Use of argumentation methods applied to legal reasoning is a relatively new field of study. The book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. The notion of scope as it relates to a model of logical form is discussed. The inability of the accepted definition of scope to account for the contrast between priority scope - the logical priority of different quantifiers & other logical notions via rule ordering - & binding scope - the identification of the connection between variables of quantification & a particular quantifier - is demonstrated. The semantic ambiguity of this dichotomy of scope is explored via examination of donkey sentences. (...) A formal representation of this dichotomy is suggested. The government-binding approach & principle of compositionality that handle scope relations via the logical form is rejected due to the complexity of the mechanism by which syntactic form results in logical forms. A discourse representational approach is also rejected. This paper addresses the theoretical notion of a game as it arisesacross scientific inquiries, exploring its uses as a technical andformal asset in logic and science versus an explanatory mechanism. Whilegames comprise a widely used method in a broad intellectual realm(including, but not limited to, philosophy, logic, mathematics,cognitive science, artificial intelligence, computation, linguistics,physics, economics), each discipline advocates its own methodology and aunified understanding is lacking. Charles Sanders Peirce was one of the United States’ most original and profound thinkers, and a prolific writer. Peirce’s game theory-based approaches to the semantics and pragmatics of signs and language, to the theory of communication, and to the evolutionary emergence of signs, provide a toolkit for contemporary scholars and philosophers. Drawing on unpublished manuscripts, the book offers a rich, fresh picture of the achievements of a remarkable man.

The aim of this investigation is to explore the role of argumentation schemes in enthymeme reconstruction. This aim is pursued by studying selected cases of incomplete arguments in natural language discourse to see what the requirements are for filling in the unstated premises and conclusions in some systematic and useful way. Some of these cases are best handled using deductive tools, while others respond best to an analysis based on defeasible argumentations schemes. The approach is also shown to work reasonably (...) well for weak arguments, a class of arguments that has always been difficult to analyze without the principle of charity producing a straw man.
