Most philosophical accounts of human rights accept that all persons have human rights. Typically, ‘personhood’ is understood as unitary and binary. It is unitary because there is generally supposed to be a single threshold property required for personhood. It is binary because it is all-or-nothing: you are either a person or you are not. A difficulty with binary views is that there will typically be subjects, like children and those with dementia, who do not meet the threshold, and so who (...) are not persons with human rights, on these accounts. It is consequently unclear how we ought to treat these subjects. This is the problem of marginal cases. I argue that we cannot resolve the problem of marginal cases if we accept a unitary, binary view of personhood. Instead, I develop a new non-binary personhood account of human rights, and defend two main claims. First, there are many, scalar properties, the having of which are conducive to personhood. Second, different subjects have different human rights depending on which of these properties they have, and what threats apply to them. On my view, and contra most existing accounts, most marginal cases have some degree of personhood and are entitled to some human rights. (shrink)

Big Data has the potential to enable unprecedentedly rigorous quantitative modeling of complex human social relationships and social structures. When such models are extended to nonhuman domains, they can undermine anthropocentric assumptions about the extent to which these relationships and structures are specifically human. Discoveries of relevant commonalities with nonhumans may not make us less human, but they promise to challenge fundamental views of what it is to be human.

Peter Singer’s arguments against the morality of the typical American diet focus on the pain of animals, and lead to the conclusion that we must become committed vegans. His approach ignores the impact that different psychological capacities can legitimately have on our moral appraisal of the interests of beings. Although we ought to eat less meat because of the externalized environmental costs that factory farming inflicts upon future people, an ideal diet may contain some environmentally sustainably raised meat. Finally, the (...) perception of ethical puritanism in committed vegans may be an obstacle to achieving the real reductions in animal suffering that they advocate. (shrink)

L’éthique du care est confrontée à un problème qui a des allures de paradoxe : bien que sa politisation paraisse nécessaire, l’éthique du care ne semble pas pouvoir trouver en elle-même les ressources suffisantes à la formulation d’une théorie politique compréhensive. Il ne semble pas exister de théorie politique du care à part entière. Cet article examine la fécondité d’un rapprochement entre éthique du care et théorie néorépublicaine de la non-domination. Le résultat, non négligeable, serait de garantir des formes importantes (...) de protections aux activités de care, mais il cela n’empêcherait pas nécessairement les représentations négatives de ces activités, dont on peut supposer qu’elle est l’un des facteurs de la marginalisation et de la répartition inégale qui les affecte. Pour bloquer ces représentations dégradantes, il faudrait que le care soit discuté et défini dans l’espace public non seulement comme un lieu possible de la domination, mais comme un aspect fondamental et positif de la vie individuelle et collective. My contribution to this conversation sets out to accomplish two things: First, I offer a definition of epistemic pushback. Epistemic pushback is an expression of epistemic resistance that occurs regularly in classroom discussions that touch our core beliefs, sense of self, politics, or worldv iews. Epistemic pushback is structural: It broadly characterizes a family of cognitive, affective, and verbal tactics that are deployed regularly to dodge the challenging and exhausting chore of engaging topics and questions that scare us. It can (...) take such forms as direct deep hostility, knee jerk skepticism, or silence. Good teaching should not only track the production of knowledge, but also the production of ignorance. There are forms of epistemic pushback that are ignorance producing, so I work with students to cultivate a mindfulness around epistemic pushback by treating it as a ‘shadow text.’ The remainder of the paper explains the nature of shadow texts, and offers suggestions for how to navigate them.
