In this article, we develop and defend an account of the normative significance of nonhuman animal agency. In particular, we examine how animals’ agency interests impact upon the moral permissibility of our interactions with them. First, we defend the claim that nonhuman animals sometimes have rights to self-determination. However, unlike typical adult humans, nonhuman animals cannot exercise this right through the giving or withholding of consent. This combination of claims generates a puzzle about the permissibility of our interactions with nonhuman (...) animals. If animals sometimes have rights to self-determination, but lack the capacity to consent, then when, if ever, is it permissible for us to touch them, hold them, bathe them, or confine them? In the second half of the article, we develop a solution to this puzzle. We argue that while we cannot obtain animals’ consent, they can engage in authoritative communications of will through acts of “assent” and “dissent.”. (shrink)

There is an apparent connection between reinforcement learning and agency. Artificial entities controlled by reinforcement learning algorithms are standardly referred to as agents, and the mainstream view in the psychology and neuroscience of agency is that humans and other animals are reinforcement learners. This article examines this connection, focusing on artificial reinforcement learning systems and assuming that there are various forms of agency. Artificial reinforcement learning systems satisfy plausible conditions for minimal agency, and those which use models of the environment (...) to perform forward search are capable of a form of agency which may reasonably be called action for reasons. In “Causality and Determination”, Anscombe stressed that, in her view, physical determinism and free action were incompatible. As the relevant passage suggests, her espousal of incompatibilism was not merely due to specific features of human ‘ethical’ freedom, but due to general features of agency, intentionality, and voluntariness. For Anscombe went on to tentatively suggest that lack of physical determination was required for the intentional conduct of animals we would not classify as ‚free‘, too. In this paper, I examine three different (...) lines of argument to establish Anscombe’s latter suggestion, which are based on general considerations about the causal efficacy of psychological-agential phenomena, the nature of agency, and the specific features of intentional agency. I start with Anscombe’s own claim from “The Causation of Action” that microphysical determinism would make psychological and personal phenomena epiphenomenal, before I turn to the view of ‘Agency Incompatibilism’, that genuine agency requires the absence of antecedent necessitation, and, lastly, to concerns about some crucial features of intentional agency which we find in both human and animal agents. Most nonhuman animals live on the terms imposed on them by human beings. This condition of being under the mastery of another, or domination, is what republicanism identifies as political unfreedom. Yet there are several problems that must be solved in order to successfully extend republicanism to animals. Here I focus on the question of whether freedom can be a benefit for individuals without a free will. I argue that once we understand the grounds that make freedom a desirable property (...) of choices, we can see how it is appropriate to predicate it of those made by any sentient agent. (shrink)

Feinberg and Mallatt, in their presentation of neurobiological naturalism, have suggested that visual consciousness was acquired by early vertebrates and inherited by a wide range of descendants, and that its neural basis has shifted to nonhomologous nervous structures during evolution. However, their evolutionary scenario of visual consciousness relies on the assumption that visual consciousness is closely linked with survival, which is not commonly accepted in current consciousness research. We suggest an alternative idea that visual consciousness is linked to a specific (...) class of agency, consequently justifying their phylogenetic claim. We also examine the implication of their phylogenetic claim: visual consciousness is homologous across vertebrates, but its neural basis is not. This apparent incongruence illustrates a general phenomenon of homology, and that the resulting hierarchical view of visual consciousness and its neural basis can be straightforwardly accommodated by neurobiological naturalism. Throughout these discussions, we aim to address the potential theoretical issues in neurobiological naturalism and refine the picture illustrated by Feinberg and Mallatt regarding phylogenetic distribution and trajectories of visual consciousness. If a person's head moves, she may or may not have moved her head, and, if she did move it, she may have actively performed the movement of her head or merely, by doing something else, caused a passive movement. And, if she performed the movement, she might have done so intentionally or not. This short array of contrasts (and others like them) has motivated questions about the nature, variety, and identity of action. Beyond the matter of her moving, when (...) the person moves her head, she may be indicating agreement or shaking an insect off her ear. Should we think of the consequences, conventional or causal, of physical behavior as constituents of an action distinct from but ‘generated by’ the movement? Or should we think that there is a single action describable in a host of ways? Also, actions, in even the most minimal sense, seem to be essentially ‘active’. But, how can we explain what this property amounts to and defend our wavering intuitions about which events fall in the category of the ‘active’ and which do not? (shrink)

This article discusses the problems which concepts pose for the attribution of thoughts to animals. It locates these problems within a range of other issues concerning animal minds (section 1), and presents a ‘lingualist master argument’ according to which one cannot entertain a thought without possessing its constituent concepts and cannot possess concepts without possessing language (section 2). The first premise is compelling if one accepts the building-block model of concepts as parts of wholes – propositions – and the idea (...) that intentional verbs signify relations between subjects and such propositions. But I shall find fault with both (section 3). This opens the way for recognizing a form of ‘holodoxastic’ thought-ascription which does not presuppose concept-possession on the part of the subject (section 4). Section 5 defends this idea against objections. Section 6 turns to the second premise of the lingualist master argument. I press the idea of judgement into service as a label for conceptual thought that need not be linguistic and argue that the possession of concepts is an ability. Section 7 accepts that concept-possession requires the ability to classify rather than merely to discriminate, but suggests that this need not disqualify animals. In the final section I confirm this verdict by returning to the notion of judgement: classification is the deliberate and considered response to a range of options in a sorting or discrimination task. Notwithstanding appearances to the contrary, the capacity for such a response does not presuppose the linguistic ability to answer questions. Judgement is a feature of a type of problem-solving that we share with some non-linguistic creatures. (shrink)

Many epistemologists have recently defended views on which all evidence is true or perceptual reasons are facts. On such views a common account of basic perceptual reasons is that the fact that one sees that p is one’s reason for believing that p. I argue that that account is wrong; rather, in the basic case the fact that p itself is one’s reason for believing that p. I show that my proposal is better motivated, solves a fundamental objection that the (...) received view faces, and illuminates the nature of reasons for belief. (shrink)

This essay argues that nonlinguistic animals qualify not just for externalist notions of rationality (maximizing biological fitness or utility), but also for internal ones. They can act for reasons in several senses: their behaviour is subject to intentional explanations, they can act in the light of reasonsprovided that the latter are conceived as objective facts rather than subjective mental statesand they can deliberate. Finally, even if they could not, it would still be misguided to maintain that animals are capable only (...) of (mechanical) behaviour, not of (intentional) action. (shrink)

We discuss whether affordances can be reasons, against the background of two interlocked considerations: (1) While the problematic degree of idealization in accounts of reasons that treat them as mental states speaks in favor of the alternative view which treats them as facts, a cognitive consideration relationship is still required to account for the motivating role of reasons. (2) While recent enactive accounts of cognition hold promise to avoid over-intellectualization of acting for reasons, these are so far either underdeveloped or (...) treat reasons as mental states after all. Considering affordances as reasons promises to strengthen the enactivist project. We first motivate factualism about reasons, then introduce enactivism and finally discuss whether affordances can play the three roles of explanatory, justifying and motivating reasons. Since we do not take this discussion to be exhaustive but rather as outlining a research program, we point to desiderata for further work. (shrink)

On expectation, most wild animals have lives of net suffering due to naturogenic causes. Some have claimed that concern for their well-being gives us reasons to intervene in nature on their behalf. Against this, it has been said that many interventions to assist wild animals would be wrong, even if successful, because they would violate their freedom. According to the Freedom-based Approach I defend in this paper, this view is misguided. Concern for wild animal freedom does indeed gives us reasons (...) to secure these animals against control-undermining interferences, but also to intervene in nature in order to enrich their choices. This paper considers the question of whether there is a human-animal or ‘anthropological difference'. It starts with a historical introduction to the project of philosophical anthropology. Section 2 explains the philosophical quest for an anthropological difference. Sections 3-4 are methodological and explain how philosophical anthropology should be pursued in my view, namely as impure conceptual analysis. The following two sections discuss two fundamental objections to the very idea of such a difference, biological continuity and Darwinist anti-essentialism. Section 7 discusses various (...) possible responses to this second objection - potentiality, normality and typicality. It ends by abandoning the idea of an essence possessed by all and only individual human beings. Instead, anthropological differences are to be sought in the realm of capacities underlying specifically human societies. The final section argues that if there is such a thing as the anthropological difference, it is connected to language. But it favours a more modest line according to which there are several anthropological differences which jointly underlie the gap separating us from our animal cousins. (shrink)

Do animals have minds? We have known at least since Aristotle that humans constitute one species of animal. And some benighted contemporaries apart, we also know that most humans have minds. To have any bite, therefore, the question must be restricted to non-human animals, to which I shall henceforth refer simply as "animals." I shall further assume that animals are bereft of linguistic faculties. So, do some animals have minds comparable to those of humans? As regards that question, there are (...) two basic stances. Differentialists maintain that there are categorical differences separating us from animals; assimilationists hold that the differences are merely quantitative and gradual (see Brandom 2000, pp. 2–3). This paper only deals with one kind of mental phenomenon, namely intentional states such as believing, desiring, and intending. I shall also refer to these as having thoughts or thinking rather than as "propositional attitudes," since that terminology is misguided. My primary target is a variant of differentialism, namely lingualism. It maintains that animals lack intentional states such as beliefs, desires, and intentions, since, on a priori conceptual grounds, the latter require language. The term "language" is here confined to public languages, notably natural languages, and excludes inner symbolisms such as the language of thought postulated by many cognitive scientists. (shrink)

In a number of articles, Hans-Johann Glock has argued against the »lingualist« view that higher mental capacities are a prerogative of language-users. He has defended the »assimilationist« claim that the mental capacities of humans and of non-human animals differ only in degree. In the paper under discussion, Glock argues that animals are capable of acting for reasons, provided that reasons are construed along the lines of the new »objectivist« theory of practical reasons. The paper critizices these views.

I first clarify the idea that blameworthiness requires consciousness as the view that one can be blameworthy only for what is a response to a reason of which one is conscious. Next I develop the following argument: blameworthiness requires exercising control in a way distinctive of persons and doing this, in view of what it is to be a person, requires responding to a reason of which one is conscious. Then I defend this argument from an objection inspired by Arpaly (...) and Schroeder according to which responding to moral reasons suffices for exercising control distinctive of persons. (shrink)

When it is considered to be in their best interests, withholding and withdrawing life-supporting treatment from non-competent physically ill or injured patients – non-voluntary passive euthanasia, as it has been called – is generally accepted. A central reason in support of the procedures relates to the perceived manner of death they involve: in non-voluntary passive euthanasia death is seen to come about naturally. When a non-competent psychiatric patient attempts to kill herself, the mental health care providers treating her are obligated (...) to try to stop her. Yet it has been suggested that death by suicide can be a part of the natural course of a severe mental illness. Accordingly, if the perceived naturalness of the deaths occurring in connection with non-voluntary passive euthanasia speaks for their moral permissibility, it could be taken that a similar reason can support the moral acceptability of the suicidal deaths of non-competent psychiatric patients. In this article, I consider whether the suicidal death of a non-competent psychiatric patient would necessarily be less natural than those of physically ill or injured patients who die as a result of non-voluntary passive euthanasia. While differentialists deny that non-linguistic animals can have a sense of justice, assimilationists credit some animals with such an advanced moral attitude. We approach this debate from a philosophical perspective. First, we outline the history of the notion of justice in philosophy and how various facets of that notion play a role in contemporary empirical investigations of justice among humans. On this basis, we develop a scheme for the elements of justice-relevant situations and for criteria of justice that should be (...) fruitful in studying both humans and animals. Furthermore, we investigate the conceptual connections between a sense of justice, on the one hand, and various other mental powers, on the other, and indicate which of the latter may be beyond the ken of animals. Next, we consider recent empirical research on justicerelated phenomena in animals. We argue for an intermediate position: While animals can at least in principle satisfy some preconditions of justice (intentional action, rulefollowing), others are problematic, notably possessing a notion of desert. A space for justice in social animals exists, yet it is rather limited compared to the rich cultures of justice in humans. Finally, we reflect on some actual or alleged implications of research on animal justice. As regards justice in humans, one should avoid a simplistic image of ‘‘natural justice’’ as boiling down to equal allocation of goods. As regards justice for animals, one should be weary of the contractualist assumption that only those capable of justice themselves are deserving of ‘‘just’’ treatment. (shrink)
