No obstante, su posición académica y social dominante informa el «sentido común» filosófico- político de nuestra época. Locke constituye un ejemplo de cómo la coyuntura interpretativa liberal, que se desplegó en el siglo XIX y se consolidó en el XX, ha oscurecido una parte de la complejidad y pluralidad de las (...) tradiciones intelectuales y normativas que heredó. This paper concentrates on three connected features of Taylor's argument. I begin by considering his historical sections on the formation of the modern identity, raising some doubts about the focus of his discussion and offering some specific criticisms in the case of Locke and Rousseau. Next I examine Taylor's list of the moral imperatives allegedly felt with particular force in the contemporary world. I question the extent to which the values listed by Taylor are genuinely shared, and point to a (...) range of criticisms put forward by conservatives, Marxists, feminists, and other opponents of liberalism, all of whose doubts Taylor appears to underestimate. Finally, I address Taylor's underlying claim that a religious dimension is indispensable if our highest human potentialities are to be realized, and conclude with a critique of his theistic arguments. Although John Locke’s theory of appropriation is undoubtedly influential, no one seems to agree about exactly what he was trying to say. It is unlikely that someone will write the interpretation that effectively ends the controversy. Instead of trying to find the one definitive interpretation of Locke’s property theory, this article attempts to identify the range of reasonable interpretations and extensions of Lockean property theory that exist in the contemporary literature with an emphasis on his argument for unilateral appropriation. It (...) goes through Locke’s argument point-by-point discussing the controversy over what he said and over what he perhaps should have said to make the most valuable and coherent argument. The result is an outline of Lockean theories of property: a menu of options by which one might use appropriation to justify property rights. Supporters only need to pick the version they find most plausible, but opponents should be aware of the entire menu. Anyone claiming to refute appropriation-based property rights must address not only one but all potentially valid versions of it. (shrink)

Although contemporary Confucianists tend to view Western liberalism as pitting the individual against society, recent liberal scholarship has vigorously claimed that liberal polity is indeed grounded in the self-transformation that produces “liberal virtues.” To meet this challenge, this essay presents a sophisticated Confucian critique of liberalism by arguing that there is an appreciable contrast between liberal and Confucian self-transformation and between liberal and Confucian virtues. By contrasting Locke and Confucius, key representatives of each tradition, this essay shows that both liberalism (...) and Confucianism aim to reconstruct a society freed from antisocial passions entailing a vicious politics of resentment, and yet come to differing ethical and political resolutions. My key claim is that what makes Confucian self-cultivation so distinctive is the incorporation of ritual propriety ( li ) within it, whereas liberal self-transformation that relies heavily on a method of self-control comes back to the problem that it originally set out to overcome. This paper investigates Locke’s views about materialism, by looking at the discussion in Essay IV.x. There Locke---after giving a cosmological argument for the existence of God---argues that God could not be material, and that matter alone could never produce thought. In discussing the chapter, I pay particular attention to some comparisons between Locke’s position and those of two other seventeenth-century philosophers, René Descartes and Ralph Cudworth. -/- Making use of those comparisons, I argue for two main claims. The first is (...) that the important argument of Essay IV.x.10 is fundamentally an argument about the causation of perfections. Indeed, Locke gives multiple such arguments in the chapter. My second main claim is that my proposed reading of IV.x is not merely consistent with what Locke says elsewhere about superaddition, but also provides reasons to favor a particular understanding of what superaddition is. Michael Moehler’s Minimal Morality: A Multilevel Social Contract Theory makes important contributions to the social contract tradition, particularly in exploring how social contract theories can address challenges that arise from deep moral pluralism. Fundamentally, the work provides a multilevel account of morality, though simplified for presentation as a two-level view of morality. These two levels of morality differ significantly in their form and in their contexts of applicability. One level is that of ‘traditional morality’, involving a rich set of practices, (...) motivations and shared values common to many mainstream moral theories. For instance, John Rawls provides a version of traditional morality in the form of principles of justice grounded in a shared conception of society as a system of cooperation between free and equal citizens motivated by a sense of justice. The second level is that of ‘minimal morality’, for which the book is named. Minimal morality is grounded in purely prudential and instrumental reasoning, and thus does not rely upon any special moral commitments or motivations. This latter level of morality, Moehler argues, is particularly important for societies possessing extremely deep moral pluralism rather than the moral consensus necessary for traditional moral. This paper argues that Gadamer's hermeneutics offers a methodological perspective for social and political theory that overcomes the impasse created by the dichotomy between the positivist and humanist approaches to social action. Both the positivists’attempt to replace the actors’subjective concepts with the objective concepts of the social scientist and the humanists’attempt to describe meaningful action strictly in the social actors’terms have been called into question in contemporary discussions. Gadamer's approach, which is based on the hermeneutical method of textual interpretation, offers (...) an alternative to both the positivist and humanist perspectives. Gadamer argues that understanding a text involves the fusing of the conceptual schemes of author and interpreter. Relying on Ricoeur's analysis of the parallels between actions and texts, it is argued that this understanding of the process of textual interpretation can be profitably applied to the analysis of social action. This application, furthermore, provides a means of analyzing social action that transcends the dichotomy between the positivist and humanist approaches. Gadamer's approach legitimizes the imposition of the observer's conceptual scheme without denying the constitutive role of the social actors’concepts. (shrink)

Abstract There has been a strong tendency in economic thought to try to take human wants, desires, and preferences as the basis for deciding how to act. This essay argues that ?needs? constitute a distinct category which cannot be reduced to preference. The reductive strategy is partly connected with a philosophical mistake about the relation between the subjective and the objective. The distinction between needs and wants must be central to any continuing form of human action, but it may also (...) not be understood in such a way as to posit some purely objective (perhaps biological) needs that can be specified independently of people's wishes and desires; nor can those desires be specified outside the context of an account of the various ways in which they arise out of, are embedded in, and are directed to ?objective? features of our world. In much of the literature on Hobbes, he is considered a proto-liberal, that is, he is seen as setting up the apparatus that leads to liberalism but his own authoritarian streak makes it impossible for liberals to completely claim him as one of their own. In this paper, I argue that, far from being a precursor to liberalism, Hobbes offers a political theory that is implicitly anti-liberal. I do not mean this in the conventional sense that Hobbes was too conservative (...) for liberalism. On the contrary, I will argue that in his writing, Hobbes evinces a concept of collective interpretation, theories of individualism and the nature and possibilities for democratic politics, that is radical and offers a completely developed alternative to liberalism even as it eschews conservative and reactionary models as well. I focus in particular on the idea of individualism and how the model offered by liberals and conservatives offers far less in terms of individual choice and justice than Hobbes’s own theory does, however paradoxical this may seem. John Locke was considerably interested and actively involved in the promotion of Protestant Christianity among American Indians and African slaves, yet this fact goes largely unremarked in historical scholarship. The evidence of this interest and involvement deserves analysis—for it illuminates fascinating and understudied features of Locke's theory of toleration and his thinking on American Indians, African slaves, and English colonialism. These features include (1) the compatibility between toleration and Christian mission, (2) the interconnection between Christian mission and English geopolitics, (3) (...) the coexistence of ameliorative and exploitative strands within Locke's stance on African slavery, and (4) the spiritual imperialism of Locke's colonial vision. Analyzing evidence of Locke's interest and involvement in Christian mission, this article brings fully to light a dimension of Locke's career that has barely been noticed. In so doing, it also illustrates how the roots of toleration in the modern West were partly evangelical. (shrink)

Abstract Inspired by Rawls?s admission that his twentieth?century contract theory builds in the parochial horizon of modern constitutional democracy, this essay critically examines two truisms about seventeenth?century contract theory. The first is the stock view that the English case is irrelevant to the logic of Leviathan and the Second Treatise. To the contrary, I argue that their political conclusions depend on introducing constitutional and legal ?facts?, in particular, facts about the constitution of the English monarchy. Second, I challenge the Whiggish (...) characterization of contract theory as an important step in the development of democratic sovereignty. I draw on Hume?s famous critique of the genre to make the case that seventeenth?century contract theory addressed a peculiarly ancien?regime issue ? namely, resistance to legitimate rulers. In both respects, Hobbes?s and Locke?s social contracts are properly regarded as ancien?regime theories of politics. They are, as Rawls would put it, ?political not metaphysical? theories. (shrink)

The paper discusses the foundation and genesis of the political society according to Locke, elaborating why the relationship between the civil society and the government is not defined in contractual terms, but by the notion of “trust”. Rehm argues against the view that Locke supports a liberal proceduralism, stressing that consent for him is indeed the necessary, but not the sufficient condition of legitimate political power: what needs to be added is action in accordance with the law of nature.

C.B. Macpherson's “Possessive Individualist” reading of Locke is one of the most radical and influential interpretations in the history of exegesis. Despite a substantial critical response over the past five decades, Macpherson's reading remains orthodox in various circles in the humanities generally, particularly in legal studies, and his interpretation of several crucial passages has unwittingly been followed even by his sharpest critics within Lockean scholarship. In order to present the definitive rebuttal to this interpretation, and so finally to lay it (...) to rest, I argue that every one of Macpherson's key pieces of textual evidence can be rejected entirely on its own terms; that is, by reference to no more than its immediate context. In this way I contend that fault of the Possessive Individualist reading lies far deeper than mere cherry-picking of the Lockean corpus, but centrally involves misreading, misplacing and misrepresenting the very parts of Locke's work Macpherson cites as evidence for his reading. The debate over the nature of egalitarianism has come to dominate political philosophy. As ever more sophisticated attempts are made to describe the principles of an egalitarian distribution or to specify the good or goods that should be distributed equally, little is said about the fundamental basis of equality. In virtue of what should people be regarded as equal? Egalitarians have tended to dismiss this question of fundamental equality. In the first part of the paper I will examine some of (...) these strategies of marginalisation and assess whether the issue of fundamental equality matters. Jeremy Waldron has criticised this strategy of avoidance in his recent book God, Locke and equality. He argues that Locke’s turn to a theistic grounding for fundamental equality provides a better approach to the problem than the approach taken by contemporary liberals such as John Rawls. I will examine Waldron’s critique of Rawls and show that it is wanting. I will conclude by suggesting that Rawls’s approach to the issue has a bearing on the way in which equality should be understood as a political value. This argument for the primacy of a political conception of egalitarianism has a bearing on the interconnection between core liberal values and the idea of the state that has been emphasised by Rawls, Dworkin and Nagel. This article argues that protection of the environment requires reconsidering basic liberal ideas relating to value and growth. It selects a central thinker in the liberal tradition, John Locke, as a starting point. The article first shows how Locke’s political writings at first glance might support a “possessive individualist” position that gives primacy to individuals and their rights to property in a way that blocks governmental action to protect the environment, much as some modern versions of liberalism and libertarianism maintain. (...) However, there are other aspects of Locke’s writings that undermine this position. In particular, a reconsideration of his views on private property in combination with his views on the harm principle, the common good, and future generations can support the position that an individual’s right to exploit nature is indeed limited. These elements of Locke are strengthened considerably if Locke’s view of nature is updated by reconsidering nature as composed of ecosystems and as providing ecosystem goods and services. That land should continue to produce abundantly is foundational to Locke, and the failure to protect the ecosystems that provide key services supporting this abundance harms both the property of others and the viability of society: preservation of these constitute a collective good that transcends the individual good. The protection of ecosystem services also works to protect the value of individual holdings as well as the value of land still held in common. Finally, Locke’s writing supports the view that it is the role of government to act to protect the abundance of nature, even against the wishes of an individual property owner.Article first published online: 25 Feb 2017. A philosophical genealogy of the development of liberal 'arts of government' through the work of John Locke and Michel Foucault.

Most comparisons of Thomas Hobbes and Baruch Spinoza focus on the difference in understanding of natural right. We argue that Hobbes also places more weight on a rudimentary and exclusive education of the public by the state. We show that the difference is related to deeper disagreements over the prospect of Enlightenment. Hobbes is more sanguine than Spinoza about using the state to make people rational. Spinoza considers misguided an overemphasis on publicly educating everyone out of superstition—public education is important, (...) but modes of superstition may remain and must be offset by institutions and a civil religion. The differences are confirmed by Spinoza’s interest in the philosopher who stands apart and whose flourishing may be protected, but not simply brought about, by rudimentary public education. Spinoza’s openness to a wisdom-loving elite in a democracy also sets up an interesting parallel with Thomas Jefferson’s own commitment to the natural aristocracy needed to sustain republicanism. In demonstrating the 17th century philosopher’s skepticism toward using the state exclusively to promote rationality, even as he recognizes the importance of a sovereign pedagogical role and the protection of philosophy, we move to suggest that Spinoza is relevant to contemporary debates about public education and may reinvigorate moral and political discourse in a liberal democracy. In Minimal Morality, Michael Moehler justifies what he calls the weak principle of universalization as a principle of pure instrumental morality. This article addresses the application of this principle and problems associated with it. Specifically, the article focuses on the principle’s ability to protect the interests of the most vulnerable members of society: agents without primary moral standing, specifically non-human animals; and the weakest members of society, either as a result of their diminished relative bargaining power in certain cases of (...) conflict, or because of their present standing in society, made worse off by historical injustices. Scholarly discussion has treated the account of the state of nature which Locke presents in his Second Treatise as neither an hypothesis nor a description but rather as a fiction. John Dunn, for example, claims that it is a `theoretical analysis of the fundamental relations of right and duty which obtain between human beings, relations which are logically prior to the particular historical situations in which all actual human beings always in fact find themselves'. Here Dunn presents a misleading account (...) of Locke's argument, presumably, as the title of his paper suggests, in order to mount an argument of his own about the `political relevance' of Locke's work to a time when no one takes seriously the early modern idea of the state of nature. However, this article also has a more serious concern. I argue that the representation of the state of nature as a merely imaginary, `theoretical analysis' of social relations obscures the significance of the early modern idea of a state of nature, not only for the work of Locke and his near contemporaries, but also, more importantly, for the broader development of western social and political thought. The idea of an original condition of freedom and equality played a central role in Locke's argument, serving as a means both to undermine the view that humans were born into a natural condition of subjection to the rule of others and to justify European expropriation of land in the Americas. It also represented one end of a developmental continuum, running from the original, most primitive, condition of humanity through to the societies of contemporary western Europe, which was thought to encompass all sections of humanity. While the idea of an original asocial condition on which this continuum was based was later brought into question, a closely related developmental framework nevertheless informed later movements in history and the social sciences. After being abandoned in its original form, this category was finally revived in 20th-century political theory, this time precisely in the form that Dunn mistakenly ascribes to Locke. The article concludes by speculating on the relationship between these normative and empirical perspectives on the state of nature. (shrink)

This article suggests that the enterprise of Mark Bevir's book (The Logic of the History of Ideas, Cambridge, 1999), is the reverse of what his title implies. Bevir seeks not to delineate the peculiar logic of a specialised subfield of history called the ‘history of ideas’, but rather the logic which underlies historical pursuit considered in general as the ‘explanation of belief’. If this is so, then the relationship between belief, meaning, and speech act in intellectual texts, and the task (...) and method of the intellectual historian, must be reinterpreted along lines closer to those of Quentin Skinner than Bevir would allow. Indeed, Bevir's criticism of Skinner, which hinges on his own account of malapropism, is shown here to fail. The article concludes with brief reflections on the purpose and nature of studying the ‘history of ideas’. (shrink)

Although most scholars trace the Liar Paradox to Plato’s contemporary, Eubulides, the paper argues that Plato builds something very like the Liar Paradox into the very structure of his dialogues with significant consequences for understanding his views. After a preliminary exposition of the liar paradox it is argued that Plato builds this paradox into the formulation of many of his central doctrines, including the “Divided Line” and the “Allegory of the Cave” and the “Ladder of Love”. Thus, Plato may have (...) been the first to formulate the view that Graham Priest calls dialetheism, roughly, the view that some contradictions are, in an illuminating way, inescapable and true. The paper argues that Plato builds this Liar paradox into the formulation of his signature views because he holds that the attempt by finite human beings to theorize about transcendent realities results in the simultaneous necessity, and impossibility, of transgressing the limits of language—leading to the paradoxes. Finally, it is argued that the existence of these paradoxes in these Platonic doctrines is the direct result of an intrinsic hermeneutical circle in Plato’s aforementioned signature views. (shrink)

Creo que la defensa de John Locke del derecho a castigar está en tensión con su defensa de la igualdad humana. El propósito central de este artículo es mostrar que esta tensión podría ser resuelta si la justificación del derecho a castigar de Locke se basa en el concepto de confianza. Este concepto es claramente usado por Locke para justificar el derecho de resistencia. Pienso que también es posible usarlo para justificar la existencia del derecho a castigar. Pero, incluso si (...) esta justificación fuera exitosa, algunos problemas permanecen. I believe that John Locke's defense of the right to punish is in tension with his defense of human equality. The main purpose of this article is to show that this tension could be resolved if Locke's justification of the right to punish is based on the concept of trust. This concept is clarley employed by Locke to justify the right of resistance. I think that it is possible to use it also to justify the existence of the right to punish. The article discusses two basic paradigms of western educational theory, namely the concept of “influence” and the concept of “development”. Two historical contextes are analyzed, John Locke's theory of human learning and Jean-Jacques Rousseau's theory of natural development. Both theories are rejected in favour of a position beyond “influence” and “development”. This position of a theory of education ( Erziehung ) is marked with the term “moral communication”.

The present essay is the first part of an analysis regarding aspects of Aristotle’s ontology. Aristotle’s ontology is, in my opinion, a formal ontology that examines the fundamental structures of reality and that investigates the features belonging to entities such as substance, quantity, quality, universals. Aristotle’s ontology investigates, moreover, the reciprocal relations existing between these entities. Aristotle’s interpretation of universals is not, in my opinion, a nominalist interpretation of universals: I do not think Aristotle regards universals as being only mental (...) entities. Aristotle, rather, aims at the differentiation between the realms of reality to which individuals and universals belong. In this part of my investigation, I first expose my interpretation of the fundaments of Aristotle’s ontology. Thereafter, I concentrate my attention on chapter Metaphysics Zeta 13: I comment on Aristotle’s investigation regarding the ontological features belonging to the universal qua universal and to the substance qua substance. I analyse the ontological laws that Aristotle finds about universal and substance: substance and universals are considered by Aristotle as mutually incompatible entities. The analysis shows that a false interpretation of the features of the universals endangers the whole ontology. Moreover, the Third-Man-Regress, which is one of the consequences of the misunderstanding of the position of universals in the reality, is regarded as the key to the interpretation of one of Aristotle’s aims: Aristotle aims at the foundation of a typological ontology putting individual entities and universal entities on different levels of reality. The danger of the Third-Man-Regress is avoided through the introduction of a new ontology, that is, through the introduction of the typological ontology of the entities. (shrink)

La relación entre patrimonio y derechos políticos en la obra de John Locke ha sido ampliamente discutida. Por un lado, se encuentran posiciones como las de Kendall y Tully que atribuyen un carácter democrático a la concepción lockeana sobre la sociedad civil. Por otro, interpretaciones como las de Ashcraft que le asignan un sesgo revolucionario e igualitario, próximo a la concepción de los Levellers. Sin embargo, a la luz de una serie de documentos, es posible discutir estas interpretaciones, como ya (...) lo han hecho diversos intérpretes parcialmente. Se mostrará aquí que Locke supone que la discusión parlamentaria compete a quienes, representando a los diferentes sectores productivos, discuten la promoción de sus actividades y que los trabajadores, al no disponer de la formación necesaria para la discusión sobre los asuntos públicos, no son considerados para participar del ejercicio parlamentario sino sólo de una resistencia excepcional. In my dissertation, I engage in a political history of waste; in particular I look at modern philosophers from the late seventeenth and early eighteenth centuries and the way that waste functions alongside narratives of civilization, progress, and perfection. I analyze the political, pedagogical, and other theories of John Locke, Jean Jacques Rousseau, and Immanuel Kant. I use Julia Kristevaâs concept of abjection to trace the legacies of these philosophers to the continued and continuing practices of wasting life their work (...) supports and maintains. Social contract theory must have its others, those wasted and abjected to limn the boundary of the âclean and properâ civilized order. Locke abjects waste in his theory of property and I link the use of his term âwastelandâ to the wastelanding of Native Americans. As Kristeva says the forgetting, repressing, or disavowal of abjection leads to the return of its repressed in the form of our âapocalypses.â I discuss Rousseauâs treatment of waste and the way it is ambivalently embraced, which I think is a more appropriate treatment of waste. I also compare Emile and Sophieâs education and argue that his education of women makes waste of their lives. Last, I discuss Kantâs theory of waste and race together, arguing that he redeems all waste and that he makes waste of all races except the white race. He assents to the use of people of color as means for the white raceâs ends, rather than treating them as ends in themselves. Thus, I conclude that social contract theories are wasteful of life and lives and that contract theory should be garbaged for a new political principle: to not make waste of life or lives. (shrink)

This article treats about the influence of Hobbes on the early writings of John Locke, Two Tracts on Government. These Tracts don’t have a particular importance in understanding Locke’s work, but they are important for understanding the spirit of the time and the intellectual development of the author of the Second Treatise. In the Two Tracts, Locke defends a conservative position in the matter of government’s role in regulating the religious policy. Locke was a puritan, but he was part of (...) that direction of Puritanism which remained attached to the Church of England and, therefore, he was critique of the anarchical spirit of radical and sectarian Protestants. Therefore, he defended the thesis that religious feelings should be subordinated to the reasons of State, as defined by the political authority. For a better understanding of the issues of the Two Tracts, we first analyze the political context in which they were written, and the main theories of that time in matter of politics and religion, especially Hobbes’s. Then, we show that the main argument of Locke in Two Tracts could be considered as hobbist, the “hobbism” being, in that time, the use of a Hobbesian view even in the refutation of Hobbes. (shrink)
