For much of the first fifty years of its existence, analytic philosophy shunned discussions of normativity and ethics. Ethical statements were considered as pseudo-propositions, or as expressions of pro- or con-attitudes of minor theoretical significance. Nowadays, in contrast, prominent analytic philosophers pay close attention to normative problems. Here we focus our attention on the work of Searle, at the same time drawing out an important connection between Searle’s work and that of two other seminal figures in this development: H.L.A. Hart (...) and John Rawls. We show that all three thinkers tend to assume that there is but one type of normativity within the realm of social institutions – roughly, the sort of normativity that is involved in following the results of chess – and that they thereby neglect features that are of crucial significance for an adequate understanding of social reality. A recalcitrant emotion is an emotion that we experience despite a judgment that seems to conflict with it. Having been bitten by a dog in her childhood, Jane cannot shake her fear of dogs, including Fido, the cute little puppy that she knows to be in no way dangerous. There is something puzzling about recalcitrant emotions, which appear to defy the putatively robust connection between emotions and judgments. If Jane really believes that Fido cannot harm her, what is she afraid (...) of? This article seeks to show how recalcitrant emotion is possible. I argue that reductive theories that identify emotions with judgments, desires, or some combination thereof, cannot explain the possibility of emotional irrationality without contradiction. I then show that the appeal to sui generis attitudes also fails to solve the puzzle of recalcitrant emotions, and diagnose this failure as stemming from a misleading analogy between emotions and perceptions, and in particular, between recalcitrant emotions and perceptual illusions. The solution can be found in a different analogy: between emotions and actions; more specifically, between recalcitrant emotions and weakness of the will, akrasia. Like akratic actions, recalcitrant emotions entail responding to reasons, but to inferior reasons. Irrational but non-contradictory emotions are possible just as weakness of will is possible. : Two common ways of explaining akrasia will be presented, one which focuses on strength of desire and the other which focuses on action issuing from practical judgment. Though each is intuitive in a certain way, they both fail as explanations of the most interesting cases of akrasia. Spinoza 's own thoughts on bondage and the affects follow, from which a Spinozist explanation of akrasia is constructed. This account is based in Spinoza 's mechanistic psychology of cognitive affects. Because Spinoza (...) 's account explains action asissuing from modes of mind that are both cognitive and affective, it captures the intuitions that motivate the two traditional views while avoiding the pitfalls that result from their one‐sided approaches. This project will allow us a fuller understanding of Spinozist moral psychology. In addition to this historical value, the Spinozist theory may offer a satisfactory explanation of certain hard cases of akrasia while avoiding the problems be set by other theories. For this reason, the Spinozist account could also be seen as a useful contribution to our philosophical understanding of the phenomenon of akrasia. (shrink)

This article shows how the social sciences rejected hard determinism by the mid-twentieth century largely on the deontological basis that it is irreconcilable with social justice, yet this rejection came just before a burst of creative development in consequentialist theories of social justice that problematize a facile rejection of determinism on moral grounds, a development that has seldom been recognized in the social sciences. Thus the current social science view of determinism and social justice is antiquated, ignoring numerous common and (...) well-respected arguments within philosophy that hard determinism can be reconciled with a just society. We support this argument by briefly tracing the parallel development of stances on determinism in the social sciences and the deontological-consequentialist debate in philosophy. The article concludes with a brief consideration of deterministic consequentialist ethics, social justice, and the problems of egoism and altruism. (shrink)

Moral particularists argue that because reasons for action are irreducibly context-dependent, the traditional quest in ethics for true and exceptionless moral principles is hopelessly misguided. In making this claim, particularists assume a general framework according to which reasons are the ground floor normative units undergirding all other normative properties and relations. They then argue that there is no cashing out in finite terms either (i) when a given non-normative feature gives rise to a reason for or against action, or (ii) (...) how the reasons that are present in a given context play off each other to determine one’s overall duties. However, the conjunction of these two theses leaves particularists without a coherent notion of a reason for action: posit too much irreducible context-dependence in the behavior of reasons, and the reasons-based framework breaks down. One upshot is that the particularists’ challenge to principle-based approaches to ethics has not, at present, been successfully made out; another upshot is that perhaps the best way to formulate that challenge involves renouncing the reasons-based framework all together. An increasing number of moral realists and anti-realists have recently attempted to support their views by appeal to science. Arguments of this kind are typically criticized on the object-level. In addition, however, one occasionally also comes across a more sweeping metatheoretical skepticism. Scientific contributions to the question of the existence of objective moral truths, it is claimed, are impossible in principle; most prominently, because such arguments impermissibly derive normative from descriptive propositions, such arguments beg the question against non-naturalist moral realism, (...) science cannot inform conceptual accounts of moral judgements, and the conceptual is logically prior to the empirical. My main aim in this paper is to clarify and critically assess these four objections. Moreover, based on this assessment, I will formulate four general requirements that science-based arguments in favor of moral realism and anti-realism should meet. It will turn out that these arguments are limited in several ways, and that some existing arguments have been unsound. Yet it is still possible in principle for the empirical sciences to contribute to the moral realism/anti-realism debate. (shrink)

In this paper, I present the results of an experimental study on intuitions about moral obligation (ought) and ability (can). Many philosophers accept as an axiom the principle known as “Ought Implies Can” (OIC). If the truth of OIC is intuitive, such that it is accepted by many philosophers as an axiom, then we would expect people to judge that agents who are unable to perform an action are not morally obligated to perform that action. The results of my experimental (...) study show that participants were more inclined to judge that an agent ought to perform an action than that the agent can perform the action. Overall, participants said that an agent ought to perform an action even when they said that the agent cannot do it. I discuss the implications of these results for the debate over OIC. (shrink)

Philosophy and its descendents in the behavioral sciences have traditionally divided incentives into those that are sought and those that are avoided. Positive incentives are held to be both attractive and memorable because of the direct effects of pleasure. Negative incentives are held to be unattractive but still memorable (the problem of pain) because they force unpleasant emotions on an individual by an unmotivated process, either a hardwired response (unconditioned response) or one substituted by association (conditioned response). Negative incentives are (...) divided into those that are always avoided and those that are avoided only by higher mental processes—archetypically the passions, which are also thought of as hardwired or conditioned. Newer dichotomies within the negative have been proposed, hinging on whether a negative incentive is nevertheless sought (“wanted but not liked”) or on an incentive's being negative only because it is confining (the product of “rule worship”). The newer dichotomies have lacked motivational explanations, and there is reason to question conditioning in the motivational mechanism for the older ones.

Both experimental findings and the examination of common experience indicate that even the most aversive experiences, such as pain and panic, do not prevail in reflex fashion, but because of an urge to attend to them. The well-established hyperbolic curve in which prospective rewards are discounted implies a mechanism for such an urge, as well as for the “lower” incentives in the other dichotomies. The properties of these lower incentives are predicted by particular durations of temporary preferences on a continuum that stretches from fractions of a second to years. (shrink)

Recently there has been a somewhat surprising interest among Kantian theorists in the moral standing of animals, coupled with a no less surprising optimism among these theorists about the prospect of incorporating animal moral standing into Kantian theory without contorting its other attractive features. These theorists contend in particular that animal standing can be incorporated into Kantian moral theory without abandoning its logocentrism: the claim that everything that is valuable depends for its value on its relation to rationality. In this (...) essay I raise doubts about the prospects for accommodating animal moral standing within a logocentric Kantianism. I argue instead that the best way to incorporate animal moral standing into Kantian theory is to admit more radical departures from Kant’s position by maintaining that consciousness is a locus of moral standing independent from rationality. I propose that we should attribute moral standing to all conscious animals because the capacity of consciousness is the criterion distinguishing individuals whose well-being generates reasons from individuals whose well-being fails to do so. We need such a criterion because we speak of the well-being of things, such as artifacts and meteorological phenomena, which clearly lack moral standing. Having already argued against the Kantian view that the criterion of moral standing is rationality, I proceed to argue that consciousness is also superior to its other principal rival for the criterion of moral standing: life. On the view that emerges from this discussion, we have obligations to show concern for conscious individuals by treating their well-being as providing us with reasons for action; the view thus endorses the criterion of moral standing typically advanced by utilitarians. On this view we also have a distinct class of obligations to show respect for conscious rational individuals; the view thus endorses the Kantian claim that persons have a distinctive moral status in virtue of their possession of rational capacities. In this essay thus begin to show how a principal insight of each leading approach to modern moral theory may be captured in a unified theory. (shrink)

Although irrationality always presupposes rationality, I think there are good arguments to claim that sometimes rationality presupposes irrationality.This paper tries to show how irrational action can support rationality in two ways: it can develop and preserve rationality. I also argue that sometimes the development and the conservation of rationality can only be realized by irrational action.

Many philosophers claim that it cannot be the case that a person ought to perform an action if this person cannot perform this action. However, most of these philosophers do not give arguments for the truth of this claim. In this paper, I argue that it is plausible to interpret this claim in such a way that it is entailed by the claim that there cannot be a reason for a person to perform an action if it is impossible that (...) this person will perform this action. I then give three arguments for the truth of the latter claim, which are also arguments for the truth of the former claim as I interpret it. (shrink)

What is required for one thing to be a reason for another? Must the reason, more precisely, be or involve a principle? In this essay I target the idea that justification via reasons of one's beliefs (e.g., epistemic or moral) requires that the 'justifying reasons' be or involve (substantive and significant) principles. I identify and explore some potential sources of a principles requirement, and conclude that none of them (i.e., the normative function of reasons, the abstract structure of reasons, the (...) universalizability constraint on [moral] reasons, and even the pragmatic considerations that attenuate 'real-world' reason-giving) mandate that reasons be principles. I then explore implications of this conclusion, and note especially the resultant and paradoxical permissibility of justifying reasons that manage to be lawlike (a sine qua non for justifying reasons) even while consisting of highly-detailed and situation-specific proposition sets, e.g., novel-length narratives. The article offers a review and analysis of the discussion on the principle of universalizability at its initial stage. The author determines the theoretical roots and key points of the discussion and reveals the directions of controversy and the position of researchers. In particular, the problem field depends on the divergence of the ethical and logical aspects of the principle of universalizability. As a result, two areas of discussion are formed: 1) the search for an ethical interpretation of the principle (...) of universalizability, 2) an analysis of the principle of universalizability in its relation to the ethical idea of the action. The author proposes the semantic models of the principle of universalizability designed to turn it into a substantive moral principle. These models are based on ideas: a) impartiality, b) justice, c) equality. The models of harmonization of universal normativity and moral experience, law and action are designed to protect the idea of universalizability from accusations of formalism and dogmatism. The grounds and vulnerabilities of the proposed semantic models of the principle of universalizability are examined and the possibility of harmonizing law and action is analyzed. The understanding of universalizability in analytic philosophy is metaphysical. Within the limits of the metaphysical understanding of universality, the problem of harmonizing the universal law and the idea of individuality cannot be solved. A possible way of solving the problem is an appeal to such a concept of universality in which the idea of universality can be reconciled with the idea of the individual freedom. (shrink)

I argue that the distinction which is current in much writing on medical ethics between autonomous and non-autonomous patients cannot cope comfortably with weak-willed patients. I describe a case involving a patient who refuses a blood transfusion even though he or she agrees that it would be in his or her best interests. The case is discussed in the light of the treatment of autonomy by B Brody and R Gillon. These writers appear to force us to treat an incontinent (...) patient either as autonomous, just like a rational agent whose decisions are in accordance with his beliefs or as non-autonomous, like comatose patients or children. Though neither is entirely satisfactory I opt for describing such patients as autonomous but point out that in cases like this the principle of respect for autonomy does not give a determinate answer about how the patient ought to be treated. In this paper, I analyzed the discussion on the principle of universalizability which took place in moral philosophy in 1970–1980s. In short, I see two main problems that attracted more attention than others. The first problem is an opposition of universalizability and generalization. M.G. Singer argued for generalization argument, and R.M. Hare defended universalizability thesis. Hare tried to refute Singer’s position, using methods of ordinary language philosophy, and claimed that in ethics generalization is useless and misleading. I have examined Singer’s (...) defense and concluded that he was right and Hare was mistaken. Consequently, generalization argument is better in clarification of the relationship between universality and morality than Hare’s doctrine of universalizability, and hence the universality of moral principles is not incompatible with the existence of exclusions. The second problem is the substantiation of the application of categorical imperative in the theory of relevant act descriptions and accurate understanding of the difference between maxims and non-maxims. In Generalization in Ethics, Singer drew attention to this theme and philosophers have proposed some suggestions to solve this problem. I describe ideas of H.J. Paton, H. Potter, O. O’Neill and M. Timmons. Paton coined the teleological-law theory. According to Potter, the best criterion for the relevant act descriptions is causal one. O’N eill suggested the inconsistency-of-intention theory. Timmons defended the causal-law theory. My claim is that the teleological-law theory and the causal-law theory fail to solve the relevant act descriptions problem and the causal criterion and the inconsistency-of-intention theory have their limits. From this, I conclude that these approaches cannot be the basis for clarifying the connection between universality and morality, in contrast to Singer’s approach, which, therefore, is better than others to clarify the nature of universality in morality. The paper aims at meeting Blackburn’s challenge to explain the non-reductive supervenience of moral predicates on natural ones. It offers a critical examination of Hare’s model of moral thinking which can be used as a candidate for such an explanation. It is argued that, as it stands, Hare’s model fails to meet Blackburn’s challenge. Yet some revisions of the model are suggested, and it is claimed that the improved version does supply the required explanation. The model suggested in the paper (...) carries a meta-ethical implication concerning the superiority of the anti-realist understanding of moral discourse. (shrink)

In this thesis I am going to explore the relationship between happiness and imprisonment. I will discuss three theories of happiness - hedonism, life satisfaction theories and emotional states theories. I will argue that the main problem of these theories is that they take happiness to consist only of psychological states. Because of this, I will turn my attention towards those theories that evaluate happiness in terms of how well life is going for the person who is living it. I (...) will argue that my Aristotelian account is the most plausible way to understand the relationship between happiness and imprisonment. This is because it takes into account both the external circumstances and the psychological and emotional life of pnsoners. Through this thesis, I will show that my account of happiness in prison accomplishes three tasks: i) it solves the problems encountered by the other theories of happiness in the evaluation of prisoners' happiness, ii) it does not suffer from two of the main objections to the other objectivist theories of happiness, and iii) it can help us to investigate the happiness of prisoners empirically more accurately. The so-called ‘central problem’ of internalism has been formulated like this: one cannot concurrently maintain the following three philosophical positions without inconsistency: internalism about practical reason, moral rationalism, and moral absolutism. Since internalism about practical reason is the most controversial of these, the suggestion is that it is the one that is best abandoned. In this paper, I point towards a response to this problem by sketching a deontic logic of internal reasons that deflates moral normativity to the normativity of (...) instrumental rationality, and provides support for the assertion that one can hold fast simultaneously to internalism and at least many of the intuitive commitments of liberal moral thinking. Crucial to the proposal is an account of the enkratic principle – I ought to attempt to realise what I ultimately desire – as the source of obligations we owe to ourselves. I attempt to show how from this, in conjunction with some plausible assumptions, obligations to others might be derived. (shrink)

We call actions right and wrong, teachers wise and ignorant, and pictures elegant and grotesque. Philosophers place evaluative concepts into two camps. Thin concepts, such as goodness and badness, and rightness and wrongness (...) have evaluative content, but they supposedly have no or hardly any nonevaluative, descriptive content: they supposedly give little or no specific idea about the character of the person or thing described. In contrast, thick concepts such as kindness, elegance and wisdom supposedly give a more specific idea of people or things. Yet, given typical linguistic conventions, thick concepts also convey evaluation. Kind people are often viewed positively whilst ignorance has negative connotations. The distinction between thin and thick concepts is frequently drawn in philosophy and is central to everyday life. However, very few articles or books discuss the distinction. In this full-length study, Simon Kirchin discusses thin and thick concepts, highlighting key assumptions, questions and arguments, many of which have gone unnoticed. Kirchin focuses in on the debate between 'separationists' and 'nonseparationists'. Thick Evaluation argues for a version of nonseparationism, and in doing so argues both that many concepts are evaluative and also that evaluation is not exhausted by thin positive and negative stances.
