In this essay both the facts/values and facticity/normativity divides are considered from the perspective of global semiotics and with specific regard to the relationships between legal meaning and spatial scope of law’s experience. Through an examination of the inner and genetic projective significance of categorization, I will analyze the semantic dynamics of the descriptive parts comprising legal sentences in order to show the intermingling of factual and axiological/teleological categorizations in the unfolding of legal experience. Subsequently, I will emphasize the translational (...) and enactive cognitive disposition underlying the construction of the second premise of the so-called judiciary syllogism and thereby the untenability of the idea that ‘law makes its facts.’ Hence, I will try to bring to the fore the cultural pre-assumptions encapsulated in the positivistic and therefore also formalistic or analytical approaches to legal experience and the loss of their inner consistency when legal experience confronts the phases and major changes of global semiotics. Finally, I will strive to relativize the opposition between the positivist and non-positivistic theories of law in view of an understanding of legal experience focused not only, or at least not primarily, on what ‘law is’ but also on ‘how’ it unwinds through, and _in spite of_, environmental and semantic transformations. Is tragedy, as Nietzsche declared, dead? In recent years many philosophers have reconsidered tragedy's relation to philosophy. While tragedy is deemed to contain important lessons for philosophy, there is a consensus that it remains a thing of the past. This article calls this consensus into question, arguing that it reifies tragedy, keeping tragedy at arm's length. With the interest of identifying the necessity of tragedy to philosophy, it draws from Quentin Skinner to put forward an alternative approach to genre as (...) living form. This approach alters our understanding of the philosopher at the heart of philosophy's dialogue with tragedy, Immanuel Kant. Drawing on various resources and requirements (as expressed by Dewey, Wittgenstein, Sellars, and Brandom), this paper proposes an externalist view of conceptual mental episodes that does not equate them, even partially, with vehicles of any sort, whether the vehicles be located in the environment or in the head. The social and pragmatic nature of the use of concepts and conceptual content makes it unnecessary and indeed impossible to locate the entities that realize conceptual mental episodes in non-personal or subpersonal contentful (...) entities (vehicles). Persons, who engage in social practices of deontic scorekeeping (Brandom), and who are thus able to produce appropriate inferential behaviour, enact conceptual mental episodes and the basis of their supervenience. Central to Dewey’s treatment of the nervous system throughout his work is its import for ameliorative action. Dewey’s theory of mentation has its origins in his early thought in which he draws on contemporary physics and biology to incorporate the nascent understanding of the nervous system. This interdisciplinary approach continues through his career. After selectively reviewing Dewey’s remarks about brains and nervous systems, I apply his ameliorative theory of mind and brain to our contemporary situation in which our digital devices (...) work against the energetic focusing that Dewey saw as integral to healthy nervous system function. I consider the threat of what Tschaepe calls dopamine democracy and reflect on whether neuropragmatism is able to meet that challenge. (shrink)

Cognitive science and its philosophy have been far too long consumed with representation. This concern is indicative of a creeping Cartesianism that many scientists and philosophers wish to evade. However, their naturalism is often insufficiently evolutionary to fully appreciate the lessons of pragmatism. If cognitive neuroscience and pragmatism are to be mutually beneficial, the representational-friendly scientists and the anti-representational pragmatists need an alternative to representation that still accounts for what many find so attractive about representation, namely intentionality. I propose that (...) instead of representations we philosophers and scientists begin thinking in terms of cultural affordances. Like Gibsonian affordances, cultural affordances are opportunities for action. However, unlike Gibsonian affordances, which are merely biological and available for immediate action in the immediately present environment, cultural affordances also present opportunities for thinking about the past and acting into the future—tasks typically attributed to representations. Hay una exposición de aspectos centrales que sobre el pragmatismo expuso Charles Pierce, específicamente sobre las creencias, el signo como mediación cognitiva, así como una consideración de las ciencias para comprender el papel tanto del razonamiento como de la percepción y el instinto. Igualmente, se exponen elementos claves de la (...) teoría del conocimiento de John Dewey, quien ante el rechazo declarado al racionalismo cartesiano y sin limitarse a la experiencia como punto de referencia para la clarificación conceptual, se encamina más a unas vivencias y contactos con un mundo observado comprometiendo así la realidad sentida la propia mente. El pragmatismo implica atención a lo que nos rodea sin generar separaciones entre sensibilidad y razón o entre pensamiento y emoción, lo cual hace que los asuntos de la ciencia y del conocimiento no se den ajenos a las acciones democráticas entre los individuos activos y sus colectivos. Rule systems are used every day to share experience, pre-existing knowledge, beliefs and ethical rules, and to provide instructions for future action. This article expands and builds upon an approach pioneered by Julius M. Moravcsik to argue that ethics cannot be completely codified into a rigid set of rules, because any such set lacks a misapplication-correcting sensibility. Thus, an ethics that is transferred purely by means of a rule-set is incomplete and thus cannot be used reliably to guide future action. (...) The balancing sensibility is formed out of pre-existing expert knowledge and takes account of the limitations of rule-sets in specific contexts. Moravcsik’s approach is then expanded by incorporating it into a holistic framework for the analysis, guidance and development of actions to be taken to support the emergence, selection and implementation of solutions for a sustainable future. This thesis argues that John Dewey’s theory of collective intelligence presents a unique critical social theory that escapes the dead-ends of Frankfurt School critical theory and speaks directly to the political situation faced today by academics and the public. In Part 1, Dewey’s critical social theory is argued to present a ‘method of democracy’ that proposes a form of ‘intelligent populism’ as the mode of collective action in contemporary ‘political democracies’. Part 2 applies the method of democracy to the contemporary (...) ‘problematic situation’ of neoliberalism in crisis. It is argued that ‘third-wave neoliberalism’ in the UK has turned to higher education as a solution to this crisis, seeking to redirect HE through the TEF, REF and KEF national performance management systems to the needs of a stagnating monopoly capitalist economy. Part 3 explores ways out of the current crisis based on Dewey’s theory of collective intelligence. Beginning with the institutional context of social theory today, Michael Burawoy’s theory of public sociology is reconstructed as ‘democratic sociology’ based on a practice of ‘co-inquiry’ with the public. While Burawoy argues that the ‘founding tension’ in sociology between professional and radical sociology can be resolved by establishing an ‘organic solidarity’ within the discipline, the analysis of marketisation presented in the thesis suggests that only by uniting with other academics and the public in the fight against neoliberalism can sociologists avoid co-optation. The method of democracy then provides the basis for a reconstruction of the academic profession on a model of ‘democratic collegiality’. Democratic collegiality in turn offers a solution to the contradictions in governance arising from marketisation, pointing to the ‘social co-operative’ as an ideal form for democratised universities. Finally, Corbynism is argued to be a ‘verification’ of Dewey’s hypothesis of intelligent populism, and the book concludes with an analysis of the Lucas Plan, which offers valuable lessons for activist-academics seeking to help realise this genuine alternative to neoliberalism today. What distinguishes the philosophies of education advanced by pragmatists? Does pragmatism have something distinctive to offer contemporary philosophy of education? This paper applies these questions, which Randall Curren asks in “Pragmatist Philosophy of Education” (2009), to a more specific current debate in philosophy of education: the debate over educating for critical thinking, and/or for intellectual virtues. Which, if either, should be given priority in higher education, and why?
