  1. Reading Principia Iuris.Pietro Costa - 2011 - Res Publica 17 (4):317-325.
This paper illustrates the main features of Luigi Ferrajoli’s theoretical approach to law, as they are developed in his Principia Juris . These include his opposition to the traditional perspective of natural law; his anti-cognitivist orientation; and, finally, his fundamentally normative approach. Among the numerous problems discussed in Ferrajoli’s compendious book, the paper focuses on his definition of constitutional democracy. In particular, the paper discusses the way in which Ferrajoli defines the complementarity between democracy and rights; Ferrajoli’s own criticism of (...)

  • Introduction.Dario Castiglione - 2011 - Res Publica 17 (4):311-315.
This symposium presents the work of the Italian legal philosopher, Ferrajoli, to the English speaking public. Ferrajoli’s work offers a reflection on law and the constitutional democratic state from a post-positivist perspective, applying the axiomatic method to the theory of law and democracy. Besides his systematic approach, Ferrajoli’s theory is remarkable for a number of original and interesting reflections that he offers on the relationship between normativity and facticity, and on how to reconcile foundamental rights and democracy. In both respects, (...)

  • Certainty, reasonableness and argumentation in law.Stefano Bertea - 2004 - Argumentation 18 (4):465-478.
This paper defends a position that parts ways with the positivist view of legal certainty and reasonableness. I start out with a reconstruction of this view and move on to argue that an adequate analysis of certainty and reasonableness calls for an alternative approach, one based on the acknowledgement that argumentation is key to determining the contents, structure, and boundaries of a legal system. Here I claim that by endorsing a dialectical notion of rationality this alternative account espouses an ambitious (...)

  • Assessment criteria or standards of proof? An effort in clarification.Giovanni Tuzet - 2020 - Artificial Intelligence and Law 28 (1):91-109.
The paper provides a conceptual distinction between evidence assessment criteria and standards of proof. Evidence must be assessed in order to check whether it satisfies a relevant standard of proof, and the assessment is operated with some criterion; so both criteria and standards are necessary for fact-finding. In addition to this conceptual point, the article addresses three main questions: Why do some scholars and decision-makers take assessment criteria as standards of proof and vice versa? Why do systems differ as to (...)

  • Invalidity.Riccardo Guastini - 1994 - Ratio Juris 7 (2):212-226.
According to the common thinking of continental European lawyers, a rule is invalid each and every time either it was not produced in accordance with the metarules which govern the production of rules in the system, or it is inconsistent with a “superior” (higher‐ranked) rule belonging to the same system. Thus, a better understanding of the concept of invalidity demands a careful inquiry into the various kinds of meta‐rules which govern the production of rules as well as into the various (...)

  • Constitutionalism Out of a Positivist Mind Cast: The Garantismo Way. [REVIEW]Pierluigi Chiassoni - 2011 - Res Publica 17 (4):327-342.
Among contemporary forms of constitutionalism, Luigi Ferrajoli’s Garantismo may be considered as the rather unfashionable attempt to build up a comprehensive and multi-layered theory, which still takes seriously the positivist heritage. This paper offers, in brief outline, a synthetic view of the social setting, the philosophical background, and the basic features of this conception of constitutionalism, when compared with legal positivism and other mainstream forms of (neo)constitutionalism.
