David Gauthier claims that it can be rational to co-operate in a prisoner's dilemma if one has adopted a disposition constraining one's self from maximizing one's individual expected utility, i.e., a constrained maximizer disposition. But I claim cooperation cannot be both voluntary and constrained. In resolving this tension I ask what constrained maximizer dispositions might be. One possibility is that they are rationally acquired, irrevocable psychological mechanisms which determine but do not rationalize cooperation. Another possibility is that they are rationally (...) acquired preference-functions rationalizing cooperation as maximizing. I argue that if they are the first thing, then their adoption fails to make co-operation rational even if, as Gauthier also claims, actions are rational if they express rational dispositions. I then suggest that taking constrained maximizer dispositions to be things of the second sort would result in them being able to make co-operation rational, and that so-taking them therefore serves the bulk and spirit of Gauthier's larger claims, which I reconstruct accordingly. Since the end of the Cold War, international ethicists have focused largely on issues outside the traditional scope of security studies. The nuclear ethics literature needs to be revived and reoriented to address the new and evolving 21st century nuclear threats and policy responses.

I argue that Gauthier's constrained-maximizer rationality is problematic. But standard Maximizing Rationality means one's preferences are only rational if it would not maximize on them to adopt new ones. In the Prisoner's Dilemma, it maximizes to adopt conditionally cooperative preferences. (These are detailed, with a view to avoiding problems of circularity of definition.) Morality then maximizes. I distinguish the roles played in rational choices and their bases by preferences, dispositions, moral and rational principles, the aim of rational action, and rational (...) decision rules. I argue that Maximizing Rationality necessarily structures conclusive reasons for action. Thus conations of any sort can base rational choices only if the conations are structured like a coherent preference function; rational actions maximize on such functions. Maximization-constraining dispositions cannot integrate into a coherent preference function. (shrink)

Gregory Kavka's 'Toxin Puzzle' suggests that I cannot intend to perform a counter-preferential action A even if I have a strong self-interested reason to form this intention. The 'Rationalist Solution,' however, suggests that I can form this intention. For even though it is counter-preferential, A-ing is actually rational given that the intention behind it is rational. Two arguments are offered for this proposition that the rationality of the intention to A transfers to A-ing itself: the 'Self-Promise Argument' and David Gauthier's (...) 'Rational Self-Interest Argument.' But both arguments – and therefore the Rationalist Solution – fail. The Self-Promise Argument fails because my intention to A does not constitute a promise to myself that I am obligated to honor. And Gauthier's Rational Self-Interest Argument fails to rule out the possibility of rational irrationality. (shrink)

Game theory is the systematic study of interdependent rational choice. It should be distinguished from decision theory, the systematic study of individual (practical and epistemic) choice in parametric contexts (i.e., where the agent is choosing or deliberating independently of other agents). Decision theory has several applications to ethics (see Dreier 2004; Mele and Rawlings 2004). Game theory may be used to explain, to predict, and to evaluate human behavior in contexts where the outcome of action depends on what several agents (...) choose to do and where their choices depend on what others choose to do. (See the entry on game theory) Game theory consequently is relevant to ethics, and it is used in moral and political philosophy in a variety of ways. We shall concentrate on the influence and use of game theory in ethics and those parts of political theory involving norms or principles of justice, ignoring questions about political and legal institutions on the one hand and questions about issues dealing with moral virtues on the other. This paper explores how the Leviathan that projects power through nuclear arms exercises a unique nuclearized sovereignty. In the case of nuclear superpowers, this sovereignty extends to wielding the power to destroy human civilization as we know it across the globe. Nuclearized sovereignty depends on a hybrid form of power encompassing human decision-makers in a hierarchical chain of command, and all of the technical and computerized functions necessary to maintain command and control at every moment of the sovereign's existence: this (...) sovereign power cannot sleep. This article analyzes how the form of rationality that informs this hybrid exercise of power historically developed to be computable. By definition, computable rationality must be able to function without any intelligible grasp of the context or the comprehensive significance of decision-making outcomes. Thus, maintaining nuclearized sovereignty necessarily must be able to execute momentous life and death decisions without the type of sentience we usually associate with ethical individual and collective decisions. Suppose that two nations A and B each possess a nuclear arsenal and are rational utility-maximizers. Suppose further that B has some interest in provoking A, possibly by attacking her with nuclear weapons. In the hope of preventing this from happening, A informs B of à conditional intention on her part to retaliate against B with nuclear weapons should B in fact attack A. By doing so A attempts to lower the probability of B's attacking A by increasing B's estimate (...) of the conditional probability of A's retaliating once provoked. Problematic deterrent situations are those in which B prefers to attack A without retaliation, A prefers most of all that she not be attacked, and A prefers an attack-with-no-retaliation scenario to an attack-with-retaliation scenario. Feature is à result of the fact that A prefers to minimize nuclear devastation, i.e., A would herself be worse off retaliating than not retaliating to an attack. Now, if B knows all of this to be the case then A's expression of a conditional intention to retaliate will not in fact deter B from attacking, since A is rational and will not act contrary to her own best interests. B has no reason to fear A's retaliation and therefore B has no reason not to attack. Deterrence, it seems, is an irrational policy among fully rational actors. This is one version of the so-called paradox of deter-rence. If expressing a conditional retaliatory intention is the best way for A to ward off an attack, then the paradox can be strengthened as follows: It is rational for A to intend to act irrationally. ABSTRACTI defend the Interdependency Thesis, according to which rational evaluations of dispositions and actions are made in light of each other. I invoke a model of rationality that relies on various levels of consistency existing between an agent's reasons for adopting a moral disposition, the argument for the moral theory she endorses, her desires, disposition, and choice to be a moral person as reflected in the maxim she adopts. The Interdependency Thesis shows that we do not need to demonstrate the (...) rationality of every morally required action in order to defeat scepticism fully. (shrink)

In his recent paper, “Justice as Fairness: Political not Metaphysical,” John Rawls makes use of a footnote to disown what to many readers must have seemed one of the most striking and original underlying ideas of his theory of justice, that it “is a part, perhaps the most significant part, of the theory of rational choice.” That Rawls should issue this disclaimer indicates, at least in my view, that he has a much clearer understanding of his theory, and its relationship (...) to rational choice than he did at the time that he wrote A Theory of Justice. As I note in Morals by Agreement, Rawls does not show that principles of justice are principles of rational choice. Hence, in appropriating the idea, I can claim diat I am undertaking a pioneering enterprise. No doubt Thomas Hobbes would have undertaken it had the resources of the theory of rational choice been at his disposal, but I do not intend to pursue counterfactuals in a search for historical antecedents. Moral theory as rational choice theory is, I claim, a new venture. (shrink)

This paper looks at the question of what form the requirements of practical rationality take. One common view is that the requirements of rationality are wide-scope, and another is that they are narrow-scope. I argue that the resolution to the question of wide-scope versus narrow-scope depends to a significant degree on what one expects a theory of rationality to do. In examining these expectations, I consider whether there might be a way to unify requirements of both forms into a single (...) theory of rationality, and what the difficulties involved in doing so can teach us about the foundations of practical rationality. What behavior is rational? It’s rational to act ethically, some think. Others endorse instrumentalism — it is rational to pursue one’s goals. Still others say that acting rationally always involves promoting one’s self-interest. Many philosophers have given each of these answers. But these answers don’t really conflict; they aren’t vying to describe some shared concept or to solve some mutually acknowledged problem. In so far as this is debated, it is a pseudo-debate. The different uses of ‘rational action’ differ merely (...) in meaning. I shall defend the following claims: ‘rational behavior’ is used in ethical, prudential, and instrumental ways (section 1); these uses of ‘rational behavior’ are distinct (section 2); they do not represent competing theories of rational behavior (section 3); we should stop using ‘rational behavior’ ethically and prudentially, but we may continue its instrumental use (section 4). Wychodząc od analizy jednego z paradoksów odstraszania wynikającego ze wspomnianego modelu, przedstawię różne sposoby rozwiązania problemów które generuje, rozpatrując je w kontekście charakteru intencji, racjonalności, oraz moralności działań podmiotu uwikłanego w SSO. Przedstawię również propozycję rozwiązania wspomnianego paradoksu, oraz wskażę na dodatkowe czynniki wpływające na ocenę etyczną działań, przyjmowania intencji, oraz jej podtrzymywania przez racjonalnego agenta reprezentującego państwo odstraszające.

To show it is sometimes rational to cooperate in the Prisoner's Dilemma, David Gauthier has claimed that if it is rational to form an intention then it is sometimes rational act on it. However, the Paradox of Deterrence and the Toxin Puzzle seem to put this general type of claim into doubt. For even if it is rational to form a deterrent intention, it is not rational act on it (if it is not successful); and even if it is rational (...) to form an intention to drink a toxin, it is not rational to act on it (come the time for drinking). This article employs an extended version of Michael Bratman's theory of intention to show how to argue systematically that it can be rational to act on rationally formed cooperative intentions, while not being committed to the rationality of apocalyptic retaliation, or pointless toxin drinking. The article begins with an overview of the historic moment of ?the end of the Cold War?, and of the paradoxically deepening moral, social, and environmental problems posed by the military system. It demonstrates that historical and contemporary analyses of defence and war have dogmatically presupposed the military paradigm, and have therefore failed to recognize the self?reproducing structure of covert premisses and inferences upon which it rests. In laying bare this underlying system of unreason, the analysis demonstrates that the military (...) paradigm's ultimately self?contradictory concepts of ?security? and ?defence? repose on unstated interests of social and political rule. Proposing new distinctions between pathological and life?enabling forms of war, and between guilty and innocent combatants, the argument develops alternative, non?military principles of war to guide rational and moral agency. The critics of rational choice theory frequently claim that RCT is self-defeating in the sense that agents who abide by RCT’s prescriptions are less successful in satisfying their preferences than they would be if they abided by some normative theory of choice other than RCT. In this paper, I combine insights from philosophy of action, philosophy of mind and the normative foundations of RCT to rebut this often-made criticism. I then explicate the implications of my thesis for the wider philosophical (...) debate concerning the normativity of RCT for both ideal agents who can form and revise their intentions instantly without cognitive costs and real-life agents who have limited control over the formation and the dynamics of their own intentions. This paper critically examines John Mark Mattox's view of the nature of the moral appropriateness of particular response options. By so doing, I aim to engage the wider readership in a debate, which I hope leads to greater clarity and precision of thinking on these topics. After summarizing Mattox's view, I argue first that in order for Mattox's ultimate conclusion to hold in moral terms, he must abandon the argument on the permissibility of nuclear reprisal to re-establish nuclear deterrence and (...) instead anchor this response solely on the moral grounds of retributive justice. Secondly, I argue that the morally superior and politically efficacious counter-nuclear terrorist response is to hunt down the nuclear terrorists and hold them accountable for war crimes in the International Criminal Court. This response is consistent with just war theoretic principles, and it also affirms the moral virtues of honor, dignity, and humane treatment in contexts where they are needed the most? the holocausts of nuclear terrorist attacks. 1. Introduction The policy of deterrence, at least to avert nuclear war between the superpowers, has been a controversial one. The main controversy arises from the threat of each side to visit destruction on the other in response to an initial attack. This threat would seem irrational if carrying it out would lead to a nuclear holocaust – the worst outcome for both sides. Instead, it would seem better for the side attacked to suffer some destruction rather than to retaliate (...) in kind and, in the process of devastating the other side, seal its own doom in an all-out nuclear exchange. Yet, the superpowers persist in their adherence to deterrence, by which we mean a policy of threatening to retaliate to an attack by the other side in order to deter such an attack in the first place. To be sure, nuclear doctrine for implementing deterrence has evolved over the years, with such appellations as “massive retaliation,” “flexible response,” “mutual assured destruction”, and “counterforce” giving some flavor of the changes in United States strategic thinking. All such doctrines, however, entail some kind of response to a Soviet nuclear attack. They are operationalized in terms of preselected targets to be hit, depending on the perceived nature and magnitude of the attack. Thus, whether U.S. strategic policy at any time stresses a retaliatory attack on cities and industrial centers or on weapons systems and armed forces, the certainty of a response of some kind to an attack is not the issue. Recent revelations of Iran’s hitherto undisclosed uranium enrichment programs have once again incited western fears that Tehran seeks nuclear weapons’ capability. Their fears seem motivated by more than the concern for compliance with the Nuclear Nonproliferation Treaty (NPT). Rather, they seem strongly connected to the western moral assumptions about what kind of government or people can be trusted with a nuclear arsenal. In this paper, I critically examine the western assumptions of the immorality of contemporary nuclear proliferation from an international (...) ethical stance that otherwise might be expected to give it unequivocal support – the stance of Kantian nonideal theory. In contrast to the uses of Kant that were prominent during the Cold War, I advance and apply a sketch of a Kantian nonideal theory that specifies the conditions (although strict conditions) under which nuclear proliferation for states like Iran is morally permissible even though the NPT forbids it. Over the last fifty years, traditional farming has been replaced by industrial farming. Unlike traditional farming, industrial farming is abhorrently cruel to animals, environmentally destructive, awful for rural America, and wretched for human health. In this essay, I document those facts, explain why the industrial system has become dominant, and argue that we should boycott industrially produced meat. Also, I argue that we should not even kill animals humanely for food, given our uncertainty about which creatures possess a right to (...) life. In practice, then, we should be vegetarians. To underscore the importance of these issues, I use statistics to show that industrial farming has caused more pain and suffering than the Holocaust. (shrink)

Supposons que les agents rationnels ne choisissent pas à l’encontre de leurs préférences, que leur choix n’est déterminé que par ces préférences, et que leurs préférences intrinsèques ne changent pas de façon spontanée, automatique et directe sous l’influence de la critique rationnelle. Même dans de telles hypothèses, les (...) agents rationnels peuvent résoudre optimalement un éventail de situations de choix paradoxal au moyen de mécanismes qui les amènent à réviser leurs préférences.
