There has been an increased focus within the AI ethics literature on questions of power, reflected in the ideal of accountability supported by many Responsible AI guidelines. While this recent debate points towards the power asymmetry between those who shape AI systems and those affected by them, the literature lacks normative grounding and misses conceptual clarity on how these power dynamics take shape. In this paper, I develop a workable conceptualization of said power dynamics according to Cristiano Castelfranchi’s conceptual framework (...) of power and argue that end-users depend on a system’s developers and users, because end-users rely on these systems to satisfy their goals, constituting a power asymmetry between developers, users and end-users. I ground my analysis in the neo-republican moral wrong of domination, drawing attention to legitimacy concerns of the power-dependence relation following from the current lack of accountability mechanisms. I illustrate my claims on the basis of a risk-prediction machine learning system, and propose institutional and project-specific solutions to mitigate domination. (shrink)

What is domination? According to a leading strand of republican political philosophy, a person is dominated when under the unconstrained power of another. Call this the dyadic conception of domination, because it involves a two‐person relation. I argue that domination is better understood structurally. Structural domination is domination by institutions. Rather than a master dominating a slave and a boss dominating a worker (as in dyadic domination), structural domination holds that the institution of slavery dominates the slave and labor law (...) dominates the worker. Without the structural conception, I contend, one misdescribes the power dynamics of paradigm cases of domination. (shrink)

There is something amiss about post-Rawlsian efforts to bring political theory down to earth by insisting upon the political primacy of the question of legitimacy, peace, or order. The intuition driving much realism seems to be that we must first agree to get along, and only then can we get down to the business of pursuing justice. I argue that the ideological narratives of the powerful pose a political problem for this primacy of legitimacy thesis. To prioritize the achievement of (...) democratic legitimacy seems to make sense only to the extent that we already live in a world in which systematic domination—and its ideological baggage—has been stamped out. I draw on the social study of domination for the sake of combatting in political theory the temptation to focus on the static design of the constitutional state at the expense of ignoring or even condemning the social processes that motivate legal and constitutional changes. Recent work in republican political theory has identified various forms of domination in the structures and relations of capitalist societies. A notable absence in much of this work is the concept of exploitation, which is generally treated as a predictable outcome of certain kinds of domination. This paper argues that the concept of exploitation can instead be conceived as a form of structural domination, understood in republican terms, and that adopting this conception has important implications for republican attempts to theorize (...) modern capitalist societies. Building on existing domination accounts of exploitation, we argue that exploitation is a form of structurally constituted domination that enables a systemic illegitimate extraction of value. However, in contrast to competing accounts, domination is understood here in the republican terms of subjection to arbitrary power. We show that conceiving of domination in these terms not only makes the concept easily accessible from within a republican framework, but has advantages over competing accounts. Our argument also demonstrates why using the concept of exploitation will be useful for republican theorists. We show that a polity based on exploitative relations of production is antithetical to key republican commitments. These asymmetric power relationships undermine the economic and political independence of citizens and, crucially, constrain the political and economic ends that a polity will be effectively able to pursue. As such, exploitation should be a central preoccupation of republican political economy. (shrink)

Relational egalitarians sometimes argue that a degree of distributive equality is necessary for social equality to obtain among members of society. In this paper, we consider how such arguments fare when extended to the intergenerational case. In particular, we examine whether relational reasons for distributive equality apply between non-overlapping generations. We claim that they do not. We begin by arguing that the most common reasons relational egalitarians offer in favour of distributive equality between contemporaries do not give us reasons to (...) object to distributive inequality between non-overlapping generations. This argument by itself however will not fully suffice to show that there are no relational reasons to care about intergenerational distributive equality, given the nature of relational equality and its requirements in the intergenerational case are likely to be qualitatively different than in the contemporary case. Therefore, we also make the positive argument that for the intergenerational case to satisfy the requirements demanded by the ideal of relational equality it suffices that future persons’ interests are meaningfully incorporated and protected in the decision-making of preceding generations, and there is no basis for a concern with distributive equality. While some have argued that the one-way and asymmetrical causal influence between non-overlapping generations means concerns of social equality are inapplicable in the intergenerational case, we argue that the ongoing nature of this influence makes concerns of social equality appropriate. If successful, the upshot of the argument is that it can be coherent to maintain a commitment to relational equality between non-overlapping generations, all while remaining agnostic about distributive equality between them. This paper defends a neorepublican account of civic virtue as consisting of stable traits of character, understood in broadly Aristotelian terms, that exhibit excellences associated with the role of citizen, and that contribute to the secure protection of freedom as non-domination. Such an account is important for the neorepublican project because neither laws nor social norms can yield reliable support for republican freedom without a parallel input from civic virtue. The paper emphasizes the need to distinguish civic virtue from desirable (...) norms, which can operate in tandem. Against other neorepublican accounts of civic virtue, it argues that the primary function of such virtue is not to support the stability of republican regimes. Rather, it has a corrective function, and may in fact challenge institutions, laws, and informal norms if they allow for the exercise of arbitrary power. Finally, the paper argues that this account of civic virtue is better positioned than a stability-focused account to shed light on the relationship between civic virtue and the common good. (shrink)

Are we being manipulated online? If so, is being manipulated by online technologies and algorithmic systems notably different from human forms of manipulation? And what is under threat exactly when people are manipulated online? This volume provides philosophical and conceptual depth to debates in digital ethics about online manipulation. The contributions explore the ramifications of our increasingly consequential interactions with online technologies such as online recommender systems, social media, user-friendly design, micro-targeting, default-settings, gamification, and real-time profiling. The authors in this (...) volume address four broad and interconnected themes: • What is the conceptual nature of online manipulation? And how, methodologically, should the concept be defined? • Does online manipulation threaten autonomy, freedom, and meaning in life, and if so, how? • What are the epistemic, affective, and political harms and risks associated with online manipulation? • What are legal and regulatory perspectives on online manipulation? The Philosophy of Online Manipulation brings these various considerations together to offer philosophically robust answers to critical questions concerning our online interactions with one another and with autonomous systems. This article argues for a systemic conception of freedom as non-domination. It does so by engaging with the debate on the so-called coalition problem. The coalition problem arises because non-domination holds that groups can be agents of (dominating) power, while also insisting that freedom be robust. Consequently, it seems to entail that everyone is in a constant state of domination at the hands of potential groups. However, the problem can be dissolved by rejecting a ‘strict possibility’ standard for interpreting non-domination’s (...) robustness requirement. Frank Lovett and Philip Pettit propose to restrict the relevant domain of possible worlds by reference to two epistemic conditions pertaining to potential group members. I argue that this strategy unduly limits non-domination’s critical potential. I then argue that a suitably systemic conception of domination avoids this problem. By placing explanatory emphasis on social institutions, and how these bear on the feasibility of individual and collective action, a systemic conception of non-domination avoids the coalition problem in a way that retains its critical potential. The article clarifies the relationship between the rule of law and the social norms and objects to the claim that non-domination is bound to deem the latter irrelevant from the point of view of freedom. Recently, some authors have claimed that, from a republican perspective, market relations are dominating. However, _prima facie_, this idea does not fit within the (neo-)republican conceptualization of domination, which models domination on the master-slave relation. The aim of this article is to twofold. First, I try to argue that market relations can be seen as dominating. Second, I attempt to show that this can be done through an extension of the (neo-)republican conceptualization of domination. I try to achieve this by (...) comparing the master-slave relation with the accounts of those authors who maintain that market relations entail domination. This comparison reveals that there are fundamental similarities between the master-slave relation and the dynamics within market relations that are identified as dominating. What they have in common is the specific harm of domination, which I call the ‘logic of domination’. However, where the master-slave relation and market relations diverge is in the characteristics of the relation that causes the logic of domination to materialize. I argue that Pettit’s concept of discursive control allows us to extend his account of domination in such a way that we can conceive of market relations as dominating. (shrink)

Members of racial and sexual minorities often live in the fear of arbitrary interference from others—rogue police officers or sexual harassers. Are they unfree by dint of believing they are unfree? I draw on the republican theory of freedom—according to which we are unfree if we are subjected to a risk of arbitrary interference—to offer a qualified positive answer. I clarify the role of probabilistic judgements about risk in republican political theory. I argue that under specific circumstances, diagnoses of republican (...) freedom can be indexed to a certain belief about probability—what it is warranted for someone to believe in light of their distinctive epistemic perspective. Using automated systems to avoid the need for human discretion in government contexts – a scenario we call ‘rule by automation’ – can help us achieve the ideal of a free and equal society. Drawing on relational theories of freedom and equality, we explain how rule by automation is a more complete realization of the rule of law and why thinkers in these traditions have strong reasons to support it. Relational theories are based on the absence of human domination and (...) hierarchy, which automation helps us achieve. Nevertheless, there is another understanding of relational theories where what matters is the presence of valuable relationships with those in power. Exploring this further might help us see when and why we should accept human discretion. (shrink)

I develop an egalitarian account of what's objectionable about coercion. The account is rooted in the idea that certain relationships, like those of master to slave or lord to peasant, are relationships of subordination or domination. These relationships are morally objectionable. Such relationships are in part constituted by asymmetries of power. A master subordinates a slave because the master has more power over the slave than vice versa. Coercion is objectionable, I argue, because it creates such asymmetries of power and (...) so creates relationships of subordination. This account, moreover, illuminates what's wrong with blackmail, exploitation, withholding aid, and compulsion. (shrink)

Shirking, the act of avoiding the demands of one’s job, is generally seen as unethical. Drawing on empirical evidence from the sociology of work, I develop a normative conception of shirking as a form of worker resistance against illegitimate managerial power. In doing so, I present a new approach to the political theory of the firm, which is more adversarial and agent-centered than available alternatives. It is more adversarial as it recognizes the political value of counterproductive and disruptive behavior in (...) capitalist firms. It is more agent-centered because it theorizes the firm from the perspective of workers, asking what pro tanto reasons they have to shirk. I show that shirking under the structural domination of capitalism has diagnostic, agential, and epistemic values. The paper contributes to the wider methodological ambition to tailor political theorizing to the positionality of social actors by shifting attention from the institutional design of the firm to the methods of worker resistance. One topic of growing interest in the debate on intergenerational justice is the duty to respect the freedom of future generations. One consideration in favor of such a duty is that the decisions of present generations will affect the range of decisions that will be available to future people. As a consequence, future generations’ freedom to direct their lives may be importantly restricted such that present generations can be seen as taking future people’s lives into their hands and disempowering them. (...) This article defends the idea that present generations have an obligation to sustain a certain threshold of freedom for members of present and future generations alike. It argues that we should regard sustainability policies as a way to redistribute freedom across members of different generations. It starts by explaining the centrality of social freedom to the way we conceive of moral persons, then explains how freedom can be understood as an object of redistribution. It then argues that by imposing some risks—such as that of resource depletion or destruction of the ecosystem—on future generations, present generations push future generations’ freedom below an acceptable threshold. The paper concludes with examples of how this focus on freedom can offer guidance in selecting and justifying sustainability policies—for example, measures for conserving biodiverse environments—even when it is not clear how they will directly contribute to the well-being of future persons. Until recently, many theorists defined domination such that it requires unequal power, and most others held that even if domination were not defined as requiring unequal power, a requirement of unequal power would nevertheless follow from the definition of what domination is. On these views, unless there is an imbalance of power between the two parties, there can be no relation of domination. However, two prominent theorists have recently broken from this consensus, on the grounds that people can depend on (...) one another's arbitrary or uncontrolled wills even in contexts where there is no inequality of power. In this paper, I argue that this is a mistake: domination theorists have a powerful reason to hold that domination cannot take place without a power imbalance. Consequently, we should only accept definitions of the concept on which domination requires unequal power. (shrink)

The political and ethical status of future generations is commonly discussed within conceptual frameworks like intergenerational justice, rights, or welfare. In this article, I argue that the concept of _domination_ can provide a novel perspective on the philosophy of intergenerational relations. To that end, I first advance and defend a (slightly) revised conception of domination, drawing on Philip Pettit’s neorepublican view. Second, I establish a _prima facie_ case for the existence of intergenerational domination and address four major objections to the (...) claim that the present generation dominates future generations: the non-concurrency challenge, a modified version of the non-identity problem, the inescapability objection, and the problem of historical domination. Finally, I explore some implications and conceptual advantages of the framework of intergenerational domination. As a theoretical foundation of a comprehensive analysis of structures of domination, the proposed framework may contribute to identifying and reducing domination within and across generations. Laborde contrasts Default Republicanism with Labordian Republicanism. The latter view ‘answers’ the Probabilistic and the Anti-Psychology Objections to Default Republicanism. The former objection holds that the mere possibility of unconstrained intervention does not matter for unfreedom, whereas the latter contends that it is by virtue of the experience-independent fact of servitude that one is unfree. I argue that people sympathetic to these objections should have reservations about Labordian Republicanism. In any case, republicans should reject the Anti-Psychology Objection. Technology scholars and journalists have recently called attention to digital platforms’ and devices’ ability to influence users based on their present moods, stress level, hunger, and other transient features. For them, such influence based on users’ present status – what the chapter calls “real-time profiling” – is not only a clear form of wrongful manipulation but also online manipulation’s future. The chapter aims to explain what makes real-time profiling wrong (when wrong) and discusses problems associated with its regulation. After explaining (...) what real-time profiling consists in and showing that it can be presumed to be a form of manipulation, the chapter argues that real-time profiling is wrong both because the profiler psychologically hijacks profiled subjects and because it works as a gateway to further wrongs. Towards the end, the chapter discusses some implications of the proposed account for the legal regulation of online manipulative technologies like real-time profiling. It is argued that existing legal frameworks are not fine-grained enough to deal with the wrongs associated with real-time profiling and related forms of online manipulation. (shrink)

Linguistic justice is about institutions distributing material and symbolic resources fairly when they are faced with linguistic diversity. However, no theory of linguistic justice has developed a systematic and comprehensive account of the moral dilemmas that take place in interpersonal linguistic relationships, in particular the power dynamics leading to (linguistic) domination. The aim of this article is to start building a general theory of linguistic domination, one that offers new conceptual tools for both empirical and normative analyses of linguistically diverse (...) societies. Using the republican tradition of thought, I argue that there is linguistic domination whenever someone is subject to the uncontrolled capacity for interference over their linguistic uses, ideology and acquisition by another agent. Big data, artificial intelligence, and increasingly precise biometric techniques have given state and private organizations unprecedented scope and power for the surveillance and dataveillance of migrants. In many cases, these technologies have evolved faster than our legal, political, and ethical mechanisms. This paper, drawing on current discussions of justice and non-domination, proposes a non-domination-based ethics of digital surveillance and mobility, in which the legitimacy of these technologies depends on their avoidance of the arbitrary use of power. This paper conceptualizes the administrative punishment of police misconduct as a republican retributivist endeavor. Blameworthiness for police misconduct stems from its collective and civic harms to liberty — as conceived of as equal protection, rather than non-interference. Police have a special obligation to uphold liberty. Failing to uphold these conditions of liberty is what makes misconduct blameworthy. Police misconduct, insofar as it represents the arbitrary domination of some people over others, threatens republican freedom. I trace this conception of police misconduct (...) across various categories of police misconduct, including criminal and non-criminal violations and violations that do and do not use police powers. While administrative punishment for police misconduct may be justified by its consequences, there also exists a retributive element to this punishment. Republicanism explains why officers are blameworthy for police misconduct, and retributivism explains why they ought to be punished for that blameworthiness. I conclude with an argument for why this republican retributivist paradigm is more coherent than traditional consequentialist or retributivist ones. (shrink)

Leslie Houts Picca and Joe Feagin argue that whites strive to isolate racial discourse to all-white social spaces. We can explain this practice by assuming that many whites—including “non-racist” whites—think of racism as shameful. Shame essentially concerns not what we do but how we are perceived. Maintaining their identities as “not racist,” then, seems to these whites primarily to involve the management of non-white people's perceptions of them. By isolating much of white racial discourse to all-white spaces, the white construal (...) of racism as shameful denies non-whites’ standing to participate in the construction of the social norms governing whites’ relationships with them. We should instead treat racism as disrespectful, and so requiring public correction because of its role in sustaining racist social norms. (shrink)

Bilateral investment treaties constitute an important instrument to facilitate global investment. Recent discussions in political theory have highlighted several normative concerns raised by bilateral investment treaties. One worry is that investment treaties undermine national self‐determination as they grant investors far‐reaching protections that can be legally enforced. Another worry is that the benefits and burdens entailed in bilateral investment treaties are distributed unfairly in a way that benefits investors at the expense of states and disadvantaged groups within states. Instead of critiquing (...) bilateral investment treaties from a perspective of global (distributive) justice, in this article I develop a class‐based critique. This involves a twofold departure. First, the article shifts the focus from distributions to the power relations that are built into the global capitalist economy and that come into sharp relief in the practice of global investment. Second, rather than focusing on the relation between states and investors, I claim that in a class‐based critique the relation between workers and investors should take centre stage. I argue that bilateral investment treaties are effectively an instrument of class domination, insofar as they reproduce and increase the power of transnational corporations while at the same time decreasing the power of workers. Jerkish speech on online platforms is at risk of being overlooked as a result of being comparatively insignificant next to the existence of explicit hate speech or other online harms. In this paper I approach online jerkish speech from a republican perspective. I discuss two ways in which republicans can account for jerkish speech. First, jerkish speech could amount to micro-domination, referring to instances of domination that are relatively inconsequential by themselves but problematic when considered in aggregate. Second, jerkish speech (...) can be considered an instantiation of systemic domination, where groups and members are structurally subordinated. I briefly discuss the role of regulatory bans on jerkish speech, before suggesting that Suzanne Whitten’s proposal for critical civility—as an appropriate answer to jerkish speech in online environments—might be too demanding. This paper focuses on the intergenerational problem for relational egalitarianism. It follows Karnein (2023), Nolt (2011), Smith (2013), and others in analysing the issue in terms of intergenerational domination but rejects their claim that the best way to understand the problem is through a group conception of domination involving current generations dominating future generations. My aim in this paper is to replace these existing accounts. I argue that intergenerational domination is better understood structurally via a Role-Based Model, where domination occurs (...) through institutions and social structures. The core idea is that our institutions and social structures created and maintained by earlier generations, enable some future generations to dominate others through and in virtue of their social roles. Because roles are the site where structure meets agency, this Role-Based Model (1) explains how the actions of only some members within a generation – whether from preceding or future generations – contribute to intergenerational domination, and (2) accurately identifies which future individuals or groups are most likely to become victims of intergenerational domination based on their roles and position within these structures. The implication is that social roles are crucial to intergenerational domination. This insight is pertinent to debates on some of the most pressing political and ethical issues of our time such as how to safeguard future generations from the consequences of climate change, antibiotic resistance, and the costs of long-term public debt. Without this Role-Based Model, we risk mischaracterising the problem and implementing ineffective solutions. (shrink)

When progressive governments attempt to redistribute wealth, nationalize major industries, or empower unions, they are often faced with the threat of capital flight. Some republican theorists have suggested that this phenomenon might be a source of domination. However, the prominent neo-republican account of domination presented by Philip Pettit cannot justify this claim, since the class of investors is not usually an agent.
