In Biro and Siegel we argued that a theory of argumentation mustfully engage the normativity of judgments about arguments, and we developedsuch a theory. In this paper we further develop and defend our theory.

On the eve of the tercentenary of Kant’s birth, just as it was a hundred years ago, Kantianism is simultaneously on the receiving end of the blows of history and attacks by rival philosophical parties, both progressivist and reactionary. The radical wings of both parties perceive modernity as a depressing, nauseating period which must be broken with by moving toward the past or toward the future. One of the most original and profound diagnoses of this attitude was offered by Hans (...) Jonas, who discerned in radical doctrines of a hundred years ago a similarity with the gnosticism of antiquity. Jonas’s diagnosis has not lost its relevance. That is why the central question addressed in this study is as follows: what prescription does the Kantian programme offer for modernity’s “gnostic dizziness?” I maintain that Kant’s critical turn is still an effective strategy by means of which to compensate for the sudden stresses and “gnostic impulses” provoked by the modern worldview revolution, bringing back an “orientation in thinking” which reorients the world process and individual activity. The imperative to always see and respect humanity in a particular individual warns against the “category mistake” committed by modern radicals who ascribe agency (subjectivity) to non-­human abstractions which cannot possess this property. In theory, Kant grounds the view that humanity should resign itself to the fact of its perspective being limited and local. Kantian practical philosophy provides the traveler with a map of regulative ideas and a “moral compass”, along with an explanation of disruptive factors, offering a working explanation of the situation and its possible outcomes. Kant’s “Copernican revolution” brings human beings back into focus and imagination to order, allowing for the hope that new challenges will be successfully met. (shrink)

The temptation to look for the “purely normative essence” of argument stems from the understandable ambition to distinguish rational persuasion from mere persuasion. But in seeking a purely normative notion of argument it is easy to overlook—or actually deny—that rational persuasion is a kind of persuasion. The burden of this essay is to show that the concept of reason from which our interest in argument derives can only exist and have normative force as a kind of persuasion, that is, as (...) something causal. This dissertation argues that recent theoretical attempts to understand fallacious reasoning fail because these theories presuppose problematic accounts of the nature of argument. Current fallacy theories agree that a fallacy is a mistake, but differ wildly about what sort of mistake it is. Chapters one through three explore three very different suggestions. Chapter one is devoted to an examination of the oldest of the modern theoretical accounts of fallacious reasoning, what Hamblin calls the standard treatment. Chapter two begins with a (...) discussion of Finocchiaro's skeptical argument against the very possibility of a fallacy theory. It then turns to a discussion of van Eemeren and Grootendorst's pragma-dialectical treatment of fallacious reasoning as a possible response to Finocchiaro's skeptical challenge. Chapter three examines two epistemic responses to Finocchiaro's analysis: Fogelin and Duggan's frequency treatment and Wreen's mistaken inference treatment. The first three chapters set the stage for an alternative account of fallacies developed in chapter four. This alternative view of fallacious reasoning is consistent with Wright's recent work on the concept of an argument. It suggests that fallacious reasoning results from a kind of incompetency. Such failures of competency, however, are not nearly as common as traditional accounts of fallacious reasoning suggests. Moreover, the very possibility of being tempted by fallacious reasoning depends on our being very competent in normal cases. Chapter four ends with a discussion of some of the implications of this alternative theory of fallacious reasoning for the way we understand and teach argument and reasoning. (shrink)

An epistemic account of fallacies is one which takes it as a necessary condition for a fallacy that it has a tendency to produce false or unwarranted beliefs. The most sophisticated form of this account occurs in an article by Robert J. Fogelin and Timothy J. Duggan (“Fallacies,”Argumentation 1, 1987, pp. 255–262). I criticize the Fogelin and Duggan proposal, in particular, and epistemic accounts, more generally. Though an epistemic approach is attractive, it enlarges the class of fallacies, beyond what would (...) be permitted by traditional accounts. I also question thenecessity of fallacies leading to unwarranted beliefs. Some fallacies are fallacious due to their expected harm to argument practices. This position touches on a theme in the work of Van Eemeren and Grootendorst, though I criticize their notion of rules of argument as too broad. (shrink)

This paper is a critical analysis of three theories of fallacy, those of Ralph Johnson, of Jaakko Hintikka, and of Robert Fogelin and Timothy Duggan. Although the theories are very different from one another, all oppose the traditional, non-dialectical view of a fallacy as a mistaken inference. The theories are exposed and explained in detail, and then subjected to critical examination. For a variety of reasons, all are found seriously wanting.
