Political liberalism, or public reason liberalism, has taken a decisive turn towards the Convergence Conception of public justification and away from the orthodox Consensus Conception. Convergence theorists argue that public justification should be understood as all reasonable people having some conclusive reason to endorse coercively enforced moral rules that are issue and context specific. They argue for this on the basis that, given the nature of deep moral and political disagreement, only the Convergence Conception can show reasonable people how to (...) achieve a stable political order. I argue however that the Convergence Conception faces the Verbal Agreement Objection which puts pressure on its claims to show people how to maintain a political order. This is because at its core it involves a tension between its account of the nature of the agreements that constitute public justification and the objects of those agreements that make it highly sensitive to context changes. This paper defends a particular view of explaining reasonable disagreement: the Conceptual View. The Conceptual View is the idea that reasonable disagreements are caused by differences in the way reasonable people use concepts in a cognitive process to make moral and political judgements. But, that type of explanation is caught between either an explanatory weakness or an unparsimonious and potentially self-undermining theory of concepts. When faced with deep disagreements, theories on the Conceptual View either do not have the resources to (...) explain them, or can only explain them by committing to a completely new theory of concepts where all moral and political concepts are a unique type of concept. This paper shows how the Conceptual View can avoid this dilemma by adopting what I dub the ‘Metalinguistic Strategy’ for explaining reasonable disagreement. The Metalinguistic Strategy uses recent innovations in the philosophy of language on metalinguistic negotiation to explain reasonable disagreements whether they be ordinary or deep disagreements as genuine disagreements whilst maintaining our ordinary ideas about concepts. L’enquête conceptuelle sur la justice de Kyle Johannsen nous incite à considérer la justice comme une simple valeur, indépendante des exigences de la pratique. Dans ce qui suit, je soulève deux questions méthodologiques afin de déterminer si Johannsen fonctionne avec la compréhension ‘correcte’ de la justice et de le convaincre que des problèmes complexes, tels que ceux concernant la justice sociale, nécessitent que la justice soit comprise comme une valeur complexe. Ainsi, les contextualistes de la justice devraient embrasser la distinction (...) entre la justice et les règles de régulation. En outre, la justice, davantage qu’une valeur parmi d’autres à considérer dans nos délibérations, doit plutôt être conçue comme leur résultat. (shrink)

RESUMO Neste artigo, são rejeitadas duas teses relativamente aceitas a respeito do projeto filosófico tardio desenvolvido por John Rawls. A primeira tese afirma que o objetivo de obras como "O Liberalismo Político" e "Justiça como Equidade: Uma Reformulação" seria o de revisar a natureza do argumento contratualista de Rawls. A segunda, por sua vez, afirma que a principal consequência dessa revisão teria sido certo recuo das implicações igualitárias de sua teoria da justiça original. Procurar-se-á rejeitar ambas as proposições mostrando que (...) "O Liberalismo Político" deve ser entendido como uma teoria acerca do uso legítimo do poder em uma sociedade democrática, e que essa teoria da legitimidade possui consequências distributivas próprias, incompatíveis com teorias liberais convencionais. ABSTRACT The article aims to reject two interrelated theses on the philosophical project carried forward by the late John Rawls. The first thesis states that there is an important change in Rawls' late works such as "Political Liberalism" and "Justice as Fairness: A Restatement" regarding the nature of his theory. Particularly, this change would had brought about a reassessment of Rawls' contractualist argument. The second thesis claims that one of the most important consequences of such reassessment is the retreat from strong egalitarian commitments, as they were present in Rawls' original theory of justice. The article rejects both theses, showing that Political Liberalism can be understood as a theory about the legitimate uses of power in a democratic society and that such new theory of legitimacy brings about distributive consequences by its own that sharply contrast with classical liberal theories. A defining characteristic of a liberal democratic society is the assignment of basic rights and liberties that protect each person’s private sphere. Hence, social choice made in a liberal democratic society must at the very least be consistent with the exercise of each person’s basic rights. However, even when everybody agrees to this basic principle, there could still remain irreconcilable social conflict and disagreement when it comes to the specific assignment of basic rights. This is especially so in a pluralistic (...) society where there is a clash among radically different and incompatible world views. Philosophers have now started to focus on this issue, which now goes by the name “perspectival diversity.” This paper extends the basic social choice theoretic framework of liberal rights by extending the domain to include individual perspectives alongside individual preferences. In this new framework, different individuals are able to see or perceive the same social alternative differently based on their own unique perspectives. The formal results of the paper imply that generating a viable social choice that is consistent with the assignment of basic rights can quickly break down once we start to increase the level of perspectival diversity in society. What can we know? How should we live? What is there? Philosophers famously diverge in the answers they give to these and other philosophical questions. It is widely presumed that a lack of convergence on these questions suggests that philosophy is not progressing at all, is not progressing fast enough, or is not progressing as fast as other disciplines, such as the natural sciences. Call the view that ideal philosophical progress is marked by at least some degree of convergence on (...) the core philosophical questions the pro-convergence thesis. I will argue that there is reason to reject the pro-convergence thesis in favor of the anti-convergence thesis, the view that significant viewpoint convergence is at odds with the aims of a philosophically ideal community. The argument centers on a thought experiment about two different philosophical communities. (shrink)
