This paper provides a comprehensive review of the experimental philosophy of action, focusing on the various different accounts of the Knobe Effect.

A coherent practice of mens rea (‘guilty mind’) ascription in criminal law presupposes a concept of mens rea which is insensitive to the moral valence of an action’s outcome. For instance, an assessment of whether an agent harmed another person intentionally should be unaffected by the severity of harm done. Ascriptions of intentionality made by laypeople, however, are subject to a strong outcome bias. As demonstrated by the Knobe effect, a knowingly incurred negative side effect is standardly judged intentional, whereas (...) a positive side effect is not. We report the first empirical investigation into intentionality ascriptions made by professional judges, which finds (i) that professionals are sensitive to the moral valence of outcome type, and (ii) that the worse the outcome, the higher the propensity to ascribe intentionality. The data shows the intentionality ascriptions of professional judges to be inconsistent with the concept of mens rea supposedly at the foundation of criminal law. (shrink)

In this essay I argue that moral judgment is a natural kind by developing an empirically grounded theory of the distinctive conceptual content of moral judgments. Psychological research on the moral/conventional distinction suggests that in moral judgments right and wrong, good and bad, praiseworthiness and blameworthiness, etc. are conceptualized as serious, general, authority-independent, and objective. After laying out the theory and the empirical evidence that supports it, I address recent empirical and conceptual objections. In the last decade, experimental philosophers have documented systematic asymmetries in the attributions of mental attitudes to agents who produce different types of side effects. We argue that this effect is driven not simply by the violation of a norm, but by salient-norm violation. As evidence for this hypothesis, we present two new studies in which two conflicting norms are present, and one or both of them is raised to salience. Expanding one’s view to these additional cases presents, we argue, (...) a fuller conception of the side-effect effect, which can be reversed by reversing which norm is salient. (shrink)

This article investigates the meaning of doing good and doing well in positive business. It examines the relationship between the two expressions and discusses their relevance, shedding new light on the significance of ‘positive’ in positive business and positive organizational scholarship. Thus, this article illuminates the ultimate end of positive states and practices. ‘Positive’ primarily represents values and assumptions. These lead to the creation of beneficial situations and marked improvements, which put individuals and organizations on an upward trajectory toward achieving (...) excellent functioning, assuring profitability in addition to sustainability and social well-being. Doing well, with reference to economic performance and profits, is partly constitutive of doing good. This presents a new approach regarding the role of economic outcomes in positive business and POS. It means that financial criteria do not have priority. Profits are considered vital and necessary, but the final ‘raison d'être’ of positive states and practices is the overall well-being of the stakeholders. (shrink)

I argue that moral judgement is a natural kind on the grounds that it plays a causal/explanatory role in psychological generalizations. I then develop an empirically grounded theory of its identity as a natural kind. I argue that moral judgement is a hybrid state of moral belief and moral emotion. This hybrid theory supports the role of moral judgement in explanations of reasoning and action and also supports its role in a dual process model of moral cognition. Although it is (...) composed of moral belief and moral emotion, moral judgement is unified, like other natural kinds, in virtue of underlying mechanisms that generate homeostasis among its components. Finally, this theory about the unity of moral judgement resolves a longstanding puzzle about moral motivation. The view explains how it is that moral judgements motivate all on their own but not all the time. (shrink)

An agent S wants to A and knows that if she A-s she will also bring about B. S does not care at all about B. S then A-s, also bringing about B. Did she intentionally bring B about? Joshua Knobe (2003b) has recently argued that, according to the folk concept of intentional action, the answer depends on B's moral significance. In particular, if B is reprehensible, people are more likely to say that S intentionally brought it about. Knobe defends (...) this position with empirical facts about how ordinary people use the adjective 'intentionally.' Knobe's results are consistent with the thesis that the concept of intentional action is fundamentally evaluative. There is an alternative hypothesis, however, which can account for Knobe's data and which keeps the concept of intentional action within the purview of action theory. The current author suggests that the following conditions are jointly sufficient for a side effect E, produced by S's action A, being intentional: (i) S knows that E will (or is likely to) occur as a result of A-ing, (ii) bringing about E counts against A-ing (from the S's perspective), and (iii) S does not try to keep E from occurring. Known immoral side effects will always, from the folk's perspective, satisfy condition (ii) of this hypothesis. (shrink)

In two experiments, we demonstrate that intentional action intuitions vary as a function of whether one brings about or observes an event. In experiment 1a (N?=?38), participants were less likely to judge that they intended (M?=?2.53, 7 point scale) or intentionally (M?=?2.67) brought about a harmful event compared to intention (M?=?4.16) and intentionality (M?=?4.11) judgments made about somebody else. Experiments 1b and 1c confirmed and extended this pattern of actor-observer differences. Experiment 2 suggested that these actor-observer differences are not likely (...) to occur when participants are asked to ?imagine? being an actor. We argue that these results challenge the substantial philosophical and empirical reliance on hypothetical thought examples about intentional action. Our data offer new and necessary methodological avenues for understanding folk intentional action intuitions. (shrink)

Various theories of moral cognition posit that moral intuitions can be understood as the output of a computational process performed over structured mental representations of human action. We propose that action plan diagrams—“act trees”—can be a useful tool for theorists to succinctly and clearly present their hypotheses about the information contained in these representations. We then develop a methodology for using a series of linguistic probes to test the theories embodied in the act trees. In Study 1, we validate the (...) method by testing a specific hypothesis (diagrammed by act trees) about how subjects are representing two classic moral dilemmas and finding that the data support the hypothesis. In Studies 2–4, we explore possible explanations for discrete and surprising findings that our hypothesis did not predict. In Study 5, we apply the method to a less well‐studied case and show how new experiments generated by our method can be used to settle debates about how actions are mentally represented. In Study 6, we argue that our method captures the mental representation of human action better than an alternative approach. A brief conclusion suggests that act trees can be profitably used in various fields interested in complex representations of human action, including law, philosophy, psychology, linguistics, neuroscience, computer science, robotics, and artificial intelligence. Hypothetical trolley problems are widely used to elicit moral intuitions, which are employed in the development of moral theory and the psychological study of moral judgments. The scenarios used are outlandish, and some philosophers and psychologists have questioned whether the judgments made in such unrealistic and unfamiliar scenarios are a reliable basis for theory-building. We present two experiments that investigate whether differences in moral judgment due to the role of the agent, previously found in a standard trolley scenario, persist when (...) the structure of the problem is transplanted to a more familiar context. Our first experiment compares judgments in hypothetical scenarios; our second experiment operationalizes some of those scenarios in the laboratory, allowing us to observe judgments about decisions that are really being made. In the hypothetical experiment, we found that the role effect reversed in our more familiar context, both in judgments about what the actor ought to do and in judgments about the moral rightness of the action. However, in our laboratory experiment, the effects reversed back or disappeared. Among judgments of what the actor ought to do, we found the same role effect as in the standard hypothetical trolley scenario, but the effect of role on moral judgments disappeared. (shrink)

Several factors have been put forward to explain the variability of moral judgments for superficially analogous moral dilemmas, in particular in the paradigm of trolley cases. In this paper we elaborate on Mikhail's view that (i) causal analysis is at the core of moral judgments and that (ii) causal judgments can be quantified by linguistic methods. According to this model, our moral judgments depend both on utilitarian considerations (whether positive effects outweigh negative effects) and on a representation of the causal (...) structure of the action (whether the negative effects are essentially side-effects rather than main goals). However, the exact contribution of each factor, as well as the precise way in which causal considerations interact with utilitarian considerations, has yet to be quantified and investigated. ABSTRACTProponents of the linguistic analogy suggest that methodologies originally developed for investigating linguistic grammar can also be fruitfully applied to the empirical study of moral grammar: the causal and intentional representations of moral events which – according to the linguistic analogy – drive moral judgements. In the current study, we put this claim to the empirical test. Participants were presented with moral dilemmas which previously have been shown to implement a central principle in moral judgements: the principle of double effect. (...) Participants responded to by and in order to probes to assess causal and intentional representations of this principle. Results show that these linguistic probes do not relate to moral judgement in the manner predicted by proponents of the linguistic analogy and moral grammar. I examine an intuitive property of folk-psychological explanations I call self-sufficiency. I argue that individualism cannot honor this property and work toward distilling an account of psychological explanation that does honor it, given some fairly standard assumptions. In doing so, my preference for an Externalist individuation of intentional state will emerge unambiguously. The assumptions I rely on are fairly standard but not uncontroversial. Yet not always do I attempt to defend them from objections. My goal is an account of folk (...) psychology consistent with our every-day practices rather than the deduction of an idealized psychology from first principles. I conclude with some applications offered as evidence that the goal was achieved. (shrink)

Knobe's laudable conclusion that we make sense of our social world based on moral considerations requires a development account of human thought and a theoretical framework. We outline a view that such a moral framework must be rooted in social interaction.

The Knobe effect is the phenomenon demonstrated in the course of repeated studies showing that moral valence affects the way in which we apply concepts. Knobe explains the effect by appealing to the nature of the concepts themselves: whether they actually apply in some situation depends upon the moral valence of some element of that situation. In this paper, a different picture of the effect is presented and given motivation. It is suggested that subjects apply concepts on the basis of (...) substitution inferences. It is attempted to show that this picture is incompatible with, but preferable to, Knobe’s theory. In closing, some further observations and suggestions are given with respect to further research into the apparent effect of moral valence. (shrink)
