Rousseau's paradox of how a multitude wills itself into the status of a sovereign people, by deciding to join the contract before existing as a people, with a general will to make that decision, presupposes the absence of any ultimate social grounds and the contingency of identities and structures. These presuppositions make Rousseau an unacknowledged precursor of Laclau's post-structuralist politics, refuting the view that Rousseau's politics seeks a totally transparent and harmonious state beyond the questioning and ambiguity defining the political. (...) The people's will grounds the social contract's legitimacy but that will lacks any pre-constituted form and clear guidelines for discerning it. It provides a groundless ground. Rousseau's legislator supplements that lack, representing the people in its absence, helping it frame suitable legislation. The people only requires the lawgiving representative because of its constitutive incompleteness: it thus resists full representation. If it already possessed a common will and identity, the lawgiver and the contract would become irrelevant. The undecidability of autonomy/heteronomy, representative/represented, fiction/reality highlighted by Rousseau's legislator affirms the impossibility of political closure as the condition of freedom and change. The people's incompleteness supports rather than jeopardises its sovereignty, allowing it to reconstitute itself in the open-ended quest for democracy. (shrink)

Du Bois's "The Damnation of Women," which explores the significance for all Americans of African American women's sexual, economic, and political lives under slavery and in its aftermath.

This essay explores the intersection of racism, racial embodiment theory and the recent hostility aimed at immigrants and foreigners in the United States, especially the targeting of people of Latin American descent and Latino/as. Anti-immigrant and anti-foreigner sentiment is racist. It is the embodiment of racial privilege for those who wield it and the materiality of racial difference for those it is used against. This manifestation of racial privilege and difference rests upon a redrawing of the color line that is (...) meant towards preserving exclusive categories of political membership. The charge of racism, however, is elided by the fact that this hostility takes the form of a specious embracement of law and lawfulness. “Illegal” in this sense not only captures the actions of those who enter the United States through clandestine or informal means, but, in light of the history of immigration and citizen- ship law, the term operates as a racial trope that designates non-white status, thus marginalizing and alienating certain immigrants from ongoing nation-formation processes. I explain the source for anti-immigrant hostility in the United States, which I take to be connected to the longevity of white normativity as the basis for American identity. I then critically assess how the idea of national belonging is crucial to the perpetuation of white-ways-of-being, especially when citizenship has historically been a venue for the embodiment of racial and even colonial privilege. I conclude by posing several questions about the nature of racial identities and racism that suggest new avenues for further research on racial embodiment in a “postracial” era. pp. 65–90. (shrink)

In The Ethics of Immigration, Joseph Carens’ builds a sophisticated account of justice in immigration based on an interpretation of liberal states’ democratic principles and practices. I dispute Carens’ contention that his hermeneutic methodology supports a broadly liberal egalitarian consensus; instead, the consensus he detects on principles and practices appears because his interpretation presupposes liberal egalitarianism. Carens’ methodology would benefit by engaging with a “hermeneutics of suspicion” that explores the ideological and exclusionary facets of liberal egalitarian principles when applied to (...) immigration. This would contribute to an account of the ethics of immigration that gives more attention to power and interest, mediated through structures of gender, race, and class. (shrink)

This article argues that although post-truth is understood to pose a particular misogynistic threat to feminism, we cannot assume that feminists should simply oppose post-truth. The way the post-truth debate is constructed is problematic for feminism in three ways: it misconceives the relationship between democracy and truth; utilizes a questionable binary between reason and emotion; and propagates elitist assumptions about protecting democracy from the people. Recognizing the insufficiency of our understanding of post-truth, feminists have called for greater understanding of the (...) roles of language, affect and truth in the post-truth debate. In response, I suggest that the theories of Judith Butler and Bonnie Honig can help. However, I seek to emphasise that if feminists are to intervene meaningfully in the inequalities and intensified affective flows that structure the post-truth paradigm they would benefit from a deintensifying, confrontational but nonaggressive, approach. I argue that BLM represents a multifaceted engagement with the complicated politics of redemption that lies at the heart of American democracy. In one sense, BLM stands for the integration of black life into the framework of political value, and thus for a redemption of the promise of ‘justice for all’. In another, it (...) is a challenge to the principles themselves, viewing justice as a threat to be managed, rather than as a principle to be redeemed. Exploring the praxis of this movement, organized both against and within the possibility of redemption, will enable us to more effectively characterize the limitations of a politics grounded in the theorization of justice and generate a richer understanding of the possibility for practical political theory to simultaneously employ and critique the politics of redemption. The articles considers how the "death of the subject" influences ways in which we understand the aestheticization of the political." It explores how Walter Benjamin's "The Work of Art in the Age of Technological Reproducibility" can contribute to a conception of the political implications of thinking the subject. It also turns to Solon's conception of subjectivity as a way of mediating the current discussion on the subject.

Identity and democracy and, more particularly, national identity and deliberative democracy account for a controversial relationship. However, from a classical deliberative democratic point of view, the controversy over who is the ‘we’ that needs to stand together in contemporary complex societies settled with the constitution of modern states. In this sense, the main contribution of this paper is twofold. On the one hand, I rebut the analytical appropriateness and conceptual coherence of Habermas’ discursive approach to democracy for the case of (...) plurinational societies in contemporary constitutional democracies. A discussion of a test case – Catalonia – demonstrates that this inadequacy renders incoherent the deliberative model regarding one of its most fundamental premises: the equal weight of the principles of law and the principle of democracy. On the other hand, I sustain that the challenge is not about identity but democracy, and more particularly, about the role deliberative democracy is called to play when controversy challenges whether the people of a state do conform to a single people or not. More concretely, I explore the opportunities offered by the systemic turn to sustain a more realistic approach to deliberative democracy regarding its capacity to steer society towards integration in the context of the system of public deliberation. The article draws on critiques in political theory and morality to argue that womanism, a worldview rooted in Black women's lives and history, provides an alternative conceptual framework to prevailing Eurocentric thinking, for promoting socially just institutions of higher education. Presupposing a positioned, encultured, and embodied account of identity, womanism’s social change perspective holds transformative promise. It foregrounds Black women’s penchant for reaching solutions that promote communal balance, affirm one’s humanity and attend to the spiritual dimension (Phillips, 2006 Phillips, L. (...) (Ed.). (2006). The womanist reader. Routledge.[Crossref], [Google Scholar]). Directed first towards scholars of color, fostering inclusivity, communalist values and acknowledged intersectionality offers an ethic of the embodied self. As a corollary, it argues for a universal that recommends at least two guiding principles for a pedagogical philosophy. It is, first oriented towards a love of self and second towards placing all disciplines within a cultural-historical context. In the first claim, there is potential for nothing less than suspending the symbolic and ontological violence to one’s sense of belonging in academia. In the second claim, such an understanding can position scholars of color to actively re-narrate their fields. As illustrations, we focus on three academic fields of education, theology in higher education, and criminal justice. (shrink)

Based on a discourse analysis of the fan-audience discussions found in the National Taiwan University and Soochow University Bulletin Board Systems, this case study discovers that the Taiwanese youth in fact draw on Japanese TV dramas as a springboard for reflexive discussions of their own social and political conditions in post-authoritarian Taiwan. The Japanomania fan discourse played a crucial role in Taiwan's democratization and nationhood-building in the 1990s. This paper argues that fan discussion networks are ‘pre-political’ because they create social (...) conditions and alternative discourses that could prepare media users for potential social changes. I contend that foreign media are not necessarily the most immediate oppressors and could become the source of subversive symbols and new meanings for local resistance. Further research is called for to illuminate the shaping of identity by the global media in non-Western contexts. (shrink)

Because of political, economic, technological, and other developments, foreigners who come as students or academics to practice philosophy in a country, geography, and culture other than their own are increasingly prevalent in academic philosophy today. Yet this reality is insufficiently discussed and is under‐thematized, so that it remains opaque even to foreigners themselves. This article seeks first to dissipate that opacity by developing an account of what it is like to be a foreigner in philosophy. I offer an understanding of (...) foreignness through a cluster of interrelated experiences, and I describe “existential dislocation” as the core experience that characterizes the foreigner. Next, the article follows some consequences of these descriptions and analyses. I address considerations of equality in the academy, and then I examine the significance of “existential dislocation” for the philosophical enterprise and propose that it occasions revitalizing possibilities for the discipline. This article explores the relationship between theory and praxis by contrasting three different models of intellectual endeavor: totalizing, particular and decolonial. Attending to the critique that Gayatri Spivak raised against Michel Foucault and Gilles Deleuze in Can the Subaltern Speak?, this article advocates a dramaturgical reading of texts as a model for political theory to address subaltern agency. It reads such agency in the smile that Pier Paolo Pasolini registers in his 1967 film version of Sophocles’ play, Oedipus Tyrannos. Dramaturgically (...) read, Oedipus reveals another text, the tragic history of a yet insufficiently explored democratic alternative that goes against the established democracy and its complicity with inequality in the continued naturalization of slavery despite its foundation in equality. This subtext demands understanding Oedipus as a political production from the speechless agency of dissident servants, a more subversive aspect of democratic politics. (shrink)

This paper examines Honig’s use of Rancière in her book ‘Democracy and the Foreigner’. In seeking to clarify the benefits of ‘foreignness’ for democratic politics it raises the concern that Honig does not acknowledge the ways in which her own democratic cosmopolitanism may be more akin to Rancière’s police than politics. By challenging Honig’s assertion that democracy is usually read as a romance with the suggestion that it is more commonly read as a horror, I unpick the interstices of Honig’s (...) and Rancière’s work to separate foreignness from democratic cosmopolitanism. Instead, although I posit democratic cosmopolitanism’s potential as a police more conducive to politics I also suggest that the particular salience of Honig’s ‘foreigner’ figure is that it supplements Rancièrian politics, demonstrating a praxis of ‘looking anew’ at our ordinary social practices. By making these seem strange to us, we can discover a new critical perspective from which to question and subvert, thereby furthering the potential of Rancièrian democratic politics. (shrink)

This paper seeks to destabilize the silent privilege given to the secured juridical-political position of the citizen as the stable site of enunciation of the problem/solution framework under which the stranger (foreigner, immigrant, refugee) is theoretically located. By means of textual, intertextual, and extratextual readings of Antigone, the paper argues that it is politically and literarily possible to (re)invent her for strangers in the twenty-first century, that is, for those symbolically produced as not-legally locatable and who resignify their ambivalent ontological (...) status between life and death as an alternative sociopolitical location of speech and action in equality with “others.”. Borders are never purely local institutions, never reducible to a simple history of conflicts and agreements between neighboring groups and powers. Borders are already global, ways of dividing the world into regions and thus make possible place and a ‘mapping imaginary’. Borders are characterized by an intrinsic ambivalence that derives from their internal and external functions, as the basis of collective belonging and state control over mobility and territory. How to hospitably welcome refugees and migrants presents urgent questions for social and political thought. Current debates can be attributed to three discursive fields. Liberal versions hold that there are good reasons for political and legal limits of hospitality, critical perspectives advocate a renewed cosmopolitanism and, finally, deconstructive perspectives focus on the demand of unconditional hospitality as an absolute ethical requirement. These concepts trouble the conventional congruence of citizenship and bounded territory that make up modern nation states, on the one (...) hand. On the other hand, they affirm the rights of political communities to decide on the contents and the extent of the universal duty to host those endangered. Taking the Mediterranean and the local arena (Lampedusa) as the example, the article, which is based on extensive, multi-sited anthropological field research, engages with the tensions and limits inherent in current notions of hospitality. The question of diversity, both with regard to the demographic profile of philosophers as well as the content of philosophical inquiry, has received much attention in recent years. One figure that has gone relatively unnoticed is that of the foreigner. To the extent that philosophers have taken the foreigner as their object of inquiry, they have focused largely on challenges nonnative speakers of English face in a profession conducted predominantly in English. Yet an understanding of the foreigner in terms of (...) the nonnative speaker does not exhaust the conceptual space of the foreigner. This article provides a more nuanced conceptual apparatus that allows for a more precise identification and discussion of other ways in which one can be a foreigner in philosophy. I develop a taxonomy of different conceptions of the foreigner, namely the linguistic, material, cultural, and epistemic foreigner; I discuss the different and specific challenges they face; and I show how foreigners enrich philosophical practice. There has been a resurgence of interest in cosmopolitanism in contemporary political theory, based upon the hopeful premise that it heralds an ameliorative response to the malignity of sovereignty's lack and the treacherous violence of sovereignty's excess. The promise of cosmopolitanism inheres in the claim that state sovereignty is and should be supplemented by an international system backed by the legitimacy of international law, grounded in the sovereignty of human rights. Drawing upon Foucault and Agamben, my argument in this essay (...) is that the laudable endeavour of liberal cosmopolitans is flawed in two ways: first, cosmopolitanism cannot escape sovereign violence, because it cannot escape sovereignty; and second, cosmopolitans misconstrue the composition of the very sovereignty they aim to escape. This means that cosmopolitan theorists are unable to identify cosmopolitan practices of sovereignty that also entail forms of violence: cosmopolitan exception. Cosmopolitan exception denotes violent sovereign practices that cannot be differentiated from the protection of rights. (shrink)

Since the publication of Between Facts and Norms, Habermas’s concept of communicative power has been the topic of significant discussion. This article contributes to this conversation by examining Habermas’s account of what makes communication powerful. I argue that Habermas’s conception of communicative power describes a nonviolent and noninstrumental mode of acting and being with others in language. This mode of engagement underwrites a conception of power that is structurally different from willing, one that builds meaningful worlds and (trans-)forms those engaging (...) in communicative procedures. In drawing out this aspect of Habermas’s conception, I show that he is not a rationalist and proceduralist whose account of communicative procedures protects decision-making from irrational aesthetic powers. Rather, he presents communication as a mimetic achievement, a set of aesthetic practices and experiences that affectively alter its participants. With this position, Habermas makes an important contribution to and not just against the analysis of the aesthetic dimensions of political life. In casting communication as a mimetic achievement, Habermas presents an account of how communication opens worlds and forms subjects. Yet since these aspects of communication arrive in linguistic form, he can also examine affective and aesthetic experiences within discursive procedures. We can understand world-opening and aesthetic (trans-)formation as an essential part of democratic politics while also identifying the perspectives and resources by which actors can reflect on and critically evaluate whether an opinion is justified or whether a political project is worth pursuing. This article examines how undocumented immigrants mobilize for greater rights in inhospitable political and discursive environments. We would expect that such environments would dissuade this particularly vulnerable group of immigrants from mobilizing in high profile campaigns because such campaigns would carry high risks (deportation) and have little chance of success. However, we have witnessed many mobilizations by undocumented immigrants in both Europe and the United States over the past 20 years. This article uses the case of undocumented youths in the (...) United States (DREAMers) to examine how a group of undocumented immigrants have overcome important barriers and become a powerful voice for immigrant rights in the country. The article suggests that while undocumented immigrants faced inhospitable contexts, cracks and “niche-openings” they continued to present themselves to groups with the right set of cultural, legal, and economic attributes. Immigrants in possession of these attributes (in this case, youth) could target a niche-opening and argue that they are particularly deserving of legalization. This article also highlights an important dilemma: In contexts characterized by general closure and hostility, narrow mobilizations targeting niche-openings provide the only path to legal status for some, but they can also differentiate (discursively and legally) between “deserving” and “undeserving” undocumented immigrants. Differentiation can contribute to stratifying the immigrant population, with those deemed more deserving facing greater rights and entitlements and those deemed less deserving facing greater restrictions and repression. This carries the risk of magnifying normative and legal inequalities between immigrant groups while introducing many points of conflict within the broader immigrant rights movement. (shrink)

The most resounding expression of the truly unprecedented mobilizations of migrants throughout the United States in 2006 was a mass proclamation of collective defiance: ¡Aquí Estamos, y No Nos Vamos! [Here we are, and we're not leaving!]. This same slogan was commonly accompanied by a still more forcefully incorrigible rejoinder: ¡Y Si Nos Sacan, Nos Regresamos! [... and if they throw us out, we'll come right back!]. It is quite striking and, as this essay contends, not merely provocative but genuinely (...) productive to note the affinity between the crucial articulation of this radically open-ended politics of migrant presence with the similarly abject and profoundly destabilizing politics of queer presence. In a manner remarkably analogous to the slogan, "We're here, we're queer, get used to it!", the dynamic enunciation of these phrases in the context of the mass mobilizations of migrants asserted an irreducible spirit of irreverence and disaffection for state power. Both gestures unreservedly and unapologetically assert not only their irreversible presence, furthermore, but also uphold the intractable challenge of their own intrinsic incorrigibility. (shrink)

This article approaches the recent Wonder Woman film as a presentation of the tensions traditionally associated with the paradox of democratic foundations. Steeped in classical mythology, Wonder Woman adapts two origin myths from the Athenian polis: the myth of Pandora and the myth of the heroic colonizing demigod. Through its adaptation of these myths I argue that Wonder Woman offers two competing responses to the democratic paradox of founding. One is exceptionalist, where sovereign interventions by extraordinary ‘super-agents’ like Wonder Woman (...) are justified by their unique origins and identities. The second response subverts this narrative, however, offering a tragic depiction of democratic agency. Through the relationships formed with Diana’s human companions, I argue that Wonder Woman shows the insufficiency of a politics of heroic origins, suggesting agents must continually struggle to establish communities which do not ignore their historical failures or their powers to address these. Wonder Woman therefore provides important imaginative resources for resisting the kinds of seductive, exceptionalist political narrative it also presents. (shrink)

This article addresses the problem of ‘the legitimacy of the people’, that is, what constitutes the legitimate demarcation of the political units within which democracy is practiced? It is commonplace among philosophers to argue that this problem cannot be solved by appeal to democratic procedure because every attempt to do so results in an infinite regress. Based on a social contract theoretical analysis of the problem, this view is rejected. Although contract theorists have ignored the problem of the legitimacy of (...) the people, this article nevertheless argues for one specific, and currently dominant, type of contract view – ‘contractarianism’ – that it contains the conceptual tools to solve it. In a contractarian view, the people are understood as a cooperative venture for mutual advantage and accordingly consist of only those individuals for whom it is mutually beneficial to bind themselves to one another. It is argued that contractarianism offers a procedurally democratic solution to the problem of the legitimacy of the people that does not cause an infinite regress. Furthermore, this article refutes a classic criticism of contractarianism’s account of moral standing. Finally, the article demonstrates contractarianism’s practical implications for one specific articulation of the problem of the legitimacy of the people, namely, immigration. (shrink)

This article is a critical analysis of the pluralist legacy in modern political discourse. The article argues that this legacy imposes conceptual constraints on empirical and normative inquiry into current forms of human belonging and interaction, a predicament most evident today in the field of global political theory. It is argued that this is due to a lasting preoccupation in the pluralist legacy with the vexed question of unity in plurality. The article analyzes the pluralist legacy historically and conceptually, by (...) tracing influential varieties of group theory in modern political discourse, from early British pluralism to mid-century interest group theory, to theories of participatory democracy and group identity, to recent theories of global politics. This review hopes to show how the question of unity in plurality has informed theorizing within as well as across different contexts, and where this leaves us today. To conclude, the article offers some suggestions as to what might be needed in order to move beyond the pluralist legacy, arguing that this would involve a wholesale change of perspectives on the question of unity in plurality, for the benefit of empirical and normative inquiry into current conditions in world politics. The civil society opposition to economic globalization, at times referred to as the ‘anti-globalization movement’, is often seen as unleashing new democratic energies. Some suggest that part of what we are witnessing is some form of deterritorialization of the democratic experience. What is often missing from this claim, however, is a more thorough evaluation of the images of democracy drawn by the movement itself. The first section of this paper will draw from various readings of the democratic experience in view (...) of providing a conceptual framework capable of problematizing the equivalence between democracy and territoriality. On the basis of this understanding of democracy, a second section will offer a reading of the document Alternatives for the Americas prepared by the Hemispheric Social Alliance, a large coalition of civil society groups located throughout the Americas that has organized opposition to the Free Trade Area of the Americas. This document offers a unique opportunity to assess the anti-globalization movement's vision of democracy. The paper's reading of the document reveals a tension between territorial and non-territorial forms of envisioning democracy. (shrink)

The political philosophy of radical democracy has made innumerable invaluable contributions to theories of democracy. However, while radical democrats tend to focus on the political, a cogent and comprehensive framework of law appropriate to radical democracy has only recently been begun to be developed. Interpreting the vast tradition of radical democracy to be based at least on the fundamental tenets of radical equality, anti-foundationalism, and to a lesser extent conflict, this paper argues that the oft-forgotten work of the American legal (...) philosopher Robert Cover may provide critical resources for a radical democratic theory of law. According to Cover, every agent living under law is embedded, or embeds themselves, within a nomos or normative universe. From this nomos legal texts become imbued with widely different meanings, many of which will be mutually incompatible. Cover’s legal anarchism, moreover, gives way to the argument that no agent or institution has a particularly privileged view of the ‘correct’ law. Accordingly, every legal texts gives rise to a proliferation of normative universes which due to their mutual incompatibility will eventually come into conflict with one another. This paper shows that Cover’s normative commitments are highly congruent with those professed by many radical democrats, and that therefore Cover’s legal philosophy furnishes a fruitful basis on which to further theorise a framework of radical democratic or agonistic law that incorporates struggle while remaining committed to equality and disavowing of any determinate foundations. This paper reads Sophocles' " Antigone " contextually, as an exploration of the politics of lamentation and larger conflicts these stand for. Antigone defies Creon's sovereign decree that her brother Polynices, who attacked the city with a foreign army and died in battle, be dishonoured - left unburied. But the play is not about Polynices' treason. It explores the clash in 5th century Athens between Homeric/elite and democratic mourning practices. The former memorialize the unique individuality of the dead, focus on (...) the family's loss and bereavement and call for vengeance. The latter memorialize the dead's contribution to the immortal polis and emphasize the replaceability of those lost. Each economy of mourning sees the other as excessive and politically unstable. The remainders of both, managed by way of exception institutions such as tragedy and the Dionysian Festival, continue to haunt us now. (shrink)

Anarchists and homosexuals have periodically occupied similar positions in relation to US laws and policies: both have functioned as the needed outside against which the proper inside of political order can be established and maintained. Both have blurred the relation of words to deeds, speaking words that are forbidden because the words themselves are seen as dangerous deeds. Examining the deportation case of anarchist John Turner in 1903 and the 1993 Pentagon ban on homosexuals serving openly in the military, and (...) utilizing the intellectual tools provided by Judith Butler in her analysis of speech acts, this article investigates the process of criminalizing an identity category as well as the political context from which that criminalization can be challenged. My goals are to make use of Butler’s arguments about insurrectionary speech to understand anarchism’s historical role in the American political imaginary, and to supplement Butler’s analysis with greater attention to the histories of anarchist struggle. The article argues that this legacy imposes conceptual constraints on empirical and normative inquiry into current forms of human belonging and interaction, a predicament most evident today in the field of global political theory. It is argued that this is due to a lasting preoccupation in the pluralist legacy with the vexed question of unity in plurality. The article analyzes the pluralist legacy historically and conceptually, by (...) tracing influential varieties of group theory in modern political discourse, from early British pluralism to mid-century interest group theory, to theories of participatory democracy and group identity, to recent theories of global politics. This review hopes to show how the question of unity in plurality has informed theorizing within as well as across different contexts, and where this leaves us today. To conclude, the article offers some suggestions as to what might be needed in order to move beyond the pluralist legacy, arguing that this would involve a wholesale change of perspectives on the question of unity in plurality, for the benefit of empirical and normative inquiry into current conditions in world politics. Asylum law functions through a dichotomy between an idealized notion of Europe as a site characterized by human rights, and non-European countries as sites of oppression. In most social sciences and humanities literature, this dichotomy is seen as legitimizing European dominance and exclusion of non-Europeans. However, it is the same dichotomy which is used by asylum seekers to claim inclusion through the grant of asylum. Focusing on the inclusive potential of this exclusive dichotomy allows us to explore the ambiguities inherent (...) in the dichotomy. In asylum claims based on persecution on account of gender and sexuality, it becomes evident that not all human rights are considered equally fundamental. In many cases, asylum seekers are required to renounce human rights in order to prevent persecution, for example by complying with patriarchal family norms. Even where this requirement is rejected, asylum law illustrates the ambiguous relation between Europe and human rights. (shrink)

In an interdependent world of overlapping political memberships and identities, states and democratic citizens face difficult choices in responding to large-scale migration and the related question of who ought to have access to citizenship. In an influential attempt to provide a normative framework for a more just global order, The Law of Peoples , John Rawls is curiously silent regarding what his framework would mean for the politics of migration. In this piece, I consider the complications Rawls’s inattention to these (...) issues creates for his broader vision of global justice. Yet I also attempt to show how these aspects of Rawls’s theory emerge from an underlying tension which confronts all liberal democratic conceptions of justice, both in theory and in practice. In my conclusion, I sketch an alternative rooted in the insights of agonistic pluralism, which “breaks” the Rawlsian silence and actively theorizes the democratic legitimation of political borders. The Repeal campaign articulated new and transformative relationships between law, reproduction and the political in Ireland. During the campaign, ordinary people took ownership of and participated in mutual teaching and critique of law on a wide scale. Art, along these lines, was often used to document and archive the injustices worked by the 8th Amendment. However, art also became a means of imagining law otherwise. What does the growing tide of displaced persons today teach us about the ongoing paradoxes of human rights regimes, which rely on the particular sovereignty of nation-states for their constitution and application but are framed and normatively justified as universal? Working with Arendt’s defense of ‘the right to have rights’ in response to the problem of statelessness which is the practical lynchpin of these historical and theoretical tensions, I specify that and why any person on earth, regardless of their legal (...) status as a national or resident or non-resident alien, can legitimately expect two things from the political community in which they reside: hospitality and membership. This article explores the relationship between theory and praxis by contrasting three different models of intellectual endeavor: totalizing, particular and decolonial. Attending to the critique that Gayatri Spivak raised against Michel Foucault and Gilles Deleuze in Can the Subaltern Speak?, this article advocates a dramaturgical reading of texts as a model for political theory to address subaltern agency. It reads such agency in the smile that Pier Paolo Pasolini registers in his 1967 film version of Sophocles’ play, Oedipus Tyrannos. Dramaturgically (...) read, Oedipus reveals another text, the tragic history of a yet insufficiently explored democratic alternative that goes against the established democracy and its complicity with inequality in the continued naturalization of slavery despite its foundation in equality. This subtext demands understanding Oedipus as a political production from the speechless agency of dissident servants, a more subversive aspect of democratic politics. (shrink)

My title could be taken to name an object, the politics of translation, but here I emphasize something related yet quite distinct: the practice that the title also identifies—the process of translating politics. This procedure remains bound up with the basic question of how to translate politics, how to put into English what Rancière means when he talks or writes about “politics.” Since the publication of Disagreement in English translation nearly twenty years ago, Rancière’s English-speaking audiences have been much exercised (...) by just this question.
