Many theories of social justice maintain that concern for the social bases of self-respect grounds demanding requirements of political and economic equality, as self-respect is supposed to be dependent on continuous just recognition by others. This paper argues that such views miss an important feature of self-respect, which accounts for much of its value: self-respect is a capacity for self-orientation that is robust under adversity. This does not mean that there are no social bases of self-respect that such theories ought (...) to incorporate. It means that they are different: they consist of the motivational and epistemic resources needed to develop and maintain such robustness. (shrink)

This article adapts John Rawls’s writings, arguing that past injustice can change what we ought to publicly affirm as the standard of justice today. My approach differs from forward-looking approaches based on alleviating prospective disadvantage and backward-looking historical entitlement approaches. In different contexts, Rawls’s own concern for the ‘social bases of self-respect’ and equal citizenship may require public endorsement of different principles or specifications of the standard of justice. Rawls’s difference principle focuses on the least advantaged socioeconomic group. I argue (...) that a historicized difference principle considers the relative standing of racial, gender, and other historically stigmatized groups; provides their members assurance by weakening incentives to manipulate justice to another group’s advantage; and may result in policies resembling reparations, though justified by forward-looking considerations of self-respect and public assurance. I then examine how disrespectful justifications were historically used to forcibly include indigenous peoples as citizens. While Rawls thinks providing citizens one package of basic liberties signals respect, indigenous self-government could better support self-respect. I invoke Rawlsian international justice, which calls for mutual respect between peoples. Indigenous peoples’ status should reflect their past and persisting peoplehood, providing assurance by weakening incentives to unjustly transform international into domestic contexts. (shrink)

ABSTRACT:This paper re-examines the import of Rawls’s theory of justice for private sector institutions in the face of the decline of the welfare state. The argument is based on a Rawlsian conception of justice as the establishment of a basic structure of society that guarantees a fair distribution of primary goods. We propose that the decline of the welfare state witnessed in Western countries over the past forty years prompts a reassessment of the boundaries of the basic structure in order (...) to include additional corporate institutions. A discussion centered on the primary good of self-respect, but extensible to power and prerogatives as well as income and wealth, examines how the legislator should intervene in private sector institutions to counterbalance any unfairness that results from the decline of the welfare state. This paper proposes a sufficientarian theory with an interval of sufficiency levels. I assume that there are upper and lower bounds of sufficiency and that all well-being levels in between can be considered sufficiency levels. This interval reflects the vagueness of the concept of sufficiency. According to the proposed principle, a distribution is morally better than another if and only if, for each threshold within the interval, the headcount of those below the threshold under the former distribution is smaller than (...) that under the latter distribution. This necessarily leads to incommensurability in moral relations. I argue that such incommensurability makes sufficientarian principles invulnerable to some fundamental objections. (shrink)

Anti-commodification theorists condemn liberal political philosophers for not being able to justify restricting a market transaction on the basis of what is sold, but only on the basis of how it is sold. The anti-commodification theorist is correct that if this were all the liberal had to say in the face of noxious markets, it would be inadequate: even if everyone has equal bargaining power and no one is misled, there are some goods that should not go to the highest (...) bidder. In this paper, I respond to the anti-commodification critique of liberalism by arguing that the political liberal has the wherewithal to account not only for the conditions under which goods should not be sold, but also for what kinds of goods should not be for sale in a market economy. The political liberal can appeal to a principle of equal basic rights, and to one of sufficiency in basic needs and the social bases of self-respect, I argue, to account for what’s problematic about markets in civic goods, necessary goods, and physical goods including body parts and intimate services. Economic disparities often translate into disparities in political influence, rendering political liberties less worthy to poor citizens than to wealthier ones. Concerned with this, Rawls advocated that a guarantee of the fair value of political liberties be included in the first principle of justice as fairness, with significant regulatory and distributive implications. He nonetheless supplied little examination of the content and grounding of such guarantee, which we here offer. After examining three uncompelling arguments in its favor, we complete a more (...) promising yet less explored argument that builds on the value of self-respect. We first inspect the conditions and duties that securing self-respect entails. I argue social and political freedom is not primarily about the absence of constraints, whether those constraints be in the form of interference or domination. Instead, social freedom is centrally about what makes us free. That is, the question of social freedom is first and foremost about determining the positive preconditions of being a free person within society. Social freedom is about what I call the social bases of freedom, or those features of our social world that we have a (...) reason to rely on in making plans or going about our business. (shrink)

Rawls argues that ‘Parties in the original position would wish to avoid at almost any cost the social conditions that undermine self-respect’. But what are these social conditions that we should so urgently avoid? One evident candidate might be conditions of material inequality. Yet Rawls seems confident that his account of justice can endorse such inequalities without jeopardising citizens’ self-respect. In this article I argue that this confidence is misplaced. Unequalising incentives, I claim, jeopardise the self-respect of those least advantaged—at (...) least under a Rawlsian schema—by undermining the very processes by which Rawls hopes to make distributional inequalities and self-respect compatible. I begin by setting out Rawls’s distinct account of self-respect before moving to describe how Rawls expects the difference principle to support citizens’ in this regard. I then draw upon GA Cohen’s distinction between ‘strict’ and ‘lax’ interpretations of the difference principle to argue that the presence of unequalising incentives undermines both the direct and indirect support that the difference principle can offer to citizens’ self-respect. As such, I claim that Rawls must either weaken his endorsement of unequalising incentives, or risk violating his ‘prior commitment’ to avoiding social conditions harmful to citizens’ self-respect. This paper argues that climate migration-in case of climate refugees in a strict sense-differs from other forms of migration not only by its finality but also by the fact that entire communities are forced to resettle elsewhere. For such communities to migrate with dignity-that is in a way that protects the social bases of their self-respect-their host countries are required to ensure the necessary institutional arrangements enabling these people to become full and equal members within a reasonably short time. Ensuring (...) that their equal participation rights are not merely formal but have ‘fair value’ requires taking cultural differences into account to ensure that they do not pose substantial disadvantages for participation in the political and social sphere. The paper takes as its starting point John Rawls’s claim that the social bases of self-respect is perhaps the most important primary good the distribution of which is governed by his principles of justice. There has been some debate about this claim in the literature and this debate has included important clarifications regarding the concept(s) involved. However, I think this discussion hasn’t gone deep enough and this – relative – lack of depth has or at least might have important implications (...) for our theory of distributive justice. To show this, I begin with Rawls’s admittedly sketchy remarks about the significance of self-respect in his theory. After this I briefly describe the debate that followed: what emerges here is a distinction between two kinds of self-respect. While I think this distinction is in good order, I also think and subsequently argue, building on the work of Robin Dillon and Anna Bortolan, that it only scratches the surface of the complex phenomenon of self-respect. In particular, as these authors show, the self-respect complex is, in fact, a multi-layered phenomenon and the distinction as used misses its fundamental level: basal self-respect (Dillon) or self-esteem (Bortolan). In the finishing part of the paper I discuss these two proposals to show that Bortolan’s version is the better one. All this then has clear relevance for the adjoining debate in political philosophy: all those who want to give an important role to self-respect in their theory of justice have potentially focused on the wrong target so far. This, I conclude, might well give rise to a new feminist critique of liberal egalitarian justice. (shrink)

The cardinal role that notions of respect and self-respect play in Rawls’s A Theory of Justice has already been abundantly examined in the literature. In contrast, it has hardly been noticed that these notions are also central to Michael Walzer’s Spheres of Justice. Respect and self-respect are not only central topics of his chapter “Recognition”, but constitute a central aim of a “complex egalitarian society” and of Walzer’s theory of justice. This paper substantiates this thesis and elucidates Walzer’s criticism of (...) Rawls that we need to distinguish between “self-respect” and “self-esteem”. (shrink)

As is well known, John Rawls opposes the idea and policy of basic income. However, this paper posits that his view of self-respect and activity could accommodate its implementation. Rawls lists the social basis of self-respect in social primary goods as the most important good, but does not assume that it is derived from wage labor alone. It appears that his theory of justice aims to criticize the work-centered (wage-labor) society and to overcome it. Besides, as Rawls desires, for our (...) work to be meaningful and our life worthwhile, we should institutionalize basic income because it can improve workers’ bargaining power and their attitude toward work, in addition to enhancing their leisure time. In this paper, by considering the normative relationship between meaningful work, worthwhile life, and self-respect from a Rawlsian perspective, I inquire into the potential of basic income in his well-ordered society. This article discusses the self-respect argument for basic liberties, which is that self-respect is an important good, best supported by basic liberties, and that this yields a reason for the traditional liberty principle. I concentrate on versions of it that contend that self-respect is best supported by basic liberties for reasons related to the recognition that such liberties convey. I first discuss the two standard approaches loosely associated with John Rawls and Axel Honneth. Here self-respect pertains to traits and conduct (...) (Rawls) or to one’s personhood (Honneth). It is argued that these approaches fail to show why self-respect is better supported by the liberty principle than certain alternatives worth taking seriously – unless (in the case of personhood self-respect) self-respect is construed in such a narrow way that it is not a condition for autonomy or welfare in any plausible sense. I then identify a self-attitude that I call “a sense of competence”, which at least shows that the liberty principle is more important to autonomy than what we might otherwise have reasons to believe. What should be the aim of LGBT-inclusive, state-mandated curricula in liberal, pluralist societies? In this article, I identify two distinct aims that such curricula might have. The first, LGBT Respect, aims to teach that LGBT individuals have equal political status and rights. The second, LGBT Approval, aims to teach a positive attitude towards LGBT relationships, including that there is nothing wrongful about these forms of relationship. I examine what arguments in favour of these different aims are available to the liberal (...) concerned with accommodating pluralism. To capture this concern, I adopt political liberalism's strict standard for legitimate political interventions that these must have justifications that all reasonable citizens can accept. This initially seems to recommend curricula that aim at LGBT Respect but stop short of LGBT Approval. Can the political liberal go any further? I propose and critically discuss the most promising arguments in favour of LGBT Approval, including the need to prevent harm to children, ensure political equality, and secure the social conditions needed for the development of the primary good of self-respect. I tentatively conclude that there exists a cumulative case for state-mandated curricula aiming at LGBT Approval, at least in the contingent, nonideal circumstances that currently obtain. (shrink)

The article critically examines the neo-Republican conception of respect put forward by Philip Pettit in Robust Demands of the Good. The paper argues that Pettit’s treatment of respect as a rich good in RDG is too thin in some ways, but too rich in others. There are four critical claims to support this argument. First, that both invading the domain of basic liberties, and failing to protect and resource the capacity to exercise choice, constitute individually sufficient conditions for disrespectful treatment, (...) and that the protection and resourcing of basic liberties are both relevant domains over which an appropriate disposition is also necessary for the provision of the rich good of respect. Second, that it is unnecessary and undesirable to rely on local conventions to provide a specification of the treatment that the status of respect requires. Third, that providing respect as a rich good in conditions of reasonable pluralism implies treating minorities in a disrespectful way. Fourth, that the role given to law in supporting the provision of the rich good of respect leads to a difficult dilemma for Pettit: either the full enjoyment of respect is not possible in nearby worlds, or it is only possible in ideal conditions that are far from nearby worlds. This paper aims to explore and examine the implied commitment to the premises of recognition in Rawls’s account of redistributive justice. It attempts to find out whether or not recognition relations that produce humiliation and cultural injustice can be followed to their logical conclusion in his theory of redistribution. This paper makes two claims. Firstly, although Rawls does not disregard the harms of misrecognition as demonstrated in his notion of self-respect being the most important primary good, he cannot liberally accommodate (...) the idea of humiliation as a case of injustice without compromising the basic premises of his theory. Secondly, while resource distribution produces indirect side effects that can impact upon cultural injustice, addressing recognition issues through the prism of redistribution can inadvertently result in further misrecognition. The paper concludes that in the final analysis Rawls wrongly takes redistribution as the overarching principle of justice to which recognition is but a subservient principle. (shrink)

My paper explores the question of when it is wrong for a state’s immigration criteria to discriminate against people with disabilities, focusing on the idea that discrimination is wrong when it demeans a group, rather than when it disadvantages them. I argue that selecting against people with disabilities often demeans them but might not always do so even when immigration criteria explicitly exclude people on the basis of having disabilities – that is, in cases of direct discrimination. Moreover, I demonstrate (...) that certain cases of less direct forms of discrimination that select against people with disabilities – in particular, when states apply health-cost limits on admissions – can function as proxies designed to exclude people with disabilities and thereby demean them. Finally, I explain why my analysis of discrimination’s wrong does not typically apply to health conditions in general, such as heart, liver, or lung disease or cancer, setting my view apart from a prominent view in the literature. In this article I examine the importance of self-respect in the justification of Rawls’s theory of justice. First, I present two elements that are part of the contemporary debate on self-respect as a form of self-worth—namely, moral status and merit. Second, I specify the bases that support self-respect within A Theory of Justice. Finally, I discuss at length the function of self-respect in justifying the principles of justice. This inquiry implies an analysis of the relationship between self-respect and the component (...) parts of the two principles of justice: basic liberties, fair equality of opportunity, and the difference principle. I also explore the connection between self-respect and the sense of justice in light of the stability argument, and how the relationship between the two is important for achieving social stability. The subject of this article is the Rawlsian right to personal property. Adequate discussion of this right has long been absent from the literature, and the recent rise in interest in other areas of Rawlsian thought on property makes the issue particularly pertinent. The right to personal property as proposed by orthodox Rawlsians – in this article, the position is represented by Rawls himself – is best understood, I claim, either as a right to be able to privately own housing (...) and personal items or as a right to actually own these things. I argue, however, that the resources of a Rawlsian theory cannot justify a basic right to property which is as extensive as this. Instead, what can be justified is a more limited set of rights, comparable with the rights we have over objects that we rent. Rawlsian justice, then, has a more radical implications in terms of basic property rights than has previously been thought. (shrink)

RESUMO O artigo examina se há alguma incompatibilidade entre práticas de discriminação privada e as duas partes do segundo princípio da justiça de Rawls, o princípio da equitativa igualdade de oportunidades e o princípio da diferença. Argumento que a discriminação no trabalho e em outras áreas importantes para o desenvolvimento das aptidões inatas somente atenta contra o PEIO quando tem como efeito geral o de tornar substancialmente desiguais as chances de cidadãos com similares aptidões inatas e motivação exercerem determinadas ocupações. (...) Comento também algumas dificuldades para considerar vedados pelo PEIO dois casos comuns de discriminação, a discriminação baseada em qualidade de reação e a discriminação por indicadores. Em relação ao PD, defendo que a proibição à discriminação privada se relaciona ao bem primário das bases sociais do autorrespeito e está circunscrita aos casos de discriminação degradante, como tal entendida, de acordo com Hellman, aquela cujo sentido expressivo é o de negar o igual status moral das pessoas pertencentes a um certo grupo. ABSTRACT This paper investigates the incompatibility between practices of private discrimination and the two parts of Rawls' second principle of justice, the fair equality of opportunity and the difference principle. I submit that discrimination at workplace and other sectors that are crucial for the development of natural talents only violates FEO when possessing the general effect of rendering substantially unequal the occupational chances of citizens with similar innate talents and motivation. I also point to some difficulties in proscribing, according to FEO, two common instances of discrimination, reaction qualification and proxy discrimination. Regarding the DP, my main statement is that a ban on private discrimination is related to the primary good of the social bases of self-respect and is circumscribed to instances of demeaning discrimination, defined, according to Hellman, as discrimination whose expressive meaning is denying people belonging to a given group their equal moral status.
