This work is an investigation into philosophical method and rational argument in moral philosophy. It makes an original contribution to human understanding, by taking some of the tools and techniques that Gordon Baker identifies in the later work of Wittgenstein, and using them as a way of fending for oneself in an area of philosophy that neither Baker, nor Wittgenstein, wrote on. More specifically, a discussion of some different aspects of the contemporary literature on Dancy’s moral particularism is used as (...) a vehicle for illustrating how Baker’s therapeutic conception of philosophy offers alternative possibilities for how we can do philosophy, and what counts as rational argument in moral philosophy. I maintain that, by considering some indicative ways in which Baker’s therapeutic approach to philosophy can dissolve, rather than solve, the kinds of perplexities found in the existing literature on Dancy’s moral particularism, we can liberate ourselves from the traditional/theoretical view of how we ought to do philosophy, and an understanding of rational argument in moral philosophy, to which we need not be committed. What makes some acts morally right and others morally wrong? Traditionally, philosophers have thought that in order to answer this question we must find and formulate exceptionless moral principles—principles that capture all and only morally right actions. Utilitarianism and Kantianism are paradigmatic examples of such attempts. In recent years, however, there has been a growing interest in a novel approach—Particularism—although its precise content is still a matter of controversy. In this paper I develop and motivate a new formulation of particularism (...) as a research program and I show that my formulation is not vulnerable to the most common objections to particularism. This paper is a survey of the generalism-particularism debate and related issues concerning the relationship between normative reasons and moral principles.

Moral particularism, on some interpretations, is committed to a shapeless thesis: the moral is shapeless with respect to the natural. (Call this version of moral particularism ‘shapeless moral particularism’). In more detail, the shapeless thesis is that the actions a moral concept or predicate can be correctly applied to have no natural commonality (or shape) amongst them. Jackson et al. (Ethical particularism and patterns, Oxford University Press, Oxford, 2000) argue, however, that the shapeless thesis violates the platitude ‘predication supervenes on (...) nature’—predicates or concepts apply because of how things are, and therefore ought to be rejected. I defend shapeless moral particularism by arguing that Jackson et al’s contention is less compelling than it firstly appears. My defense is limited in the sense that it does not prove shapeless moral particularism to be right and it leaves open the possibility that shapeless moral particularism might attract criticisms different from the ones advanced by Jackson et al. But at the very least, I hope to say enough to undermine Jackson et al’s powerful attack against it. The plan of this paper is as follows. Section 1 glosses the view of moral particularism and why it is taken to be essentially committed to the shapeless thesis. Section 2 examines a Wittgensteinian argument for the shapeless thesis. I shall argue that the Canberrans’ counter-arguments against it on grounds of disjunctive commonality and conceptual competence do not succeed. Section 3 explicates Canberrans’ predication supervenience argument against the shapeless thesis. Section 4 offers my criticisms of the Canberrans’ predication supervenience argument. In view of the above discussions, in Sect. 5, I conclude that there is no compelling argument (from the Canberrans) to believe that the shapeless thesis fails (as I have argued in Sect. 4). In fact, there is some good reason for us to believe it (as I have argued in Sect. 2). If so, I contend that moral particularism, when construed as essentially committed to the shapeless thesis, still remains as a live option. (shrink)

We refine a line of feminist criticism of pornography that focuses on pornographic works' pernicious effects. A.W. Eaton argues that inegalitarian pornography should be criticized because it is responsible for its consumers’ adoption of inegalitarian attitudes toward sex in the same way that other fictions are responsible for changes in their consumers’ attitudes. We argue that her argument can be improved with the recognition that different fictions can have different modes of persuasion. This is true of film and television: a (...) satirical movie such as Dr. Strangelove does not morally educate in the same way as a realistic series such as The Wire. We argue that this is also true of pornography: inegalitarian depictions of sex are not invariably responsible for consumers' adoption of inegalitarian attitudes toward sex in reality. Given that pornographic works of different genres may harm in different ways, different feminist criticisms are appropriate for different genres of pornography. (shrink)

Jonathan Dancy, who defends a version of moral particularism, is committed to the view that any feature or reason for action might, in logical terms, have a positive moral valence in one context, a negative moral valence in a different context, and no moral valence at all in yet another context. In my paper, I attempt to demonstrate that, despite the denial by Dancy that proposed grounding properties with invariant moral valences may play a foundational role in morality, his own (...) approach toward moral reasoning unknowingly assumes such foundational grounding properties. I argue that Dancy's moral particularism is unknowingly directed toward moral absolutism, and, in making that argument, uncover reasons, admittedly inconclusive, to favor an absolutist ethic. In this essay I offer a new particularist reading of Aristotle’s Nicomachean Ethics. I argue that the interpretation I present not only helps us to resolve some puzzles about Aristotle’s goals and methods, but it also gives rise to a novel account of morality—an account that is both interesting and plausible in its own right. The goal of this paper is, in part, exegetical—that is, to figure out how to best understand the text of the Nicomachean Ethics. But this paper (...) also aims to contribute to the current exciting and controversial debate over particularism. By taking the first steps towards a comprehensive particularist reading of Aristotle’s Ethics I hope to demonstrate that some of the mistrust of particularism is misplaces and that what is, perhaps, the most influential moral theory in the history of philosophy is, arguably, a particularist moral theory. Moral particularists argue that because reasons for action are irreducibly context-dependent, the traditional quest in ethics for true and exceptionless moral principles is hopelessly misguided. In making this claim, particularists assume a general framework according to which reasons are the ground floor normative units undergirding all other normative properties and relations. They then argue that there is no cashing out in finite terms either (i) when a given non-normative feature gives rise to a reason for or against action, or (ii) (...) how the reasons that are present in a given context play off each other to determine one’s overall duties. However, the conjunction of these two theses leaves particularists without a coherent notion of a reason for action: posit too much irreducible context-dependence in the behavior of reasons, and the reasons-based framework breaks down. One upshot is that the particularists’ challenge to principle-based approaches to ethics has not, at present, been successfully made out; another upshot is that perhaps the best way to formulate that challenge involves renouncing the reasons-based framework all together. The book develops, defends, and applies a "Dual Scale" model of weighing reasons to resolve various issues in ethics. It tells you everything you ever wanted to know about weighing reasons and probably a lot of stuff you didn't want to know too. It addresses, among other things, what the general issue of weighing reasons is; what it is to weigh reasons correctly; whether reasons have more than one weight value (e.g., justifying, requiring, and/or commending weight); whether weight values are (...) context sensitive; how to tell what the weights of reasons are; how reasons for are related to reasons against; and how the weights of reasons aggregate. After addressing such issues, it explains a number of puzzling phenomena in ethics, such as the All or Nothing Problem, the normative significance of small improvements, and the intransitivity of the makes-it-permissible-to-act-against relation. This paper is a survey of the generalism-particularism debate in ethics. It's an updated version of "Moral Particularism", in Christian B. Miller (ed.), The Continuum Companion to Ethics (Continuum, 2011), pp. 247-260.

The intersection between virtue and care ethics is underexplored in contemporary moral philosophy. This thesis approaches care ethics from a neo-Aristotelian virtue ethical perspective, comparing the two frameworks and drawing on recent work on care to develop a theory thereof. It is split into seven substantive chapters serving three major argumentative purposes, namely the establishment of significant intertheoretical agreement, the compilation and analysis of extant and new distinctions between the two theories, and the synthesis of care ethical insights with neo-Aristotelianism (...) to generate a virtue ethical theory of care. In the first two chapters, I outline virtue ethics and care ethics, and argue for considerable agreement over central premises. Chapter 2 summarises the foundational commitments of care ethics, focusing particularly on their relational ontology and its links to the other ethical claims care ethicists universally ascribe to, namely particularism, partialism, the moral salience of emotions, and the rejection of hard public/private distinctions. Chapter 3 lays out the central concepts in neo-Aristotelian virtue ethics, including eudaimonism, virtue, and character traits, and drawing a number of comparisons between virtue and care ethics specifically with regard to relational ontology and the meta-ethical commitments it underpins. In addition to doing the necessary expository work for the remainder of the thesis, Chapters 2 and 3 also argue that care ethics and virtue ethics have much more in common than is typically acknowledged – the first major contribution of this thesis to the literature. Chapters 2 and 3 to provide at least a prima facie justification for pursuit of the questions I confront in the remainder of the thesis. In Chapter 4, I ask what differentiates these two ethical theories. I survey some of the differences which philosophers in either camp have identified and offer some of my own. I suggest that several of those differences either rest on misunderstandings of one ethic or the other, or that in erecting a divide between virtue and care ethics they also disunify ethics of care. I do, however, identify two differences which seem defensible. Specifically, they are that virtue ethics seems to lack an account of care, which I define minimally as a response or responsiveness to need, and that virtue and care ethics organise their meta-ethical and normative concepts differently. This chapter thus presents a second contribution to the literature: a study of the differences between virtue ethics and care ethics. It also serves to set the trajectory for the remaining chapters, where I respond to the claim that virtue ethics lack an account of care. I spend the remainder of the thesis constructing what I take to be a satisfying foundation for a virtue ethical theory of care. In Chapter 5, I offer three initially viable means of incorporating care into virtue ethics, all of which treat care as a virtue. These are the analogical approach, according to which care is analogous to an existing virtue; the additive approach, according to which care is a novel virtue; and the bundling approach, according to which care is a bundle of virtues. I also offer and evaluate reasons to reject the claim that care is a virtue, concluding that the claim is indeed a viable one so long as the concept of care is sufficiently thick, and I contend that analogical approaches, and particularly analogies with charity, outperform the others. Chapter 5 therefore serves two ends. First, it proffers a novel meta-analysis of concepts of care as a virtue, and thus makes a third contribution to the literature. In doing so, it makes an inroad into the second: the development of a neo-Aristotelian theory of care. Chapter 6 continues this project. I attempt to show how care can be construed as an act-type and a practice. I argue in this chapter that practices are a subcategory of actions, and that care qualifies as an Anscombean act-type which aims at the meeting of needs relating to the care-recipient’s flourishing. I go on to consider the implications of this account for ethics which deploy care as a moral concept, maintaining that it not only offers a better account of consequences than theories of care which include success criteria, but also that it affords us interesting insights into the distinction between ‘caring about’ and ‘caring for’ which allow us to make sense of certain tenets of neo-Aristotelianism. This represents a contribution to both discourses, since neither care nor virtue ethicists working at the intersection of their respective normative theories have delved very deeply into the philosophy of action. Chapter 7 discusses caring relations, suggesting that a virtue ethical theory of caring relations can lean on the work care ethicists have done, and adding some necessary refinements, such as a distinction between ideal and non-ideal caring relations, and a theory of caring relations as reasons for action. This final chapter also draws these three concepts of care together by arguing that virtuous caregivers who are invested in the flourishing of those for whom they care are also sensitive to the relations those care-recipients bear to their institutional environment. I argue that because they are caring participants in caring relations, virtuous agents are characteristically motivated by states of need and dependency to engage in certain sorts of conventionally political practices. In other words, the virtue or virtues of caring characteristically manifest in certain sorts of political or social practices, relating specifically to those areas of moral life. This allows us to build upon recent work in feminist virtue ethics of the sort offered by Tessman and Friedman. I also offer a novel analysis of migration, suggesting that the account of care presenting here is analytically useful both when it comes to historical cases of migration such as the underground railroads and escapes from Nazi-occupied Europe, but also for contemporary issues such as the migrations occurring in the Southern United States and in much of Europe. I thus conclude not only that virtue ethicists ought to incorporate care into their normative framework, and that the theory of care presented here is a coherent one, but that this leads us naturally into applied topics such as virtue politics. I conclude the thesis by considering some its implications and by identifying some further avenues for research. (shrink)

This manuscript examines two accounts that discuss rights disputes. On the one hand, Russ Shafer-Landau argues for specificationism (or what is referred to here as SA), which deems rights as having innate limitations. One the other, Judith Jarvis Thomson defends infringement theory (or what is referred to here as IVA), which views rights to be competing factors. Shafer-Landau in “Specifying Absolute Rights” endeavored to discredit Thomson’s IVA and promote his favored theory. This material responds to and criticizes the claims Shafer-Landau (...) pressed in his article. First part of the thesis addresses his concerns and finds them unconvincing. Using tools of logic, it is demonstrated that Shafer-Landau’s demands on compensation are without warrant. More than this, his demands on the tripartite are misguided. Second part tackles some shortcomings of SA. One of which is the finding that two of the three arguments Shafer-Landau posited for SA’s superiority run counter to each other. Should Shafer-Landau save one, it would remain untenable for the foundations therein rest on a mistake. Finally, his position of SA being sufficiently explanatory is in itself wanting. Though this material does not go as far as proving which theory is practically better, the project is not bereft of purpose. By the end, IVA would already have been relieved of the criticisms whereas SA would be confronted with multiple challenges. (shrink)

Jonathan Dancy challenges moral generalists to come up with a picture of moral thought and judgment which requires a provision of principles that cover the ground. The aim of this paper is to provide a response to Dancy's challenge. I argue that reasonable moral thought requires us to explain ourselves when we have reason to doubt our moral judgment about some particular case, that any such explanation commits us to a general moral principle over some domain of discussion and that (...) this principle expands to cover more and more ground as we consider more and more cases. This paper makes the non-monotonicity of a wide range of moral reasoning the basis of a case for particularism. Non-monotonicity threatens practical decision with an overwhelming informational complexity to which a form of ethical generalism seems the best response. It is argued that this impression is wholly misleading: the fact of non-monotonicity is best accommodated by the defence of four related theses in any theory of justification. First, the explanation of and defence of a default/challenge model of justification. Secondly, the (...) development of a theory of epistemic status and an explanation of those unearned entitlements that accrue to such status. Thirdly, an explanation of the basis of epistemic virtues. Finally, an account must be given of the executive capacity of rational decision itself as a ‘contentless ability’. This overall set of views can accommodate a limited role for generalizations about categories of evidence, but not such as to rescue a principled generalism. In particular, the version of particularism defended here explains why one ought not to accept the principled holism that has proved to be a problem for Dancy’s form of particularism. Ethics certainly involves hedged principles. However, principles cannot be self-hedging: there cannot be a that’s it operator in a principle as Richard Holton has claimed that there can be. Practical reasoning is concluded by the categorical detachment of the action-as-conclusion itself. (shrink)

This paper is a survey of the generalism-particularism debate in ethics.

Moral philosophers are, among other things, in the business of constructing moral theories. And moral theories are, among other things, supposed to explain moral phenomena. Consequently, one’s views about the nature of moral explanation will influence the kinds of moral theories one is willing to countenance. Many moral philosophers are (explicitly or implicitly) committed to a deductive model of explanation. As I see it, this commitment lies at the heart of the current debate between moral particularists and moral generalists. In (...) this paper I argue that we have good reasons to give up this commitment. In fact, I show that an examination of the literature on scientific explanation reveals that we are used to, and comfortable with, non-deductive explanations in almost all areas of inquiry. As a result, I argue that we have reason to believe that moral explanations need not be grounded in exceptionless moral principles. (shrink)

Scale-based models of weighing reasons face challenges concerning the context sensitivity of weight, the aggregation of weight, and the methodology for determining what the weights of reasons are. I resolve these challenges.

According to Realism about Epistemic Value, there is such a thing as epistemic value and it is appropriate to evaluate things—e.g., beliefs—for epistemic value because there is such a thing as epistemic value. Allan Hazlett's A Luxury of the Understanding is a sustained critique of Realism. Hazlett challenges proponent of Realism to answer explanatory questions while not justifiably violating certain constraints, including two proposed naturalistic constraints. Hazlett argues they cannot. Here I defend Realism. I argue that it is easy for (...) proponents of Realism to answer Hazlett's explanatory questions. The interesting issue is whether those answers violate Hazlett's naturalistic constraints. My own view is that epistemic value is irreducible to natural properties; it thus violates Hazlett's proposed constraints. I argue that this is justifiable because Hazlett fails to convincingly motivate his naturalistic constraints and there is reason for thinking epistemic value is irreducible to natural properties anyway. In this article, we present an analysis of defeasible generalizations -- generalizations which are essentially exception-laden, yet genuinely explanatory -- in terms of various notions of privileged conditions. We argue that any plausible epistemology must make essential use of defeasible generalizations so understood. We also consider the epistemic significance of the sort of understanding of context that is required for understanding of explanatory defeasible generalizations on any topic.

It is commonly thought that moral rules and principles, such as ‘Keep your promises,’ ‘Respect autonomy,’ and ‘Distribute goods according to need ,’ should play an essential role in our moral deliberation. Particularists have challenged this view by arguing that principled guidance leads us to engage in worse decision making because principled guidance is too rigid and it leads individuals to neglect or distort relevant details. However, when we examine empirical literature on the use of rules and principles in other (...) domains, we find that people can learn to use rules discriminately and that rule-based models tend to outperform even expert judgment. I argue that this evidence poses a problem for the moral particularist. If the particularist claims that we should not rely on decision-making rules when making practical decisions and it turns out that these rules help us make better decisions, then the particularists’ prescriptive account is deficient. However, if the particularist claims that we should rely on practical decision-making rules but not on moral rules, she needs to explain how practical rules are different from moral rules and why we should rely on the former but not the latter. A putative problem for the moral particularist is that he or she fails to capture the normative relevance of certain considerations that they carry on their face, or the intuitive irrelevance of other considerations. It is argued in response that mastery of certain topic-specific truisms about a subject matter is what it is for a reasonable interlocutor to be engaged in a moral discussion, but the relevance of these truisms has nothing to do with the particularist/generalist dispute. Given that practical (...) reasoning is plausibly a form of abductive reasoning, and is therefore non-monotonic, any arbitrary addition of information can change the degree of support evidence offers for a conclusion. Given this arbitrariness, it is no objection to the particularist if he or she represents the ‘normative landscape as flat’ in a way that does not display the ‘obvious’ relevance of certain considerations. The normative landscape is flat and our best account of practical reasoning represents it precisely as such. Appealing to a distinction between practical reasoning and moral reasoning does not help to resurrect this pseudoproblem for particularism. What are moral principles? In particular, what are moral principles of the sort that (if they exist) ground moral obligations or—at the very least—particular moral truths? I argue that we can fruitfully conceive of such principles as real, irreducibly dispositional properties of individual persons (agents and patients) that are responsible for and thereby explain the moral properties of (e.g.) agents and actions. Such moral dispositions (or moral powers) are apt to be the metaphysical grounds of moral obligations and of particular (...) truths about what is morally permissible, impermissible, etc. Moreover, they can do other things that moral principles are supposed to do: explain the phenomena “falling within their scope,” support counterfactuals, and ground moral necessities, “necessary connections” between obligating reasons and obligations. And they are apt to be the truthmakers for moral laws, or “lawlike” moral generalizations. (shrink)

W. D. Ross is commonly considered to be a generalist about prima facie duty but a particularist about absolute duty. That is, many philosophers hold that Ross accepts that there are true moral principles involving prima facie duty but denies that there are any true moral principles involving absolute duty. I agree with the former claim: Ross surely accepts prima facie moral principles. However, in this paper, I challenge the latter claim. Ross, I argue, is no more a particularist about (...) absolute duty than a utilitarian or a Kantian is. While this conclusion is interesting in its own right, it is also important, I argue, because it prevents us from overlooking Ross's criterion of moral obligation and because it may have implications on the broader debate between particularists and generalists. Particularism takes an extremely ecumenical view of what considerations might count as reasons and thereby threatens to ‘flatten the moral landscape’ by making it seem that there is no deep difference between, for example, pain, and shoelace color. After all, particularists have claimed, either could provide a reason provided a suitable moral context. To avoid this result, some particularists draw a distinction between default and non-default reasons. The present paper argues that all but the most deflationary ways of drawing this (...) distinction are either implausible or else insufficient to help the particularist avoid flattening the moral landscape. The difficulty can be avoided, however, if we reject particularism's extremely ecumenical view of reasons. (shrink)

This paper presents a profile of the welfare regime in Lebanon which is posited on the twin precepts of human ethics and welfare particularism. It highlights the key role that moral values play in the conceptualization and implementation of social policy, as well as in the measurement of welfare outcomes. This is marked by the dominance of duty, traditionalism and elitism in the ethics of religious welfare in Lebanon. The paper argues that the social welfare regime in Lebanon overlaps with (...) the debates on the ethics of care and on virtue ethics in Western moral philosophy. This is also linked in with contemporary conceptualizations of religious ethics in Judaism, Christianity and Islam. The paper asserts that religious ethics is a valid endeavour in its own right and an ever more pertinent subject matter for the study of social welfare and social policy. This challenges the traditional dichotomy between reason and faith which has subdued the relevance of religion to public life. Indeed, religion, the nuclear family and clientelism networks are shown to play a critical role in Lebanese social welfare, such that, in spite of state incapacity, the welfare regime there cannot be considered rudimentary. The method adopted for this research was a large qualitative case study involving service providers and users at the Ministry of Social Affairs and five leading Christian and Muslim religious welfare organizations in Lebanon. This dissertation is a study of Thomas Aquinas’s and Godfrey of Fontaines’s moral philosophies. In this study, I conduct a detailed analysis of two Aristotelian commitments concerning the character virtues, namely, The Plurality of the Character Virtues and The Connection of the Character Virtues. Both Aquinas and Godfrey think that there are many distinct character virtues, however, one cannot possess these character virtues in separation from each other. In Chapter I, it is established that Aquinas believes in the plurality of (...) the character virtues not because of a specific account of the human soul, but because he is committed to a plurality in what he calls “the notion of goodness.” In Chapter II, it is argued that Aquinas’s account of virtuous action requires that there be a likeness between a person and their actions in terms of the notion of goodness explored in Chapter I. Chapters III through V lay out my account of how to reconstruct both Aquinas’s and Godfrey’s arguments for The Connection of the Character Virtues. The focus here lies on finding an interpretation that provides a valid argument for the connection of the character virtues. I argue that we ought to focus on a dependence between prudence and the character virtues. A central problem for this analysis is how to account for prudence as a unified virtue. On this issue, Godfrey provides an explicit argument that conceives of prudence as unified because prudence strikes a balance between the character virtues. Chapter VI investigates whether different groups, such as men and women, possess different types of character virtues. Godfrey offers a novel argument for the impossibility of male- and female-specific virtues. Finally, Chapter VII explores the question of how we should understand Godfrey’s account of prudence itself. I show that his discussion emphasizes the variable nature of ethics and that he endorses a view that has certain affinities with ethical particularism. (shrink)

In Applied Ethics, methodology refers to the method of justification and solution of moral issues. There are three main methods in this area that have risen in contrast to one another: the first method is syllogism which emphasizes the importance of moral theories and their application in justifying moral issues and employs an ascending view; the second method is inductivism which has a particularistic and anti-theory approach and supports a descending view; the third method is principalism, which tries to strike (...) a balance between the two views while maintaining a moderate view towards the application of the major moral theories in practice, and in this way find a cohesive solution. The topic of discussion in this paper is the second method i.e. inductivism. This method focuses on practical decisions regarding particular cases where the verdict cannot simply be put under general norms. The advocates of this method have formally recognized various forms of induction, the most important and comprehensive of which are as follows: case study or a study of particular circumstances and states, narrative ethics and some expositions of virtue ethics. This article is dedicated to the discussion and study of dedicated case study and tries to show the pros and cons of this approach clearly. (shrink)
