The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

I argue that the analysis most capable of systematising our intuitions about coherence as a relation is one according to which a set of beliefs, A, coheres with another set, B, if and only if the set-theoretical union of A and B is a coherent set. The second problem I consider is the role of coherence in epistemic justification. I submit that there are severe problems pertaining to the idea, defended most prominently by Keith Lehrer, that justification amounts to coherence (...) with an acceptance system. Instead I advance a more dynamic approach according to which the problem of justification is the problem of how to merge new information with old coherently, a process which is seen to be closely connected with relational coherence. Justifying a belief gives reason to think that the belief is true. So our concept of justification contains a ‘truth connection’. I canvass a number of proposals for analysing this. In the end, two competing conceptions of the truth connection remain: the first, that justifying a belief makes the belief objectively probable, the second, that justifying a belief makes the belief probable in a world which would make true our other beliefs. I discuss reasons for embracing and rejecting these two (...) versions of the truth connection. Ultimately, the two versions appear to represent distinct but equally plausible conceptions of justification. I conclude by rejecting the proposal that these truth connections respectively capture internalist and externalist conceptions of justification. (shrink)

RESUMO Neste artigo pretendemos mostrar as vantagens do modelo epistemológico coerentista quando aplicado ao universo moral. O ponto de partida será apontar que a justificação da crença moral é dada pela coerência com um sistema coerente de crenças que é consistente e que isso pretende resolver o problema da dicotomia entre fato e valor. Posteriormente, apresentam-se as características centrais do coerentismo holístico e investiga-se o método do equilíbrio reflexivo. O próximo passo será fazer referência a três conhecidas objeções ao coerentismo, (...) a saber: o problema do isolamento, os sistemas coerentes alternativos e a circularidade viciosa. Por fim, procuramos responder a essas objeções apelando para os seguintes argumentos: holismo social, razoabilidade e estabilidade social. ABSTRACT In this paper we aim to demonstrate the advantages of the epistemological coherentist model when applied to the moral sphere. The starting point will be to show that the justification of moral belief is a matter of how beliefs fit together with a coherent system of beliefs that is consistent and that it tries to solve the issue of the fact/value dichotomy. Following this, we shall point out the core characteristics of the holistic coherentism and we will investigate the reflective equilibrium method. Next step is to show three standard objections to coherentism, namely, the isolation problem, the alternative coherent systems objection and the vicious circularity. Finally, we shall then try to respond these criticisms with the following arguments: social holism, reasonableness and social stability. (shrink)

This paper argues that individual propositional knowledge, as traditionally analyzed in terms of true-justified-ungettiered belief, does not require phenomenal experience. Accordingly, those who are satisfied with the traditional conception need to come to terms with the possibility that AI and other zombies that lack phenomenal experience possess knowledge. Alternatively, those who resist attributing knowledge to AI based on the assumption that knowledge requires phenomenal experience need to modify or replace the traditional conception of knowledge to incorporate this requirement.

In this paper, I show the complementarity of foundationalism and coherentism with respect to any efficient system of beliefs by means of a distinction between two types of proposition drawn from an analogy with an axiomatic system. This distinction is based on the way a given proposition is acknowledged as true, either by declaration (F-proposition) or by preservation (C-proposition). Within such a perspective, i.e., epistemological complementarism, not only can one see how the usual opposition between foundationalism and coherentism is irrelevant, (...) but furthermore one can appreciate the reciprocal relation between these two theories as they refer to two separate epistemological functions involved in the dynamics of constituting and expanding an epistemic system. I develop a probabilistic account of coherence, and argue that at least in certain respects it is preferable to (at least some of) the main extant probabilistic accounts of coherence: (i) Igor Douven and Wouter Meijs’s account, (ii) Branden Fitelson’s account, (iii) Erik Olsson’s account, and (iv) Tomoji Shogenji’s account. Further, I relate the account to an important, but little discussed, problem for standard varieties of coherentism, viz., the “Problem of Justified Inconsistent Beliefs.”.
