Freedom of religious expression is to many a fundamental element of their identity. Yet the jurisprudence of the European Court of Human Rights on the Islamic headscarf issue does not refer to autonomy and identity rights of the individual women claimants. The case law focuses on Article 9 of the European Convention on Human Rights, which provides a legal human right to freedom of religious expression. Accounts of mothering have both contributed to feminist theory's development and depended on certain of its central concepts. Some of its critics, however, argue that feminist theory is undermined by the problems of exclusion and essentialism. Here I distinguish between these two problems and consider their implications for questions about mothering. I conclude that exclusion and essentialism do not present insurmountable obstacles to theorizing motherhood, but do suggest new directions for such theorizing.

Irigaray demonstrates that metaphysics depends upon the specific negation and exclusion of the female body. Readings of Irigaray's Speculum of the Other Woman tend to highlight the status of this excluded materiality: is there an essential female body which precedes negation or is the feminine only an effect of exclusion? I approach Irigaray's work by way of another question: is it possible to move beyond a feminist critique of metaphysics and towards a feminist philosophy?

I support this general theme by examining a particular case—a dilemma faced by Chinese feminists today. Susan Okin has written an important book on justice and the family. Animated by the experiences that contemporary feminism has sought to articulate, and guided by a principled hostility to the subordination of women that continues to disgrace American life, she argues that the current ordering of domestic life in the United States is unjust and that its alteration ought to be made a matter of public policy.Families, according to Okin, are not havens in an otherwise heartless world. Instead the (...) current division of domestic labor marks them as the centerpiece of a broader system of inequalities between men and women. Justice condemns those inequalities and commands their remedy through the transformation of our domestic practices. Because the division of domestic labor is so fundamental to injustice, we need in particular to ‘encourage and facilitate’ equal sharing by parents in the responsibilities of child-rearing, and in the more quotidian chores that provide the material foundation of modern domesticity.
