Should the liberal state accommodate the cultural traditions of minority groups even if these traditions infringe upon the rights of women? This article discusses two empirical cases that pose just this problem for public policy in the Netherlands: requests for surgical reconstruction of the hymen and gender-selective abortion. While hymen reconstruction is linked to a cultural norm that young women, but not young men, remain virgins until marriage, sex-selective abortion is linked to a cultural preference for sons. The autonomy of (...) women is at issue in these cases in two ways: the traditions limit their autonomy, yet it is the women who demand the medical intervention. The cases illustrate the complexities of women's agency under oppressive social conditions. The author develops a moral argument concerning these two cases that understands the women in question as moral agents, while taking into account these complexities. The article does not pit multicultural and feminist concerns against each other. Instead, it is argued that good feminism may well require acts of multiculturalism. It is not desirable, so it is argued, to restrict access to abortion or to ban hymen repair. (shrink)

Most political philosophers are reluctant to treat cultural rights as basic. Instead, the predominant view is that cultural interests are only important derivatively, in virtue of their contribution to some other interest. In this chapter I argue that political philosophers ought to follow international human rights norms regarding the importance of culture. Not only do international human rights courts and committees come to the right conclusion about the significance of culture, but, as importantly, they come to this conclusion because they (...) think about what cultural rights protect inthe right way. Contemporary political philosophers prefer to treat cultural rights as derivative in part because they tend to treat culture as a “resource” or a “good,” but this is a mistake. Cultural rights are better understood as protecting and promoting an activity. Respecting and promoting cultural participation is a constitutive element of showing respect for human dignity because, like free expression, political participation, and freedom of conscience, cultural participation is something persons do as part of making a life for themselves. In what ways might we best, and justly, allow for cohabitation between individuals and groups with plural conceptions of the good? Confronting this question, students of political philosophy in the past two decades have encountered a routine contrast between liberal universalism, with a focus on equal individual rights and uniform application of the law, and on the other hand various versions of a 'politics of difference'(...).
