This essay addresses the other side of the robot ethics debate, taking up and investigating the question “Can and should robots have rights?” The examination of this subject proceeds by way of three steps or movements. We begin by looking at and analyzing the form of the question itself. There is an important philosophical difference between the two modal verbs that organize the inquiry—can and should. This difference has considerable history behind it that influences what is asked about and how. (...) Second, capitalizing on this verbal distinction, it is possible to identify four modalities concerning social robots and the question of rights. The second section will identify and critically assess these four modalities as they have been deployed and developed in the current literature. Finally, we will conclude by proposing another alternative, a way of thinking otherwise that effectively challenges the existing rules of the game and provides for other ways of theorizing moral standing that can scale to the unique challenges and opportunities that are confronted in the face of social robots. Despite widespread recognition of an emergent politics of data in our midst, we strikingly lack a political theory of data. We readily acknowledge the presence of data across our political lives, but we often do not know how to conceptualize the politics of all those data points—the forms of power they constitute and the kinds of political subjects they implicate. Recent work in numerous academic disciplines is evidence of the first steps toward a political theory of data. This article maps (...) some limits of this emergent literature with an eye to enriching its theoretical range. The literature on data politics, both within political theory and elsewhere, has thus far focused almost exclusively on the algorithm. This article locates a further dimension of data politics in the work of formatting technology or, more simply, formats. Formats are simultaneously conceptual and technical in the ways they define what can even count as data, and by extension who can count as data and how they can count. A focus on formats is of theoretical value because it provides a bridge between work on the conceptual contours of categories and the technology-centric literature on algorithms that tends to ignore the more conceptual dimensions of data technology. The political insight enabled by format theory is shown in the context of an extended interrogation of the politics of racialized redlining. (shrink)

This paper reinvents Freire’s concepts of ‘banking education’ and ‘literacy’ within the context of the exponential growth of digital instruction in the 21st century. We argue that digital learning (i.e. online or technology enhanced) undoubtedly increases access to education globally, but also can intensify some of the worst problems described in Freire’s banking model. Accordingly, we draw from postdigital theory to scrutinize the specific structures and functions of common digital Learning Management Systems (LMSs) used by schools (i.e. Blackboard and Google (...) Classroom) to reveal a type of learning that further exacerbates the teacher-student dichotomy without liberating either party in a Freirean sense. We then use a Foucauldian lens to bring an awareness to how the accelerated use of these systems at scale, in part caused by the COVID-19 pandemic, can further entrench a data-driven, dehumanized educational experience which increases corporate profitability perhaps over the needs of students. Finally, we use these insights to modernize Freire’s concept of ‘literacy’ by building on Critical Medial Literacy (CML) in order to help educators address LMSs, (mis)information facilitated by digital content, and schooling in a (post)pandemic and postdigital world. The field of computational law has increasingly moved into the focus of the scientific community, with recent research analysing its issues and risks. In this article, we seek to draw a structured and comprehensive list of societal issues that the deployment of automatically processable regulation could entail. We do this by systematically exploring attributes of the law that are being challenged through its encoding and by taking stock of what issues current projects in this field raise. This article adds to (...) the current literature not only by providing a needed framework to structure arising issues of computational law but also by bridging the gap between theoretical literature and practical implementation. Key findings of this article are: (1) The primary benefit (efficiency vs. accessibility) sought after when encoding law matters with respect to the issues such an endeavor triggers; (2) Specific characteristics of a project—project type, degree of mediation by computers, and potential for divergence of interests—each impact the overall number of societal issues arising from the implementation of automatically processable regulation. At the center of contemporary discourse on technology — or the digital discourse — is the assertion that network technology ushers in a new phase of capitalism which is more democratic, participatory, and de-alienating for individuals. Rather than viewing this discourse as a transparent description of the new realities of techno-capitalism and judging its claims as true (as the hegemonic view sees it) or false (a view expressed by few critical voices), this article offers a new framework which sees the (...) digital discourse as signaling a historical shift in the technological legitimation of capitalism, concurrent with the emergence of the post-Fordist phase of capitalism. Technology discourse legitimated the Fordist phase of capitalism by stressing the ability of technology and technique to mitigate exploitation. It hence legitimated the interventionist welfare state, the central planning in businesses and the economy, the hierarchized corporation, and the tenured worker. In contrast, contemporary technology discourse legitimates the post-Fordist phase of capitalism by stressing the ability of technology to mitigate alienation. It hence legitimates the withdrawal of the state from markets, the dehierarchization and decentralization of businesses, and the flexibilization of production and the labor process. (shrink)

Rapid advances in nanoscience and nanotechnology are profoundly influencing the ways in which we conceptualize the world of the future, and human ability to manipulate matter at the atomic and molecular levels offers previously unimagined possibilities for scientific discovery and technological applications. The convergence of nanotechnology with biotechnology, information technology, cognitive science, and engineering may hold promise for the improvement of human performance at a number of levels. Based on a National Science Foundation-funded Research Experiences for Undergraduates Program in nanoscience (...) and nanotechnology at the University of Central Florida (summer 2002), a variety of social and ethical issues associated with these advances is discussed. This article interrogates Andrew Feenberg’s thesis that modern technology is in need of ‘re-aestheticization’. The notion that modern technology requires aesthetic critique connects his political analysis of micro-contexts of social shaping to his wider concern with civilization change. The former involves a modified constructionism, in which the motives, values and beliefs of proximal agents are understood in terms of their wider sociological significance. This remedies a widely acknowledged blind-spot of conventional constructionism, enabling Feenberg to identify democratic potential in progressive agency (...) at the scene of technology design. Feenberg argues that the aesthetics of naturalistic modernism may serve as a bridge between such interventions and cultural transformation. Referring to developments in design culture, especially as this relates to the human-machine interface on digital artefacts, the article suggests that this part of Feenberg’s argument has been falsified. This kind of aesthetic modernism is hegemonic in contemporary design and it has not brought about significant progressive advance. In conclusion, the article suggests a different approach to aesthetic critique that is based on difference rather than wholeness, and on the principle that there is no inherent correspondence of aesthetic standards and ethics in technology design. This paper examines the relationship between identities and the bicycle as portrayed in films. The analysis finds that taking the viewpoint of the bicycle emancipates the bicycle from being subjected to closure, as the constructionists would have it, and thus articulates the differences with which the bicycle can communicate to its rider. The paper examines the bicycle as depicted in three films: Premium Rush (Davis Koepp, 2012), A Sunday in Hell (Jørgen Leth, 1977) and Life on Earth (Abderrahmane Sissako, 1998). (...) It engages with the concept of ‘interpretative flexibility’ and the development of the bicycle, as examined by Wiebe Bijker and others, and argues that the interpretative flexibility of bicycles does not cease just because the high-wheeler was abandoned and the ‘safety’ bicycle was universally accepted. The fight for the role of the bicycle continues and the bicycle is subject to constant transformations in order to reconstruct it according to human needs. Andrew Feenberg’s modified constructivism is applied to re-examine the technical development of the bicycle, claiming that technology is dependent on specific social structures as well as human agency. The paper argues that just as social structures are negotiable and unfixed at any point in time, the bicycle too is never neutral but remains negotiable and unfixed. Consequently, since the bicycle constantly ‘speaks’ back to the user, there is never closure in the technical development of the bicycle. Drawing on the writings of Bruno Latour and the Deleuzian idea of assemblages, the bicycle and its rider are considered as an organic entity that is constantly forged and un-forged. Understanding the rhetoric of the bicycle machine helps the convergence of a bicycle becoming with becoming a rider, marking the bicycle as equal to its rider. Viewed in this way, the hierarchy of agency collapses and a crystallization emerges out of the rider and bicycle entwinement. (shrink)

This essay examines whether and to what extent the “other” in communicative interactions may be otherwise than another human subject and the moral opportunities and challenges this alteration would make available to us. Toward this end, the analysis proceeds in five steps or movements. The first reviews the way the discipline of communication has typically perceived and theorized the role and function of technology. The second and third parts investigate the critical challenges that emerging technology, such as artificial intelligence applications (...) and robots, poses to this standard instrumentalist way of thinking. The fourth part introduces an alternative called “relational ethics,” which effectively flips the script on the usual way of proceeding. And the fifth part presents and responds to one important and notable objection to this alternative. The goal in all of this is not to complicate things but to introduce and formulate a techno-ethics that is more agile in its response to the opportunities and challenges of the 21st century and beyond. In the aftermath of the 2008 financial crisis, Bitcoin emerged as an alternative monetary system that could circumvent political and financial authorities. A practice in libertarian prefigurative politics, Bitcoin demonstrates the capacity for online subgroups to creatively appropriate internet-based technologies to enact alternative futures. Andrew Feenberg’s critical theory of technology clarifies this capacity and outlines the significance of agency in technical action. As technology mediates many social relations, it has a significant role in the reproduction of social power. Technological agency (...) is therefore a crucial site of resistance in which users can form alternative, democratic rationalizations of technology. Yet are such instances of agency intrinsically democratic? In analysing this aspect of Feenberg’s theory, this article argues that Bitcoin represents a ‘popular rationalization’ of technology – a creative appropriation of technology that empowers some groups while lacking the ethical justification necessary to be considered democratic. This article argues that the computer game can be a locus of aesthetic form in contemporary culture. The context for understanding this claim is the decline of the artwork as bearer of form in the late 20th century, as this was understood by Adorno. Form is the enigmatic other of instrumental reason that emerges spontaneously in creative works and, in the modern era, is defined as that which makes them captivating and enigmatic yet resistant to analytic understanding. Clarification of the (...) ways in which form is at work in game play is sought from aesthetic theory (Kant), ludology (or theory of games), and the idea of a neo-baroque entertainment culture (Ndalianis). Kant emphasized the role of play in the constitution of imaginary realms associated with aesthetic pleasure. Ludology takes play as an anthropological given differentiated historically by the development of game structures. Neo-baroque theory postulates a labyrinthine, complex and de-centred entertainment culture, largely shaped by computing as a cultural practice. The article synthesizes insights from these perspectives and, drawing on ideas from Adorno and Benjamin, argues that computer games can occupy an oppositional or critical role within contemporary aesthetics and culture. Reflection on the constitutive processes of computer game play discloses a new place for instrumental reason within aesthetic experience, as the dialectic of form and analysis migrates from traditional art materials to digital electronics. Many engineering corporations are attempting to adapt successful manufacturing quality initiatives to the office environment. These adaptations can be improved by considering the cultural domains in which knowledge is created and transferred. Ethnographic research conducted at a research engineering company identifies several shared cultural domains within the systems engineering group. It is suggested that the elements in these domains be incorporated into quality improvement, new employee training, and career development opportunities. This research identifies technology design as a common concern for (...) both anthropologists and engineers. The nature of emerging technology practice will change to the degree that these and other disciplines interact to shape choices affecting how technology is designed rather than waiting to discuss how it should be used. This paper draws attention to the role of representation in the depiction of scientific and technological innovation as a means of understanding the narratives that circulate concerning the shape of things to come. It considers how metaphors play an important part in the conduct of scientific explanation, and how they do more than describe the world in helping also to shape expectations, normalise particular choices, establish priorities and create needs. In surveying the range of metaphorical responses to the digital and (...) biotechnological age, we will see how technologies are regarded both as 'endangerment' and 'promise'. What we believe 'technology' is doing to 'us' reflects important implicit philosophies of technology and its relationship to human agency and political choice; yet we also need to be alert to the assumptions about 'human nature' itself which inform such reactions. The paper argues that embedded in the various representations implicit in new technologies are crucial issues of identity, community and justice: what it means to be (post)human, who is (and is not) entitled to the rewards of technological advancement, what priorities (and whose interests) will inform the shape of global humanity into the next century. In recent years several approaches—philosophical, sociological, psychological—have been developed to come to grips with our profoundly technologically mediated world. However, notwithstanding the vast merit of each, they illuminate only certain aspects of technological mediation. This paper is a preliminary attempt at a philosophical reflection on technological mediation as such—deploying the concepts of ‘transparency’ and ‘opacity’ as heuristic instruments. Hence, we locate a ‘theory of transparency’ within several theoretical frameworks—respectively classic phenomenology, media theory, Actor Network Theory, postphenomenology, several ethnographical, psychological, and (...) sociological perspectives, and finally, the Critical Theory of Technology. Subsequently, we render a general, systematic overview of these theories, thereby conjecturing what a broad analysis of technological mediation in and of itself might look like—finding, at last, an essential contradiction between transparency of ‘use’ and transparency of social origins and effects. This article presents an analysis of the concept of disability in Amartya Sen’s capabilities and functionings approach in the context of Information and Communication Technologies (ICT). Following a critical review of the concept of disability—from its traditional interpretation as an essentially medical concept to its later interpretation as a socially constructed category—we will introduce the concept of functional diversity. The importance of human diversity in the capabilities and functionings approach calls for incorporating this concept into the analysis of well-being and (...) quality of life in persons with disability—aspects in which ICT currently plays a major role. When one contemplates these technologies, it becomes clear that factors such as accessibility, design for all, and user participation in development and implementation processes are key strategies in promoting equal rights and equal opportunity for persons with disability in the different environments of the information society. This paper explores what insights can be drawn from critical theory to enrich and strengthen Sen’s capability approach in relation to technology and human development. The two theories share some important commonalities: both are concerned with the pursuit of “a good life”; both are normative theories rooted in ethics and meant to make a difference, and both are interested in democracy. The paper provides a brief overview of both schools of thought and their applications to technology and human development. Three (...) areas are identified where critical theory can make a contribution to the capability approach: conceptually, by providing a critical account of individual agency and enriching the concept of technology beyond the simplistic notion of commodities; methodologically, by sensitising towards reification and hegemony of scientific tools, and, finally, by emphasising reflexivity of researchers.
