The purpose of this article is to present a phenomenological description of how athletes in specific risk sports explore human interaction with natural elements. Skydivers play with, and surf on, the encountering air while falling towards the ground. Kayakers play on the waves and with the stoppers and currents in the rivers. Climbers are ballerinas of the vertical, using cracks and holds in the cliffs to pull upwards against gravity forces. The theoretical background for the description is found in the (...) phenomenology of Heidegger and Merleau-Ponty. The phenomenology of Husserl focused on the theoretical intentionality of the transcendental ego. With Heidegger the human being's concrete and practical interaction with the environing world moved to the foreground. Heidegger's analyses of ?equipmentality? also throw important light on equipmentality in sports and how we deal with tools and equipment in sports. However, in Heidegger's analyses the body resides in the background both as subject and object. The importance of the active body-subject is well documented in the work of Merleau-Ponty, and also Todes. The human being is a bodily ?being-in-the-world? and the body is the active medium through which the world is grasped. The body is however also situated and aligned with the fundamental dimensions of the world, with vertical gravity and with horizontal action space. In this article I show in a concrete way how in some sports we use fundamental characteristics of the environing world in a mode of playfulness. In these sports human beings play in an extreme way with fundamental elements of nature. The article thus puts phenomenology to a test. It should be able to move from general characteristics to specific features of our bodily human involvement with the environing world. (shrink)

In healthcare practice, care providers are confronted with tragic situations, in which they are expected to make choices and decisions that can have far-reaching consequences. This article investigates the role of moral case deliberation in dealing with tragic situations. It focuses on experiences of care givers involved in the treatment of a pregnant woman with a brain tumour, and their evaluation of a series of MCD meetings in which the dilemmas around care were discussed. The study was qualitative, focusing on (...) the views and experiences of the participants. A case study design is used by conducting semi-structured interviews with health care professionals who both played a role in the treatment of the patient and attended the MCD. The results show that MCD helps people to deal with tragic situations. An important element of MCD in this respect is making explicit the dilemma and the damage, demonstrating that there is no simple solution. MCD prompts participants to formulate and share personal experiences with one another and thus helps to create a shared perception of the situation as tragic. The article concludes that MCD contributes to the sharing of tragic experiences, and fosters mutual interaction during a tragedy. Its value could be increased through explicit reflection on the aspect of contingency that characterises tragedy. (shrink)

In healthcare practice, care providers are confronted with decisions they have to make, directly affecting patients and inevitably harmful. These decisions are tragic by nature. This study investigates the role of Moral Case Deliberation in dealing with tragic situations. In MCD, caregivers reflect on real-life dilemmas, involving a choice between two ethical claims, both resulting in moral damage and harm. One element of the reflection process is making explicit the harm involved in the choice. How harmful are our decisions? We (...) investigated how facilitators of MCD experience the importance of addressing harm in MCD and what participants learn from reflecting on harm. The study was qualitative, focusing on the views and experiences of the facilitators of MCD. Semi-structured interviews were conducted with facilitators of MCD. The research focuses on the subjective experiences of facilitators. Grounded Theory was used for analysis. The results show two main categories. The first concerns the awareness of tragedy. Within this category, five themes were discerned: making explicit that there is no solution, visualizing consequences, uncovering pain, focusing on emotion, and exploring perspectives on harm. The second category concerns the support for healthcare professionals in dealing with the tragedy of the choices they face. In this category, five themes came forward: acknowledging, offering comfort, managing harm, consideration through dialogue and repairing harm. Our study shows that addressing harm in MCD in tragic situations provides an important moral learning opportunity for participants. By formulating and becoming aware of harm, MCD aids healthcare professionals in the task they are faced with, namely making difficult and painful choices. MCD helps healthcare professionals to repair moral damage, making clear at the same time that harm cannot be undone. (shrink)

ZusammenfassungDer Beitrag thematisiert die Genese des Dogmas der Unübersetzbarkeit des Korans. Mit Unübersetzbarkeit ist gemeint, dass der Koran nichtübersetztwerdenkann, nicht, dass er nichtübersetztwerdensoll. Das Dogma besagt, dass die sprachliche Form des Korans göttlich gewollt ist und auf eine himmlische arabische Urschrift zurückgeht, so dass der Koran unübersetzbar ist. Hier ist der Frage nachzugehen, welche Faktoren die Entwicklung dieses Dogmas begünstigt haben. Einen zweiten Schwerpunkt bildet der Vergleich islamischer und islamwissenschaftlicher deutscher Koranübersetzungen. Religionswissenschaftlich ist dies von Interesse, weil so veranschaulicht werden (...) kann, wie sich Gläubige und Wissenschaftler zum selben Gegenstand verhalten, wie sie ihre voneinander abweichenden Haltungen begründen und legitimieren. Es wird die These vertreten, dass der Koran übersetzbar ist. In Übersetzungen geht allerdings vieles vom Originaltext verloren, was aber für alle übersetzten Texte gilt. (shrink)

Continental philosophies of science tend to exemplify holistic themes connecting order and contingency, questions and answers, writers and readers, speakers and hearers. Such philosophies of science also tend to feature a fundamental emphasis on the historical and cultural situatedness of discourse as significant; relevance of mutual attunement of speaker and hearer; necessity of pre-linguistic cognition based in human engagement with a common socio-cultural historical world; role of narrative and metaphor as explanatory; sustained emphasis on understanding questioning; truth seen as horizonal, (...) aletheic, or perspectival; and a tolerance for paradoxical and complex forms of expression. Continental philosophy of science is thus more comprehensive than philosophy of science in the analytic tradition, including (and as analytic philosophy of science does not tend to include) perspectives on the history of science as well as the social and practical dimensions of scientific discovery. Where analytic philosophy is about reducing or, indeed, eliminating the perennial problems of philosophy, Continental philosophy is all about thinking and that will mean, as both Heidegger and Nietzsche emphasize, making such problems more not less problematic. In this article I consider some central aspects of the naturalist philosophy of science and science and technology studies in dealing with the contested status of technoscience in medicine. Focusing on the concepts of realism and representation, I argue that theories of science-as-practice in naturalist philosophy of science should expand their scope so as to reflect more thoroughly on the social and political context of technoscience. I develop a hermeneutic of technomedical objects in order to highlight the internal connectedness between (...) social action, material agency, and the actions of scientific communities. The framework thus developed is used to re-consider the genomic turn in medicine. Pointing to the discrepancies between socially dominant representations of genomic technology and the actual interventions brought about through those technologies, I raise the question of how and where to address problems of theory and policy. Recent advances in evolutionary biology and ethology suggest that humans are not the only species capable of empathy and possibly morality. These findings are of no little consequence for theology, given that a nonhuman animal as a free moral agent would beg the question if human beings are indeed uniquely created in God's image. I argue that apes and some other mammals have moral agency and that a traditional interpretation of the imago Dei is incorrectly equating specialness with exclusivity. By (...) framing the problem in terms of metaphor, following the work of Paul Ricoeur and Sallie McFague, I propose that the concept of the imago Dei could be extended to accommodate moral species other than our own. Persons with profound intellectual and multiple disabilities cannot speak about their Quality of Life, which makes it necessary to involve others. In current approaches, these ‘others’ are seen as assessors trying to describe QoL as objectively as possible, which involves a reduction of their experiences, through which they develop knowledge on the QoL of the person with PIMD. The objective of this paper is to give caregivers’ knowledge on the QoL of a person with PIMD a theoretical basis that values (...) these experiences. We will argue that caregivers should be seen as witnesses, not assessors, and their statements on QoL as testimonies, not assessments. Audiences judge the trustworthiness of these witnesses intersubjectively, which implies a relationship characterized by trust and suspicion. Trust supports the witness to tell in her own words about the QoL of the person with PIMD; it demands receptivity, indicating that both the witness and the audience are willing to reconsider their perspective on QoL. Suspicion is necessary too, which helps the witness to critically approach her own interpretations and supports her to create more trustworthy testimonies. We conclude that the concept of witnessing helps to acknowledge caregivers’ experiential knowledge of QoL of a person with PIMD, which may also apply to other persons who cannot speak about their own QoL. We hope that our study will empower caregivers to give testimonies on QoL of a person with PIMD, which is crucial when complex decisions about the life of this person have to be made. (shrink)

Starting from the often-used metaphor of the “horizon of experience” this article discusses three different types of intercultural hermeneutics, which respectively conceive hermeneutic interpretation as a widening of horizons, a fusion of horizons, and a dissemination of horizons. It is argued that these subsequent stages in the history of hermeneutics have their origin in—but are not fully restricted to—respectively premodern, modern and postmodern stages of globalization. Taking some striking moments of the encounter between Western and Chinese language and philosophy as (...) example, the particular merits and flaws of these three types of hermeneutics are being discussed. The claim defended is that although these different types of hermeneutics are mutually exclusive from a theoretical point of view, as interpreting beings in the current era we depend on each of these distinct hermeneutic practices and cannot avoid living them simultaneously. This paper deals with the particularities of vagueness in law. Thereby the question of the law’s capacity for vagueness is closely related to the question of the impact of vagueness in law, since exaggerated vagueness combined with the elasticity of legal interpretation methodology may affect the constitutional principles of legal certainty, the division of powers, and the binding force of statute. To represent vagueness and the instability of legal concepts and rules, a Hyperbola of Meaning is introduced, opposing Heck’s metaphor (...) of a core and a periphery of meaning. Furthermore, evidence is provided that the use of vague legal concepts and the capability of legal methodology to affect the specific meaning of those concepts, may give rise to astonishing and irrational changes of meaning of the law. Finally the paper sets out in search of an added value of vagueness in law, and weighs several stated pros and contras of vagueness. Gadamer’s notion of dialogical truth relies on the claim that self and world “belong together” as aspects of a single, unitary phenomenon, one which is made manifest in language. This view has difficulty, however, accounting for that which is untruthful. To get past this obstacle I suggest that we turn to Nishida’s work, which shows how we can bring self and world together into a kind of harmony such that the cultivation of perception makes possible truthful expression.

The concept of moral individualism is part of the foundational structure of most prominent modern moral philosophies. It rests on the assumption that moral obligations towards a respective individual are constituted solely by her or his capacities. Hence, these obligations are independent of any ἔθος, of any shared ethical sense and social significations. The moral agent and the individual with moral status are construed as subjects outside of any social relation or lifeworld significations. This assumption has been contested in the (...) last decades by diverse authors with very different approaches to moral philosophy. In the last years, an increasing number of philosophers like Cora Diamond and Alice Crary, but also phenomenologists like Paul Ricœur, Klaus Held, and Bernhard Waldenfels question the presupposition that individual capacities are the agent-neutral and context-neutral ground of moral considerations. This critique of moral individualism in different contemporary discourses shows a striking similarity between Wittgensteinian and phenomenological philosophers as their critical inquiry of prominent theories like the ones by Immanuel Kant, John Rawls, Peter Singer or Tom Regan is derived from mostly implicitly efficacious Aristotelian theorems. Telling examples are the ἔθος as pre-given normative infrastructure, the ἕξις as individual internalization of the ethos, the φρόνησις described as a specific practical know-how in contrast to scientific knowledge, and not at least the definition of the human being as ζῷον πολιτικόν. However, the Aristotelian sources of this movement have not yet been scrutinized systematically. This paper aims, first, to reveal the significance of these sources to make them visible and, second, to contribute to the notion of the topicality of Aristotelian philosophy in current debates on ethics. The History of Philosophy as a Problem: Four Fundamental Views in the German Debate and Heidegger’s Hermeneutical Dissolution Resumen: El artículo pretende introducir el problema que supone el estudio de la historia de la filosofía, especialmente hoy cuando esta práctica se ha establecido como elemento indisociable de la formación en la materia. Con el fin de plantear de manera más concreta dicho problema, el artículo trata la legitimidad del enfoque hermenéutico, pues este parece consistir en identificar el estudio histórico de (...) la filosofía con el propio filosofar. Para lograr una evaluación precisa de este enfoque, se lleva a cabo un recorrido por las cuatro posiciones cardinales del debate alemán en torno al sentido, el método y la función de la historia de la filosofía. Mediante la contraposición de la propuesta de Heidegger frente a estas cuatro posiciones cardinales, se espera aclarar cuáles son los fundamentos del pensamiento hermenéutico y sacar a la luz las razones por las que el estudio del pasado filosófico podría ser considerado esencial para la formación en filosofía.: The article aims to introduce the problem that represents the study of the history of philosophy, especially today when this practice has established as the model in the academic formation of the field. In order to raise this problem more specifically, the article focuses on the legitimacy of the hermeneutic approach, as it consists in the affirmation of the necessity of the study of the past for philosophy. The evaluation of this approach is carried out in the light of a description of the four cardinal positions of the German debate about the meaning, method and function of the history of philosophy. By contrasting Heidegger’s proposal with these four cardinal positions, it is hoped to clarify the foundations of hermeneutic thought and to bring to light the reasons because the study of philosophical past can be considered essential for philosophy. By studying several cases of expert systems' use, a variety of difficulties were identified as directly depending on specific characteristics of experts and their tasks. This concerns more than the questions: “May experts be replaced by machines?” or “Is experts' knowledge explicable?”. The organisational structure of their work as well as the cyclic, non-plannable way of their task performing have further relevance. The paper introduces the concept of experts' systems to deal with diversities of their expertise and complexities of their (...) work. It draws a distinction between non-monotonic problem solving, exploration, medium and modification, and argues that these modes are not reducible to yet another improved input/output strategy or dialogue style but introduce additional functions supporting the human-computer interaction according to experts' needs. In the first few sections, the paper covers the theoretical and empirical results of our research, whereas Section 4 introduces our design suggestions for experts' systems. (shrink)

This contribution investigates the idea that an act of signification can be understood in terms of the self-referentiality that is typical of the biological organization. The capacity of a living being to interpret and appreciate its own environment can be understood as being grounded in its ability to perform self-referential experiences. We may call this the living being’s capacity of sense. In any act that generates sense, it is possible to distinguish a process of signification from its outcome, but such (...) a distinction between logical levels inevitably demands an external observer’s point of view. Hence, the concept of ‘subjectivity’ can be defined in terms of an absence of such distinction between logical levels. This absence is considered pivotal both for the self-referential organization of the living and for the generation of sense. A case example from the field of psychotherapy is added to illustrate the distinction as well as the non-distinction between logical levels of description. (shrink)

This article seeks to shed light on some of the problematic assumptions underpinning the contemporary debate over the constitutional identity of the European Union. The central claim put forward here is that the development of the European Union’s constitution is significantly constrained by what Charles Taylor has described as the modern social imaginary. The constraint operates at two levels. First, modern understandings of constitutionalism typically ignore or underemphasize its dynamic and historical characteristics and its relationship with the self-understanding of political (...) subjects. Thus, modern constitutionalism fails to acknowledge the importance of historically conditioned assumptions involved in the formation of the identities of political subjects. In short, it fails to understand constitutionalism as a ‘regime’. Second, modern constitutionalism’s blind-spots result in a relatively unreflective adherence to a particular type of constitutional regime: the modern economy and its associated ‘consumerist’ form of political citizenship. Hermeneutic research in nursing: developing a Gadamerian‐based research method This paper takes the stance that although there are many different approaches to phenomenological and hermeneutic research, some of these have become blurred due to multiple interpretations of translated materials. Working from original texts by the German philosophers, this paper reconsiders the relevance of phenomenology and hermeneutics to nursing research. We trace the development of Gadamer's philosophy in order to propose a research method based in this tradition. Five steps have been (...) identified as a guide for nurse researchers. In this article, we explore the implicit conceptions of business ethics and social responsibility of owners−managers of small and medium enterprises (SME) in Cameroon. While using a hermeneutical approach, our main objective is to clarify how Sub-Saharan African business people themselves understand and define corporate responsibility in their particular economic and political environment. Our aim is not to deliver an empirical study of business practices and management behavior in SMEs. We wish to discuss which responsibilities they themselves judge to be (...) relevant and which can legitimately be attributed to them by third parties. Secondly, we relate our findings to other empirical work on SMEs, in Africa and elsewhere. It is shown that there are similarities with the way in which SMEs in Europe interpret their responsibility, but also striking differences. Further, we relate our findings to some theoretical controversies around corporate social responsibility (CSR) in SMEs, to questions about evaluation tools for CSR in the SME context, and to the role of CSR with respect to poverty alleviation in developing countries. The Sublime in a phenomenological sense: The Affective Bodily Experience of Space The aim of the following paper is to redefine the sublime in phenomenological terms, a task long overdue. Departing from Kant, it claims that the phenomenological sublime is an emotion aroused neither by the power of our reason transcending the inadequacy of imagination as it concerns nature, nor by the overwhelming powers of imagination as it concerns an artwork, but by the excess of sensuousness over conceptuality, which is (...) bodily felt. This shift into bodily apprehensions, though advanced by empirical psychologists, took place in the twentieth century resulting from Husserl's and Merleau-Ponty's reformulation of the affective sphere of the body and of its concomitant experience of space. Their criticism of compossibility and harmony lead to a disruption of the bodily metaphoric order inherent to artistic representation. This becomes evident in the conception of present architecture, as the works of Tschumi and Eisenman show. The phenomenological emotion of sublimity expresses thus the affective bodily experience of space. (shrink)

Pig farmers and scientists appear to have different perspectives and underlying framing on animal welfare issues as tail biting and natural behaviour of pigs. Literature proposes a joint learning process in which a shared vision is developed. Using two different settings, a symposium and one-to-one dialogues, we aimed to investigate what elements affected joint learning between scientists and pig farmers. Although both groups agreed that more interaction was important, the process of joint learning appeared to be rather potentially dangerous for (...) the farmer–scientist relationship. During the symposium, farmers were only moderately open for scientific knowledge and the issue of tail biting had the tendency to run into a deadlock. The setting was an influencing element for the degree of success, because the dialogues did lead to improved mutual trust and understanding of each other’s framing and context. Another element was the degree of usability and absoluteness of scientific facts. They were frequently not concrete enough, too uncertain or not relating to the context of the farmers. In addition, some scientific facts were not recognized by the farmers. Both groups appeared to react and argue from their praxis, including their local environment, way of living, handling and understanding their environment. These praxises appeared to function as a filter, influencing the way of observing the environment, inducing ‘blind spots’ and misunderstandings. Stepping in each other’s praxis might provide concrete and fusing insights, required to realize joint learning processes. (shrink)

The purpose of this article is to critically assess the ‘three-world theory’ as it is presented—with some slight but decisive differences—by Jürgen Habermas and Karl Popper. This theory presents the philosophy of science with a conceptual and material problem, insofar as it claims that science has no single access to all aspects of the world. Although I will try to demonstrate advantages of Popper’s idea of ‘the third world’ of ideas, the shortcomings of his ontological stance become visible from the (...) pragmatic point of view in Habermas’s theory of communicative acts. With regard to the critique that the three-world theory has met in both its pragmatic and ontological versions, I will take a closer look at John Searle’s naturalistic counter-position. By teasing out some problematic implications in his theory of causation, I aim to show that Searle’s approach is, in fact, much closer to Popper’s than he might think. Finally, while condoning Habermas’s distinction between the natural world and the lifeworld, I will opt for a pragmatically differentiated view of ‘the real’, rather than speaking of different worlds. Argument“The Case of Ellen West” was published by the Swiss psychiatrist, Ludwig Binswanger, in 1944–1945. The case-history depicts the illness and suicide of a young woman who was his patient twenty years earlier. It came to be considered one of the paradigmatic studies of the newly established discipline ofDaseinsanalyse, an attempt to synthesize existential philosophy and therapeutic practice. This paper analyzes the case-study, employing newly uncovered archival material to expose important details regarding the treatment of Ellen West and the posthumous (...) writing of her case-history. The richness of the archival sources and the various historiographical characteristics they exhibit raise methodological questions about the potentialities and limitations of historical representation. The new data will thus serve as a platform from which to explore and discuss more generally the problems involved in historical reconstruction – of both subjective experience and clinical knowledge – and the questions of authorship and intertextuality in the genre of the case-history. [/] -/- In permanent contrast with Heidegger’s thought, this study develops Gadamer’s conception of otherness, its place in the hermeneutic project of Truth and Method and the reformulation that all this entails of human existence disclosedness and the event of being itself. Work starts raising Gadamer’s critique to the ontological [42] recognition of the others by Heidegger; it shows then the opposition between the “being-towards-death” and “being-for-history”, and the relevance of practical life and the idea of dialogue as a model of understanding in Gadamer’s philosophy. A scholar of Hellenistic and Prussian history, Droysen developed a historical theory that at the time was unprecedented in range and depth, and which remains to the present day a valuable key for understanding history as both an idea and a professional practice. Arthur Alfaix Assis interprets Droysen’s theoretical project as an attempt to redefine the function of historiography within the context of a rising criticism of exemplar theories of history, and focuses on Droysen’s claim that the goal underlying historical (...) writing and reading should be the development of the subjective capacity to think historically. In addition, Assis examines the connections and disconnections between Droysen’s theory of historical thinking, his practice of historical thought, and his political activism. Ultimately, Assis not only shows how Droysen helped reinvent the relationship between historical knowledge and human agency, but also traces some of the contradictions and limitations inherent to that project. Este ensaio examina a explicação de Husserl sobre o que afinal acontece quando ocorre a compreensão. Os tópicos de sua Primeira Investigação Lógica são familiares ao ponto de serem menosprezadas: distinções essenciais envolvendo atos conferidores de significação e preenchedores de significação e seus conteúdos, caracterizações dos atos conferidores de significação, a flutuação dos significados das palavras e a idealidade das unidades de significação, e os conteúdos fenomenológico e ideal das vivências de significação. Uma vez feitas as distinções essenciais, a investigação (...) abre um caminho direto. Ela conduz dos atos psiquicamente reais de significação e seus conteúdos subjetivamente flutuantes às significações logicamente ideais e seus conteúdos objetivamente constantes. Dado que aparentemente a estratégia de Husserl para lidar com expressões essencialmente ocasionais e suas significações aparentemente flutuantes pode funcionar para a Lógica pura, com sua necessidade de rigor de identidade e determinação de sentido, mas não, entretanto, para o discurso ordinário, parece que a Primeira Investigação Lógica não pode prover uma explicação sobre a compreensão. Contudo, este ensaio tenta mostrar que Husserl apresenta uma hermenêutica fundamental na Primeira Investigação Lógica e que ela se volta da linguística para a ontologia, ou de ‘meras palavras’ para as ‘coisas elas mesmas’. O objetivo deste artigo é mostrar que o conceito de imaginação, tal como é concebido pelo mentalismo filosófico ou psicológico, é uma ilusão gramatical que pode ser desfeita pelo regresso ao "solo áspero" da linguagem ordinária.This paper proposes to demonstrate that the concept of imagination, as it is conceived by philosophical or psychological mentalist doctrines, is a grammatical illusion, which can be solved by means of a movement back to the "rough ground" of ordinary language.
