Contemporary reasoning about health is infused with the work products of experts, and expert reasoning about health itself is an active site for invention and design. Building on Toulmin’s largely undeveloped ideas on field-dependence, we argue that expert fields can develop new inference rules that, together with the backing they require, become accepted ways of drawing and defending conclusions. The new inference rules themselves function as warrants, and we introduce the term “warranting device” to refer to an assembly of the (...) rule plus whatever material, procedural, and institutional resources are required to assure its dependability. We present a case study on the Cochrane Review, a new method for synthesizing evidence across large numbers of scientific studies. After reviewing the evolution and current structure of the device, we discuss the distinctive kinds of critical questions that may be raised around Cochrane Reviews, both within the expert field and beyond. Although Toulmin’s theory of field-dependence is often criticized for its relativism, we find that, as a matter of practical fact, field-specific warrants do not enjoy immunity from external critique. AikinIThe notion of universality in argumentation is as fecund as is it is controversial. Chaïm Perelman and Lucie Olbrechts-Tyteca’s notion of universal audience (UA), given their requirement that all arguments be evaluated in terms of their audiences, clearly promises a rich account of argumentative norms. It equally yields a variety of questions. For the most part, the questions come (...) in three forms: what, precisely, is the universal audience; whether it is, in the end, a coherent notion; and how its norms actually constrain argument. Many objections to the notion claim that it is either incoherent or too empty to constrain. My objective here is to provide an account of Perelman’s notion of UA that avoids these objections. I will argue that the UA can be clarified with a distinction between two functions it plays in argumentation— one pragmatic and another epistemic. Perelman and Olbrechts-Tyteca do not explicitly disambiguate these roles themselves, though they do use the notion in two distinct ways in The New Rhetoric (TNR [1969]), and so it seems clear that although the view in the end may be Perelmanian, it is arguably not Perelman’s. No matter. The purpose of this essay is not to exhume Perelman but to resurrect and exercise his views. That is, historical work in philosophy must straddle the demands of two distinct goals— fidelity to the author in question and defensibility of the views developed. My case [End Page 238] will jointly depend on the comparative plausibility of my account as an interpretation of Perelman’s universal audience and of the view as correct regarding argumentative norms in relation to the other competing interpretations of Perelman’s UA. So if my argument for a divided universal audience is at least Perelmanian in spirit, and if it survives the objections to UA that other interpretations do not survive, it should be the philosophically preferable interpretation.IIThe first principle of Perelmanian rhetoric is that arguments are addressed to audiences for the purpose of inducing or increasing adherence to a view (TNR, 14). Consequently, the less reliant arguments are on a specific audience’s idiosyncratic commitments, the more effective the arguments will be in generating assent and resolving disagreements in wider and wider groups of people. Perelman describes the universal audience in The Realm of Rhetoric (RR [1982]) as “itself... made up of an infinite variety of particular audiences” (14). The UA is the regulative ideal of maximal intersubjective agreement. That is, we see both the relative weakness of arguments that depend on the commitments of particular audiences and “the value attached to opinions that enjoy unanimous approval” (TNR, 31). This unanimity is reached at its highest point in the universal audience. As such, UA is an agglomerative notion that functions as a criterion for how widely an argument may be given credence. Call this trajectory toward unanimity the pragmatic element of UA.However, the universal audience’s assent is used to define facts for arguments, and as such, it is a marker of the objectivity of a conclusion, not just the breadth of the effectiveness of an argument. Perelman and Olbrechts-Tyteca stipulate that “from the standpoint of argumentation, we are confronted with a fact only if we can postulate uncontroverted, universal agreement with respect to it” (TNR, 67). Facts and truths are defined in terms of the “agreement of the universal audience” (TNR, 67). This, of course, is not to say that arguments make facts but, instead, that their universal acceptability is a criterion for whether some purported fact is or is not the case. Agreement on this level does not play a metaphysical role of explanation but, rather, a cognitive role of justification for taking a commitment as a premise for further argument. Our typology is based on two ground adequacy factors, one logical and one epistemic. Logically, the step from premises to conclusion may be conclusive or only ceteris paribus. Epistemically, warrants may be backed a priori or a posteriori. Hence there are four types of arguments: conclusive a priori, defeasible a priori, defeasible a posteriori, and prima facie conclusive a posteriori. We shall give an example of each and compare our scheme with other typologies.

In the domain of medical science, factual evidence is usually considered as the criterion on which to base decisions and construct hypotheses. Evidence-based medicine is the translation of this approach into the field of patient care, and it means providing only the type of care that is based on evidence that proves its effectiveness and appropriateness. However, while the literature has focused on the types and force of evidence used to establish the recommendation and treatment guidelines, the problem of how (...) evidence is used in doctor–patient interactions to motivate, or refuse, treatment or habit change has been almost completely neglected. In this specific context, characterized by the epistemic unbalance between the interlocutors and a specific conversational goal, the scientific categories of evidence are often irrelevant. The goal of this paper is to address this challenge by analyzing the role evidence plays in doctor–patient interactions in diabetes care. After introducing an analytical distinction between the epistemic and the pragmatic aspect of evidence, we will propose a classification of the types and functions of evidence in chronic care communication, and illustrate its possible uses through its application to our corpus of diabetes-care consultations. From our qualitative analyses, it is possible to observe how in this communicative context a crucial role is played by the conflicts of evidence, in which providers correct patients’ uses of evidence leading them to using less defeasible levels of evidence. A conclusion is a “material consequence” of reasons if it follows necessarily from them in accordance with a valid form of argument with content. The corresponding universal generalization of the argument’s associated conditional must be true, must be a covering generalization, and must be true of counter-factual instances. But it need not be law-like. Pearl’s structural model semantics is easier to apply to such counter-factual instances than Lewis’s closest-worlds semantics, and gives intuitively correct results.

We argue that Cohen’s concept of inductive or ampliative probability facilitates proper explication of sufficient strength for non-demonstrative arguments conforming to the Toulmin model. The data and claims of such arguments are singular statements. We may epistemically classify the warrants of such arguments as empirical (either physical or personal), institutional, or evaluative. Backing evidence and rebutting considerations vary with the epistemic type of warrant, but in each case the notion of ampliative probability for arguments with warrants of that type can (...) be characterized. We may then use ampliative probability to define sufficient strength and related notions for Toulmin arguments. (shrink)

Is it possible to distinguish communities of arguers by tracking the argumentation schemes they employ? There are many ways of relating schemes to communities, but not all are productive. Attention must be paid not only to the admissibility of schemes within a community of argumentational practice, but also to their comparative frequency. Two examples are discussed: informal mathematics, a convenient source of well-documented argumentational practice, and anthropological evidence of nonstandard reasoning.

Suppose two persons disagree over whether an act is right, justifying their judgments by appealing to divergent higher-level moral principles. These principles function as backing and rebuttals in their argumentation. To justify these principles, we may argue either that they would be accepted in some ideal model or that they are in reflective equilibrium with our considered moral judgments. Disagreement over the model indicates difference in philosophical anthropology but does not preclude resolution through argument.

In this paper, we look at reasoning with evidence and facts in criminal cases. We show how this reasoning may be analysed in a dialectical way by means of critical questions that point to typical sources of doubt. We discuss critical questions about the evidential arguments adduced, about the narrative accounts of the facts considered, and about the way in which the arguments and narratives are connected in an analysis. Our treatment shows how two different types of knowledge, represented as (...) schemes, play a role in reasoning with evidence: argumentation schemes and story schemes. (shrink)

In axiological argumentation that refers to issues concerning matters of ethics, politics, or aesthetics, a warrant is derived from a general axiological base, which consists of propositions that are accepted by a particular social group. Such a warrant is supported by ideology, understood as a relatively well organised set of evaluative propositions. In axiological argumentation beliefs are represented by cultural objects that serve as the arguments. Cultural objects are universals, which have a culturally developed interpretation. Without proper recognition of the (...) interpretant, the correct reading of the sign and its appraisal is impossible. The main purpose of this article is to show how ideological objects constitute the base of the discourse. In analysis of chosen texts I will demonstrate, how at every stage of argumentation arguers exploit the topic and interactive potential of argumentation. (shrink)

In this paper, the political pamphlet “Der Hessische Landbote” by the eminent German author, Georg Büchner (1813–1837), will be positioned within the context of its political and historical background, analyzed as to its argumentative and stylistic structure, and critically evaluated. It will be argued that propaganda texts such as this should be evaluated by taking into account both rhetorical perspectives and standards of rational discussion. As far as argumentative structure is concerned, a modified version of the Toulmin scheme will be (...) used for the description of three passages of the “Landbote”. As far as stylistic techniques are concerned, Büchner’s strategic use of some figures of speech, especially parallelism, metaphor and metonymy will be examined. As to the critical evaluation, the recently developed concept of “strategic maneuvering” within Pragma-Dialectics, the typology of argumentative dialogues established by D. Walton, and sets of critical questions will be used to assess the status of the arguments within the “Landbote” as potentially fallacious ones. (shrink)
