In this open access book, Timothy Aylsworth and Clinton Castro draw on the deep well of Kantian ethics to argue that we have moral duties, both to ourselves and to others, to protect our autonomy from the threat posed by the problematic use of technology. The problematic use of technologies like smartphones threatens our autonomy in a variety of ways, and critics have only begun to appreciate the vast scope of this problem. In the last decade, we have seen a (...) flurry of books making “self-help” arguments about how we could live happier, more fulfilling lives if we were less addicted to our phones. This article applies Charles W. Mills’ notion of the domination contract to develop a Kantian theory of justice. The concept of domination underlying the domination contract is best understood as structural domination, which unjustifiably authorizes institutions and labour practices to weaken vulnerable groups’ public standing as free, equal and independent citizens. Though Kant’s theory of justice captures why structural domination of any kind contradicts the requirements of justice, it neglects to condemn exploitive gender- and race-based labour relations. Immanuel Kant was possibly both the most influential racist and the most influential moral philosopher of modern, Western thought. So far, authors have either interpreted Kant as an “inconsistent egalitarian” or as a “consistent inegalitarian.” On the former view, Kant failed to draw the necessary conclusions about persons from his own moral philosophy; on the latter view, Kant did not consider non‐White people as persons at all. This article examines how Kant’s conceptualizations of natural history and teleological judgement shape his understanding of human difference and race. I argue that the teleological framework encasing Kant’s racial theory implies constraints on the capacity of non-whites to make moral progress. While commentators tend to approach Kant’s racial theory in relation to his political theory, his late-life cosmopolitanism, and his treatments (or non-treatments) of colonialism, empire and slavery, the problem I focus on here is that race is itself only intelligible (...) in relation to a teleological natural history limiting certain races’ capacities to engage in humanity’s moral vocation. ABSTRACT Readers should be aware that content about Kant’s racism may be difficult and distressing to read. In various texts, Kant makes statements alleging that Indigenous Americans have ‘no culture’ and Black people possess only the ‘culture of slaves’. These are straightforwardly repugnant commitments. In order to address the role of Kant’s account of ‘culture’ in his racism and provide additional support to Charles Mills’ ‘Untermensch (subhuman) interpretation’ of Kant’s views on race, this article situates Kant’s comments on ‘racialized cultures’ (...) within his teleological account of human history. In his system, ‘culture’ refers to the possession of developed capacities to achieve the ends that one sets for oneself. He sees achievement of culture as part of the development of human beings into members of a socialized, moral kingdom. Given his understanding of culture, I argue that Kant’s remarks on the cultural limitations of persons of color commit him to the further claims that Indigenous Americans and Black people are incapable of setting their own ends and that these deficiencies are hereditary and permanent. For Kant, this has the consequence that these individuals do not possess genuine moral worth in his system, thus supporting Mills’ Untermensch interpretation of Kant’s views on race. (shrink)

An important aspect of moral expertise is moral sensitivity, which is the ability to be sensitive to the presence of morally salient features in a context. This requires being able to see and acquire the morally relevant information, as well as organise and interpret it, so that you can undertake the related work of moral judgement, focus (or motivation) and action. As a distinct but interrelated component of ethical expertise, moral sensitivity can and must be trained and educated. However, despite (...) its importance to moral education, there has been comparatively little discussion about the role of ethical sensitivity and the ways that it can be trained within the context of Kant’s, and Kantian, ethics. This paper seeks to address this gap. While Kant does not explicitly focus in detail on moral sensitivity, by breaking sensitivity down into seven distinct aspects through drawing on the Four Component Model, we are able to identify a wealth of resources in Kant’s work from which we can con- struct an account of moral sensitivity education that draws on his underlying moral theory. This is a paper about model-building and overfitting in normative ethics. Overfitting is recognized as a methodological error in modeling in the philosophy of science and scientific practice, but this concern has not been brought to bear on the practice of normative ethics. I first argue that moral inquiry shares similarities with scientific inquiry in that both may productively rely on model-building, and, as such, overfitting worries should apply to both fields. I then offer a diagnosis of the problems of (...) overfitting in moral inquiry and explain how our current practice seems worryingly susceptible to such problems. I conclude by giving suggestions for how we might avoid overfitting when doing normative ethics. (shrink)

This open access book revises Kant’s ethical thought in one of its most notorious respects: its exclusion of animals from moral consideration. The book gives readers in animal ethics an accessible introduction to Kant’s views on our duties to others, and his view that we have only ‘indirect’ duties regarding animals. It then investigates how one would have to depart from Kant in order to recognise that animals matter morally for their own sake. Particular attention is paid to Kant’s ‘Formula (...) of Humanity,' the role of autonomy and the moral law, as well as Kant’s notions of practical reason and animal instinct. The result is a deliberately amended version of Kantianism which nevertheless remains faithful to central aspects of Kant’s thought. The book’s final part illustrates the framework’s use in applied contexts, addressing the issues of using animals as mere means, the ethics of veganism and vegetarianism, and environmental protection. Nico Dario Müller shows how, when furnished with duties to animals, Kant's moral philosophy can be a powerful resource for animal ethicists. (shrink)

This article examines Kant’s theory of property through a comparative analysis of Gottfried Achenwall’s justification of ownership rights. I argue that at the core of Achenwall’s and Kant’s understanding of ownership rights lies the idea that rights are to be acquired through a juridical act (factum iuridicum, rechtlichen Act) of the will. However, while Achenwall thinks of this act as emerging from a private will, Kant holds that rights and obligations can only be brought about by an act of the (...) general will. By contrasting these two views, I aim to illuminate one of the main features of Kant’s theory of property, namely, that ownership rights are only possible in a rightfully constituted state. I conclude with a suggestion regarding Kant’s view of the notion of ‘provisional’ possession in the state of nature. (shrink)

Contemporary political philosophers often take for granted that for political purposes all humans are to be considered of equal worth. The difficulty, as Bernard Williams observed, is to find an interpretation of this claim that does not collapse into absurdity or triviality. I show that the principal attempts to solve this problem all beg the question against an Aristotelian proponent of natural hierarchy. I then explore existing proposals for dissolving the problem of basic equality, whether by denying the need for (...) justification altogether or by reframing justification in either ostensive or coherentist fashion, showing that each fails to account for our sense that basic equality is objectively true. In response, I outline a Hegelian approach that treats the commitment to basic equality as a social fact that constrains philosophical reasoning in contemporary liberal democracies. By itself that might suggest complacent conservatism or cultural relativism, but I argue that practices and institutions that reflect and foster a commitment to basic equality have a distinct value in permitting reciprocal recognition and thereby enabling us to make a distinct class of normative claims on one another. This Hegelian resolution of the problem is dialectically superior to its rivals and therefore warrants further development. (shrink)

In ‘What is Enlightenment?’, Kant claims that no women are currently enlightened. Here I argue that this exclusion is due to certain legal restrictions guiding Kant’s conception of enlightenment. As enlightenment is intended to take place in society, it appears that Kant has a specific legal context in mind that affects its enactment. His twofold conception of citizenship and the dimension of subordination he puts forward by restricting the private use of reason will prove useful in clarifying those legal restrictions. (...) This article explores an overlooked motif in the Critique of Pure Reason: the Damsel in Distress. Kant uses the trope to motivate his first Critique on a narrative level. Reason is depicted as a high-born female subject in a hopeless predicament, unable to free herself. A hero rescues her, not by liberation, but by discipline, mirroring the myth where the rescued female is appropriated through marriage. The paper examines the parallels between this popular trope and the narrative of the first (...) Critique, arguing that Kant’s choice of this motif is due to cultural and political biases. While this narrative aligns with Kant’s goal of establishing philosophy as a strict science, it marginalizes the also present, progressive potential of Kant’s concept of the highest faculty as a hermeneutical, world-making, and orienting capacity as means for universal cum critical thinking. The discussion proceeds from (1) argumentatively relevant methodological considerations, to showing that Kant (2) does use the damsel in distress in the Critique of Pure Reason. Subsequently, (3) with regard to the reasons for the choice of the narrative, it is argued that it is based on the convictions about the nature of women that Kant advocates in the Observations on the Beautiful and the Sublime and in his Anthropology. (4) Insofar as narratives and metaphors shape convictions and delineate the realm of the conceivable, Kant’s narrative choice undermines his own conception of reason, according to which the highest faculty is to be understood positively as an active, hermeneutic and orienting ability as well as a selfreflective basis for critical thinking. Samuel Fleischacker is interested in two questions that are—what he refers to as—a rephrasing of three implications Charles Mills takes away from his encounter with Kant: (1) Is Kant's moral philosophy racist at its core? and (2) Whether it is or not, how should we respond to the fact that Kant displays open racism in some of his writings when we study, teach, or try to make use of his purportedly egalitarian teachings? Frederick Douglass was an abolitionist who wrestled with (...) similar questions regarding the liberatory and inclusive nature of emancipatory documents like the Constitution. In this essay, I want to consider Douglass's changing views on this issue and reasons behind them to think about how he might offer insights into this current debate concerning Kant and race. In doing so, I will consider to what extent Fleischacker adheres to Douglass's guidelines on this matter as he makes his case. I then offer suggestions on how to move forward. (shrink)

Tom Beauchamp and James Childress‘s revolutionary textbook, Principles of Biomedical Ethics, shaped the field of bioethics in America and around the world. Midway through the Principle’s eight editions, however, the authors jettisoned their attempt to justify the four principles of bioethics —autonomy, beneficence, nonmaleficence, justice—in terms of ethical theory, replacing it with the idea that these principles are part of a common morality shared by all rational persons committed to morality, at all times, and in all places. Other commentators contend (...) that their theory has never been empirically confirmed and is unfalsifiable, since counterexamples can be deemed irrational, or as held by those living lives not committed to morality. The thesis of this paper is that common morality theory is the artifact of a category mistake—conflating common areas regulated by moral norms with common norms regulating moral conduct—that accords mid-twentieth century American liberal morality the status of transcultural, transtemporal, eternal moral truths. Such a conception offers bioethicists no tools for analyzing moral change—moral progress, regress, reform, evolution, devolution, or revolution—no theoretical basis for deconstructing structural classicism, racism, and sexism, or for facilitating international cooperation on ethical issues in the context of culturally based moral differences. Is the Kantian inheritance in cosmopolitan thought still viable for social theory, or is it hopelessly outdated because irretrievably flawed, as post-colonial assessments and critics of Kant’s “racism” would argue? This question is explored vis-à-vis Émile Durkheim’s extension of the more “sociological” dimensions in Kant’s cosmopolitanism, ideas also taken up later by Ulrich Beck. Such contributions suggest Kant’s ongoing timeliness. Haunting these relatively optimistic considerations is the possibility of the future extinction of the human species, rendering Kant’s cosmopolitanism as a (...) viewpoint offering possibilities for humanity that may come too late for it. Liberalism remains the dominant political philosophy of the 21st century, despite the challenges it faces. One of these challenges was the rise of right-wing populism, which is based on anti-liberal nationalist rhetoric. However, some political philosophers try to combine liberalism and nationalism. This article explores the plausibility of such a hybrid theory. This article examines the compatibility of nationalism with the three main forms of liberalism: neutralist, perfectionist and republican. Liberal neutralism is incompatible with nationalism because the policy of national (...) self-determination violates the principle of state neutrality between reasonable conceptions of the good life. Liberal perfectionism is incompatible with nationalism because the rationale for nationalist policies doesn’t refer to any deeper aspects of human nature other than external phenotypic traits, and a preference for national community as the basis for political self-government is arbitrary. Liberal republicanism is incompatible with nationalism because it faces problems of domination and inclusion. The problem of domination is that nationalist policies prevent the maximization of non-domination both between nations and within nations. The problem of inclusion is that nationalists have no nonarbitrary reason to limit political communities to the boundaries of nation-states. The article concludes with seven arguments for a synthesis of liberalism and nationalism. An analysis of these arguments demonstrates that none of the reasons given can motivate liberals’ appeal to nationalist values. Thus, nationalism is incompatible with liberalism, and consistent liberal nationalism is impossible. (shrink)
