What would it mean to have a suitably ‘realistic’ account of political liberty? On the one hand, I don’t think we can properly understand liberty without an underlying account of personhood or agency.2 In making sense of liberty, we need to ask: What kind of agency does it presuppose or promote? What kind of independence do we care most about? What does it mean to exercise control, or to be self-guiding, in the kind of world we live in today? At (...) the same time, a conception of moral and political personhood needs to be appropriately ‘realistic’: It shouldn’t be over-idealized (or over-simplified), nor demand more than can be reasonably expected, given the kind of creatures we are. If bioethical questions cannot be resolved in a widely acceptable manner by rational argument, and if they can be regulated only on the basis of political decision-making, then bioethics belongs to the political sphere. The particular kind of politics practiced in any given society matters greatly: it will determine the kind of bioethical regulation, legislation, and public policy generated there. I propose approaching bioethical questions politically in terms of decisions that cannot be “correct” but that can be “procedurally legitimate.” Two (...) procedures in particular can deliver legitimate bioethical decisions, once combined: expert bioethics committees and deliberative democracy. Bioethics so understood can exceed bioethics as a moral project or as a set of administrative principles to regulate medical practice; it can now aspire to a democratic project that involves ordinary citizens as far as reasonably possible. I advance this argument in four steps: (1) using the example of human germline gene editing, (2) I propose a general understanding of proceduralism, and (3) then combine two types and (4) conclude with a defense of majoritarian proceduralism. What features of structural injustice distinguish it from mere collections of injustices committed by individuals? I argue that the standard model of moral judgment that centers agents and actions fails to adequately articulate what’s gone wrong in cases of structural injustice. It fails because features of the social world that arise only at large scale are normatively salient, but unaccounted for by the standard model. I illustrate these features with historical examples of normatively-different outcomes driven by institutional structure rather, holding (...) fixed characteristics of agents’ motivations. The article examines whether realist theory should adopt a philosophical anarchist position concerning political obligation. The conclusions are mixed. Drawing on a distinction between strong and weak theories of political obligation (in the terminology of the paper, strong theories are committed to morality-based theorizing while weak theories depart from it), the article argues that philosophical anarchism and realist theory are natural allies against strong theories of political obligation but they must part company when it comes to weak theories because it (...) is exactly their departure from morality-based theorizing that can make weak theories especially appealing to realists. In addition, two further objections can be raised against philosophical anarchism on realist grounds: first, philosophical anarchists are drawn to undesirably sweeping conclusions about the non-existence of legitimate political authority or the extreme scarcity of genuine political relations by their Kantian or Lockean background assumptions and, second, Simmons seems to have an implicit weak theory of political obligation which could be, ironically, much more appealing to realists than his overall Lockean anarchism or his sweeping criticism of weak theories. The influential realist thesis that politics and morals are distinct and mutually exclusive spheres of interest is one that has been challenged within the tradition of analytic moral and political theory. Over the last 50 years, several notable liberal analytic philosophers, including Isaiah Berlin, Stuart Hampshire, and Thomas Nagel, have argued that not only is politics not separate from and inimical to ethics but that there exists such a thing as political morality. This article contends that while the notion of (...) political morality may make more sense of what is regarded as a central and troubling problem of politics, it also forces us to confront the more fundamental challenge of the radical contingency of our moral and political predicament. In contemporary democracies, global capitalism exerts a significant influence over how state power is exercised, raising questions about where political power resides in global politics. This question is important, since our specific considerations about justifiability of political power, i.e. political legitimacy, depend on how we characterize political power at the global level. As a partial answer to this question, I argue that our notion of global political legitimacy should be reoriented to include the structural power of the Transnational Capitalist Class (...) as its subject matter. Structural power is a social relation in which the institutional context makes some agents comply with others’ preferences regardless of actors’ intentional efforts to bring about such outcomes. Even when global business elites do not intentionally exercise power to obtain political control of global governance, their structural power has recognizable effects that partly enforce the world order. To advance my claim, I utilize the radical realists’ argument that the notion of legitimacy is applicable to a broader range of social practices that are beyond dyadic power relations, i.e. rulers intentionally exercising power over subjects. It is no exaggeration to say, in this context, that sufficient momentum has gathered to qualify the situation as "democratic recession," despite people may have different understandings as to the exact (...) nature of this recession and how long it will last. Accompanying this recession, Confucian political meritocracy, whose aim is to correct the wrongs of democracy, is constructed as an alternative to liberal democracy. The ethics of immigration is currently marked by a division between realists and idealists. The idealists generally focus on formulating morally ideal immigration policies. The realists, however, tend to dismiss these ideals as far-fetched and infeasible. In contrast to the idealists, the realists seek to resolve pressing practical issues relating to immigration, principally by advancing what they consider to be actionable policy recommendations. In this article, I take issue with this conception of realism. I begin by surveying the way in (...) which it exemplifies what certain political theorists have recently called ‘problem-solving’ realism – a species of realism which they reject as incoherent. These theorists demonstrate that what counts as a ‘feasible’ solution is far harder to establish than most problem-solving realists would have us believe. Applying this general critique to the specific domain of immigration ethics turns out to radically undermine the notion of realism that prevails in this sphere of applied ethics. I conclude that we should therefore revise our conception of what constitutes a genuinely realist approach to the problem of immigration. (shrink)

Jeremy Bentham is usually seen as an anti-realist political thinker, or a proponent of what Bernard Williams has termed ‘political moralism’. This article questions that prevalent view and suggests instead that there are good grounds for considering Bentham a political realist. Bentham’s political thought has considerable commonalities with that of the sociologist and political realist Max Weber: both agree that politics is a unique domain of human activity defined by its association with power; that consequently, ethical conduct is unavoidably inflected (...) by power in politics; that a commitment to truth in politics can only ever be contingent; and that politics has a set of basic conditions that it would be not only misguided but dangerous to attempt to transcend. Whilst it is often held that Bentham advanced a reductive framework for understanding politics, in fact, his utilitarianism was a far more realistic approach to political ends and means than has generally been acknowledged, and one that contemporary political theory realists would benefit from taking seriously. This article challenges the association between realist methodology and ideals of legitimacy. Many who seek a more “realistic” or “political” approach to political theory replace the familiar orientation towards a state of justice with a structurally similar orientation towards a state of legitimacy. As a result, they fail to provide more reliable practical guidance, and wrongly displace radical demands. Rather than orienting action towards any state of affairs, I suggest that a more practically useful approach to political theory would directly (...) address judgments, by comparing the concrete possibilities for action faced by real political actors. Political philosophy has traditionally been defined as a normative discipline with a distinctively ideal component, largely informed by moral philosophy. In this paper, I investigate a prominent critique of ideal theory specifically with the goal of resituating the debate within a larger framework in the philosophy of science. I then mount a novel case for how ideal theory should be viewed in terms of scientific modelling. I close with a discussion of how this view can dissolve apparent paradoxes and provide (...) distinct advantages to the political theorist. (shrink)

Realist political theory is often confronted with the objection that it is biased towards the status quo. Although this criticism overlooks the fact that realist political theories contain various resources for critique, a realist approach that is strong in status quo critique and contributes, constructively, to the theorising of alternatives to the status quo is a desideratum. The article argues that contextual realism, which sources its normativity from particular contexts, harbours an underexploited potential to establish such a form of political (...) theorising. By drawing on ideas and principles that have guided critical engagements with social and political forms in a particular context, and on widely shared views of need for reform, realists can identify deficits of the status quo and contribute to a debate on how these deficits might be addressed. This article describes and illustrates the idea of a transformative contextual realism, and defends it against some potential objections. (shrink)

Most politically minded Kurds agree that their people need liberty. Moreover, they agree they need liberation from the domination they suffer from the four states that divide them: Turkey, Syria, Iraq, and Iran. What is less certain is the precise nature of this liberty. A key debate that characterizes Kurdish political discourse is over whether the liberty they seek requires the existence of an independent Kurdish nation-state. Abdullah Öcalan, the jailed intellectual leader of the Kurdistan Workers’ Party, has argued that (...) Kurdish liberty can only be achieved through liberation from the nation-state model itself. Instead of founding an independent Kurdistan, Öcalan proposes regional autonomy for the Kurds through a strictly egalitarian and directly democratic confederalism reminiscent of Murray Bookchin’s anarchist-inspired libertarian municipalism. We argue, in response to Öcalan’s approach, that employing an anarchist rejection of the state is largely mistaken. We diagnose certain historical and conceptual problems with the anarchist understanding of the state and develop the admission made in passing by certain anarchists, including Öcalan, that anarchist liberty could only be achieved after a long period of statist existence. Mostly counter to the anarchist model of non-domination, we propose a republican model of liberty and liberation, also as non-domination, that necessitates the formation of an independent state, at least in this historical period, for Kurds and hence any dominated people to count as truly free. We conclude by attempting to combine certain elements of the anarchist and republican conceptions and offer a synthetic communitarian view that could serve as a better foundation for Kurdish aspirations for liberty. In this paper I unpack a realistic conception of politics by tightly defining its constitutive features: conflict and order. A conflict emerges when an actor is disposed to impose his/her views against the resistance of others. Conflicts are more problematic than moralists realize because they emerge unilaterally, are potentially violent, impermeable to content-based reason, and unavoidable. Order is then defined as an institutional framework that provides binding collective decisions. Order is deemed necessary because individuals need to cooperate to survive, but (...) groups cannot spontaneously secure collective decisions and are prone to conflicts. Particularly, the fact that potentially violent conflicts emerge unilaterally means that order requires coercion. I conclude that mischaracterizing conflict and order leads to undesirable normative principles, and that this criticism can be leveraged not only against Rawlsian liberals who moralize conflicts away, but also against some agonists who underestimate the need for order and some communitarians who underplay both circumstances. ZusammenfassungIn diesem Aufsatz gehe ich der Frage nach, ob der Staat von Migrant*innen fordern darf, sich zu integrieren. Nach einer Erläuterung des Begriffs „Integration“ und der verschiedenen Dimensionen der Integration werde ich ein Argument vorstellen, das zeigt, dass sich auf Grundlage des politischen Liberalismus eine staatliche Forderung nach politischer Partizipation von Migrant*innen begründen lässt. Diese Forderung beruht auf Gerechtigkeits- sowie demokratietheoretischen Überlegungen. Weil die politische Partizipation zugleich eine gewisse strukturelle, soziale und identifikative Integration der Migrant*innen voraussetzt, erstreckt sich die Forderung (...) auch auf diese Voraussetzungen. Da sich die entsprechende Forderung gleichermaßen an Migrant*innen als auch an Einheimische richtet, entgeht die hier vorgestellte Argumentation dem Vorwurf, auf einem bloß partikularen Interesse der einheimischen Bevölkerung zu beruhen, dass sich die Migrant*innen der bzw. einer nationalen Kultur anpassen mögen. Zuletzt diskutiere ich einen Einwand, der sich gegen eine der Prämissen meiner Argumentation richtet. Dieser lautet, dass ein liberaler Staat keinen Einfluss auf die Haltungen und Überzeugungen seiner Bürger*innen nehmen darf. Ich verteidige die Behauptung, dass es auch im liberalen Staat legitim ist, die Bürger*innen zur Demokratie zu erziehen. (shrink)

Realists and supporters of ‘democratic underlabouring’ have recently challenged the traditional separation between political theory and practice. Although both attack Jürgen Habermas for being an idealist whose philosophy is too removed from politics, I argue that this interpretation is inaccurate. While Habermas’s social and political theory is indeed oriented to truth and understanding, he has sought realize his communicative conception of democracy by increasing the quality of political debate as a public intellectual. Building on his approach, I argue that giving (...) the theorist a direct role in public policy undermines theory as an enterprise oriented towards truth while overlooking the contingency, participatory nature and complicated internal logics of social and political practice. My basic thesis is that Habermas’s understanding of the relationship between theory and practice overcomes these difficulties by providing an account of theory that is independent but simultaneously also allows philosophers to participate in politics as public intellectuals. A prevailing understanding of realism, chiefly among its critics, casts realists as those who seek a ‘distinctively political normativity’, where this is interpreted as meaning nonmoral in kind. Moralists, on this account, are those who reject this and believe that political normativity remains moral. Critics have then focused much of their attention on demonstrating that the search for a nonmoral political normativity is doomed to fail which, if right, would then seem to fatally undermine the realist endeavour. This paper makes (...) the case that casting the difference between realism and moralism in these terms is a mistake, one which overlooks the substantial body of realist work which is clear that it has no such aspirations to develop a nonmoral political normativity. The hope is that in drawing attention to this mistake a line can be drawn under these unhelpful debates, and we can move on to more fruitful constructive and critical discussions between realists and their critics. This article argues that political realists have at least two strategies to provide distinctively political normative judgements that have nothing to do with morality. The first ground is instrumental normativity, which states that if we believe that something is a necessary means to a goal we have, we have a reason to do it. In politics, certain means are required by any ends we may intend to pursue. The second ground is epistemic normativity, stating that if something is true, this (...) gives us a reason to believe it. In politics, there are certain empirical regularities that ought to be acknowledged for what they are. Both sources are flawed. Instrumental normativity only requires coherence between attitudes and beliefs, and one can hang on to false beliefs to preserve attitudes incompatible with reality. I may desire to eschew power relations, and accordingly I may imagine politics to be like a camping trip. Epistemic normativity, on the other hand, operates critically, striking down existing normative claims. It shows us that politics is nothing like a camping trip, but it doesn’t tell us what we should do about it. We conclude by showing that if the two are taken together, they remedy each other’s flaws. This article argues that Hannah Arendt’s thought can offer significant insights on political judgement for realism in political theory. We identify a realist position which emphasises the need to account for how humans judge politically, contra moralist tendencies to limit its exercise to rational standards, but which fails to provide a sufficient conception of its structure and potential. Limited appeals to political judgement render the realist defence of the political elusive and compromise the endeavour to offer a meaningful alternative to (...) the moralist tendency to displace politics. The potential and limitations of realist discussions on judgement are made visible in relation to proto-realists Judith Shklar and Isaiah Berlin. In seeking to enrich the realist conception of the political, the article introduces the displacement critique found in the neglected Arendtian ‘realism’. It also provides the foundations for a distinctly realist account of political judgement which, we argue, requires elaboration along two dimensions: the social coding of political judgement and the political capacities that help judgement build a suitable political sphere. Some realists in political theory deny that the notion of feasibility has any place in realist theory, while others claim that feasibility constraints are essential elements of realist normative theorising. But none have so far clarified what exactly they are referring to when thinking of feasibility and political realism together. In this article, we develop a conception of the realist feasibility frontier based on an appraisal of how political realism should be distinguished from non-ideal theories. In this realist framework, political (...) standards are feasible if they meet three requirements: they are politically intelligible, contextually recognisable as authoritative, and contestable. We conclude by suggesting that our conception of realist feasibility might be compatible with utopian demands, thereby possibly finding favour with realists who otherwise refuse to resort to the notion of feasibility. This article argues that populism, cosmopolitanism, and calls for global justice should be understood not as theoretical positions but as appeals to different segments of democratic electorates with the aim of assembling winning political coalitions. This view is called democratic realism: it considers political competition in democracies from a perspective that is realist in the sense that it focuses not first on the content of competing political claims but on the relationships among different components of the coalitions they work to (...) mobilise in the pursuit of power. It is argued that Laclau’s populist theory offers a sort of realist critique of other populists, but that his view neglects the crucial dynamics of political coalition-building. When the relation of populism to global justice is rethought from this democratic realist angle, one can better understand the sorts of challenges each faces, and also where and how they come into conflict. This paper makes the case for a revision of contemporary forms of political realism in political theory. I argue that contemporary realists have gone awry in increasingly centring their approach around a metaethical claim: that political theory should be rooted in a political form of normativity that is distinct from moral normativity. Several critics of realism have argued that this claim is unconvincing. But I suggest that it is also a counterintuitive starting point for realism, and one unnecessary to avoid (...) the ‘applied morality’ approach to political theory that realists oppose. Instead, realism should be methodologically orientated around what I term ‘empirically constitutive political realities’ - enduring features of real political contexts that are systematically consequential in their normative implications. Realists can persuasively argue that such empirically constitutive political realities must be attended to in political theory-building, and not merely treated as a context in which independently formulated moral theories are simply applied. This framing of realism accords real politics a genuinely foundational theoretical role, but without requiring any contentious metaethical stance about a non-moral political normativity. I explain some methodological implications that follow for realism – in particular the need to prioritise empirically grounded theorisation of real political contexts over abstract and rather essentialist claims about ‘the political’. I also argue that such a framing of realism helps engender a more accurate, less divisive, and more pluralist conception of methodological debates within political theory. (shrink)

This article offers a realist interpretation of Tacitus’s analysis of political failure. Tacitus described the early Roman Empire as a balance between the conflicting and irreconcilable values and interests of the emperor, the army, and the senate. For him Stoic-republican morality in itself—without the intervention of a political standard demanding political agency in every circumstance—cannot provide an all-purpose guide to action. He provides a fine-grained analysis of types of political failure, such as failing to act, or to realize one’s limited (...) scope for maneuver, or the inevitability of failure given particular political circumstances. Tacitus also describes Thrasea, a moderate member of the senatorial opposition to Nero, as an exceptionally laudable figure. His preference for moderate politics places Tacitus on the side of contemporary status-quo oriented, liberal, realists (e.g., Bernard Williams), rather than on the side of radical realists (e.g., Raymond Geuss, Enzo Rossi), but the central lesson of his understanding of Roman politics is not so much that political order is fragile as that the cost of political failure can indeed be unbearably high. This article will examine dimensions of Habermas’s work that relate to many realist concerns in political theory. I argue that while he escapes the commonplace caricature of an abstract thinker who is inattentive to real world affairs, Habermas’s claims in relation to communication, historical and empirical context, and (...) the development of rights in history, reveal a narrow consideration of what defines context and a progressivist narrative of history that fails to address seemingly outdated beliefs and political forces. Bentham’s political thought has considerable commonalities with that of the sociologist and political realist Max Weber: both agree that politics is a unique domain of human activity defined by its association with power; that consequently, ethical conduct is unavoidably inflected (...) by power in politics; that a commitment to truth in politics can only ever be contingent; and that politics has a set of basic conditions that it would be not only misguided but dangerous to attempt to transcend. Whilst it is often held that Bentham advanced a reductive framework for understanding politics, in fact, his utilitarianism was a far more realistic approach to political ends and means than has generally been acknowledged, and one that contemporary political theory realists would benefit from taking seriously. Realists criticise the moralised approaches that inform ideal political theory for being unable to handle the brute facts of disagreement that constitute political reality. As a result, such approaches are insufficiently political, too ambitious in terms of the substantive unanimity that can be expected to emerge from political differences, and naive in the proposals they make. In this paper, I use Brian Barry’s ‘moralised‘ approach – as developed in ’Justice as Impartiality’ – to argue that ideal theory can be reformulated (...) to make it capable not only of responding to realist criticisms, but of offering a moralised approach to politics that has significant realist pedigree. As an instance of this pedigree, I argue thus understood, ideal theory can provide us the tools to distinguish between the making of compromises and the acceptance of capitulation and thereby contribute to an understanding of our political worlds. A cryptonormative judgment, roughly speaking, is a judgment that is presented by the agent who makes it as non-normative, but that is in fact normative. The idea of cryptonormativity is familiar from debates in social theory, social psychology, and continental political philosophy, but has to my knowledge never been treated in analytic metaethics, moral psychology or epistemology except in passing. In this paper, I argue, first, that cryptonormative judgments are pervasive: familiar cases from everyday life are most naturally diagnosed as (...) cryptonormative judgments. Secondly, they reveal that normative judgment is a state that can be quite deeply non-transparent to its bearer, in a way that is not, for example, assimilable to the phenomenon of self-deception. Thirdly, they shed light on debates over amoralism and lend some support to a picture of normative psychology that links normative judgment constitutively to motivation. In the conclusion, I make some remarks about the social and political insidiousness of cryptonormativity, looking forward to future work. (shrink)

Many normative political theorists have engaged in the systematic collection and/or analysis of empirical data to inform the development of their arguments over the past several decades. Yet, the approach they employ has typically not been treated as a distinctive mode of theorizing. It has been mostly overlooked in surveys of normative political theory methods and methodologies, as well as by those critics who assert that political theory is too abstracted from actual political contestation. Our aim is to unearth this (...) grounded normative theory (GNT) approach – to identify its definitive practices and highlight its potential significance. We detail four overlapping commitments characteristic of GNT. These include commitments to expanding the comprehensiveness of input for normative arguments through original empirical research and/or analysis, recursivity in the development of normative claims, attentiveness to the systematic inclusion of a range of voices and ways of knowing, and accountability to those engaged by the theorist in empirical contexts. We discuss methodological distinctions within GNT, including between more- and less-solidaristic approaches. We discuss how GNT answers calls for theorists to engage more closely with empirical political dynamics and we consider responses to possible critiques. (shrink)

This paper examines the differences between moralist, realist, and pragmatist approaches to political legitimacy by articulating their largely implicit views of judgment. Three claims are advanced. First, the salient opposition among approaches to legitimacy is not between “moralism” and “realism.” Recent realist proposals for rethinking legitimacy share with moralist views a distinctive form, called “normativism”: a quest for knowledge of principles that solve the question of legitimacy. This assumes that judging legitimacy is a matter of applying such principles to a (...) case at hand. Second, neither Rawls nor Habermas is a normativist about political legitimacy. The principles of legitimacy they proffer claim to express rather than adjudicate the legitimacy of a liberal-democratic regime, and thus cannot solve the question of legitimacy at a fundamental level. But perhaps we should question the normativist aspiration to theoretically resolving the problem to begin with. My third claim is that a “pragmatist” approach enables us to rethink political legitimacy more deeply by shifting focus from the articulation of principles to the activity of judging. Implicit in Rawls’s and Habermas’s theories I then find clues towards an alternative account of judgment, in which the question of legitimacy calls not for theoretical resolution but for ongoing practical engagement. Is realism in political theory compatible with utopianism? This article shows that it is, by reconstructing a highly restrictive realist approach to political theory for guiding legislation and public policy, drawn from the work of Adam Smith, and showing how it can accommodate Piketty’s utopian proposal for a global tax on capital. This shows not only that realism and utopianism are compatible; but how realist and utopian political theory can be carried out in concrete cases. This moves debates to more (...) interesting questions of which forms of utopianism are permissible within which forms of realism; contributes to moving the contemporary realism debates from a Methodenstreit to questions of how it can and ought to be done; and contributes to an important contemporary debate about the permissibility of utopian proposals for political and economic reform in general and Piketty’s proposed global tax on capital in particular.
