive focused critical attention. In this paper I address the standard of proportionality applicable to personal self-defense and the role that proportionality plays in justifying the use of harmful force in self-defense. I argue against an equivalent harm view of proportionality in self-defense, and in favor of a standard of proportionality in (...) self-defense that requires comparable seriousness and takes into account the wrong, as opposed simply to the harm that the victim is fending off. I distinguish the standard of proportionality in self-defense from proportionality in circumstances of necessity, and I discuss whether proportionality is an internal or an external constraint on the right of self-defense. A principle that many have found attractive is one that goes by the name “'Ought' Implies 'Can'.” According to this principle, one morally ought to do something only if one can do it. This essay has two goals: to show that the principle is false and to undermine the motivations that have been offered for it. Toward the end, a proposal about moral obligation according to which something like a restricted version of 'Ought' Implies 'Can' is true is floated. Though (...) no full-fledged argument for this proposal is offered, that it fits with a rather natural and intuitive picture of the structure of morality and seems to explain certain salient features of the debate over whether the principle is true, goes some way toward recommending it. Emily Carroll and Parker Crutchfield propose a new inconsistency argument against abortion restrictivism. In response, I raised several objections to their argument. Recently Carroll and Crutchfield have replied and seem to be under the impression that I’m a restrictivist. This is puzzling, since my criticism of their view included a very thinly veiled, but purposely more charitable, anti-restrictivist inconsistency argument. In this response, I explain how Carroll and Crutchfield mischaracterize my position and that of the restrictivist.

Jeremy Williams argues that both anti-abortion and pro-choice theories seem to justify two forms of anti-abortion violence – (1) violence against those that perform abortions, and (2) the subjugation of women seeking abortion. He illustrates this by way of his Death Camps analogy. However, Williams does not advocate such violence; rather he seems despondent over his conclusion. Here I argue Williams’ conclusion turns on confusion regarding the restrictivist position and a failure to adequately meet the challenge of Thomson’s Violinist case. (...) The Death Camps analogy is incomparable to the practice of abortion because it fails to capture the risks, burdens, and rights relationships present in pregnancy. (shrink)

Do innocent civilians who will be killed in a justified attack on a nearby military target have a right to defend themselves by shooting down the bomber pilot? I argue that they do not, and that Jeff McMahan's view that they do have such a right—that there is a moral equivalence between pilot and civilian—is flawed in much the same way that Michael Walzer's moral equivalence of combatants—a position that McMahan has so persuasively refuted—is flawed.

This essay argues on behalf of a hybrid theory for an ethics of self-defense understood as the Forfeiture-Partiality Theory. The theory weds the idea that a malicious attacker forfeits the right to life to the idea that we are permitted to prefer one's life to another's in cases of involuntary harm or threat. The theory is meant to capture our intuitions both about instances in which we can draw a moral asymmetry between attacker and victim and cases in which we (...) cannot. I develop the theory by attending to instances of intentional, villainous harm and instances of involuntary danger—the latter of which are a matter of bad luck. I call some bad luck cases "Interpersonal Lottery Conflicts." These cases refer to potentially lethal conflicts into which parties are thrown as victims of circumstance. Although neither party has a moral advantage over another, that fact does not preclude permissible self-defense. (shrink)

This article seeks to show that Israel’s war in Gaza in 2023 and 2024 has been an unjust war because it has violated both the requirement of proportionality and the requirement of necessity. The article explains the nature of proportionality, arguing that the main form of proportionality in war is simply the limit to the amount of harm inflicted on innocent people that can be justified either as the lesser evil or, more plausibly, on the basis of the special relations (...) between combatants and their fellow citizens. The argument of the article is that, even on the basis of assumptions about moral justification and the numbers of innocent people who have been killed or saved by the war that are highly favorable to Israel, the war has nevertheless been highly disproportionate and morally unnecessary. A dominant trend in the philosophical literature on abortion has been concerned with the question of whether the fetus has moral status and how such a status might or might not conflict with women's liberties. However, a new and powerful trend against abortion requires philosophical examination. We refer to this trend as the paternalistic argument. In a nutshell, this argument holds that, insofar as motherhood is a constitutive end of women's well-being, abortion harms women; thus, abortion is wrong and should (...) be prohibited, restricted, or avoided when possible regardless of the moral status of the fetus. In this article we undertake three tasks. First, we analyze four variations of this reasoning: what we call the Kantian PA, the Aristotelian PA, the Catholic Church PA, and the Psychological PA. Second, we show how some public policies that regulate or prohibit abortion around the world are now in fact following paternalistic justifications and imposing distinctive paternalistic restrictions ; we refer to these policies as “the new abortion laws.” Finally, we argue that both the four paternalistic arguments presented and the new abortion laws are at times ill-intentioned, comprehensive in nature and thus unsuited for guiding public policy, empirically flawed, or else unjustified. Recent debates in just war theory have been concerned with the status of combatants during war. Unfortunately, however, the debate has, up to now, focused on self-defensive wars. The present article changes the focus slightly by exploring the status of combatants during military humanitarian intervention (MHI). It begins by arguing that MHI poses a number of challenges to our thinking about the status of combatants. To solve these it draws on Jeff McMahan's theory of combatant liability. On this basis, the (...) article contends that, first, combatants engaged in atrocities lack the same set of rights and liberties held by intervening combatants. Second, and more controversially, drawing on McMahan's theory as well as the notion of complicity, it suggests that the same applies to those combatants who do not perpetrate atrocities but are merely ordered to defend the target state against the intervening state. Theories of recognition have largely neglected the question of whether “struggles for recognition” might permissibly use violent means. In this article I explore the question of whether and how it is possible to show proper respect for the victim of one’s violence. Focusing on self-defense as the paradigmatic case of justified violence, two questions arise: (1) What renders an agent liable to violent action? (2) If she is liable, what is the appropriate, i.e., proportionate, degree of defensive violence that still (...) expresses respect for her? I claim that – in order to answer these questions – three dimensions of what is defended must be distinguished: goods, rights and one’s moral status. Clarifying their relationship allows me to argue that persons become liable to defensive violence if they directly pose (or intentionally and significantly contribute to) an unjustified threat to important goods protected by the rights of another person, even if they, as “attackers “or “threats “are innocent, i.e., do not display disrespect. I argue that those accounts which claim a moral symmetry between innocent attackers or threats on the one hand and innocent bystanders on the other hand, misunderstand the role of (dis) respect in a theory of justified violence. Moreover, when it comes to considerations of proportionality the dimension of (dis) respect has to be taken much more seriously than is usually the case. Here, instead of focusing mainly on the importance of goods we should pay more attention to (especially political) relationships of intersubjective (dis) respect. (shrink)

Much philosophical attention has been paid to the question of whether, and why, one may divert a runaway trolley away from where it will kill five people to where it will kill one. But little attention has been paid to whether the reasons that ground a permission to divert thereby ground a duty to divert. This paper defends the Requirement Thesis, which holds that one is, ordinarily, required to act on lesser-evil justifications for harming for the sake of others. Cases (...) in which we have lesser-evil justifications of harming for the sake of others are rescue cases. Ordinarily, an agent is under a duty to rescue unless doing so imposes too great a cost on her, or violates someone else's rights. When neither of these defeating conditions obtain, one is required to rescue even if this involves causing harm to innocent people. (shrink)

In “Evictionism and Libertarianism,” published in this journal, Walter Block defends the view that, although the fetus is a human being with all the rights to its body, it may nonetheless be evicted from the woman’s body as a trespasser, provided the pregnancy is unwanted. We argue that this view is untenable: the statement that the unwanted fetus is a trespasser does not follow from the premises that the fetus uninvitedly resides in the woman’s body and that the woman is (...) a full self-owner. For this statement to follow, one more statement would have to be true; namely, the woman would have to hold her self-ownership rights specifically against the fetus, and for this to be the case, the fetus would have to have a correlative duty to the woman to abstain from interfering with her body. Re-Reading: Judith Jarvis Thompson, 'A Defense of Abortion'.

The study attempts to determine whether or not human fetuses have moral status. Three broad categories of answers to the question were analyzed. The arguments developed by Michael Tooley in Abortion and Infanticide are assessed as representative of the liberal view. Those of L. W. Sumner in Abortion and Moral Theory stand as moderate claims and in the position defended by William May in "Abortion and Man's Moral Being" represents a conservative position. The work of other authors is drawn upon (...) to help analyze the central arguments and to provide alternate interpretations. Among these are Jane English, Judith Thomson, Christina Hoff Sommers, Ronald Green, Joseph Donceel, Lawrence Becker, and Gareth Matthews. ;Though each of the three principal authors is found to present potentially forceful arguments, none of them is thought to provide a fully convincing account of the moral status of fetuses. Important difficulties stem from the use of particular theories of rights and from inadequate treatment of the concept of potentiality. ;The study arrives at two conclusions. The first is that arguments for or against the moral status of fetuses are grounded in more basic, conflicting moral theories about rights or moral behavior. Thus the question of the moral status of fetuses is not likely to receive a universally acceptable answer before moral philosophers come to agreement on basic moral principles. ;The second is that the discussions above have nonetheless yielded two important considerations which together form the basis of a tenable position on the moral status of fetuses. I suggest that an argument can be developed from two claims. One is a conservative claim that an embryo or fetus is the same entity as a later human being. The other is a moral principle discussed by Michael Tooley, viz. that where an entity will at some time in its life have rights, it is wrong to affect it so that the entity will be incapable of exercising those rights when the time comes. The argument supports the conclusion that, from the period of the embryo on, there is an entity that merits our moral consideration. (shrink)
