In this article culture is understood as the ensemble of systems of classification, assessment, and interaction that establishes a basic community of values in a given social field. We will argue that this is made possible through the institution of fundamental prohibitions understood as mythical points of closure that set the last frontiers of that community by designating what crime is. Exploring these theses, we will see that criminal transgression may be thought of as the actualization of a rigorous otherness. (...) This otherness, however, is nothing but the culture itself in its extreme vectors, its contradictions, and residues. From there we will differentiate three types of crimes: paroxysmal, archaic, and impossible. And we will conclude that the criminal question it is not a ‘social problem’ among others. Rather, it is a fundamental crossroad where the very constitution of any culture is at stake. It is the question of the beginning and end of the societal order and its subjects. (shrink)

This article explores the relationships between crime, collective responses to it, and the social production of so-called great criminals. It argues that crime, especially sexual and violent crime, produces significant imbalances in individuals habitually subject to instrumental actions, identitarian thinking and positive law. These imbalances are emotional as well as cognitive and, under certain conditions of communication, can generate states of multitude, that is, collective states linked to an intense affectivity and to the prevalence of mythic or symbolic thinking. These (...) states reach their limits and become condensed in the mytho-historical figure of the great criminal. In this sense, great criminals are a function of such multitudinous states: points of imputation that concentrate and catalyze the affective imagination unleashed by collective effervescence. The improvement of ultrasound scan techniques is enabling ever earlier prenatal diagnosis of developmental anomalies. In France, apart from cases where the mother’s life is endangered, the detection of “particularly serious” conditions, and conditions that are “incurable at the time of diagnosis” are the only instances in which a therapeutic abortion can be performed, this applying up to the 9th month of pregnancy. Thus numerous conditions, despite the fact that they cause distress or pain or are socially disabling, do not (...) qualify for therapeutic abortion, despite sometimes pressing demands from parents aware of the difficulties in store for their child and themselves, in a society that is not very favourable towards the integration and self-fulfilment of people with a disability. Cleft lip and palate (CLP), although it can be completely treated, is one of the conditions that considerably complicates the lives of child and parents. Nevertheless, the recent scope for making very early diagnosis of CLP, before the deadline for legal voluntary abortion, has not led to any wave of abortions. CLP in France has the benefit of a exceptional care plan, targeting both the health and the integration of the individuals affected. This article sets out, via the emblematic instance of CLP, to show how present fears of an emerging “domestic” or liberal eugenic trend could become redundant if disability is addressed politically and medically, so that individuals with a disability have the same social rights as any other citizen. The objective of this paper is to highlight the confluence of pastoral power and biopolitical power, as foundations for today’s unholy alliance that undermines the sense of democratic political subjectivity. From that perspective, it explores the connections between the Heideggerian conception of subjectivity and alternative pastoral power and biopolitics that Foucault calls through its ethics focused on self-care.

This article provides a reading and analysis of Foucault’s 1973-4 lecture course Le pouvoir psychiatrique. It begins by situating the course within the wider context of Foucault’s work, notably in relation to Histoire de la folie and the move of the early 1970s to the conceptual tools of power and genealogy. It is argued that Le pouvoir psychiatrique is a rewriting of the last part of Histoire de la folie from the perspective of these new conceptual tools. Analysis then moves (...) to more thematic concerns, showing how this course enriches our understanding of Foucault’s work on the sources of power, the individual and the family, and the spaces of the disciplinary society. Particular focus is given to the role of the army, public health, the hospital, children, women and hospital architecture. The article concludes by showing how the themes of this course, while not worked up for publication themselves, point the way to concerns in Foucault’s later work, notably The History of Sexuality and collaborative work on urban medicine and habitat. In this paper Foucault’s thought on monstrosity is explored. Monsters appear whenever and wherever knowledge/power assemblages emerge. That which eludes the latter, and which threatens to subvert them, is the monstrous. Foucault distinguished the production, throughout history, of juridical-natural monsters, moral monsters, and political monsters. In this paper it is argued that Foucault must have sensed that monstrosity eludes all notions of identity and difference, and therefore also the notion that places it ‘outside’. It is the space of emergence itself, (...) i.e. the location where sheer potentiality becomes the possible of and in the event. All monstrosity is therefore deeply, and inevitably, political. In this paper I investigate a largely untold chapter in the history of race thinking in Northern Europe and North America: the transition from the form of racism that was used to justify a race-based system of slavery to the medicalising racism which called for segregation, apartheid, eugenics, and, eventually, sterilization and the holocaust. In constructing this history I will employ the notion of biopower introduced by Michel Foucault. Foucault’s account of biopower has received a great deal of attention recently, (...) but because what he actually has to say about race tends to be vague and radically incomplete, many race theorists have been critical of his contribution. However, even if the account of the holocaust in terms of biopower is incomplete, there is still a great deal to be learned from Foucault’s identification of this biologizing, or medicalising racism. The aim of this master’s thesis is to analyse and highlight the interaction between science, politics and law. More precisely, our research question concerns the use of scientific arguments in social spheres (notably in politics and law) instead of legal or political arguments. In fact, we want to raise the way in which certain actors invoke scientific arguments to impose "objective" elements of fact in debate and, in this way, refrain from politically and "subjectively" discussing these same elements (or, at (...) least, their social consequences). This Master’s thesis will adopt an interdisciplinary theoretical framework (chapter 1) mobilising philosophy of science, philosophy of law, sociology of law, legal technique and analytical theories. Then, we will apply it to a case study: the European regulation of genetically modified organisms (GMOs) after the European Court of Justice (CJEU) ruling of 25 July 2015 (chapter 2). The first chapter will provide theoretical elements to rethink the interaction between science, politics and law. The first section will propose a 'state of the art’ of the philosophical literature on the relationship between science (as a regime of truth) and politics. This master’s thesis will assess a truth under construction rather than a transcendental truth. Section 2 anticipates authoritarian claims based on science by considering the relationship science can have with power (Foucault). A solid review of philosophical, sociological and legal literature highlights the risks of giving decision-making power to an all-powerful science. Notably, the use of science to justify discriminatory policies is emphasised as these policies could not be challenged because, at the time, it was considered an objective scientific truth. Finally, section 3 offers a critique of the narratives of neutral and objective science, through the approach of science in action. This sociological approach presented all the doubts and subjectivity of science in action. The second chapter will propose a case study to illustrate the theoretical framework. We have chosen GMOs because they constitute a hybrid 'event', marked by scientific controversies, and with major socio-economic implications. The legal framework of GMOs in the European Union will be presented in the first section. In addition, the legal status of new breeding techniques (NBTs) will be examined. The second section will analyse the ruling of the European Court of Justice which made NBTs subject to GMO regulation. Finally, the third section will propose a reflection on the philosophy of law on the modes of existence of scientific, legal and political disciplines. (shrink)

In the present work, we will analyze the concept of intuition mainly in relation to the epistemological and the metaphysical theses of Schopenhauerian theory. In the first section, we will discuss the central axes of Schopenhauer’s metaphysical system, especially regarding the concept of will (Wille) and the relationship that this entails with his theory of knowledge. Then, we will examine the difference that the German philosopher establishes between representative —or mediated— rational knowledge and direct —or immediate— intuitive knowledge. Likewise, we (...) will trace at first the theses and the fundamental problems of the dualism of representation and we will furtherly establish the problem of the intuition of one’s own body. Finally, we will consider the scope and the limits of intuition, as well as its different variants: mainly aesthetic intuition and its culmination in mystical intuition. (shrink)

Le discours psychiatrique s’établit au XIXe siècle par un corps médical qui reproduit des relations de pouvoir : dans le cas de l’hystérie, le corps médical (majoritairement masculin) impose un discours de vérité sur un corps féminin qui est celui de la patiente. C’est la dimension genrée de ce phénomène que nous chercherons à clarifier en ce qui a trait aux relations de pouvoir, en avançant la thèse que les hystériques se dressent comme figure de résistance devant le pouvoir psychiatrique (...) – cette résistance étant rendue possible par la réappropriation d’une parole dérobée dans la production d’un discours de vérité. Pour ce faire, nous présenterons en premier lieu les démarches de Charcot, puis de Freud et Breuer dans les études sur l’hystérie. Nous emprunterons ensuite le cadre conceptuel foucaldien pour analyser les relations de pouvoir qui se trouvent au cœur de ces deux exemples, et nous tenterons finalement de montrer comment les hystériques peuvent être vues comme « militantes », à partir d’une perspective critique et féministe. The purpose of this article is to construct a critique of some works by the French artist Lucy Schwob, better known as Claude Cahun, who was active between 1910 and 1950. A writer and photographer, Cahun was at first very close to symbolist positions; later she was closer to the surrealist movement. Her work and her life, continually suspended between genders, and between ‘normality’ and ‘deviance’, have so far been analysed mainly through gender studies. This article attempts to restore the (...) inherent complexity of her poetic work and aesthetic. It tries to widen the field of study to deal with the representation of alterity, through reversing the stereotypical representation. (shrink)

Este artigo aborda o tratamento que Canguilhem e Foucault oferecem da medicina. Passando pelas distintas análises da clínica, da medicina em sua história e de seu aspecto social e político, observaremos desdobramentos irredutíveis em torno de uma problemática compartilhada.

Gabriel Tarde, along with Durkheim and others, set the foundations for what is today a common-sense statement in social science: crime is a social phenomenon. However, the questions about what social is and what kind of social phenomenon crime is remain alive. Tarde’s writings have answers for both of these capital and interdependent problems and serve to renew our view of them. The aim of this article is to reconstruct Tarde’s definition of crime in terms of genus and specific difference, (...) exploring his criminology as a case of his general sociology. This procedure shows that Tarde succeeded in creating a comprehensive theory of crime and criminals founded not only on his most well-known concept, imitation, but also on his equally important concepts of invention, opposition, social logic and social teleology. For Tarde, crime is a complex phenomenon related to criminal inventions, criminal propagations, the production of penal laws, the execution of controls and punishments, and the collective reactions to all these. In this paper I analyze two distinct contemporary perspectives on the Foucauldian concept of power and resistance, namely the perspectives enlightened by Judith Butler’s La vie psychique du pouvoir and by Stéphane Legrand’s Le marxisme oublié de Foucault. Although these two approaches are interesting ways of discussing the Foucauldian concept of resistance and power, they fail to take into account the role that intellectuals play in practices of social emancipation. This article deals with Michel Foucault’s 1978 and 1979 courses on liberalism and neoliberalism. It aspires to elucidate the historical circumstances, the conception of liberalism as critical political rationality and its projections in Foucault’s subsequent research. Along the same lines, the article also makes some critical considerations about the reception of Foucault’s ideas about liberal and neoliberal thought.

O artigo procura avaliar a consolidação e os desdobramentos da função heurística e simbólica ocupada pelo Ungeheuer [o monstro ou o monstruoso] na filosofia kantiana, tendo em vista a emergência do horizonte da racionalidade moderna. Uma reconfiguração dessas imagens do Monstro e da Monstruosidade parece ter lugar no momento mesmo em que a filosofia moderna procurou pensar sua identidade e seus limites. O pensamento de Kant, que ocupa - de fato ou de direito - um lugar central nessa ruptura, apresentaria (...) de modo exemplar, embora não evidente, o percurso dessa transformação. This work intends to evaluate the origins and developments of the symbolic and heuristic function at stake in the term Ungeheuer [the monster or the monstrous] within Kant's philosophy, regarding the rising horizon of modern rationality. A reconfiguration of the Monster and Monstrous imagery seems to take place right at the moment when modern philosophy had to reflect upon its own identity and limits. Kant's thought, that occupies - de jure or de facto - a central place within this rupture could exemplarily, but not obviously, show the path of such transformation. (shrink)

Resumo: O artigo tem por objetivo apresentar como, a partir da analítica foucaultiana da biopolítica, podem-se interpretar as práticas terapêuticas. Para isso, faremos uma apresentação de como Foucault concebe a biopolítica como uma política que inverte o princípio de soberania, buscando garantir a vida da população e, a partir daí, enfocar como as práticas terapêuticas são criadas e agenciadas no intuito de caucioná-la com um sentido muito mais preciso de doença em seu fundo biossocial do que de um ponto de (...) vista anátomo-individual.
