I criticize two ways of interpreting Kant's claim that property rights are merely ‘provisional’ in the state of nature.Weak provisionalityholds that in the state of nature agents can make rightful claims to property. What is lacking is the institutional context necessary to render their claims secure. By contrast,strong provisionalityholds that making property claims in the state of nature wrongs others. I argue for a third view,anticipatory provisionality, according to which state of nature property claims do not wrong others, but anticipate (...) a condition in which the authority to make such claims can no longer be unilaterally determined. For years business ethics has limited the moral duties of enterprises to negative duties. Over the last decade it has been argued that positive duties also befall commercial agents, at least when confronted with large scale public problems and when governments fail. The argument that enterprises have positive duties is often grounded in the political nature of commercial life. It is argued that agents must sometimes take over governmental responsibilities. The German republican tradition argues along these lines as does Nien-Hé (...) Hsieh. Agents in commercial life are bound by positive duties because at some point they become citizens that must take on the responsibilities of the state. In this paper we leave undisputed the claim that corporations must acknowledge positive duties. However, we demonstrate that the political grounding fails, at least in the sense that this theory insufficiently acknowledges a long standing liberal tradition that vindicates apolitical markets and clear borderlines between politics and economics. We carve out an alternative route to the grounding of one specific positive duty—the duty to further justice. Our argument is based on the moral nature of commercial agents and tries to demonstrate that the duty to further justice ensues from liberalism. Taking a Kantian perspective, it conceptualizes the duty to further justice as a moral duty, orientated toward the political domain. It is grounded in the obligation to attain moral autonomy in the civil condition. (shrink)

Environmental philosophers have argued that Kant’s philosophy offers little for environmental issues. Furthermore, Kant scholars typically focus on humanity, ignoring the question of duties to the environment. In my dissertation, I turn to a number of underexploited texts in Kant’s work to show how both sides are misguided in neglecting the ecological potential of Kant, making the case for the green Kant at the intersection of Kant scholarship and environmental ethics. I build upon previous literature to argue that the green (...) Kant matters for both sides. Rather than a liability, Kant is indeed a conceptual resource. Though many conceive of Kant’s philosophy as environmentally problematic, I argue that underappreciated evolutionary, aesthetic, and holistic sides of Kant’s philosophy can provide conceptual resources for issues in climate change and environmental ethics. Some aspects, such as the pre-critical view of nature, are quite green and merely require an application, while others, such as Kant’s philosophy of history, require a green appropriation to be relevant. The theoretical foundations I develop in these texts will allow Kantians to articulate duties regarding nature and duties for sustainability. This re-thinking of Kant redresses the complaints environmental thinkers hold against Kant. By means of a philosophical interpretation, defense, and application of particular texts from Kant’s works such as Universal Natural History, Critique of Judgment, and Idea for a Universal History, I show how the greening of Kant is not only helpful for contemporary issues, but also defensible. This will make the green Kant agreeable to Kant scholars yet all the while relevant for today with regard to environmental ethics and, more importantly, climate change. (shrink)

Although the “Transcendental Aesthetic” is the briefest part of the first Critique, it has garnered a lion's share of discussion. This fact reflects the important implications that Kant drew from his arguments there. He used the arguments concerning space and time to display examples of synthetic a priori cognition, to secure his division between intuitions and concepts, and to support transcendental idealism. Earlier, in the years around 1770, Kant's investigations into space and time had facilitated his turn toward “critical” philosophy. (...) Prior to that time, Kant's main interests in space and time pertained to physics and metaphysics. As he entered the critical period, he delved into the cognitive basis of our experience of space (and time), and drew his conclusions about their ideality. Kant's doctrines of space and time provoked extensive response in his own time and throughout the nineteenth century. These responses variously concerned the metaphysics, physics, epistemology, psychology, and geometry of space. Throughout the nineteenth century, philosophers, physiologists, and psychologists sought to extend or to refute Kant's theories of space. By the last decades of the nineteenth century, many had rightly concluded that the existence of non-Euclidean geometry as a candidate description of physical space refuted Kant's full doctrine of space - though some have hoped that his position might be saved by restricting it to “visual space.”.
