This article argues for reading the Algerian-French sociologist Abdelmalek Sayad (1933–1998) as a political theorist of migration. Various contributions have recently called to move away from the court-like assessment of claims by host states and foreigners and to engage more frankly with empirical work more attentive to concrete experiences and power relations. I contend that Sayad’s sociological work constitutes a substantial empirical and normative resource for ethical and political theory of migration, pointing to the persistence of ‘state thought’ and presenting (...) original normative perspectives on emigration, inclusion in democracy, naturalization or postcolonial relationships. Such a reading of Sayad from a political theory perspective would then constitute a prime example of the cross-fertilization of empirical and normative approaches. (shrink)

This paper discusses a recent turn in the ethics of refugee resettlement which involves taking the interests of refugees themselves into account in the distribution of refugees among potential refugee receiving countries. It argues that there is an important category of interest that does not align with the two commonly held views on what is owed to refugees: ‘safety’ or ‘conditions of a good life’. This category, focussing on the refugees’ interests in not being subjected to a variety of non-asylum-grounding (...) injustices, should, by default, take precedence in the assessment of the refugee-based reasons in refugee resettlement. The normative salience of this category – not being subjected to injustice – is illustrated with the help of the case of LGBTIQ+ refugees, and the kinds of injustices they may be subject to in countries that provide them with asylum. In this review essay, I discuss two recent works in refugee and migration ethics, Serena Parekh’s No Refuge: Ethics and the Global Refugee Crisis and Amy Reed-Sandoval’s Socially Undocumented: Identity and Immigration Justice. I find that their methodological ambitions overlap significantly and that their arguments represent welcome and largely successful examinations of generally neglected issues. I also explain how both approaches could fruitfully learn from each other, and argue that they lay pioneering groundwork for future work to continue the analysis (...) of only nascent modes and areas of inquiry. I suggest that virtue ethics can learn from Foucault’s critical observations on biopolitics and governmentality, which identify how a good cannot be disassociated from power and freedom. I chart a way through which virtue ethics internalizes this critical point. I argue that this helps address concerns that both virtue ethics and the critical scholarship inspired by Foucault otherwise ignore. I apply virtue ethics to the contexts of refugee arrival, asylum procedure, and immigrant integration in Western Europe; I then see how (...) Foucault’s critical thought provides a counterpoint to virtue ethics; I finally analyze how incorporating that critique allows virtue ethics to make sense of both the context and the stakes involved. Many authors argue that refugees should be enfranchised independently of citizenship. The enfranchisement of refugees is often seen as crucial for affirming their agency in the politics of asylum. However, most arguments in the literature do not explain why precisely it matters that they exercise their agency in the realm of democratic decision-making, i.e. why it matters that refugees participate in collectively wielding the public power to which they are subjected, rather than passively enjoy protection against the excessive and intrusive (...) exercise of this power. This leaves it unclear what value refugee enfranchisement realises precisely, and what function or role it is meant to play within the overall provision of asylum. My goal is to propose a plausible explanation of the significance of democratic inclusion from the viewpoint of refugees' agency. I argue that refugee enfranchisement affirms refugees' agency by advancing their interest in acting as makers of justice within the political context in which they find themselves. (shrink)

There is a growing recognition that victims of injustice may have privileged access to knowledge about the injustices they experience, and that injustices are perpetuated through silencing victims by taking them to be less credible, and through denying them the platform and capacity to speak. However, these are not ideas that political philosophers tend to engage with in a sustained manner, to the extent that they alter methodological approaches to be systematically attentive to victim testimony. In this article, I provide (...) two arguments in favour of political philosophers attending to victim testimony, one moral, one epistemic, and demonstrate that the moral case has little purchase, but that the epistemic case is more successful. Then, I present the strongest case against including victim testimony in political philosophy, and I argue that it does not hold up to scrutiny. In so doing, I demonstrate how methodological practices in political philosophy could be improved through drawing on feminist social epistemology; attending to victim testimony can enrich political philosophy in epistemically acceptable ways, and it also corrects for a range of potential biases. In this paper, I focus on recognition respect as a component of Anderson’s democratic equality – specifically, how it places certain requirements on the way political institutions such as states treat both citizens and non-citizens. I argue for two claims: that recognition respect is a plausible political (as well as ethical) value, and that it should be understood in large part as a matter of an agent’s material relational standing rather than as their merely being regarded in a certain way (...) by others. In particular, I argue that the second-personal emphasis of recognition respect, the conceptual requirement that recognising somebody as an agent involves recognising them as somebody to whom you are in principle accountable, requires that agents actually be able to hold you to account rather than merely that you see them as being the right sort of being to do so. In turn, this implies that recognition respect requires non-vulnerability. Together, these claims go some way towards further fleshing out democratic equality as a philosophical ideal, and determining what implications this ideal has for matters of theory and policy.
