So-called evolutionary error theorists, such as Michael Ruse and Richard Joyce, have argued that naturalistic accounts of the moral sentiments lead us to adopt an error theory approach to morality. Roughly, the argument is that an appreciation of the etiology of those sentiments undermines any reason to think that they track moral truth and, furthermore, undermines any reason to think that moral truth actually exists. I argue that this approach offers us a false dichotomy between error theory and some form (...) of moral realism. While accepting the presuppositions of the evolutionary error theorist, I argue that contract-based approaches to morality can be sensitive to those presuppositions while still vindicating morality. Invoking Stephen Darwall’s distinction between contractualism and contractarianism, I go on to offer an evolutionary-based contractarianism. (shrink)

Contemporary discussions about practical reason or practical rationality invoke four competing views which can be named as follows by reference to their historical models: Aristotelian, Hobbesian, Kantian and Nietzschean. The subject-matter of this article is a defence of the Kantian conception of practical rationality in the interpretation of discourse theory. At the heart, lies the justification and the application of the rules of discourse. An argument consisting of three parts is pre sented to justify the rules of discourse. The three (...) parts are as follows: a transcen dental-pragmatic argument; an argument which takes account of the maximisation of individual utility and an empirical premise about an interest in correctness. Within the framework of the problem of application, the article outlines a justification of human rights and of the basic institutions of the democratic constitutional state on the basis of discourse theory. Current suggestions for capacities that should be targeted for moral enhancement has centered on traits like empathy, fairness or aggression. The literature, however, lacks a proper model for understanding the interplay and complexity of moral capacities, which limits the practicability of proposed interventions. In this paper, I integrate some existing knowledge on the nature of human moral behavior and present a formal model of prosocial motivation. The model provides two important results regarding the most friction-free route to moral enhancement. First, (...) we should consider decreasing self-interested motivation rather than increasing prosociality directly. Second, this should be complemented with cognitive enhancement. These suggestions are tested against existing and emerging evidence on cognitive capacity, mindfulness meditation and the effects of psychedelic drugs and are found to have sufficient grounding for further theoretical and empirical exploration. Furthermore, moral effects of the latter two are hypothesized to result from a diminished sense of self with subsequent reductions in self-interest. (shrink)

This paper presents considerations on altruism and prosocial behaviour formulated on the basis of some experiments with the ultimatum game. In the first part it will discuss relations between expected utility theories, the characteristics of homo oeconomicus and a modern understanding of altruism. It will focus in particular on conceptual differences, indicating that we can find more than one definition of altruism in modern literature. The second part of the text will provide an overview of selected behavioural theories of prosocial (...) behaviour. It will also present the manner in which needs, social determinants, norms, and individual psychological features affect the propensity to behave in a prosocial fashion. (shrink)

Libertarianism is a theory of justice that places significant moral weight on exclusive property rights. On this basis, many libertarian philosophers, from Robert Nozick to Michael Huemer, criticize any form of income redistribution. Ironically, some libertarians, following Philippe Van Parijs, Matt Zwolinski, and Charles Murray, have supported the introduction of an unconditional basic income. This essay seeks to prove that this support is not just a political compromise. By contrast, libertarian justice advocates have a strong moral basis for supporting income (...) redistribution in the form of unconditional cash payments. This essay explores one such reason, the Lockean proviso. The Lockean proviso is a moral requirement for the appropriation of unowned resources to leave “enough and as good” for others. There are many interpretations of the Lockean proviso, but the most ambitious are the egalitarian proviso and the sufficiency proviso. Each of them, but for different reasons, requires the introduction of a basic income. The egalitarian proviso establishes the equal rights of all people to natural resources, and therefore requires that all benefits from the ownership of natural resources be shared egalitarianly — in the form of unconditional equal payments. The sufficiency proviso establishes some threshold of sufficiency, and then imposes a restriction on exclusive property rights so that they can’t prevent redistribution in order to raise all people to the threshold of sufficiency. However, while both provisos require a basic income, they diverge on three important dimensions in assessing this basic income: applicability, taxable base, and amount of cash payments. (shrink)

This paper contributes to the explanation of human cooperative behaviour, examining the implications of Brian Skyrms’ modelling of the prisoner’s dilemma (PD). Augmenting a PD with signalling strategies promotes cooperation, but a challenge that must be addressed is what prevents signals being subverted by deceptive behaviour. Empirical results suggest that emotional displays can play a signalling role and, to some extent, are secure from subversion. I examine proximate explanations and then offer an evolutionary explanation for the translucency of emotional displays. (...) Selection acts on the basis of lifetime fitness consequences and, crucially for my argument, the intensity of selection decreases over the course of a lifetime. Hence we tend to possess traits that promote survival when young and, with regard to emotional displays, translucency allows successful maturation over our protracted period of nurturing by close kin. This is due to the vital role played by emotional interactions in the normal cognitive and social development of Homo sapiens. (shrink)

The philosophy of each of these disciplines is a mixture (a) of metaphysics of the discipline, asking what is the nature and justification of the entities that form the theoretical framework of the discipline, ie, which ones really exist in reality (not being mere instruments for achieving results) and what are its fundamental categorizations, natures and theoretical functions, (b) the epistemology of this discipline, when we ask ourselves how such an area could obtain knowledge reliably and if it does, and (c) theories of value, when we ask ourselves, for example, about the moral value of the development of a certain discipline and, finally, (d) the logic, which permeates everything, when we ask ourselves about the consistency of the theses assumed by the discipline. It is not for nothing that we say that philosophy is the mother of all sciences. It is a mother both in a generational sense, as most sciences were particular empirical or formal developments of philosophical questions on a certain topic, and in a fundamental sense, as it is philosophy that provides the most general, metaphysical, epistemic, evaluative and logical foundations, in the construction of the theoretical framework of each science and in the quality of the methods to approach the truth that the discipline uses. Biology, for example, was created by Aristotle, like the first developments in meteorology (in fact, it starts with the pre-Socratics), and much of the foundation of current physics lies in discussions of the philosophy of physics. Whether you are a philosopher or scientist from another area, philosophy promises to give you the basis for a general reflection or about your area, which is much more informed and profound than what you could accomplish without it. Justice and Vulnerability in Europe contributes to the understanding of justice in Europe from both a theoretical and empirical perspective. It shows that Europe is falling short of its ideals and justice-related ambitions by repeatedly failing its most vulnerable populations. Interdisciplinary and expert contributors search for the explanations behind these failing ambitions, through analysis of institutional discourse, legal debate and practice and the daily experiences of vulnerable populations, such as those dependent on social care and welfare. By setting tentative criteria (...) for justice as 'participatory parity', in line with the insights of the political philosopher Nancy Fraser, the book challenges European policy makers to re-define redistributive, recognitive and representative justice. What is morality’s scope? Should all our actions be evaluated morally? Is it necessary to be causally responsible for harm to have a responsibility to reduce it? Is there a morally relevant distinction between those consequences of our actions which we intend or do and those which we foresee but do not intend or allow but do not do? Is helping others a matter of supererogation (i.e. beyond the call of moral duty) or a matter of obligation? These are crucial (...) questions that need to be debated in normative and applied ethics. However, they were not raised seriously and independently until the last decades of the 20th century. There are several answers to these questions. This paper defends the answers of an approach which is called “moderate morality.” So, at first, it defines “moderate morality,” and pays heed to the views of its opponents, including Peter Singer, Shelly Kagan, and Peter Unger. Then, it tries to defend “moderate morality” based on “interest-based contractarianism.” Finally, it examines “its result in applied ethics” and tries to find a reasonable answer to a crucial question in the “political ethics of international relations” in our globalized era: What moral obligation, if any, do we have individually and as a society toward the people whose basic human rights are being violated not only in our country but also all over the world? David Gauthier in his article, Maximization constrained: the rationality of cooperation, tries to defend of the joint strategy in situations which no outcome is both equilibrium and optimal. Prisoner’s Dilemma is the most familiar example of these situations. He first starts with some quotes by Hobbes in Leviathan; Hobbes, in chapter 15 discusses an objection by someone is called Foole, and then will reject his view. In response to Foole, Hobbes presents two strategies (i.e. joint and individual) and two kinds (...) of agents in such problems including Prisoner’s Dilemma – i.e. straightforward maximizer (SM) and constrained maximizer(CM). Then he considers two arguments respectively for SM and CM, and he will show that why in an ideal and transparent situation, the first argument fails and the second one would be the only valid argument. likewise, in the following part of his article, he considers more realistic situations with translucency and he concludes that under some conditions, joint strategy would be still the rational decision. Authority figures permeate our daily lives, particularly, our political lives. What makes authority legitimate? The current debates about the legitimacy of authority are characterised by two opposing strategies. The first establish the legitimacy of authority on the basis of the content of the authority’s command. That is, if the content of the commands meet some independent normative standard then they are legitimate. However, there have been many recent criticisms of this strategy which focus on a particular shortcoming – namely, its (...) seeming inability to account for who can legitimately command whom. This is the basis of the second strategy, which attempts to characterize the normative relationship that underlies and makes possible authoritative commands. The central point of Part I is that these two strategies are, in fact, not opposed and both raise questions which a theory of legitimacy must answer. If this is the case, then we need to ask: how ought we to determine the legitimacy both of the content of commands as well as who can command whom? Part II will answer this question. Starting with the question of standing, I argue that we ought not to look for normative principles outside of the institutions in which authority is embedded. Rather, one ought to start by elaborating the ontology of institutions in which a sui generis form of normativity arises. A joint commitment account of social ontology provides the tools necessary to see how the direction obligations emerge concurrently with the formation of institutions. Similarly, the question of content can be answered by paying close attention to the social ontology of institutions. We need not look beyond the internal constitutive standards of the institution itself. The constitutive standards provide an internal criterion by which the legitimacy of commands can be established. This paper pictures emotions as able to provide reasons for action in so far as the beliefs and desires which make up reasons for action are constitutive elements of emotions themselves. It claims that the states of the world which prompt emotional attitudes “justify” them in so far as they render the beliefs constitutive of those attitudes true. Finally, it addresses the question what can make the desires or valuings ingredient to emotions appropriate to their objects.

The incompleteness problem for virtue ethics is inherited by a virtue-based theory of argumentation as developed by Daniel Cohen. A complete normative theory of argumentation should be able to provide reasons for why argumentative virtues such as open-mindedness are worthwhile, along with being able to resolve conflicts of such virtues. Adumbrating virtue-based argumentation theory with a pragmatic utilitarian approach constitutes a more complete theory that can account for why argumentative virtues are worthwhile.

This paper offers a critique of David Gauthier’s contractarian moral theory. I point out morally counter-intuitive implications of Gauthier’s theory – for example, with respect to societies with slavery or concerning the protection of animals – as well as theoretically unattractive features, such as the overly optimistic assumption of translucent agents. However, contractarian moral theories can be improved by correcting the theoretically unattractive features. Moreover, though some morally counter-intuitive implications cannot be avoided, whether we should accept these implications ultimately depends (...) on whether an instrumentalist account of practical reason is defensible and how morality relates to practical reason. Thus, contractarian moral theories cannot be refuted as easily as one might think at first. (shrink)

In this paper, the author offers a synoptic view of different theories of intergenerational justice, along two dimensions (savings/dissavings) and three modalities (prohibition, authorisation, obligation). After presenting successively the indirect reciprocity, the mutual advantage, the utilitarian and the Lockean approaches, special attention is given to the egalitarian theory of intergenerational justice. Two key differences between the egalitarian view on intergenerational justice and the sufficientarian interpretation of sustainability are highlighted.

One of the fundamental tradeoffs underlying society is that between efficiency and equality. The challenge for institutional design is to strike the right balance between these two goals. Game-theoretic models of public-goods provision under ‘meritocratic matching’ succinctly capture this tradeoff: under zero meritocracy, theory predicts maximal inefficiency but perfect equality; higher levels of meritocracy are predicted to improve efficiency but come at the cost of growing inequality. We conduct an experiment to test this tradeoff behaviorally and make the astonishing finding (...) that, notwithstanding theoretical predictions, higher levels of meritocracy increase both efficiency and equality, that is, meritocratic matching dissolves the tradeoff. Fairness considerations can explain the departures from theoretical predictions including the behavioral phenomena that lead to dissolution of the efficiency-equality tradeoff. (shrink)

In this paper I will discuss the role of national identity in the light of modern political and moral theories. My strategy here is threefold: firstly, I will present an overview of pre-modern theories of rights and duties of individuals, and then show how they fail to make sense of the notions of freedom and equality ; secondly, I will introduce modern political and moral theories as an outstanding alternative to those ones, given the paradigm of values established by modern (...) society; thirdly, I will argue against the supposed universality or objectivity of modern political and moral theories, taking into account the role of national identity. Many questions concerning health involve values. How well is a health system performing? How should resources be allocated between the health system and other uses or among competing healthrelated uses? How should the costs of health services be distributed among members of a population? Who among those in need of transplants should receive scarce organs? What is the best way to treat particular patients? Although many kinds of expertise bear on these questions, values play a large role in answering them. (...) These values are of many kinds – judgments about how health states contribute to the well-being of individuals depend on views about what is good for a person, whereas judgments about how to share the costs of health care or about how to distribute scarce organs among those in need of transplants depend on theories of fairness. The value judgments that need to be made are not only multifaceted and heterogeneous; they are also controversial. Both the understanding of the questions and the substance of the answers may vary widely from individual to individual and among different groups within countries and across national boundaries. How are these many complicated, difficult and controversial evaluative questions to be answered? This could be a question about who should answer them as well as a question about how they should be answered. There are various possible mechanisms, and there is no reason why the same method should be employed to answer every question. Among the possible methods are (1) moral argument, (2) political deliberation and (3) eliciting preferences or judgments from some group. Included in the third method lie many different techniques of elicitation. For example, one could study attitudes by the use of deliberative (focus) groups, by permitting individual choice in some sort of market or quasi-market, by polling or by voting. These methods of answering evaluative questions are not always incompatible with one another. Moral argument can play a role within political deliberation, deliberation by focus groups, individual market choice, or voting.. (shrink)

This thesis studies some philosophical and ethical issues that economic design raises. Chapter 1 gives an overview of economic design and argues that a crossfertilisation between philosophy and economic design is possible and insightful for both sides. Chapter 2 examines the implications of mechanism design for theories of rationality. I show that non-classical theories, such as constrained maximization and team reasoning, are at odds with the constraint of incentive compatibility. This poses a problem for non-classical theories, which proponents of these (...) theories have not addressed to date. Chapter 3 proposes a general epistemology of economic engineering, which is motivated by a novel case study, viz. the reform of a matching market for medical practitioners. My account makes use of causal graphs to explain how models allow encoding counterfactual information about how market outcomes change if the design of the market changes. The second part of the thesis examines ethical issues. In Chapter 4, I apply tools from matching theory to gain insights into the distribution of refugees, such as among countries of the European Union. There is an ethical trade-off between the fairness of matchings and their efficiency, and I argue that in this context, fairness is the morally weightier criterion. Chapter 5 deals with the ethics of kidney exchange. Against critics, I give two arguments for the implementation of kidney exchange programmes. The first argument is that they are instrumental in meeting a moral obligation, namely to donate effectively. The second is that kidney exchange may increase the motivation for altruistic donations, because the donation of one kidney may trigger > 1 life savings. The final chapter identifies questions for future research and it closes with some thoughts about the future trajectory of economic design. (shrink)

In a recent discussion of disenchantment and re-enchantment Charles Taylor suggests that it is possible to respond to the disenchanted view of the world, in which meaning and value are understood as subjective projections, by articulating a re-enchanted sense of nature or the universe from the perspective of human ‘agency-in-the-world’, in which meaning and value are objective. The question I address in this thesis is, what could it mean to articulate a re-enchantment from within our ‘agency-in-the-world’? In Chapter One I (...) examine the work of John McDowell in order to explore the possibility that he gives sense to the idea of a re-enchantment from within our agency-in-the-world. I conclude that he provides one way of doing so. However I argue that McDowell’s naturalism of second nature can seem limited as it does not address the ‘proto-religious’ dimension to Taylor’s understanding of re-enchantment. In Chapter Two I turn to the work of Roger Scruton to consider whether he provides a re-enchantment from within our agency-in-the-world that does accommodate this proto-religious dimension. I conclude that he does, but raise concerns about how convincing Scruton’s re-enchantment is. I argue that, from a McDowellian point of view, a case can be made that Scruton implicitly accepts as true certain significant elements of the disenchanted view of the world. In Chapter Three I look to the later Heidegger for an alternative re-enchantment from within our agency-in-the-world that attempts to accommodate the proto-religious. I focus on two interpretations of the later Heidegger given by Julian Young and Charles Taylor. In response to a worry put forward by Young, I argue that Charles Taylor’s interpretation can accommodate a proto-religious dimension. In my Conclusion I argue that McDowell’s naturalism of second nature and the understanding of our agency-in-the-world as presented by Taylor’s Heidegger, form interestingly continuous re-enchantments. On this basis I argue that although McDowell himself does not extend his idea of second nature to accommodate the proto-religious, the example of later Heidegger shows that there is nothing inherently limited about the framework of second nature that means it cannot be extended to encompass important proto-religious responses to the world. Sometimes a series of choices do not serve one's concerns well even though each choice in the series seems perfectly well suited to serving one's concerns. In such cases, one has a dynamic choice problem. Otherwise put, one has a problem related to the fact that one's choices are spread out over time. This survey reviews some of the challenging choice situations and problematic preference structures that can prompt dynamic choice problems. It also reviews some proposed solutions, and explains how (...) some familiar but potentially puzzling phenomena — including, for example, self-destructive addictive behavior and dangerous environmental destruction — have been illuminated by dynamic choice theory. Banks have a central role and importance in all commerce and hence in all societies. This thesis investigates the ethical basis of banking practice with the aim of developing an account of the virtues appropriate to bankers and banking. One central issue concerns a conflict between the interests of banks and their customers, and how this conflict plays out in relation to the lending policies and fee structure of banks. Such lending policies can have a significant effect on banks, their (...) customers and a range of stakeholders. This research project investigated empirical evidence through qualitative interviews with senior bankers in two locations, Australia and Hong Kong, to elicit their thoughts on banking areas that involve customer interaction, namely, deposit-taking, credit cards, home mortgage loans, corporate finance, and foreign exchange. The institutions selected hold a substantial segment of banking business in their respective countries and are thus representative of bankers’ perspectives. The dissertation also entailed a case study of the causes and consequences of the American sub-prime crisis that was precipitated by the financial sector. The interviews revealed an assertion of good ethical conduct based on adherence to peer-determined codes of conduct and compliance with regulations. There was also a common predisposition to claims of corporate social responsibility and reputation preservation but these have tended to mask the powerful underlying sales thrust. A key finding of the study points to a lapse in ethical values in banks due to excessive reliance on self-interest. Although self-interest is not in itself wrong, there has been a lack of moderation vis-à-vis the interests of less powerful customers. A related finding is a prevailing resistance to regulation that is necessary to curtail selfish and irresponsible behaviour by banks. The interview subjects prefer industry self-regulation to government supervision. However, the banks in Australia and Hong Kong, which have been subjected to tighter regulation, have survived the global financial crisis better than their American counterparts despite complaints about the severity of their regulatory climate. There is a strong case to ascribe ethical failure to American practices that triggered the sub-prime calamities, which have devastated homeowners and the global economy. American banks and regulators both operated on the erroneous supposition that the quest after extreme profits would be restrained by free market forces. The conclusions allude to virtues that are necessary for banks to espouse moral conduct. These virtues can be embedded through leadership and cultural change. (shrink)

One of the distinctive features of Gerald Gaus’s public justification theory is his extensive use of the empirical data from the social sciences to support his normative claims. One such claim which stands out for its importance, within the context of Gaus’s theory, is the evolution of strong reciprocity: over time, members of large societies develop a tendency to follow social rules and punish defectors. This claim, in turn, is supported by several studies in experimental economics involving mixed motive games, (...) which show how subjects are inclined to punish, even at a net cost for themselves, any perceived violation of social norms such as fairness. While critics of Gaus’s theory focused mainly on whether the use of empirical evidence in a normative theory is prima facie admissible, in this paper I address two different issues. The first concerns the accuracy of the empirical evidence used by Gaus’s theory, and whether the conclusions advanced by the social scientists on the grounds of this evidence are actually sound. The second issue, on the other hand, concerns the consistency between the empirical assumptions underlying these experiments and the claims of Gaus’s theory. I argue that both concerns are warranted. On the one hand, there is empirical evidence that the rule-following behavior observed in experiments involving mixed motive games is context dependent: the tendency of subjects to follow rules and punish defectors is strongly correlated to the epistemic constraints, such as anonymity, commonly imposed during the experiments. On the other hand, these constraints hardly reflect the circumstances of life in modern societies, which is the context assumed by Gaus’s justificatory theory. I conclude that Gaus’s account of rule-following punishers is not altogether invalidated, but the empirical evidence from experimental economics is insufficient to support it. (shrink)

Evolutionary explanations of altruism and human cooperation, first set forth by pioneers such as Darwin, Hamilton and Trivers, suggest that biology might be capable of offering a plausible scientific explanation of the core of human morality. According to this project, morality and human cooperation arise when resourcesare scarce; they cannot be exploited by isolated individuals; and individuals cannot maintain a long-term position of domination over others in order to advance their selfish ends. An important philosophical question that arises with respect (...) to this project has to do with the concepts of de morality and moral motivation that itpresupposes. The evolutionary project has not been clear in this respect. The article argues in favor of two theses: 1) evolutionary explanations of cooperation suggest a contractual type of morality, but they are ambiguous regarding the motivations favored by natural selection, thus reflecting, without resolving it, a traditionaldisagreement between Hobbes’s moral contractualism (selfish motivations) and that of Kant (altruistic motivations); 2) in their current form, these explanations cannot resolve that disagreement, but a reflection on the role of the capacity to interpret the motivations and character of others in the evolution of morality could provide arguments in favor of Kantian contractualism. This paper contributes to the explanation of human cooperative behaviour, examining the implications of Brian Skyrms’ modelling of the prisoner’s dilemma. Augmenting a PD with signalling strategies promotes cooperation, but a challenge that must be addressed is what prevents signals being subverted by deceptive behaviour. Empirical results suggest that emotional displays can play a signalling role and, to some extent, are secure from subversion. I examine proximate explanations and then offer an evolutionary explanation for the translucency of emotional displays. Selection (...) acts on the basis of lifetime fitness consequences and, crucially for my argument, the intensity of selection decreases over the course of a lifetime. Hence we tend to possess traits that promote survival when young and, with regard to emotional displays, translucency allows successful maturation over our protracted period of nurturing by close kin. This is due to the vital role played by emotional interactions in the normal cognitive and social development of Homo sapiens. (shrink)
