There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. Esta obra colectiva expone diversas concepciones teóricas, ontológicas, epistemológicas, axiológicas y prácticas sobre el origen, sentido, problemáticas, ventajas, detrimentos, alternativas y desafías de la filosofía de la innovación y su incidencia en la educación; reflexiona sobre las contribuciones de la tecnología y responde a interrogantes como: ¿Cuáles son los aporte de la tradición filosófica, del pensamiento ilustrado, de la postmodernidad y de la teoría crítica para la filosofía de la innovación educativa?; ¿Cuál es la función de la filosofía para la (...) comprensión de la innovación?; ¿Cómo se explica el progreso tecno-científico desde la epistemología contemporánea?; ¿Cuál es el componente pedagógico de la innovación?; ¿Cuáles son las aportaciones del Laudato Si para la innovación educativa?. Además, plantea la necesidad de repensar algunos aspectos relacionados con la educación, el Estado y la identidad latinoamericana para determinar las posibilidades, las limitaciones y los retos de la innovación, entendida como un fenómeno en permanente construcción. Este tomo se encuentra conformado por ocho capítulos en los que los autores formulan un conjunto de contribuciones para la generación de nuevas investigaciones. La formación docente es indispensable para responder a los requerimientos de la compleja sociedad actual. De su conocimiento, iniciativa, praxis y creatividad depende el éxito o el fracaso del sujeto que aprende. Al modificar el rol del docente se transforma la actitud de los estudiantes. ¿Cómo entender la formación filosófica transdisciplinar? Este texto responde a este y otros cuestionamientos: ¿cuáles son los planteamientos pedagógicos afines a la era digital? ¿en qué medida las TIC se encuentran al servicio de una filosofía (...) educativa transdisciplinar?, ¿cómo se explica ese enfoque en la formación del docente?, ¿cuál es la función de la formación en la innovación educativa?, ¿cómo formar para la ciudadanía mundial?, ¿cuáles son las contribuciones de las nuevas ciencias para la formación educativa? El crecimiento exponencial de la ciencia y de la tecnología nos obliga a pensar en procesos formativos innovadores. En tal sentido, resulta imprescindible el estudio de estas problemáticas. (shrink)

Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no (...) necessary connection between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

A partir de los postulados de una concepción semántica de norma y su clasificación en reglas y principios, Robert Alexy ha enunciado una tesis fuerte de la separación, al concebir que entre ambos tipos de normas no solo existe una diferencia gradual, sino también cualitativa. En este contexto, los principios son descritos como mandatos de optimización, caracterizados por un cumplimiento gradual en atención a las posibilidades reales y jurídicas, y a través de la denominada técnica de la ponderación. A pesar de las objeciones recibidas, la vigencia de esta tesis resulta incuestionable, sirviendo todavía de inspiración a las nuevas generaciones de juristas interesados en la Teoría del Derecho. Alexis de Tocqueville is often seen as a champion of personal liberty and human greatness in the face of the conformism and mediocrity of the democratic social state. In this light, his vision of “soft despotism” anticipates familiar reservations about state managerialism and political apathy. Yet this picture risks eclipsing one of Tocqueville’s most pregnant ambiguities. Though deeply concerned by threats to liberty posed by modern mass society, Tocqueville is alive to the special need such societies have of authority, particularly (...) moral authority, and hence of restraints to liberty itself. The freedom to decide how best to lead one’s life must become self-destructive, he contends, without a corresponding inclination to look outside oneself for prudent leadership and counsel. This paper elucidates the reasoning behind this paradoxical position. I argue that beneath the need of authority Tocqueville detects an enduring human problem, though one that takes a unique and even insuperable form under modern egalitarianism. I suggest that dwelling on this problem promises to enrich debates about the cynical nativism now menacing liberal democracies. Its origins are to be found less in economic upheaval and communication technology run amok than in the decay of civil religion and civic virtue, a trend that runs very much with the grain of democratic society and whose progress may be irrevocable. Con la presente ponencia, analizamos el instituto de justicia procesal denominado justicia premial a la luz de lo establecido en la Ley 906 de 2004 colombiana, haciendo énfasis en la situación del capturado en flagrancia, regulado en el artículo 301 de la misma Ley, y del artículo 57 de la Ley 1453 de 2011. Seguidamente, analizamos esta institución procesal, a la luz del concepto de racionalidad dialógica de Habermas, para luego discutir dicho concepto con la idea del discurso práctico racional (...) de Robert Alexy como manera de alcanzar justicia constitucional; y finalmente, analizar el concepto de justicia vista desde la situación de discriminación inversa presentada en la concepción filosófica de Ronald Dworkin, para luego arribar a algunas reflexiones finales. A xurisprudencia constitucional española (STC 37/2011, de 28 de marzo, entre outras) ten establecido como fundamento do consentimento informado o dereito á integridade física e moral (art. 15 CE). O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. O presente artigo pretende precisamente revisar a natureza iusfundamental do consentimento informado a partir da obra de W.N. Hohfeld e Robert Alexy. (shrink)

Jellinek define “estatus” como la “relación con el Estado que califica al individuo”. Su teoría distingue cuatro tipos: pasivo o subiectionis, negativo o libertatis, positivo o civitatis y activo o de la ciudadanía activa. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. La cuestión versa sobre la posición de los derechos de defensa en la tesis de Jellinek y si es viable su empleo en la conceptualización de los actuales derechos fundamentales. (shrink)

The book introduces a conception of discourse ethics, an intersubjectivist version of Kantian ethics. Analysing contributions by Jürgen Habermas, Karl-Otto Apel, Wolfgang Kuhlmann, Albrecht Wellmer, Robert Alexy, Klaus Günther, Rainer Forst, Marcel Niquet and others, it reconstructs critical discussions of the justification of the principle of morality (Part I) and the various proposals for its application (Part II). It defends an alternative model of how discourse ethics can provide guidance in non-ideal circumstances and avoid both arbitrariness and rigorism.

Che cosa distingue, concettualmente, l’esattore delle tasse che esiga da un uomo, a pena di sanzioni, una determinata somma di denaro, dal bandito che gli intimi, sotto la minaccia di un’arma, di consegnargli la medesima somma? È sul soddisfacimento del requisito della giustizia che si fonda, come sostenne Agostino, l’eterogeneità tra uno Stato e un’accolita di furfanti? «Se non è rispettata la giustizia, che cosa sono gli Stati, se non delle grandi bande di ladri? Perché le bande di briganti che (...) cosa sono, se non dei piccoli Stati?». Il volume ripercorre le risposte più autorevoli fornite nel XX secolo, entro un orizzonte postmetafisico, alla domanda agostiniana: prima dell’avvento del regime nazista, la tesi che un’associazione a delinquere sia indistinguibile da uno Stato è stata sostenuta da Benedetto Croce, Santi Romano e Hans Kelsen; dopo l’esperienza del nazismo e delle sue atrocità, perpetrate in nome dello Stato e della legge, le questioni relative alla natura del diritto e alla relazione tra morale e diritto hanno assunto – come ha osservato Robert Alexy – «l’urgenza di un problema scottante», e la domanda filosofica sulla validità della legge ingiusta è apparsa ineludibile non solo ai maggiori filosofi del diritto (Herbert L.H. Hart, Alf Ross, Ronald Dworkin e lo stesso Alexy), ma alle stesse corti tedesche. (shrink)

The concept of human dignity has been criticized as either too thick or too thin. However, according to the non-positivistic standpoint, the legal normativity of human dignity can be justified and thus strengthened by means of its moral correctness. From the individual perspective, Mencius’ understanding of human dignity as an intrinsic value and Kant’s formula of ‘man as an end in itself’ can be adequately understood based on the differentiation of, as well as the connection between, principium diiudicationis and principium (...) executionis, between will and choice, and between homo phaenomenon and homo noumenon (that is, ‘humanity in the personality’). From the social perspective, since the dual dimensions of the individual and the social person are both fictive constructions, even Radbruch, once as a supporter of social law, has not replaced the concept of ‘legal person’ and, in the post-War period, acknowledges individualistic human dignity as the criterion for applying the famous ‘disavowal formula’. On the one hand, human dignity shows at least a weak normative character, which requires, firstly, balancing between the exercise of state powers and the constitutional review under the guidance of the dual dimensions of man and, secondly, optimization of the principle of human dignity in individual cases. On the other hand, through the necessary connection between the concept of dignity and that of personality, human dignity can exhibit a strong normative character, which unavoidably requires a metaphysical justification. The rise of populism and its consequences – such as democratic backsliding, the erosion of constitutional principles, and the weakening of the rule of law – are among the most pressing issues facing comparative constitutional scholars today. To address these emerging challenges, the Unconstitutional Constitutional Amendment Doctrine (UCAD) has emerged as the most promising remedy for the “third counterwave of democracy”. A partir do século XIX, a teoria democrática foi desenvolvida com base no confronto entre duas doutrinas políticas: o liberalismo e o socialismo. O liberalismo é um projeto que defende as limitações dos poderes governamentais, buscando a proteção dos direitos econômicos, políticos, religiosos e intelectuais dos membros da sociedade. Ou seja, para os liberais o poder do Estado deve ser limitado, pois eles acreditam que a verdadeira liberdade depende da menor interferência possível do Estado e das leis nesses direitos. A (...) defesa do liberalismo tem como principal representante Benjamin Constant. Membro da Assembleia Nacional Francesa, escreveu a obra A liberdade dos antigos comparada com a dos modernos, na qual afirma que a liberdade dos modernos, que deve ser promovida e desenvolvida, é a liberdade individual na relação com o Estado (ou seja, as liberdades civis e políticas), enquanto a liberdade dos antigos, que se tornou impraticável, é a liberdade de participação direta na formação das leis.1 Outros autores como, como o francês Alexis de Tocqueville2 e o inglês John Stuart Mill3 , defenderam a ideia de que a única estrutura democrática compatível com o Estado liberal seria a democracia representativa. Uma passagem interessante para o nosso debate sobre a democracia é o princípio do dano, de Stuart Mill. Por esse princípio, cada indivíduo tem o direito de agir como quiser desde que suas ações não prejudiquem outras pessoas. Se a ação afeta diretamente apenas a pessoa que a está realizando, a sociedade em tese não tem o direito de intervir, mesmo que o indivíduo esteja prejudicando a si próprio. Contudo, se os indivíduos fizerem algo ruim para si mesmos ou para sua propriedade podem indiretamente prejudicar a coletividade, já que ninguém vive isolado, devendo por isso ser impedidos de fazê-lo. Stuart Mill isenta desse princípio aqueles que são incapazes de se governar. Em síntese, todo o processo de democratização, como se deu nos Estados liberais democráticos, consiste numa transformação mais quantitativa do que qualitativa do regime representativo. Ou seja, o avanço da democracia nesses regimes ocorre em duas direções: no alargamento gradual do direito do voto e na multiplicação dos órgãos representativos. Para a doutrina socialista, o sufrágio universal é apenas o ponto inicial do processo de democratização do Estado, enquanto para o liberalismo é o ponto de chegada. Alguns dos principais teóricos do socialismo, como Antonio Gramsci4 e Rosa Luxemburgo5 , afirmam que o aprofundamento do processo de democratização na perspectiva das doutrinas socialistas ocorre de dois modos: por meio da crítica à democracia representativa (e da retomada de alguns temas da democracia direta) e pela ampliação da da participação popular e do controle do poder por meio dos chamados “conselhos operários”. Em outras palavras, a diferença crucial entre a democracia dos conselhos e a democracia parlamentar é que a primeira reconhece ter havido um deslocamento dos centros de poder dos órgãos tradicionais do Estado para a grande empresa, na sociedade capitalista. Por isso, o controle que o cidadão pode exercer por meio dos canais tradicionais da democracia política não é suficiente para impedir os abusos de poder. Logo, o controle deve acontecer nos próprios lugares de produção, e seu protagonista é o trabalhador real, não o cidadão abstrato da democracia formal. Mais recentemente, na metade do século XX, surgiu a corrente pluralista. Os pluralistas, em particular Robert Dahl6 , cientista político estadunidense, não procuravam estabelecer uma definição abstrata e teórica acerca da democracia, mas, por meio da observação das experiências de sistemas políticos, estipularam alguns requisitos mínimos: funcionários eleitos, eleições livres justas e frequentes, liberdade de expressão, fontes de informação diversificadas, autonomia para associações e cidadania inclusiva. Com base nesses critérios são caracterizadas quatro estruturas de governo: hegemonias fechadas, que são regimes em que não há disputa de poder e a participação política é limitada; hegemonias inclusivas, regimes em que não há disputa de poder, mas ocorre participação política; oligarquias competitivas, regimes nos quais há disputa de poder, mas com limitada participação política; e poliarquias, regimes em que não há disputa de poder e participação política ampliada. Joseph Schumpeter (1883-1950), economista austríaco, criticou as teorias clássicas de democracia, especialmente na relação estabelecida entre a democracia e a soberania popular7 . Para o autor, a definição clássica de democracia supõe duas ficções incapazes de resistir a uma análise realista: a existência do bem comum e a universalidade da racionalidade dos indivíduos. Para Schumpeter, a unidade da vontade geral, que constituiria o bem comum, e a racionalidade dos indivíduos seriam mitos, porque, para ele, esses elementos se tornaram irracionais por não conseguirem definir coerentemente suas preferências diante da influência da propaganda e de outros métodos de persuasão. Dessa forma, Schumpeter rompe com a ideia de democracia como soberania popular para propô-la como método, um tipo de arranjo institucional (de governos) para alcançar decisões políticas. Assim, sugere a superação do impedimento provocado pela irracionalidade das massas, reduzindo sua participação na política ao ato da produção de governos (ato de votar). As atribuições político-administrativas ficariam a cargo das elites eleitas. Essa é uma postura polêmica, na medida em que propõe uma redução da participação popular. Contrário a essa visão, o cientista político canadense C. B. Macpherson8 , sustenta que a liberdade e o desenvolvimento individual só podem ser alcançados plenamente com a participação direta e contínua dos cidadãos na regulação da sociedade e do Estado. Macpherson defende uma transformação estruturada em um sistema que combine partidos competitivos e organizações de democracia direta, que criam uma base real para a existência da democracia participativa. Mas, para que esse modelo pudesse se desenvolver, seria necessário que os partidos políticos se democratizassem, com princípios e procedimentos de democracia direta, complementada e controlada por organizações geridas por pessoas comuns, em seus locais de trabalho e nas comunidades locais. Na teoria das elites, o poder político pertence ao restrito círculo de pessoas que toma e impõem decisões a todos os membros que tenha de recorrer, como ação radical, à força. Ainda na doutrina liberal, mas opondo-se ao pluralismo, existem os elitistas, que utilizam o termo “elite” como referência a grupos sociais superiores de vários tipos. O termo seria empregado no pensamento social e político somente no final do século XIX. Essas teorias sociológicas, propostas pelos pensadores Vilfredo Pareto (1848-1923), sociólogo e economista francês; Gaetano Mosca (1858-1941), cientista político italiano, e Robert Michels (1876-1936), sociólogo alemão radicado na Itália, defendem que em toda sociedade existe apenas uma minoria, que, por diversos motivos, vem a se tornar detentora do poder. Pareto afirmava que existe uma “circulação das elites”, ou seja, uma minoria de pessoas que se alternam no poder. Mosca justifica o poder das elites governamentais pelo fato de serem uma minoria articulada e organizada, enquanto os governos seriam uma classe numerosa, mas dividida e desorganizada. Ao estudar as formações partidárias, Michels destacou como a própria estrutura das organizações favorecia o surgimento das elites e sua longa permanência no poder. Nas palavras de Michels, essa estabilidade das elites no poder é a “lei de ferro das oligarquias”. Ao longo dos últimos séculos foram construídas diversas interpretações e teorias acerca dos objetivos e conteúdos da democracia. Na prática, a democracia pode ser um modelo de governo que amplia as capacidades de desenvolvimento social, político e econômico, com base em princípios de igualdade e cidadania, ou se tornar uma simples “regra” para formar governos que não priorizem necessariamente o atendimento das demandas sociais. PREMISSA No século XIX, ocorreram transformações impulsionadas pela emergência de novas fontes energéticas (água e petróleo), por novos ramos industriais e pela alteração profunda nos processos produtivos, com a introdução de novas máquinas e equipamentos. Depois de 300 anos de exploração por parte das nações europeias, iniciou -se, principalmente nas colônias latino-americanas, um processo intenso de lutas pela independência. É no século XIX, já com a consolidação do sistema capitalista na Europa, que se encontra a herança intelectual mais próxima da (...) qual surgirá a Sociologia como ciência particular. No início desse século, as ideias do Conde de Saint-Simon (1760-1825), de Georg Wilhelm Friedrich Hegel (1770-1831), de David Ricardo (1772-1823) e de Charles Darwin (1809-1882), entre outros, foram o elo para que Alexis de Tocqueville (1805-1859), Auguste Comte (1798-1857), Karl Marx (1818 -1883) e Herbert Spencer (1820-1903), entre outros, desenvolvessem reflexões sobre a sociedade de seu tempo. Auguste Comte e Karl Marx foram os pensadores que lançaram as bases do pensamento sociológico e de duas grandes tradições – a positivista e a socialista – que muito influenciaram o desenvolvimento da Sociologia no Brasil. 1 AUGUSTE COMTE E A TRADIÇÃO POSITIVISTA Isidore Auguste Marie François Xavier Comte nasceu em Montpellier, na França, em 19 de janeiro de 1798. Com 16 anos de idade, ingressou na Escola Politécnica de Paris, fato que teria significativa influência na orientação posterior de seu pensamento. De 1817 a 1824, foi secretário do Conde de Saint-Simon. Comte declarou que, com Saint -Simon, aprendeu muitas coisas que jamais encontraria nos livros e que, no pouco tempo em que conviveu com o conde, fez mais progressos do que faria em muitos anos, se estivesse sozinho. Toda a obra de Comte está permeada pelos acontecimentos que ocorreram após a Revolução Francesa de 1789. Ele defendeu parte dos princípios revolucionários e criticou a restauração da monarquia, preocupando-se fundamentalmente em reorganizar a sociedade, que, no seu entender, estava em ebulição e mergulhada no caos. Para Comte, a desordem e a anarquia imperavam em virtude da confusão de princípios (metafísicos e teológicos), que não se adequavam à sociedade industrial em expansão. Era, portanto, necessário superar esse estado de coisas, usando a razão como fundamento da nova sociedade. Propôs, então, a mudança da sociedade por meio da reforma intelectual plena das pessoas. De acordo com o pensador, com a modificação do pensamento humano, por meio do método científico, que ele chamava de “filosofia positiva”, haveria uma reforma das instituições. Com a proposta do estudo da sociedade por meio da análise de seus processos e estruturas, e da reforma prática das instituições, Comte criou uma nova ciência, à qual deu o nome de “física social”, passando a chamá-la posteriormente de Sociologia. A Sociologia representava, para Comte, o coroamento da evolução do conhecimento, mediante o emprego de métodos utilizados por outras ciências, que buscavam conhecer os fenômenos constantes e repetitivos da natureza: a observação, a experimentação, a comparação e a classificação. De acordo com esse pensador, a Sociologia, como as ciências naturais, deve sempre procurar a reconciliação entre os aspectos estáticos e os dinâmicos do mundo natural ou, no caso da sociedade humana, entre a ordem e o progresso. O lema da “filosofia positiva” proposta por Comte era “conhecer para prever, prever para prover”, ou seja, o conhecimento é necessário para fazer previsões e também para solucionar possíveis problemas. A influência de Comte no desenvolvimento da Sociologia foi marcante, sobretudo, na escola francesa, evidenciando-se em Émile Durkheim e seus contemporâneos e seguidores. Seu pensamento esteve presente em muitas das tentativas de criar tipologias para explicar a sociedade. Suas principais obras são: Curso de filosofia positiva (1830-1842), Discurso sobre o espírito positivo (1848), Catecismo positivista (1852) e Sistema de política positiva (1854). Para concluirmos, Comte explanava que para a superação da anarquia reinante na nova sociedade industrial, a filosofia positivista defendia a subordinação do progresso à ordem. O mesmo era contra o retorno de Luís XVIII ao trono: em sua concepção, a sociedade industrial que emergia requeria um governo fundado na razão. 2 A TRADIÇÃO SOCIALISTA: KARL MARX E FRIEDRICH ENGELS Karl Heinrich Marx nasceu em Tréveris, na antiga Prússia, hoje Alemanha, em 1818 e, em 1830, ingressou no Liceu Friedrich Wilhelm, nessa mesma cidade. Anos depois, foi cursar Direito na Universidade de Bonn, transferindo-se para Berlim em seguida. Pouco a pouco, entretanto, seus interesses migraram para a Filosofia, área na qual defendeu, em 1841, a tese de doutorado A diferença da filosofia da natureza em Demócrito e Epicuro. Sua vida universitária foi marcada pelo debate político e intelectual influenciado pelo pensamento de Ludwig Feuerbach (1804-1872) e, principalmente, pelo de Georg Wilhelm Friedrich Hegel (1770- 1831). Friedrich Engels (1820-1895) nasceu em Barmen (Renânia), na antiga Prússia, hoje Alemanha, filho mais velho de um rico industrial do ramo têxtil. Terminou sua formação secundária em 1837 e a partir de então sua formação intelectual foi por conta própria (autodidata), com alguns cursos universitários esparsos e de curta duração. Desde cedo começou a trabalhar nas empresas de seu pai e foi nessa condição que se deslocou para Bremen por três anos e depois foi enviado pelos pais a Manchester, na Inglaterra, onde trabalhou nas fábricas da família. Engels ficou impressionado com a miséria na qual viviam os trabalhadores das fábricas inglesas. Os dois, Marx e Engels, se encontraram em 1842, quando Marx passou a escrever para A Gazeta Renana, jornal da província de Colônia, do qual Engels era colaborador e mais tarde editor-chefe. O jornal, que criticava o poder prussiano, foi fechado em 1843, e Marx se viu desempregado. Ao perder o emprego, mudou-se para Paris, na França. Ali escreveu, em 1844, os Manuscritos econômico-filosóficos (só publicados em 1932) e, junto com F. Engels, o livro A sagrada família. Por sua vez, F. Engels, em 1844, decidiu voltar para a Alemanha, onde publicou, em 1845, A situação da classe trabalhadora na Inglaterra. Entre 1845 e 1847, Marx exilou-se em Bruxelas, na Bélgica, onde escreveu A ideologia alemã (em parceria com Friedrich Engels) e Miséria da filosofia (1847), obra na qual criticou o filósofo Pierre-Joseph Proudhon (1809-1865). Em 1848, ainda na Bélgica, a parceria com Engels se solidificou ao escreverem juntos o livreto O Manifesto Comunista. Em 1848, Marx foi expulso da Bélgica e retornou a Colônia, na Alemanha (Prússia), sempre pensando na possibilidade de uma mudança estrutural em sua terra natal. Isso, entretanto, não aconteceu e Marx foi expulso da Alemanha em 1849, ano em que migrou para Londres, na Inglaterra, onde permaneceu até o fim da vida. Lá escreveu O 18 Brumário de Luís Bonaparte (1852), sua mais importante obra de reflexão sobre a vida política europeia do século XIX, desenvolveu pesquisas e concluiu seu maior trabalho: O capital: crítica da economia política. O primeiro volume dessa obra foi publicado em 1867; os outros três, em 1885, 1894 e 1905, após a morte de Marx, revisados por F. Engels. 2.1 O contexto histórico e a obra de Marx e Engels Para situar a obra de Marx e Engels, é necessário conhecer um pouco do que acontecia em meados do século XIX. Com as transformações que ocorriam no mundo ocidental, principalmente na esfera da produção industrial, houve um crescimento expressivo no número de trabalhadores industriais urbanos, com uma consequência evidente: precariedade da vida dos operários nas cidades. As condições de trabalho no interior das fábricas eram péssimas. Os empregados eram superexplorados, alimentavam-se mal e trabalhavam em ambientes insalubres. Para enfrentar essa situação e tentar modificá-la, os trabalhadores passaram a se organizar em associações e sindicatos e a promover movimentos de reivindicação. Desenvolveu-se, então, uma discussão das condições sociais, políticas e econômicas para se definirem as possibilidades de intervenção nessa realidade. Desde o início do século XIX, muitos pensadores discutiram essas questões, nas perspectivas socialista e anarquista. Na Inglaterra podem ser citados, entre outros: William Godwin (1756-1836), Thomas Spence (1750-1814), Thomas Paine (1737-1809), Robert Owen (1771-1858) e Thomas Hodgkin (1787-1866). Na França, destacaram-se Étienne Cabet (1788- 1856), Flora Tristan (1803-1844), Charles Fourier (1772-1837) e Pierre-Joseph Proudhon (1809-1865). Marx e Engels levaram em conta esses pensadores, debatendo com alguns contemporâneos e criticando-os. Além disso, incorporaram a tradição da economia clássica inglesa, presente principalmente nas obras de Adam Smith e de David Ricardo. Pode-se dizer, portanto, que Marx e Engels desenvolveram seu trabalho com base na análise crítica da economia política inglesa, do socialismo utópico francês e da filosofia alemã. Esses dois autores não buscavam definir uma ciência específica para estudar a sociedade (como a Sociologia, para Auguste Comte) ou situar seu trabalho em um campo científico particular. Em alguns escritos, Marx afirmou que a História seria a ciência que mais se aproximava de suas preocupações, por abarcar as múltiplas dimensões da sociedade, a qual deveria ser analisada na totalidade, não havendo uma separação rígida entre os aspectos sociais, econômicos, políticos, ideológicos, religiosos, culturais etc. O objetivo de Marx e Engels era estudar criticamente a sociedade capitalista com base em seus princípios constitutivos e em seu desenvolvimento, visando dotar a classe trabalhadora de uma análise política da sociedade de seu tempo. Assim, a tradição socialista nascida da luta dos trabalhadores, muitos anos antes e em situações diferentes, tem como expressão intelectual o pensamento de Karl Marx e Friedrich Engels. Para entender as concepções fundamentais de Marx e Engels é necessário fazer a conexão entre as lutas da classe trabalhadora, suas aspirações e as ideias revolucionárias que estavam presentes no século XIX na Europa. Para eles, o conhecimento científico da realidade só tem sentido quando visa à transformação dessa mesma realidade. A separação entre teoria e prática não é discutida, pois a “verdade histórica” não é algo abstrato e que se define teoricamente; sua verificação está na prática. Apesar de haver algumas diferenças em seus escritos, os elementos essenciais do pensamento de Marx e Engels podem ser assim sintetizados: • historicidade das ações humanas – crítica ao idealismo alemão; • divisão social do trabalho e o surgimento das classes sociais – a luta de classes; • o fetichismo da mercadoria e o processo de alienação; • crítica à economia política e ao capitalismo; • transformação social e revolução; • utopia – sociedade comunista. A obra desses dois autores é muito vasta e não ficou vinculada estritamente aos movimentos sociais dos trabalhadores. Pouco a pouco foi introduzida nas universidades como parte do estudo em diferentes áreas do conhecimento. Estudiosos de Filosofia, Sociologia, Ciência Política, Economia, História e Geografia, entre outras áreas, foram influenciados por ela. Na Sociologia, como afirma Irving M. Zeitlin, no livro Ideología y teoría sociológica, tanto Max Weber quanto Émile Durkheim fizeram, em suas obras, um debate com as ideias de Karl Marx. Pelas análises da sociedade capitalista de seu tempo e a repercussão que tiveram em todo o mundo, principalmente no século XX, nos movimentos sociais e nas universidades, Marx e Engels são considerados autores clássicos da Sociologia. No campo dessa disciplina, porém, o pensamento deles ficou um pouco restrito, pois perdeu aquela relação entre teoria e prática (práxis), ou seja, entre a análise crítica e a prática revolucionária. Essa relação esteve presente, por exemplo, na vida e na obra dos russos Vladimir Ilitch Ulianov, conhecido como Lênin (1870-1924), e Leon D. Bronstein, conhecido como Trotsky (1879-1940), da alemã Rosa Luxemburgo (1871-1919) e do italiano Antonio Gramsci (1891- 1937), que tiveram significativa influência no movimento operário do século XX. Com base no trabalho de Marx e Engels, muitos autores desenvolveram estudos acadêmicos em vários campos do conhecimento. Podemos citar, por exemplo, Georg Lukács (1885-1971), Theodor Adorno (1903-1969), Walter Benjamin (1892-1940), Henri Lefebvre (1901-1991), Lucien Goldmanm (1913 -1970), Louis Althusser (1918 -1990), Nikos Poulantzas (1936-1979), Edward P. Thompson (1924-1993) e Eric Hobsbawm (1917 -2012). O pensamento de Marx e Engels continua, assim, presente em todo o mundo, com múltiplas tendências e variações, sempre gerando controvérsias. Do factive mental states come in degrees? If so, what is their underlying structure, and what is their theoretical significance? Many have observed that ‘knows that’ is not a gradable verb and have taken this to be strong evidence that propositional knowledge does not come in degrees. This paper demonstrates that the adjective ‘aware that’ passes all the standard tests of gradability, and thus strongly motivates the idea that it refers to a factive mental state that comes in degrees. His commitment to social reform, education, and the improvement of human welfare can be seen as an extension of his spiritual values, grounded in the belief that the divine resides within every person, regardless of their social or economic status. Alexis karpouzos believe that the process of spiritual growth was a deeply personal journey. He often spoke of the importance of inner freedom and self-realization. For him, true liberation was not something that could be granted from outside, but a state of consciousness that could only be attained through deep self-awareness and connection to the universe. This self-realization, however, did not mean renouncing the social and historical world; rather, it involved seeing the universal consciousness in all aspects of life and acting in alignment with it. While intimately familiar, gender eludes theorizing. We argue that well-known challenges to gender’s analysis originate in a subtle ambiguity: questions about gender sometimes express questions about gender categories themselves (e.g., womanhood, manhood, and so on), while at other times expressing questions about what makes someone a member of these categories. Distinguishing these questions accentuates gender’s connections to morality, making a novel “antirealist” view of gender, or as we call it, “unrealist” view, especially natural. Gender’s relations to identity, sex, and social (...) position are illuminated along the way. Taking cues from both historical and contemporary debates in metaethics about the roles that attitudes can play in metaphysical and semantic analysis, we introduce and begin developing a comprehensive non-ameliorative framework for explicating gender’s nature and our thought and talk about it. Fear is a preventer, sometimes robustly so. When fear robustly prevents, it changes or diminishes what an agent is able to do. Various popular conceptions of fear focus on its negative role: fear sometimes prevents us from acting as we should, as in certain cases of akrasia. But by the same token, fear sometimes prevents us from acting as we shouldn’t, as in certain other cases of inverse akrasia. The poetic thought of Alexis karpouzos is a expressions of soul's inner experiences, expression of universality. The inspiring visual images and the symbolic use of language offer a description of elevating experiences of consciousness, a glimpse of higher worlds. The philosophy of Alexis karpouzos speak to the human experience from a universal perspective, transcending all religions, cultural and national boundaries. Using vivid images and a direct language that speaks to the heart, his philosophy evokes a sense of deep communication with the collective unconscious, a sense of connection to all the creatures of the world, compassion for others, admiration for the beauty of nature, reverence for all life, and an abiding faith in the invisible touch of world. Albert Camus’ views contributed to the rise of the philosophy known as Absurdism, he defines the Absurd “as the conflict between the human tendency to seek inherent value and meaning in life, and the human inability to find any meaning in a purposeless, meaningless, and irrational universe, with the ‘unreasonable silence’ of the universe in response.” However, this world in itself is not absurd, what is absurd is our relationship with the universe, which is irrational. Camus is considered to be (...) an existentialist, even though he firmly rejected the term throughout his lifetime. He is properly categorised as an atheist existentialist. However, he would also disagree with this label. In his notebooks, he presents the following contradictory statement: -/- “I do not believe in God and I am not an atheist.” -/- This reflects the notion of the Absurd. The search of the possibility of the existence of God is humanly impossible, but this also entails that the proof that God does not exist is impossible too. He writes in The Myth of Sisyphus: “In a universe suddenly divested of illusions and lights, man feels an alien, a stranger. His exile is without remedy since he is deprived of the memory of a lost home or the hope of a promised land. This divorce between man and his life, the actor and his setting, is properly the feeling of absurdity.” The Myth of Sisyphus is a fierce expression of the Absurd. It starts off with a powerful and thought-provoking statement: “There is but one truly serious philosophical problem and that is suicide. Judging whether life is or is not worth living amounts to answering the fundamental question of philosophy.” . (shrink)

In the Sociology of Emotion and Affect Studies, affects are usually regarded as an aspect of human beings alone, or of impersonal or collective atmospheres. However, feelings and emotions are only specific cases of affectivity that require subjective inner selves, while the concept of ‘atmospheres’ fails to explain the singularity of each individual case. This article develops a theory of social affect that does not reduce affect to either personal feelings or collective emotions. First, I use a Spinozist understanding of (...) the ‘body’ to conceptualize the receptivity and mutual constitution of bodies, to show how affects do not ‘belong’ to anybody; they are not solely attributable either to the human or to any kind of body alone, but emerge in situations of the encounter and interaction (between bodies). Next I build upon Jean-Marie Guyau’s concept of transmissions to show how we can theorize affect as an emerging transmission between and among bodies. Finally, I demonstrate how we now have a complete conceptual frame for theorizing affect in relation to all bodies in any given social scene, the grand composition of which I call affectif. (shrink)

Why should musical compositions and artistic images be included among the types of expression covered by free speech principles? One way to answer this question is to show how expression in nonverbal media can be functionally similar to other types of verbal expression. But this leaves us with an intuitively unsatisfying explanation of why free speech principles cover nonverbal creative expression that does not functionally emulate literal speech. In this article, as an alternative justification, we develop and defend the idea (...) that musical and pictorial expression‚ much like literal speech, can be media through which people think aloud, as opposed to mere tools for the transmission of thought. We use this proposal to provide a more robust justification for including nonverbal creative expression in the scope of free speech coverage, and we outline some of the practical policy implications that come with adopting this justificatory strategy. A common objection to Sosa’s epistemology is that it countenances, in an objectionable way, unsafe knowledge. This objection, under closer inspection, turns out to be in far worse shape than Sosa’s critics have realised. Sosa and his defenders have offered two central response types to the idea that allowing unsafe knowledge is problematic: one response type adverts to the animal/reflective knowledge distinction that is characteristic of bi-level virtue epistemology. The other less-discussed response type appeals to the threat of dream scepticism, (...) and in particular, to the idea that many of our everyday perceptual beliefs are unsafe through the nearness of the dream possibility. The latter dreaming response to the safety objection to Sosa’s virtue epistemology has largely flown under the radar in contemporary discussions of safety and knowledge. We think that, suitably articulated in view of research in the philosophy and science of dreaming, it has much more going for it than has been appreciated. This paper further develops, beyond what Sosa does himself, the dreaming argument in response to those who think safety (as traditionally understood) is a condition on knowledge and who object to Sosa’s account on the grounds that it fails this condition. The payoffs of further developing this argument will be not only a better understanding of the importance of insights about dreaming against safety as a condition on knowledge, but also some reason to think a weaker safety condition, one that is relativised to SSS (i.e., skill/shape/situation) conditions for competence exercise, gets better results all things considered as an anti-luck codicil on knowledge. Matteo Ricci (1552-1610) was an Italian Jesuit and one of the first Christian missionaries to China in the modern era. He was a genuine polymath—a translator, cartographer, mathematician, astronomer, and musician. Above all, Ricci was a missionary for the gospel. As we briefly examine his 1603 seminal work, The True Meaning of the Lord of Heaven, our hope is that we, as evangelical educators, will perceive some of the deeper principles necessary for our own missionary work among unreached people.

Philosophers of mind commonly draw a distinction between the personal level – the distinctive realm of conscious experience and reasoned deliberation – and the subpersonal level, the domain of mindless mechanism and brute cause and effect. Moreover, they tend to view cognitive science through the lens of this distinction. Facts about the personal level are given a priori, by introspection, or by common sense; the job of cognitive science is merely to investigate the mechanistic basis of these facts. I argue (...) that this view misrepresents the structure of cognitive-scientific enquiry. Taken at face value, cognitive science makes no commitment to the existence of a distinctive level at which persons or selves appear. Thus, in the age of cognitive science, we should not expect to find the self in an ontologically distinct realm. Instead, we should expect to locate it in cognitive-scientific models themselves. Claims about what justice “requires” and the “requirements” of justice are pervasive in political philosophy. However, there is a highly significant ambiguity in such claims that appears to have gone unnoticed. Such claims may pick out either one of two categorically distinct and noncoextensive kinds of requirement that we call 1) requirements-as-necessary-conditions for justice and 2) requirements-as-demands of justice. This is an especially compelling instance of an ambiguity that John Broome has famously observed in the context of claims about other (...) requirements (notably the requirements of rationality and morality). But it appears to have been overlooked by political philosophers in the case of claims about the requirements of justice. The ambiguity is highly significant inasmuch as failing to notice it is liable to distort our normative thinking about politics and make us vulnerable to certain kinds of normatively consequential errors: both mistakenly drawing inferences about what justice demands of us from claims that certain states or societies are not just; and mistakenly drawing inferences about what states or societies are or would be just from claims that justice does not demand of states or societies that they do certain things. Paying greater attention to the distinction between these two different kinds of requirements and the ways in which they come apart is helpful, not merely in avoiding these distortions and errors, but also in resolving, or at least clarifying, a number of other notoriously murky meta-normative debates, especially various important debates about realism and idealism in political philosophy. A theory of cognitive systems individuation is presented and defended. The approach has some affinity with Leonard Talmy's Overlapping Systems Model of Cognitive Organization, and the paper's first section explores aspects of Talmy's view that are shared by the view developed herein. According to the view on offer -- the conditional probability of co-contribution account (CPC) -- a cognitive system is a collection of mechanisms that contribute, in overlapping subsets, to a wide variety of forms of intelligent behavior. Central to (...) this approach is the idea of an integrated system. A formal characterization of integration is laid out in the form of a conditional-probabilitybased measure of the clustering of causal contributors to the production of intelligent behavior. I relate the view to the debate over extended and embodied cognition and respond to objections that have been raised in print by Andy Clark, Colin Klein, and Felipe de Brigard. (shrink)

In the same spirit with the theme of last issue of this SGJ journal (“Ongoing creation”), this paper shortly reviews a plausible mechanism from Aether to become ordinary matter from the perspective of Neutrosophic Logic. We also discuss two other possible applications of Neutrosophic Logic, including a resolution of conflicting paradigms in medicine. We hope that some ideas as outlined herein will be proved useful in the near future.

In a recent paper, we describe how a model of quantum communication based on combining consciousness experiment and entanglement can serve as impetus to stop 5G-caused diseases. Therefore, in this paper we will discuss how entanglement can be explained in terms of quantum theory. This short review may be considered as an effort to bring QM into real problem solving, i.e. telecommunication.

Smarandache Hypothesis states that there is no speed limit of anything, including light and particles. While the idea is quite simple and based on known hypothesis of quantum mechanics, called Einstein-Podolski-Rosen paradox, in reality such a superluminal physics seems still hard to accept by majority of physicists. Here we review some experiments to support superluminal physics and also findings to explain Smarandache Quantum Paradoxes and Quantum Sorites Paradox. Much has been said about Confucius’ negative formulation of the Golden Rule. Most discussions center on explaining why this formulation, while negative, does not differ at all in intention from the positive formulation. It is my view that such attempts may have the effect of blurring the essential point behind the specifically negative formulation, a point which I hope to elucidate in this essay. It is my first contention that such a negative formulation is consonant with other basic implicit Confucian (...) attitudes such as modesty and the belief in the inherent goodness of human nature. My second contention is that this negative formulation has the intent and/or effect of promoting growth and, more importantly, preventing moral harm. My broader thesis is that the negative version of the Golden Rule does differ significantly from the positive version and that the difference that exists might well have been intended by Confucius to highlight the nature of his most basic moral principle. Although scientific studies have focused on out-of-body experiences (OBEs) and near-death experiences (NDEs), there is scant evidence to support the claim that consciousness survives death. Many speculative theories state that consciousness moves through various afterlife realities. Tantalizing clues are found in world religion, esoteric philosophy, extrasensory perception, hypnotic regression, and scientific experimentation. At the present time, there is an abundance of theoretical scholarly discourse on the topic of “survival.” (...) Sidgwick holds that pleasures are feelings that appear desirable qua feeling. I defend this interpretation against other views sometimes attributed to Sidgwick—for example, the view that pleasures are feelings that are desired qua feeling, or that pleasures are feelings with a particular feel that can be specified independently of desire. I then defend Sidgwick’s view against recent objections. I conclude that his account of pleasure should be attractive to those looking for an account suitable for normative work.

If the world itself is metaphysically indeterminate in a specified respect, what follows? In this paper, we develop a theory of metaphysical indeterminacy answering this question.

History of science and philosophy of science are not perfectly complementary disciplines. Several important asymmetries govern their relationship. These asymmetries, concerning levels of analysis, evidence, theories, writing, and training show that to be a decent philosopher of science is more difficult than being a decent historian. But to be a good historian-well, the degree of difficulty is reversed.

The common understanding of Chuang-Tzu as one of the earliest deconstructionists is only half true. This article sets out to challenge conventional characterizations of Chuang-Tzu by adding the important caveat that not only is he a philosophical deconstructionist but that his writings also reveal a non-relativistic, transcendental basis to understanding. The road to such understanding, as argued by this author, can be found in Chuang-Tzu’s emphasis on the illusory or dream-like nature of the self and, by extension, the subject-object dichotomy (...) inherent in all forms of conceptualization and descriptive language. These two obstacles to true understanding - the self and literal, linguistic expressions - are overcome in the Chuang-Tzu by implementing metaphorical and poetic language, such as the Kun-Peng myth, the swamp pheasant parable, the introduction of physically deformed interlocutors, various dream analogies, and so forth. By employing such literary devices in a comprehensible and non-mystical manner, this article concludes that Chuang-Tzu successfully communicates his essential wisdom by guiding the reader to a higher state of spiritual awareness, a state in which one transcends the self, language, conceptual paradoxes, and even the idea of transcendence itself. Consequently, through the following explication of Chuang-Tzu’s complementary emphasis on both preventing mental rigidity and promoting spiritual transcendence, this article seeks to earn Chuang-Tzu the reputation of a deconstructionist with a difference. This chapter defends the account of metaphysical indeterminacy of Barnes and Williams against Eklund's objections.

Are interpersonal comparisons of desire possible? Can we give an account of how facts about desires are grounded, that underpins such comparisons? This paper supposes the answer to the first question is yes, and provides an account of the nature of desire that explains how this is so. The account is a modification of the interpretationist metaphysics of representation that the author has recently been developing. The modification is to allow phenomenological affective valence into the “base facts” on which correct (...) interpretation is grounded. To use this extra resource within that theory to vindicate interpersonal comparisons, we will need to appeal rational connections between level of valence and level of desire, which this paper sets out and examines. Decisions are made under uncertainty when there are distinct outcomes of a given action, and one is uncertain to which the act will lead. Decisions are made under indeterminacy when there are distinct outcomes of a given action, and it is indeterminate to which the act will lead. This paper develops a theory of (synchronic and diachronic) decision-making under indeterminacy that portrays the rational response to such situations as inconstant. Rational agents have to capriciously and randomly choose how to resolve (...) the indeterminacy relevant to a given choice-situation, but such capricious choices once made constrain how they will choose in the future. The account is illustrated by the case of self-interested action in situations where it is indeterminate whether you yourself will survive to benefit or suffer the consequences. The conclusion emphasizes some distinctive anti-hedging predictions of the account. (shrink)

This paper generalises the classical Condorcet jury theorem from majority voting over two options to plurality voting over multiple options. The paper further discusses the debate between epistemic and procedural democracy and situates its formal results in that debate. The paper finally compares a number of different social choice procedures for many-option choices in terms of their epistemic merits. An appendix explores the implications of some of the present mathematical results for the question of how probable majority cycles (as in (...) Condorcet's paradox) are in large electorates. (shrink)
