Maxims play a crucial role in Kant's ethical philosophy, but there is significant disagreement about what maxims are. In this two-part essay, I survey eight different views of Kantian maxims, presenting their strengths, and their weaknesses. Part I: Established Approaches, begins with Rüdiger Bubner's view that Kant took maxims to be what ordinary people of today take them to be, namely pithily expressed precepts of morality or prudence. Next comes the position, most associated with Rüdiger Bittner and Otfried Höffe, that (...) maxims are Lebensregeln, or 'life-rules'– quite general rules for how to conduct oneself based on equally general outlooks on how the world is. These first two interpretations make sense of Kant's claim, made in his anthropological and pedagogical writings, that we have to learn how to act on maxims, but they become less plausible in light of Kant's probable view that people always act on maxims – after all, how can people learn how to act on something they always act on anyway? The next two views, each advanced, at different times, by Onora O'Neill, make better sense of the fact that people always act on maxims, for they hold that maxims are intentions – either specific intentions, such as 'to open the door', or general intentions, such as 'to make guests feel welcome'– and it is perfectly sensible to claim that people always act on intentions. However, they face the same problem as the two previous views, which is that if people always act on maxims, what sense does it make to say they also have to learn how to act on them? Henry Allison, the main representative of the fifth view, claims, on the basis of Kant's doctrine of the 'highest maxim', that maxims are principles organized hierarchically, such that an agent endorses one maxim because she endorses a more general maxim. Unfortunately for Allison, there is little direct textual support for his claim that maxims are organized hierarchically. (shrink)

In Part II: New Approaches, I look at three more recent views in somewhat greater detail than I do the five treatments canvassed in 'Recent Works on Kantian Maxims I: Established Approaches'. First, there is Richard McCarty's Interpretation, which holds that Kant's understanding of maxims (...) can be illuminated by placing them in the context of the Wollfian tradition, according to which maxims are the major premises of practical syllogisms. The next subject Maria Schwartz, holds that careful attention to Kant's distinction between rules and maxims, as well as Kant's concept of happiness, allows us to make sense of almost all of Kant's remarks on maxims. It may be, however, that on Schwartz's view agents turn out to perform actions as opposed to thoughtlessly habitual behaviors much less often than is plausible. This leads to the final approach, exemplified by Jens Timmermann, which is that Kant understands maxims equivocally. I claim that something like Timmermann's approach is the only way to make sense of all of what Kant has to say on maxims. (shrink)

Research on moral judgment is refueling public interest in an old debate concerning the general foundation of morals. Are moral judgments based on reason or on feeling? Recent research in moral psychology and neuroscience concludes that moral judgments occur rapidly, automatically, and largely without the aid of inference. Such findings are utilized to criticize moral theories that require deliberation to precede moral judgment as its cause. The main targets of this criticism are the moral theories of Piaget and Kohlberg, but (...) Kant's moral philosophy is also criticized for this failing. This essay defends Kant from this charge by clarifying the role of deliberation in his moral theory and by demonstrating that, for Kant, moral judgment invokes a self-organizing system that has the capacity to rapidly determine the moral permissibility of any desired purpose - real or imagined. Further support for Kant's moral theory is gleaned from recent work on self-organization in the brain. (shrink)

In this article, I examine what Kant’s Formula of Universal Law requires of an individual agent in situations of great need, e.g.: if you can easily help a drowning child, or if you know of a famine situation in another country. I first explain why I do not simply apply the standard interpretation of how one can derive concrete duties from Kant’s Universal Law formulation of the Categorical Imperative. I then glean an alternative procedure from Kant’s texts and give the (...) reasons for using that interpretation. Finally, I apply the alternative procedure to situations of great need. – According to the interpretation I glean from Kant’s texts, one (i) should not make an exception to (ii) laws that we believe to be objectively necessary, whereby we derive these rules from (iii) universal ends of humankind. Since we take survival as one of the universal ends of mankind, we deem helping someone whose life is in danger as objectively necessary (to achieve the end). The formal Categorical Imperative demands that one does not make an exception to this rule. Applying this interpretation to cases of great need depends on at least three factors: (i) how urgent the need is, (ii) how great the costs are to the one who helps, and (iii) how many people can help. But at one extreme, where you are the only one who can easily save an innocent person’s life, the Kantian procedure generates a strict duty to help the other in need. (shrink)

In A Theory of Justice (1971), John Rawls introduces the concept of “reflective equilibrium.” Although there are innumerable references to and discussions of this concept in the literature, there is, to the present author's knowledge, no discussion of the most important question: Why reflective equilibrium? In particular, the question arises: Is the method of reflective equilibrium applicable to the choice of this method itself? Rawls's drawing of parallels between Kant's moral theory and his own suggests that his concept of “reflective (...) equilibrium” is on a par with Kant's concept of “transcendental deduction.” Treating these two approaches to justification as paradigmatic, I consider their respective merits in meeting the reflexive challenge, i.e., in offering a justification for choice of mode of justification. My enquiry into this topic comprises three parts. In this first part, I raise the issue of the reflexivity of justification and question whether the reflexive challenge can be met within the framework of A Theory of Justice. (shrink)

The Ontological Dilemma of Normative Ethics. This paper pursues two goals. The first is to show that normative ethics is confronted with the following dilemma: to be coherent, this discipline is ontologically committed to acknowledge the existence of objective values, but, to be scientifically respectable, it is committed to repudiate such values. The second goal is to assess the possible solutions to this dilemma. To this end, the following strategies are discussed: Kant’s constructive objectivism, Jürgen Habermas’ “epistemic ersatzism”, Franz von (...) Kutschera’s “confirmation pragmatism”, and David Brink’s “objectivist tour de force”. The paper’s conclusion is that the dilemma cannot be solved because it rests on a clash of intuitions none of which can be given up. (shrink)

The aim. To analyze comprehensively the policy as a way of human being, as well as the important today’s criteria of legitimacy of the government and the nature of political morality through a consistent reconstruction of the relations between morality and politics in the contemporary and classic historical and philosophical discourses. Methodology. The methods of historical reconstruction, hermeneutic, social and transcendental ones, which allowed to involve actively into understanding the important problems of modern life, conceptual apparatus of political and moral (...) philosophy and to explore the relationships between politics and morality through the idea of social agreement, justice and freedom are used for coherent and consistent understanding of the measurements and definitions of relations policy and morality. Scientific novelty. The used in the article methodological principles made it possible to create actual for today version of political ethics. It is proved that the development of moral and ethical principles, their consistent adherence by not only politicians, but by all the citizens are able to hinder the pragmatic interests of statesmen, who, under cover of the idea of the common good, protect primarily not the public but narrow corporate interests. A true freedom and justice based on the relationship of rights and duties, respect for them, which is more significant than conventional or compulsory recognition of them. Not only classic but also modern philosophical arguments for the combination of morality, ethics and politics were reconstructed. The thoughts of E. Tuhendhat about the nature of morality as a special regulatory system, and the basic principles of justification of moral standards in a modern philosophy were analyzed. It is shown that the landscape of contemporary crisis of social being, moral principles appear both as formal and procedurally - material ones, but the necessary for politicians mental attitude not only to their close, but also to other people requires the willingness to be honest and open. Conclusions. The understanding of the ways of combining the morality and politics through the achievements of a compromise of completive views and life strategies is essential for the development of real, but not apparent "legal state" in which the ruling authority represents not the interests of citizens, but only their own interests and goods. Concerning the public discourse of social agreement, it goes about the need for compromise and consideration of individual life plans, and the problem of legitimacy of power and necessary for the operation of universal principles of sense of justice and trust. In the first part of this enquiry (Eng 2014a), I raised the issue of the reflexivity of justification and questioned whether the reflexive challenge can be met within the framework of A Theory of Justice. In the second part (Eng 2014b), I outlined a Kantian approach that represents a paradigmatic alternative to Rawls. In this third and final part, I shall argue that Rawls's reflective equilibrium cannot justify the choice of itself and that in the broader perspective thus necessitated, we cannot escape the metaphysical issues integral to the Kantian approach. Despite the popularity of many of Kant’s ethical notions, such as autonomy, dignity and respect for persons, there is a perception, even among Kant scholars themselves, that one cannot reliably derive concrete duties from Kant’s moral philosophy. Against this, I shall argue that — properly understood — Kant’s ethics is of prime importance even today. I shall argue that Kant’s preferred procedure is actually the way we develop new ethical rules during the recent Coronavirus pandemic. In order to demonstrate this, (...) I shall first reflect on how we came up with ethical rules such as keeping six feet of distance, wearing a mask, or restricting the number of people who can occupy a room at the same time. I shall then give the reasons why I do not follow the standard interpretations of how one derives concrete duties from Kant’s main formulation of the Categorical Imperative or the Formula of Humanity. Finally, I shall present the textual evidence that Kant proposes a method like the one we use today during a pandemic, and argue that this alternative interpretation can deal much better with the main objections that are commonly levelled against the standard interpretation of Kant’s procedure to derive concrete duties from the Categorical Imperative. Immanuel Kants Metaphysische Anfangsgründe der Rechtslehre, 1797 als erster Teil der Metaphysik der Sitten erschienen, stellen einen Beitrag zur neuzeitlichen Rechts- und Staatsphilosophie dar. Hinsichtlich der normativen Prinzipien von Recht und Staat entwickelt Kant eine erfahrungsunabhängige, insofern metaphysische Theorie. Sie beginnt mit einem angeborenen und unveräußerlichen Menschenrecht und geht dann zu den Institutionen des Eigentums und des Rechtsstaates über. Besonders aktuell ist die Formulierung eines rechts- und friedensfunktionalen Völkerrechts und eines Weltbürgerrechts. Darüber hinaus behandelt Kant auch das Ehe und Familienrecht, (...) das Verhältnis von Staat und Kirche und das Straf- und Begnadigungsrecht.
