1795 erschien die 1. Auflage von Kants Schrift Zum ewigen Frieden. Zu einer der vordringlichsten, von der Philosophie aber häufig vernachlässigten Aufgaben der Politik stellt sie bis heute den wichtigsten klassischen Text dar. Kant entfaltet in ihm die philosophischen Grundlagen für eine internationale Rechts- und Friedensgemeinschaft. Gleichzeitig stellt er sich aber auch die Frage nach einer Vermittlung von normativer Theorie und politischer Praxis. In 12 Beiträgen wird Kants Text in diesem Band 'entschlüsselt', interpretiert, auf seine systematische Überzeugungskraft und auf seine (...) politische Tragweite hin untersucht und in seinen und unseren sozialgeschichtlichen Kontext gestellt. Nowadays Kant's practical philosophy is as highly regarded as his theoretical philosophy. This is an important development since the more constructive side of Kant's philosophy is to be found in his moral and political works. The main task of the Critique of Pure Reason is to clarify its concepts and to get rid of basic errors, and thus only ‘negative’. The moral and political writings, on the other hand, try to expand the scope of reason ‘for practical purposes’ . Immanuel Kants Metaphysische Anfangsgründe der Rechtslehre, 1797 als erster Teil der Metaphysik der Sitten erschienen, stellen einen Beitrag zur neuzeitlichen Rechts- und Staatsphilosophie dar. Hinsichtlich der normativen Prinzipien von Recht und Staat entwickelt Kant eine erfahrungsunabhängige, insofern metaphysische Theorie. Sie beginnt mit einem angeborenen und unveräußerlichen Menschenrecht und geht dann zu den Institutionen des Eigentums und des Rechtsstaates über. Besonders aktuell ist die Formulierung eines rechts- und friedensfunktionalen Völkerrechts und eines Weltbürgerrechts. Darüber hinaus behandelt Kant auch das Ehe und Familienrecht, (...) das Verhältnis von Staat und Kirche und das Straf- und Begnadigungsrecht. Durch den thematischen Reichtum und die begriffliche Genauigkeit, vor allem jedoch durch die Radikalität seiner Fragen und die Originalität der Antworten ist Kants Rechtsdenken bis heute von hohem systematischem Rang. Die elf Beiträger dieses kooperativen Kommentars, der anlässlich des 300. The article investigates the problem of Kant's proposal for a final global legal order. Kant expressed his stance very vaguely in the consecutively published texts On the Common Saying, Toward Perpetual Peace and The Metaphysics of Morals, which enabled numerous, often contradictory interpretations. The aim of the paper is to propose an alternative method of analysis of Kant's texts, which on one side reconciles textual discrepancies in his writings and on the other throws new light on many of the previous (...) interpretations. In order to accomplish this goal, I draw distinctions between four perspectives, from which the philosopher considers this issue in his writings. This allows me to give the final form of Kant's world peace, explain the character of the international state of nature vs the original one, and understand the role of the principles of politics and the status of Kant's teleological understanding of history. There exists a standard view of Kant’s position on global order and this view informs much of current Kantian political theory. This standard view is that Kant advocates a voluntary league of states and rejects the ideal of a federative state of states as dangerous, unrealistic, and conceptually incoherent. This standard interpretation is usually thought to fall victim to three equally standard objections. In this essay, I argue that the standard interpretation is mistaken and that the three standard objections miss (...) their target. Kant does advocate the establishment of a non-coercive league of states, at least in his mature political writings (such as Perpetual Peace and the Metaphysics of Morals), but he does so for different reasons than is usually thought and without rejecting the ideal that a world federation of states eventually be realized. I end by indicating how Kant’s revised view can be made productive for present-day philosophical purposes. (shrink)
