In this thesis I outline a view of primary legislation from a systems perspective. I suggest that systems theory and, in particular, autopoietic theory, as modified by field theory, is a mechanism for understanding how society operates. The description of primary legislation that I outline differs markedly from any conventional definition in that I argue that primary legislation is not, and indeed cannot be, either a law or any of the euphemisms that are usually accorded to an enactment by a (...) parliament. I cite two reasons for such a conclusion. The primary reason for my conclusion is that I see primary legislation as being an output of a particular subsystem of society, while the law is the output of another subsystem of society. I argue that these outputs are the discrete products of separate subsystems of society. I argue that primary legislation should be viewed as a trinity. The first state of this trinity is that, upon enactment, primary legislation is a brute fact in that it is but a thing and the only property of this thing is that of being a text. The second state of this trinity is that following the act of enactment, the thing enacted will be reproduced and this reproduction is a separate thing that will sit in some repository until used. The third state of this trinity is that, upon use, this thing that is primary legislation will be transformed into an object and the user will attribute such functions and attributes to that object as are appropriate to the context within which the object is used. The thing has therefore become an object and an institutional fact. The second reason for my conclusion that primary legislation is not a law relates to the fact that the thing that is primary legislation is a text and the only function of a text is that it is available to be read. That is to say, of itself, a text is incapable of doing anything: it is the reader who defines the status of the text and attributes functions and attributes. Upon use, primary legislation thus becomes a censored input for future action and one of these actions may be some statement by a court of law. I assert that the view of primary legislation that has been accepted within the body politic is the product of the discourse of a particular subsystem of society that I have designated 'the legal practice', and I outline why and how this has occurred. Outlining a view about primary legislation also necessitates outlining a view as to the nature of the law. I assert that the law is a myth and I see this myth as a product of the discourse of the legal practice. I have asserted that although it is the judges that state the law, such statements flow from the discourse of those who practise the law. (shrink)

Abstract This article examines the little-explored remarks on verification in Wittgenstein's notebooks during the period between 1930 and 1932. In these remarks, Wittgenstein connects a verificationist theory of meaning with the notion of logical multiplicity, understood as a space of possibilities: a proposition is verified by a fact if and only if the proposition and the fact have the same logical multiplicity. But while in his early philosophy logical multiplicities were analysed as an outcome of the formal properties of simple (...) objects and simple signs, Wittgenstein in the early 1930s connects the notion of logical multiplicity with the notion of ways of seeing. I will argue that the relevant ways of seeing are closely similar to seeing-as or aspect seeing. According to Wittgenstein's view in the early 1930s, logical multiplicities are part of our perceptual experience of propositions and facts. In this sense, the verification relation depends on how we experience propositions and facts as being surrounded by a logical space of possibilities. Strikingly, Wittgenstein's way of thinking about the verification relation offers solutions to a set of seemingly intractable problems connected with the versions of verificationism developed by members of the Vienna Circle. Philosophy strives to give us a firmer hold on our concepts. But what about their hold on us? Why place ourselves under the sway of a concept and grant it the authority to shape our thought and conduct? Another conceptualization would carry different implications. What makes one way of thinking better than another? This book develops a framework for concept appraisal. Its guiding idea is that to question the authority of concepts is to ask for reasons of a special kind: (...) reasons for concept use, which tell us which concepts to adopt, adhere to, or abandon, thereby shoring up—or undercutting—the reasons for action and belief that guide our deliberations. Traditionally, reasons for concept use have been sought either in timeless rational foundations or in concepts’ inherent virtues, such as precision and consistency. Against this, the book advances two main claims: that we find reasons for concept use in the conceptual needs we discover when we critically distance ourselves from a concept by viewing it from the autoethnographic stance; and that sometimes, concepts that conflict, or exhibit other vices such as vagueness or superficiality, are just what we need. By considering not what concepts are absolutely best, but what concepts we now need, we can reconcile ourselves to the contingency of our concepts, determine the proper place of efforts to tidy up thought, and adjudicate between competing conceptions of things—even things as contested as liberty or free will. A needs-based approach separates helpful clarification from hobbling tidy-mindedness, and authoritative definition from conceptual gerrymandering. (shrink)

Emotion is an important issue in Wittgenstein’s philosophy of psychology, yet the literature on this topic is quite small. Wittgenstein’s philosophical investigation is a grammatical one, and he tries to dissolve philosophical problems by using many philosophical methods. In this paper I examine the grammatical rules for some emotion words and the methods he employs in dealing with the philosophical problem of emotion. To facilitate this examination, I first analyze Wittgenstein’s treatment of the problem of sudden understanding, where the grammar (...) and methods are easier to comprehend. I will then show that the grammar and methods used by Wittgenstein in the cases of sudden understanding and emotion are rather similar. (shrink)

ABSTRACT In order to explore what it means to pursue philosophical investigations for theological reasons, this paper argues that Ludwig Wittgenstein continues and corrects Pseudo-Denys’ project in The Divine Names. I first argue that The Divine Names should be interpreted as attempting to render human thought transparent to the divine by relativizing our concepts. The success of this project is compromised because the concept of ‘unity’ is not relativized. I then develop the claim that Wittgenstein does relativize unity in a (...) similar way and for similar religious reasons to Pseudo-Denys. As such, he can be read as continuing and correcting the Pseudo-Dionysian project. I conclude by reflecting on several of this argument’s implications for the relationship between philosophy and Christian systematic theology. (shrink)

The following contribution aims at presenting a reading of Wittgenstein’s later philosophy as a kind of idealism within the Kantian and post-Kantian traditions. The goal is to argue that Wittgenstein’s position shares substantial theoretical and methodological grounds with Hegel’s idealism. The main concepts pertaining to the later Wittgenstein’s position are analyzed and understood as a form of idealism. After defending the reading against anti-idealist interpretations we argue that the kind of idealism presented clashes with central tenets of the Kantian position. (...) These points of departure are then shown to cover in a substantial manner the same kind of criticism Hegel raised against Kant. In the last section, an interpretation of central concepts of the Hegelian position is offered in order to dissolve any fundamental incompatibility with Wittgenstein’s idealism. (shrink)

In “Truth by Convention” W.V. Quine gave an influential argument against logical conventionalism. Even today his argument is often taken to decisively refute logical conventionalism. Here I break Quine’s arguments into two— the super-task argument and the regress argument—and argue that while these arguments together refute implausible explicit versions of conventionalism, they cannot be successfully mounted against a more plausible implicit version of conventionalism. Unlike some of his modern followers, Quine himself recognized this, but argued that implicit conventionalism was explanatorily (...) idle. Against this I show that pace Quine’s claim that implicit conventionalism has no content beyond the claim that logic is firmly accepted, implicit rules of inference can be used to distinguish the firmly accepted from the conventional. As part of my case, I argue that positing syntactic rules of inference as part of our linguistic competence follows from the same methodology that leads contemporary linguists and cognitive scientists to posit rules of phonology, morphology, and grammar. The upshot of my discussion is a diagnosis of the fallacy in Quine’s master critique of logical conventionalism and a re-opening of possibilities for an attractive conventionalist theory of logic. According to a widespread interpretation, in the Investigations Wittgenstein adopted a deflationary or redundancy theory of truth. On this view, Wittgenstein’s pronouncements about truth should be understood in the light of his invocation of the equivalences ‘p’ is true = p and ‘p’ is false = not p. This paper shows that this interpretation does not do justice to Wittgenstein’s thoughts. I will be claiming that, in fact, in his second book Wittgenstein is returning to the pre-Tractarian notion of bipolarity, (...) and that his new development of this notion in the Investigations excludes the redundancy-deflationary reading. Wittgenstein’s thoughts about truth are instead compatible with another interpretative option: Wittgenstein remains faithful to his methodological pronouncements, and he merely presents us with platitudes about the notions of “true” and “false”. Wittgenstein scholars have tended to interpret the acquisition of certainties, and by extension, of a world-picture, as the achievement of a state in which these certainties are assimilated in a seemingly unconscious way as one masters language-games. However, it has not been stressed that the attainment of this state often involves facing a series of challenges or difficulties which must be overcome for the development of the world-picture and therefore the socialization process to be achieved. After showing, on the one (...) hand, how a world-picture is usually developed, and on the other hand, why a child who seemingly found itself trapped in a precocious skepticism might have serious problems in assimilating certainties, in this paper, I describe some of the challenges children often meet as they acquire a world-picture. Since the overcoming of these challenges is often needed for children to develop a world-picture, I aim at raising the awareness of the necessity of ‘learning to believe’, that is, of developing a series of skills that allow children to undertake the challenges described in this paper. In 1982 Saul A. Kripke proposed a reconstruction of the central insights of Ludwig Wittgenstein's remarks on rule-following. The reconstruction prominently featured a sceptical challenge which soon was recognised as a new and very radical form of scepticism. According to the challenge there is no fact of the matter which constitutes meaning. As there is no such fact, the first-person authority people intuitively seem to have concerning what they mean is also baseless. In response to the sceptic, many solutions have (...) been proposed. This thesis is about one family of solutions, according to which facts about meaning are sui generis and can neither be reduced to other facts about the world nor to non-semantic facts about the human mind. The non-reductionist proposals by Colin McGinn and Crispin Wright will be assessed in detail and arguments against both will be introduced. The arguments stem only partially from Kripke himself, some are based on recent literature, others are completely new. The emerging situation will be used as a basis to propose an alternative non-reductionism about meaning-facts. (shrink)

Taking Wittgenstein's love of music as my impetus, I approach aporetic problems of epistemic relativity through a round of three overlapping (canonical) inquiries delivered in contrapuntal (higher and lower) registers. I first take up the question of scepticism surrounding ‘groundless knowledge’ and contending paradigms in On Certainty (physics versus oracular divination, or realism versus idealism) with attention given to the role of ‘bedrock’ certainties in providing stability amidst the Heraclitean flux. I then look into the formation of sedimented bedrock knowledge, (...) or practices of knowing, by comparing Wittgenstein's remarks on animal habituation and initiate training into human forms of life. In the latter case, mastery of techniques—our common education—secures agreement in judgment. Finally, I entertain Wittgenstein's obscure references to Einstein's Relativity in Zettel, showing initiate training as a way of ‘setting the clocks’ with variable degrees of certainty, relative to the language‐games played. Together, these three approaches help us to stop the ‘endless circling’ when philosophers try to address knowledge questions through the logic of object and designation, or verification of correspondence between propositions and things. Instead, attention moves to the way we educate our children and how we employ agreements and bedrock certainties in practices. (shrink)

: In this essay I argue that Kuhn's account of science, as it was articulated in The Structure of Scientific Revolutions, was mainly defended on philosophical rather than historical grounds. I thus lend support to Kuhn's later claim that his model can be derived from first principles. I propose a transcendental reading of his work and I suggest that Kuhn uses historical examples as anti-essentialist Wittgensteinian "reminders" that expose a variegated landscape in the development of science.

The paper explores Wittgenstein’s notion of grammar in the sense of a discipline or an activity, as opposed to the object sense of the term (grammar as a body of rules for the use of a language). I argue that the Wittgensteinian activity of grammar consists in giving expression to rules of our language use. It differs from the traditional grammarian’s activity not only in focusing on a different type of rules, but also in that it does not aim at (...) an explicit and exhaustive treatment of a specific domain of language. Instead, Wittgenstein conceives its goal as therapeutic: the dissolution of particular philosophical problems. Further, I attempt to reconcile his seemingly contradictory remarks on the character of grammatical statements, defining the senses in which they respectively can, and cannot, be considered descriptive assertions. I confront G. P. Baker’s and P. M. S. Hacker’s conceptions of the Wittgensteinian grammatical activity and I argue in favour of the former. Finally, I critically examine N. Garver’s claim that Wittgenstein, in his later conception of philosophy as grammar, succeeded in formulating a successfully self-referential criterion of philosophical critique. I also argue that grammatical activity, despite Wittgenstein’s overt commitment, is in fact not the only method of his later philosophy. (shrink)

This paper is more than a plea for Rhees’ reading of the work of Wittgenstein (particularly of On Certainty). My interest in Rhees’ interpretation lies on its resemblance with my own reading, on the one hand, and on its being (surprisingly) unmentioned by other interpreters, on the other. The two core aims of this paper focus on Rhees’ main ideas. First, I argue that although certain facts that are accepted beyond doubt belong to the method, which in turn is included (...) in grammar, this does not mean that these facts are expressions of rules of grammar. Second, I argue that grammar is not conditioned by a certain class of facts (i.e. general facts of nature), but a language-game is possible because we do not call in question certain facts (i.e. grammar is not conditioned by something like ontology). The point is that those facts that are not called in question are beyond truth and falsity, but this does not mean that these facts must be true. The logical role these facts (and the sentences used to express them) play in a language-game is not that of being true or false. Moreover, grammar itself constitutes what is meant by ‘object’, ‘fact’, or ‘general fact of nature’. (shrink)

Wittgenstein's 'plan for the treatment of psychological concepts' in the second volume of his Remarks on the Philosophy of Psychology (§§63, 148) is often understood as motivated by purely classificatory concerns that have little philosophical significance. I argue that this is a misinterpretation of Wittgenstein and that his planned and partly realized 'treatment of psychological concepts' deserves a better fate. In the first part of the paper I attempt to show that Wittgenstein's interest in psychological concepts in RPPII, far from (...) being merely an interest in their classification, is in fact closely connected to one important element of his conception of philosophy in the Philosophical Investigations, the requirement that 'all explanation must disappear, and description alone must take its place' (PI §109). In the second part of the paper I present the broad outlines of Wittgenstein's new, post-Investigations treatment of psychological concepts, as they are seen both in the account of the concepts directly addressed in RPPII §§63, 148 (those of seeing and other sense-impressions, of sensations, mental images and emotions), and also elsewhere in that volume where other important psychological concepts are discussed, e.g., those of thinking, intention and states of mind (Seelenzustande). Although it represents work in progress that was never brought to completion, I suggest that the account of psychological concepts in RPPII is an original, insufficiently appreciated strand of thought within Wittgenstein's oeuvre, and also that it is an account worth exploring for anyone not convinced by the scientism accepted by so much of the recent philosophy of mind. I explain why Wittgenstein’s account does not fall (...) prey to Davidson’s animadversions against the idea of a conceptual scheme as a force operating on a pre-conceptual content. In the sequel I deny that the distinction between grammatical and empirical propositions disappears in the last writings: it is neither deliberately abandoned, nor willy-nilly undermined by the admission of hinge propositions in On Certainty or by the role accorded to agreement in judgement. The book explains why and how Wittgenstein adapted the Tractatus in phenomenological and grammatical terms to meet challenges of his 'middle period.' It also shows why and how he invents a new method and develops an anthropological perspective, which gradually frame his philosophy and give birth to the Philosophical Investigations.

Ziel der Arbeit ist zu zeigen, dass sich in der theoretischen Philosophie David Humes Ansätze zu einer therapeutischen Methode finden, wie sie von Ludwig Wittgenstein angewandt und beschrieben wurde. Im ersten Teil wird Wittgensteins Konzeption der Philosophie und ihre Anwendung anhand einer genauen Textexegese dargestellt. Der zweite Teil untersucht primär die Humeschen Überlegungen zu Kausalität und Induktion, seine methodologischen Aussagen sowie seine Perzeptionstheorie und argumentiert für die These, dass Hume ebenfalls, wenn auch mit Einschränkungen, Elemente einer therapeutischen Methode und eine (...) entsprechende Konzeption der Philosophie zugeschrieben werden können.
