This lecture presents the text of the speech about the genealogy of the modern state delivered by the author at the 2008 British Academy Lecture. It explains that to investigate the genealogy of the state is to discover that there has never been any agreed concept to which the word state has answered. The lecture suggests that any moral or political term that has become so deeply enmeshed in so many ideological disputes over such a long period of time is (...) bound to resist any efforts at definition. In this paper, I argue that, just as the problem of unconceived alternatives provides a basis for a New Induction on the History of Science to the effect that a realist view of science is unwarranted, the problem of unconceived objections provides a basis for a New Induction on the History of Philosophy to the effect that a realist view of philosophy is unwarranted. I raise this problem not only for skepticism’s sake but also for the sake of making a (...) point about philosophical argumentation, namely, that anticipating objections to one’s claim is not the same as supporting one’s claim. In other words, defending p from objections does not amount to support or evidence for p. This, in turn, presents dialectical and pragma-dialectical approaches to argumentation with the following question: does proper argumentation require that arguers anticipate and respond to unconceived objections? Munoz-Dardé (2009) argues that a social contract theory must meet Rousseau's 'liberty condition': that, after the social contract, each 'nevertheless obeys only himself and remains as free as before'. She claims that Rousseau's social contract does not meet this condition, for reasons that suggest that no other social contract theory could. She concludes that political philosophy should turn away from social contract theory's preoccupation with authority and obedience, and focus instead on what she calls the 'legitimacy' of social arrangements. Catharine Macaulay's first political pamphlet, “Loose remarks on certain positions to be found in Mr. Hobbes's philosophical rudiments of government and society with a short sketch for a democratical form of government in a letter to Signor Paoli,” published in London in 1769, has received no significant scholarly attention in over two hundred years. It is of primary interest because of the light it sheds on Macaulay's critique of patriarchal politics, which helps to establish a new line of thinking about (...) the historian as an early feminist writer. It appears she was working from an unauthorized edition of the Thomas Hobbes'sDe Cive entitledPhilosophicall Rudiments of Government and Society, printed by a royalist bookseller in London 1651. Some errors in this translation may explain Macaulay's skewed understanding of Hobbess argument in support of the premises of monarchy. Her intriguing analysis of paternal authority in “Loose Remarks” anticipates recent feminist explorations of Hobbesian political thought. (shrink)

O presente artigo procura mostrar a crítica conservadora inglesa do século XVII às noções de liberdade natural e contrato originário, ao deslocar a origem do poder político para as relações afetivas estabelecidas pelos laços sentimentais de família que mantêm pais e filhos unidos. Mais exatamente, a legitimação política do poder teria como fundamento uma autoridade natural semelhante à relação verificada entre pais e filhos. Segundo essa teoria, cujo mais importante representante foi Robert Filmer, o fundamento da autoridade política não é (...) fruto de uma instituição arbitrária dos homens, mas uma necessidade introduzida por Deus, com o propósito de justificar as monarquias absolutistas. Con frecuencia la teoría política trata a la familia como un hecho incuestionable de la vida social. Sin embargo, y especialmente en el marco del liberalismo político, vale la pena preguntarse por su justificación. En el presente trabajo analizo la teoría de la justicia de John Rawls buscando reconstruir no sólo lo que efectivamente dice sobre esta cuestión sino también el potencial que encierra para propocionar respuestas más contundentes. Rawls parece suscribir una explicación puramente instrumental del valor de la familia, (...) centrada en su utilidad para la reproducción y estabilidad de una sociedad bien ordenada. Sin embargo, como señalaré, aunque Rawls no explora esta alternativa, una aplicación consecuente del “primer principio”, que pauta la distribución de libertades y derechos básicos de los individuos, abre el camino para una justificación normativa más concluyente. RESUMO O objetivo deste artigo é analisar a concepção de liberdade encontrada em "Discourses concerning government" de Algernon Sidney. Mantendo a perspectiva republicana, a liberdade é definida pela ausência de dominação, ou seja, pela não submissão, sujeição ou exposição à vontade arbitrária de outra pessoa; e assumindo a perspectiva jusnaturalista, a liberdade é considerada um direito natural, inerente à condição humana, que deve ser preservado e assegurado pela autoridade política. Pretende-se discutir como Sidney articula essas duas perspectivas em sua teoria (...) política, projetando a concepção republicana de liberdade na modernidade.ABSTRACT The objective of this paper is to analyze the concept of freedom found in Algernon Sidney’s "Discourses Concerning government". Keeping the republican thought, freedom is defined by the absence of domination, i.e., the denial of submission, bondage or exposure to the arbitrary will of another person; and taking the jusnaturalist thought, freedom is considered a natural right inherent to the human condition, which must be preserved and guaranteed by the political authority. I intend to discuss how Sidney articulates these two perspectives in his political theory, outlining the republican conception of freedom in modernity. (shrink)

Ao longo da história da filosofia, John Locke tem sido frequentemente associado à tradição do liberalismo político, o que decorre, invariavelmente, de um modo peculiar de interpretação da noção de liberdade para o filósofo, que estaria estruturada em torno da ideia de não-interferência. Derivada frequentemente de propostas analíticas realizadas em um “vácuo histórico”, em que as ideias de Locke são tomadas como uma estática coleção, tal conclusão expressa uma perspectiva que não considera o caráter essencialmente discursivo da filosofia política e (...) o “campo problemático” em que os conceitos foram pensados pelo filósofo. Diante dessa perspectiva, o propósito deste artigo é o de realçar, na linguagem política utilizada pelo filósofo, os elementos contextuais que permitem a compreensão dos argumentos desenvolvidos pelo autor como parte de uma _performance_ – na acepção proposta por John Pocock –, a fim de destacar os aspectos que indicam a possibilidade de aproximação do conceito de liberdade de Locke da ideia de liberdade republicana, descrita por Philip Pettit a partir da ideia de não-dominação, sem descuidar da análise das evidências textuais que indicam a presença de argumentos na obra do autor que compõem o cerne da concepção republicana de liberdade.
