It is conventional wisdom that appreciating the role of luck in our moral lives should make us more sparing with blame. But views of moral responsibility that allow luck to augment a person’s blameworthiness are in tension with this wisdom. I resolve this tension: our common moral luck partially generates a duty to forgo retributively blaming the blameworthy person at least sometimes. So, although luck can amplify the blame that a person deserves, luck also partially generates a duty not to (...) give the blameworthy person the retributive blame that he deserves at least sometimes. Is the idea of the voluntary important? Those who think so tend to regard it as an idea that can be metaphysically deepened through a theory about voluntary action, while those who think it a superficial idea that cannot coherently be deepened tend to neglect it as unimportant. Parting company with both camps, I argue that the idea of the voluntary is at once important and superficial—it is an essentially superficial notion that performs important functions, but can only perform them (...) if we refrain from deepening it. After elaborating the contrast between superficial and deepened ideas of the voluntary, I identify the important functions that the superficial idea performs in relation to demands for fairness and freedom. I then suggest that theories trying to deepen the idea exemplify a problematic moralization of psychology—they warp psychological ideas to ensure that moral demands can be met. I offer a three-tier model of the problematic dynamics this creates, and show why the pressure to deepen the idea should be resisted. On this basis, I take stock of what an idea of the voluntary worth having should look like, and what residual tensions with moral ideas this leaves us with. (shrink)

The received view is that Kant denies all moral luck. But I show how Kant affirms constitutive moral luck in passages concerning radical evil from Religion within the Boundaries of Mere Reason. First, I explicate Kant’s claims about radical evil. It is a morally evil disposition that all human beings have necessarily, at least for the first part of their lives, and for which they are blameworthy. Second, since these properties about radical evil appear to contradict Kant’s even more famous (...) claims about imputation, ‘ought implies can’, and free will, I unpack Henry Allison’s proof of radical evil and show how it is consistent with interpretations of Kant’s broader views about morality. Third, I define and illustrate the category of constitutive moral luck and argue that Kant embraces the existence of constitutive moral luck given Allison-style interpretations of radical evil. This provides a reason for philosophers to reject the received view, and it creates an occasion for Kantians and Kant scholars to check their reasons if they deny moral luck. (shrink)

The received view of Kant’s moral philosophy is that it precludes all moral luck. But I offer a plausible interpretation according to which Kant embraces moral luck in circumstance and constitution. I interpret the unconditioned nature of transcendental freedom as a person’s ability to do the right thing no matter how she is inclined by her circumstantial and constitutive luck. Philosophers often consider problems of free will and moral luck in isolation from one another, but both are about control and moral responsibility. One problem of free will concerns the difficult task of specifying the kind of control over our actions that is necessary and sufficient to act freely. One problem of moral luck refers to the puzzling task of explaining whether and how people can be morally responsible for actions permeated by factors beyond their control. This chapter explicates and (...) assesses skeptical, compatibilist, and libertarian approaches to moral luck. First, I argue that what makes the above problems of free will and moral luck distinct is largely their emphasis on different kinds of luck. Second, I describe and evaluate skeptical arguments from constitutive and circumstantial luck that it is impossible to act freely. Third, I explicate and assess various support and implication relationships between various kinds of compatibilism and libertarianism, on the one hand, and causal, constitutive, circumstantial, and resultant moral luck, on the other. Proceeding from the assumptions that forgiveness is at least sometimes elective and that it changes the normative relations between victims and wrongdoers, this paper argues that our practices of forgiveness are subject to an overlooked form of moral luck, forgiveness-luck. Forgiveness-luck is introduced via reflection on ‘differential forgiveness’, wherein of two equally culpable and remorseful agents, one is forgiven and the other not, and both justifiably so. In being forgiven—at least if forgiveness is normatively significant— one undergoes a positive alteration (...) in one’s moral status, i.e., a positive alteration in one’s permissions, obligations, or interpersonal reasons that is implied by one’s being the target of a positive moral responsibility-response. It is also illustrated how responsibility-responses other than forgiveness are candidate determinates of one’s moral status. As such, this paper outlines a capacious conception of moral luck, according to which moral statuses beyond blameworthiness (and praiseworthiness) are determinable by factors beyond one’s control. The capacious conception avoids rendering the existence of moral luck a trivial matter (as it preserves the distinction between moral luck and morally significant plain luck) and—at least if moral responsibility is understood in terms of accountability— preserves continuity with narrower conceptions of moral luck. The aims of this paper are fourfold. The first aim is to characterize two distinct forms of circumstantial moral luck and illustrate how they are implicitly recognized in pre-theoretical moral thought. The second aim is to identify a significant difference between the ways in which these two kinds of circumstantial luck are morally relevant. The third aim is to show how the acceptance of circumstantial moral luck relates to the acceptance of resultant moral luck. I argue that the phenomenon underlying Bernard Williams’ (1976) “agent-regret” is considerably broader than appreciated by Williams and others. Agent-regret— an anguished response that agents have for harms they have caused, even if faultlessly— I maintain, is a species of a more general response to harms that need not be one’s fault, but which nonetheless impact one’s practical identity in a special way. This broader genus includes as a species what I call “relation-regret”, a pained response to harm caused by (...) a person to whom one is intimately related, as a co-member of a group partly constitutive of one’s practical identity (e.g. one’s family). After providing an account of the moral psychology of relation-regret, I attend to its normative significance, proposing in particular that acceptance of relation-regret provides us with reasons for accepting a novel form of moral luck, namely associative luck: the luck of being vulnerable to responsibility-responses in virtue of one’s attachments to others, despite one’s personal faultlessness. Philosophical discussion of gratitude tends to emphasize the way in which the emotion is responsive to manifestations of benevolence (or good will). In some cases, however, gratitude ‘grows’—or increases in strength— across time, in ways that are intuitively fitting but unaccounted for by gratitude’s sensitivity to benevolence. To make sense of this kind of gratitude-growth, I argue that there are conditions in which manifestations of benevolence— particularly, benevolent hopes—can rationally accommodate the unforeseen and unintended outcomes to which they give rise, (...) rendering fitting a greater degree of gratitude than was fitting in response to the original manifestation of benevolence. According to some, luck forms an inevitable part of admirable moral agency. According to others, it is incompatible with a basic principle of moral worth. What's the issue? Is there a ‘problem’ of moral luck; or are there many, or none? With reference to the practice of moral praise, I suggest that there is no single problem of moral luck as traditionally understood. Instead, there is a family of issues regarding the interpretation and assessment of moral performance. In the background (...) is a mixture of descriptive and normative issues, including how to understand the legitimacy of social expectations, the value of effort, and the duties of communities to enable their members to live good and virtuous lives. The present article studies Bernard Williams’s view on moral responsibility using an analytical-critical approach. The discussion of moral responsibility includes the definition, conditions, and problem of moral responsibility. In Western philosophical texts, moral responsibility refers to the praise and blame of the agent by himself or others for an act he has committed. This is while, according to our moral appetites and the theories based on them such as Kant’s, moral responsibility is conditioned on free action and every healthy human (...) being has the capacity for moral understanding, the ability to act accordingly and to deserve moral praise and blame for one’s actions as they all equally benefit from reason and free-will. Thus, the foundation of moral responsibility is empirical and safe from factors beyond control, that is, luck. In addition, the problem of moral responsibility is the conflict of free-will or freedom and determinism, and different philosophers have theorized regarding the three approaches of compatibility, incompatibility, and impossibility. Bernard Williams, a great philosopher on ethics with an Aristotelian influence - though he does not seem to define moral responsibility as opposed to what has been mentioned - offers a completely different view of the conditions and problem of moral responsibility and challenges our moral intuitions and theories such as Kant’s and distinguishes between morality and ethics. He considers voluntary action to be the result of deliberation and intention but by innovating the term moral luck and relying on it, he even considers human voluntary action to be influenced by constitutive luck and resultant luck. Therefore, by violating a completely voluntary act, he breaks the relation between freedom and moral responsibility and considers moral responsibility to be superficial or dependent on the concept of luck and gives it an empirical basis. Faced with the problem of moral responsibility, he criticizes compatibilists and incompatibilists in three ways. According to Williams, there is a misunderstanding in the concept of blame used by compatibilists and incompatibilists. In addition, compatibilists must compromise between determinism, psychological concepts, and moral responsibility. Also, the compatibilists do not pay attention to the difference between what free-will is and the will we have. On the other hand, incompatibilists have used determinism in the sense of fatalism. Finally, the incompatibilist view fails to establish a relationship between choice, intention, and action. By claiming a compatibilist view that is safe from these problems, Williams argues that there is a compromise between the above-mentioned items if we separate ourselves from our moral intuitions and the present ethics. This article explains Williams’ moral responsibility, with an introduction to Williams and moral responsibility. It then describes Williams’ compatibilism while also expresses his critique of compatibilism and incompatibilism. Finally, by assessing Williams’s view, it concludes it to be a truly deterministic view that violates freedom and moral responsibility and the basis of its evidence and arguments as weak. For this reason, it is difficult and indefensible to accept it. (shrink)
